Mr. Witlib: 1.Why is 1160895 Ontario Limited apparently representing themselves as the owner of the property to be developed in the attached Application for Plan of Subdivision/ Condominium, and why did Cameron Sellers ( Innovative Planning Solutions) swear before a Justice of the Peace(as attached) that 1160895 Ontario Limited was in fact the owner of the property when not only the subdivision property but the Block 22 Right of Way are owned jointly by Guen Chul KIM and Sa Young KIM (as attached) and have been since December 12,1988 ? Would this not constitute an offence under the Planning Act and render the Application before Council null and void? Do you not check Planning Act applications that come in to see if the content is in fact truthful? 2.Why were none of the interest ratepayers and landowners that are directly affected personally by this proposed development notified of this upcoming Agenda Item? 3.How can you claim all the Public Comments and Written Correspondence regarding this application were considered and noted within the report when they were clearly NOT including Section D in the above noted Wayne Lintack submission re. OP Section D3.2.1, removal of vegetative buffer affecting the “heritage landscape/village streetscape “of several historical properties along RidgeRoad including our property now” listed “in OM under Section 27(1) of the Ontario Heritage Act? In addition, requests I made for an EIS to be conducted in the old field/barn foundation portion of the property related to rare threatened and endanger species have been ignored by you as well. 4.Why have you stated in the report that “Appropriate Draft Plan Conditions “have been prepared to address the concerns of the public around storm water management when clearly there is a significant outstanding storm water management issue? Both OM and the LSRCA have identified that the owner of the farm downstream of the proponents “ overland flow channel “ will be required to agree and sign a legally binding “ Drainage Easement “ to accept the storm water off the proponents property. I had occasion to speak in person with the owner, Mr. Jeff Crawford last night and he advised he met with you, the Township and Proponents Engineer and John Crawford and clearly REJECTED all options put fort to him around accepting this storm water. Mr. th , 2016. Jeff Crawford was also not aware Council would be voting on this matter on September 7 Why are you recommending proceeding with a development that requires a legally binding ” Drainage Easement” on a neighboring property when the property owner has provided no indication he will even agree to it ? Why have they not been personally contacted and consulted by both you andthe proponent as of the last time I was in contact with them? Their legal rights regarding this matter appear to have been ignored by both you and the proponent. 6.Can you please explain the attached e-mail you authored to Cameron Sellers, the proponents th Planner on June 19, 2015? Please correct me if I am wrong but it appears to me you clearly not only pointed out the location of the storm pond on Agricultural land outside the Settlement Area was contrary to Section 4.2 of the Simcoe County Official Plan,but that Mr. Sellers could beat it by trying to use the argument that the storm pond meets the definition of “sewer facilities “under some the Ministry of Environment and Climate Change legislation (completely irrelevant and unrelated in my opinion)? Why did you withhold the important consideration that the proposed storm pond location is contrary to the Simcoe County Official Plan from Council? Members of Council, I could go on with questioning Mr. Witlib about the content of his report and why he would bring such a matter before council for their consideration given the above circumstances alone, however, I think I have clearly raised sufficient grounds to defer the matter until Mr. Witlib has provided both Council and ratepayers with satisfactory answers. Council, OM clearly has too many residents enduring financial hardship spending money out of their own pocket unnecessarily bringing OM Planning decision matters before the OMB for arbitration. As Council you should clearly be questioning why OM likelyhas the highest litigation rates and legal costs per ratepayer for a rural municipality in Simcoe County or perhaps even Ontario .This is nothing to bag about. There is far too much:” planning staff opinion “ in OM planning recommendations at the expense of ratepayers who simply ask for nothing more than for Staff and council to follow their own Official Plan and By-laws , the 2014 PPS, the Planning Act, the Planning Act Regulations and the Simcoe County Official Plan . This is why you were elected andwe have a cadre of senior staff at OM basking in the sun of the “Sun Shine List”, to provide the utmost professional work on behalf of the residents of OM who they actually work for are should be accountable to . Public MeetingNotes ontheOralSubmission by Wayne Lintack regarding proposed Amendment to the Zoning By-Law and the Draft Plan of Subdivision 2012-ZBA-14, Oro Medonte Township,March 20, 2013 I have resided at 50 Ridge Road East, adjacent to the proponent’s property for 30 years and I have a number of concerns relatedto the above noted proposed Amendment to Zoning By-Law and Draft Plan of Subdivision. The proponent has refused to provide us copies of reports relatedto the proposal (Planning JustificationReport, Functional ServicingandStorm Water Management Report) so we couldproperly preparefor thisPublic Meeting.I believe this shows a lack of good faithwhen dealingwith the public and lack of transparencywith the public about the proposed development.This has hindered our abilityto be properly prepared for this Public Meeting. My lawyer recently advised me to request that the Chairman of thisPublic Meeting adjourn the meetinguntil such time that the proponent,who I understandto be “The Premium Group”from Toronto, providesme with copies of the two reports requested on March 6,2013 through the Township of Oro.My lawyer also advised thatI should file an immediate appeal if I made the request for adjournment and it was not granted. Allowing me to see the documents at the office, without having a copy, makes it impossible for me to seek advice on the matter.If it is true that the Township does require consent to release thesereports the proponent should be aware that refusal to give the appropriate consent can only delay the process.I would think it is likely the reports would be made available in the usual disclosure process preliminary to an OMB hearing,so why not make them available now? I believe theDraft Plan of Subdivisionproposal ispoorly planned andcontrary to many sectionsof the Official Plan (OP) for Oro-Medonte andshould not be approvedby the Township of Oro-Medonte. A. The proposed development contravenes the “Community Vision”of the OP which is “Environment First”, with protection for natural heritagesystems while managing growth; to support and emphasize unique character, rural lifestyle andheritage featuresand to have a positive impact on qualityof life. B.Section A2.2 of the Oro-Medonte OP callsfor maintaining and enhancingthe existing ground water resources in quality and quantity. In my opinion the Draft Planof Subdivision fails to have regard for this section of the OP. Water from the community well will be used to service 18 new homes. The possible interference with other local wells wasevaluatedbasedlargelyon a 30 year old report by Snider Well Drillingpart of which is hand written. Public Meeting Submission by Wayne Lintack regarding proposed Draft Plan of Subdivision 2012-ZBA-14, Oro Medonte Township March 20, 2013 Page 1of 7 Page 6 of 415 2.a) Motion to Approve the Agenda. No on-site testing of any type was observed on thesubjectpropertyto determine the capability of the area to support 18 new septicsystemswhichwill require some form of pre-treatmentto be accommodated on thenumeroussmallbuildinglots (i.e.possibly high maintenance aerobic systems?).The developer failed to disclose the type of pre- treatmentsystemthat would be usedin theirreportsandbased their conclusionslargely on geological mapping reviews, well record reviews,and a review of the “South Simcoe Groundwater Study”. The proponent has had no regard for pending legislation under the Clean Water Act, and has 4 septic systems (lots 1,2,18,19) locatedwithin 100 metres(m)of the “Wellhead Protection Area”intended to protect the water taken from the Oro Station community well.In addition,thelocations of these septic systems may contravene section B1.6.5 of the Oro-Medonte OP that deals with “Wellhead Protection”.Regardless of whether the new Provincial Legislation is passed or not the Township should have regard for it. Our barn is located 0.58 (m)from our rear lot line, our drilled well is located 2.33 m from our rear lot line and the closest part of our house is 5.79 m (19 feet) from our rear lot line (see attached survey plan). The proponent’s Functional Servicing and Storm Water Management Plan Mapping shows a septic bed onproposedlot 13 that is4 m from our barn and 11.6 mfrom our well. Depending on the location of the distributionpipe within the bed, thisseptic bed may violate Section 8 of the Ontario BuildingCode.In addition a drainage swale is located in the 3 m that areleft between the septic bed on lot 13 and our rear lot line. C.Section A.2.4of the Oro-Medonte OPcalls for the preservation of areas showing a high capacity for agricultural production. I have lived adjacent to the subject property for 30 yearsandthere has been no year when the land was not under agricultural production. The proposedPlan of Subdivision has no regardfor this sectionof the OPor the section relatedto the StrategicObjectives for protecting agricultural lands. The stormwater pondthat collectsstormwater from the north half of the development is located outside the “Settlement Area”, on agricultural land rather than being located within the development itself which is contrary to this section of the OP as well. D.The goal of the Oro-Medonte OPas stated inSection A.2.5 is to protect, maintain and enhance the natural, agricultural and open space rural character of the area. The proponent’splan has had no regard for this section of the OP. A treed vegetative buffer occursalong the rear lotlines of the subject property from proposed lots 11-15(see attached aerial photo). Public Meeting Submission by Wayne Lintack regarding proposed Draft Plan of Subdivision 2012-ZBA-14, Oro Medonte Township March 20, 2013 Page 2of 7 Page 7 of 415 2.a) Motion to Approve the Agenda. The treedvegetativebuffer behind our house is about 14 metres deep andmost of the buffer is on the subject property. In the past, we have tried to purchase this property to protectour privacy and the ruraland heritage characterof the area, but we were denied the opportunityto purchase this buffer by theprevious owner. The Functional Servicing and Storm Water Management Plan mapping shows the complete removal of the vegetative buffer on theirpropertyfrom lots 11,12,13,14,15 to accommodate a drainage swale and septic beds. Removal of thistreedvegetative buffer behind our house will diminish the ruralcharacter of the area. Removal of the trees on the subject property and the creation of the swale on the lot line may also adversely affectthe healthour remaining trees and make themmore prone to wind damage andmayresult indamage toour home andneighboring properties. Three of thehousesmost affectedby the removal of this treed vegetative bufferand the placement of new modern homesare part of the heritage landscape of Oro Station and have scenic interest and architectural value. Francis Bell, an original settler in Oro,built one of these homes in 1880(Robert MacGregor personal communications March 2013).Francis Bell wasreported to own all of Lot 24 , Concession8 in OroTownship as early as1872-3(Gazetteer and Directory of the County of Simcoe 1872-3, Eastern Georgian Bay Historical Society, 1985).The next adjacent home was built by a Bell descendant(Kith N Kin, J McEwen, 1978) around1900, and our home, which was built in 1901,was believed to have originally been built by a Bell descendant as well and later occupied by the Miller family. Removal of thetreedvegetative bufferand placement of new modern housesbehind these three homes of historic interest is alsocontrary to Section D3.2.1 of the OP, which requires that “all new development should occur in a manner which respects the municipality’sphysical heritage which includesarchitectural value, heritage landscape and village and urban areas of historic and scenic interest”. E. Section D3.2.5 of the Oro-Medonte OPrequires the municipality to preserveor rescue from excavation, significantarcheological resources.The proponent has had no regard for this section of the OP. There are 68 known Huron Village Sites in the former Township of Oro, as documented by Andrew F. Hunterin 1903(Notes on The Huron Villages in the Township Of Oro) (see attached note by Hunter). Part of Lot 24, Con8, the same lot and concession as the proponent’s developmentis a known Huron Village Sitenoted as Site 65 by Andrew Hunter (see attached map by Hunter). Hunter reports that RichardBell found the “usual relics” (associated with a village) and a human skull when he dug the basement forhis house on the east half of Lot 24,Con 8. The Bell property is located directly adjacent to proposed lots 10 and 11. In a History of Public Meeting Submission by Wayne Lintack regarding proposed Draft Plan of Subdivision 2012-ZBA-14, Oro Medonte Township March 20, 2013 Page 3of 7 Page 8 of 415 2.a) Motion to Approve the Agenda. Simcoe County(1998 ) by Hunter,he reports Huron Villages can range in size from two or three lodges to extensive hamlets that cover an area over 15 acres in size. More recent studies by Wilfred Laurier University have shown that Huron Villages can be even larger in Simcoe County and their studies of the Warminister Huron Villagesite revealed 72 long houses, and there are other village sites in the County with around 100 long houses (J. Hunter, Director of the Huronia Museum, personal communications March 2013). The book entitledthe “History of Oro”(J.McEwen, 1978) also makes reference to the archeological significance of the area around Oro Station. Page 1of the bookhas a map showing an Indian Trail along Ridge Road from Shanty Bay to Hawkestone (see attached). On page 299, of “The History of Oro” (J.McEwen 1978) notes “there must have been Indian encampmentsaround Oro Station because farmershave dug up various Indian tools, such as skinning knives, leather pouches of sharpenedstones and a stone tomahawk”(see attached). As a result of this historical and more recent informationan Archeological Impact Assessmentfor the proponent’s property is required under Section D.3.2.5 of the OP. Consideration should also be given to Federal and Provincial Policies that outlines protocols to follow with First Nation groups before dealing with known native sites. F.Section A.1.2 (EnvironmentalProtected One) of the Oro-Medonte OPprovides protection for significant portions of habitat of Endangeredand ThreatenedSpecies. Ontario Regulation 242/08 under the Endangered Species Act 2007 administered by the Ontario Ministry of Natural Resourcesalso provides protection for individual species defined as Endangered under the Act. I believe there are over 30 Butternut trees on or near the proponent’s property, all of which require assessment by a qualified Butternut Health Assessor pursuantto Ontario Regulation 242/08 (see attached areal photo). I believe trees requiring assessmentare growing on or inclose proximity tothe southern portionof proposed lots 10, 11, 12, 13, 14, 15, 17, and18. The south west corner of proposed lot 18has a mature Butternut tree with a blue flagging tape that notes “HYDRO ONE BUTTERNUTDO NOT CUT”. The proponent has had no regard for anypossible retainable Endangered Butternut trees on their property. The mapping foundin the “Functional Servicing and Strom Water Management Plan” shows a storm water swale located where I believe many of these Butternut trees are currently located. Public Meeting Submission by Wayne Lintack regarding proposed Draft Plan of Subdivision 2012-ZBA-14, Oro Medonte Township March 20, 2013 Page 4of 7 Page 9 of 415 2.a) Motion to Approve the Agenda. The municipalityhas reasonable grounds to require the proponent to conduct an EnvironmentalImpactStudyof the subject property and should do so under Section B.5.1.1. of the Oro-Medonte OP. G.Section E1.9 of the Oro-Medonte OPprovides for the removal of older draft plan approval for residential subdivisions from the OPunder certain circumstancesif the plan lapses. These includes developmentsthat are not appropriate for development today because theyimpact the rural character of area and the NaturalHeritage System the plan is trying to protect today. On March 15, 2013 I submitted a formal MunicipalFreedom of InformationAct request to Oro-MedonteTownship to obtain all “records” relating the establishment of the Oro Station“Settlement Area”. Previous to that, planning staff were unable to provide any information, historicalor otherwise, that outlinedthe logic, rationale, criteria orthe timeline related to the establishment of this“Settlement Area”.I was not aware thatthis area was in the “Settlement Area”.I was assured byTownship Planning Staff before I purchased our propertyin 1983, and more recently before we built a house addition that the proponent’s propertywas zoned Agricultural and could not be developed. I am further requesting that the Municipality provide me with an additionalopportunity to comment on theDraft Plan Of Subdivision after they have fulfilled my Municipal Freedom of Information Act request and provided a reasonable time for what ever records are produced to be reviewed by myself or my agents. The “Settlement Area” status of the property should be re-evaluated pursuant to the results of an Environmental Impact Study, an Archeological Impact Assessment and a review of sections of thecurrent OPthat speak to maintainingand enhancing the rural character, high agricultural production, and Natural Heritage Systems within the Municipality. The principlefor possiblyremoving this area from theOro Station”Settlement Area” flows from the intent of Section E.1.9 of the OP. H.AdditionalConcerns: The proponent’s agricultural field is tile-drained with at least one row of old yellow clay field tile that enters our property and continues down-hill, towards Ridge Road. There may be more field tiles entering our property or adjacentproperties along Ridge Road. The one tile we found on our property was severed by a septic contractor when we installed a new septic system in the fall of 2007. During the spring of 2008 our basement flooded for the first time in 25 years. We had never needed a sump pump during that time but were forced to install oneina small existing sump hole. Thepump ran constantly until late May or early June of that year. During late June 2008, we encounteredthe same old yellow clay fieldtilewhen we added an addition to our house (see attached photo #). We were reluctant to cut this field tile on our property and possibly saturate the ground adjacentto our old house which onlyhas a crawl space under ourkitchen and no weeping tile around the foundation. To remedy the problem, we allowed the old clay field tile to outfall into the new weeping tile installed around the footing of our houseaddition. If any other activityother than agriculturaluse is to occur on the proponent’s property, they will need to properly locate and decommissionall fielddrainagetiles well before they leave their property to prevent ourhouse weeping tilefrom being silted in or otherwisecontaminated by their activities. Summary We are opposed to the re-zoning of the proponents property from Agricultural/Rural Exception15(A/RU*15) and Agricultural Rural (A/RU) to Residential One (R1) and Open Space (OS) Zones . We are also opposed to the relatedDraft Plan of Subdivision for the property. THE TRANSFEROR grants and transfers to the Transferee, its successors and assigns to be used and enjoyed as appurtenant to the Transferee’s lands, a free and unencumbered easement (the “Easement”) in perpetuity upon, over, in, under and across lands more particularly described in box 5 on Page 1 attached (the “Easement Lands”): 1.the right to construct, operate, maintain, repair, replace, renew, or make additions at all times to telecommunications facilities (the “Facilities”) or any part thereof forming part of continuous lines between the Transferee’s lands and other lands including, without limitation, all necessary cable and wires (both buried and aerial), conduits, conduit structures, markers, poles, anchors, guys, maintenance holes, fixtures, equipment, and all appurtenances thereto. 2.the right of free and unimpeded access at all times to the Transferee, its contractors, agents, employees, vehicles, equipment, and supplies to and over the Easement Lands. 3.the right of free and unimpeded access at all times to the Easement Lands from and over the Property or abutting road allowances or abutting rights of way for the purpose of exercising the rights hereby granted. 4.the right to remove, trim, sever, or fell any obstructions such as trees, roots, brush, stumps, boulders or rock encountered during the course of construction or subsequent maintenance of the Facilities. THE TRANSFEROR shall have the right to fully use and enjoy the Easement Lands provided that without the prior written consent of the Transferee, such consent not to be unreasonably withheld, the Transferor shall not place any buildings or other structures or dig, drill, pave or excavate within the Easement Lands. THE TRANSFEREE shall: 1.be responsible for any damage caused at any time by its agents or employees to the Property. When practical, the Transferee, after any of its activities, shall restore the Property appropriately. The subsequent maintenance of the Property shall be the responsibility of the Transferor. 2.indemnify and save the Transferor harmless from all actions, causes of actions, suits, claims and demands of every nature and kind whatsoever which may be made against the Transferor relating toor arising out of the placement of the Facilities by the Transferee and for which the Transferee, in law, is responsible. 3.at its sole discretion, be permitted to attach, or permit the attachment of, wires, cables and equipment of any other company or commission for the purposes only of supplying a service to the public. NOTWITHSTANDING any rule of law or equity and even though any of the Facilities may become annexed or affixed to the Easement Lands, title to the Facilities shall nevertheless remain in the Transferee. THIS AGREEMENT including all rights, privileges, and benefits herein contained shall extend to, be binding upon, and enure to the benefit of, the parties hereto and their respective heirs, executors, administrators, successors, and assigns. THE TRANSFEREE, in the event it grants a release of Easement, may abandon the Facilities annexed/affixed to the Easement Lands at its option. It appears that at some point the Township approved the current configuration of lots. I see no reason why the Township should choose to negatively impact the residents and current taxpayers for the financial gain of a developer. The proposed new owner can build on the existing lots as is and is in no way disadvantaged by the current configuration. The only motivation is to increase the profit margin after development. It has been brought to my attention that there is a limitation on the existing water system as well that should not be a burden, inconvenience or detriment to existing rate payers. I trust the Township will consider the impact on existing residents and not only look to appease the request of a developer who will develop the properties sell them and have no further relationship with the community. We submit the application should be denied, for the following reasons specifically non conformance with several plan and by law sections. Gernallly, The proposal and sketches do not adequately describe the existing lot and plan, the proposed construction and impact on the neighbourhood. 1)The Lake Simcoe Plan Protection plan identifies a 30 m (100 foot) regulatory limit that is not displayed on the sketches, and in addition, comment is needed on the creation of two lots with insufficient lake frontage, from one that was previously in conformance and one that previously did not exist. Clarity on the impact of the regulatory limit andn conformance with the plan, should therefore be obtained from the Lake Simcoe Conservation Authority. 2)The minimum regulatory setbacks from the lake, of any new structure, according to the official plan and zoning bylaw is not described on the sketches. Township official plan section C5.6 a.The regulatory limit will push the building envelope too close to existing lot lines b.Based on the information available to us at this time, the randomn trapezoidal shape will result in all manner of unpredictable minor variance applications to enable a building to be constructed. c.The randomn shape of the revision to 49B to permit construction, does not conform with the plan of subdivision standards for Maplewood Drive. d.The reason why the township created the lot 49B is not explained i.49B does not appear to be an existing lot intended to be built on. 3)Non Conformance: Minimum lot lake frontage according to section C5 3.4 of the official plan in shoreline areas, must be 45 meters. Where one was in conformance, now two lots are out of conformance. a.Township staff (Report DS2016-085) does not properly identify minimum lake frontage requirements, or street side lot frontage, cited in the official plan. i.Table B1 of the zoning bylaw (SR column) requires a minimum lot lake frontage of 30m. 49 B appears to have a lot frontage of only 9m or less ii.If approved this severance application creates not one but two new circumstances in non conformance with the official plan, and its intentions, and the zoning bylaw for lake frontage in SR zones. 4)In addition, we wish to hear from staff how an application can be approved if it is in non conformance with : a.Non conformance: Section 5.20.2.3 Driveway setbacks ( lot line minimums of 3M to interior and exterior side lines. And again minimum lot frontage of 30 M b.Non conformance; Corner lot requirements. Section 5.20.2.4 Minimum distance of 15 m from the exterior lot line. i.49B Maplewood is an atypical corner lot, situated on a tight bend with poor visibility. Lot 49B meets the definition of a corner lot, law) ii.Drainage in this area particularly during spring runoff is a concern, and will likely be made worse, with insufficient culverts installed. There is an insufficient width at the driveway to allow for a proper culvert Finally staff opinion that the proposal will not affect the surrounding area is an opinion that we disagree with. Safety concerns regarding the non conformance of the proposed driveway on a corner lot, removal of long established healthy coniferous trees, during a period when Emerald ash borer is reducing the townships tree canopy, non conformity with interior and exterior lot lines. The neighbourhood consists of larger lots, this proposal shoehorns two construction proposals where a single lot for construction purposes was intended by the plan of subdivision. With what appears to us to be clear contravention of the by laws in several areas, we request the application for the creation of this new lot be denied. The proposal results in the creation of not one but two lots in non conformity with the official plan. 1) The township official plan states : C5.3.4 Limits of Shoreline development d) the proposed lots, if located on the shoreline, have a water frontage of no less than 45 metres. The proposed severance will bring 57 Maplewood Parkway out of conformance with, and with disregard to section C5.3.4. While this is not a new plan of subdivision, policy guidance here restricts the township from taking existing lots out of conformance with the 45 meter minimum requirement. 2) We also r equest comment from Lake Simcoe Conservation Authority, as we believe the proposal is in non conformance with the Lake Simcoe Protection Plan, section 6.45-DP. 6.45-DP Where a policy in this Chapter permits development or site alteration in relation to existing uses, the following policies apply: a. All existing uses lawfully used for such purposes on the day before the Lake Simcoe Protection Plan comes into force are permitted; b. The construction of a building on an existing lot of record is permitted, provided it was zoned for such as of the date the Plan comes into effect, or where an application for an amendment to a zoning by-law is required as a condition of a severance granted prior the date this Plan comes into effect; Among other reasons, we submit that the application should be denied for non- conformance with the minimum lake front requirements specified above.
