1995-068 To Impose a Sewer Service Rate pursuant to paragraphs 221 (20) and 221 (22) of the Municipal Act, R.S.O. 1990, c M.45 ,\." ,., '. , THE CORPORATION OF THE TOWNSHIP OF ORO-MEDONTE BY-LAW NO. ]gg'i-fiR BEING A BY-LAW TO IMPOSE A SEWER SERVICE RATE PURSUANT TO PARAGRAPHS 221 (20) AND 221 (22) OF THE MUNICIPAL ACT, R.S.O. 1990, C. M.45 e WHEREAS the Corporation of the Township of Oro-Medonte (the "Municipality") has passed a by-law pursuant to paragraph 210 (84) of the Municipal Act, R.S.O. 1990, c.M.45 to authorize the acquisition, operation and maintenance of sewage works (the "sewage works") for the provision of sewage service to a portion of the Municipality more particularly described in the schedules attached hereto; AND WHEREAS the Municipality deems it to be necessary for municipal purposes to impose a sewer service rate upon those lands that derive a benefit from the sewage works; NOW THEREFORE, THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF ORO-MEDONTE HEREBY ENACTS AS FOLLOWS: 1. A sewage service rate is hereby imposed upon the owners or occupants of those lands more particularly described in Schedule "A" attached hereto as a charge for the operation, repair and maintenance of the sewage works. 2. The sewage service rate shall be imposed upon the lands described in Schedule "A" attached hereto in accordance with the Sewage Service Rate Structure set out in Schedule "B" attached hereto. The sewage service rate shall be an annual charge upon the lands described in Schedule "A" hereto. 3. There shall be added to any such sewage service rate due but unpaid the sum of 1 1/4% of the unpaid balance on the day following the due date and on the first day of each calendar month thereafter. 4. In the event that any owner of lands not described in Schedule "A" attached hereto (the "property owner") wishes to have the sewage works extended so as to service those additional lands, the following provisions shall apply: (a) For the purposes of this paragraph, the term "municipal engineer" shall mean any engineer employed by the Municipality or any independent engineer appointed by the Municipality from time to time as applicable; (b) The extension of the sewage works shall first be approved by the Council of the Municipality upon application of the property owner, provided that Council shall have the right to determine, in its sole discretion, whether there is sufficient capacity in the sewage works to service the proposed extension; . (c) All engineering drawings relating to the proposed extension must be prepared by a Consulting Engineer retained by the property owner, at the property owner's sole cost. Such engineering drawings are subject to the approval of the Municipal Engineer; (d) The property owner shall execute an Agreement with the Municipality pursuant to which the property owner shall agree to be responsible for all engineering, legal and related fees incurred by the Municipality as the result of the request for proposed extension of the sewage works by the property owner; . . . /2 . . ,. ' " , - 2 - (e) The Agreement between the property owner and the Municipality shall also require the property owner to pay the total capital cost of the proposed extension, the Municipality's costs as set out in subparagraph (d) above, together with a further sewage service rate in an amount to be determined by by-law of Council, prior to the commencement of any work. 5. The Treasurer of the Municipality is hereby appointed and authorized to have charge of and the power and responsibility for billing and collecting the sewage service rates imposed under this by-law. 6. This by-law shall come into force and effect upon the date of its passage.
