Motion No. SC160706-5 Moved by Crawford, Seconded by Coutanche Be it resolved that the correspondence dated June 21 and 23, 2016 and PowerPoint presentation presented by Keith Doxsee, Grand Chief of the Montagnais Metis First Nation re: Burl's Creek Event Grounds Inc. be received and considered in conjunction with Item 8a) Robin Dunn, CAO re: Consideration of Special Events Permits for Burl's Creek Event Grounds. Carried. 6. Open Forum: The Open Forum provides an opportunity for the public to provide verbal comments to Council, in Open Session, on matters scheduled on the current agenda. Given the time limit of Open Form and the number of individuals who wished to provide verbal comments, individuals were provided tickets. The Clerk drew random tickets. Individuals whose tickets were drawn provided verbal comments. Twelve individuals provided comments with respect to Item 8a). 7. By -Laws: a) By -Law No. 2016-104: A By-law to Amend By-law No. 2015-115, Being a By-law of The Corporation of the Township of Oro-Medonte To provide for the imposition of fees or charges (Fees and Charges By-law). Motion No. SC160706-7 Moved by Macpherson, Seconded by Hall Be it resolved that By -Law No. 2016-105: A By-law to Amend By-law No. 2015-123, Being a By-law to establish a framework with respect to notification and issuance of permits for special events in the Township of Oro-Medonte (Special Events By-law) be read a first, second and third time, passed, be engrossed by the Clerk, signed and sealed by the Mayor. Carried. 8. Reports of Municipal Officers: a) Robin Dunn, CAO re: Consideration of Special Events Permits for Burl's Creek Event Grounds. Motion No. SC160706-8 Moved by Coutanche, Seconded by Crawford Be it resolved that the PowerPoint presentation dated July 6, 2016, as amended, and presented by Robin Dunn, CAO re: Consideration of Special Events Permits for Burl's Creek Event Grounds be received, And that the Mayor and Clerk be authorized to execute the Memorandum of Understanding Amendment between the Township and Burl's Creek dated June 29, 2016. Unanimously Carried. Page 6 of 9 Special Council Meeting Minutes — Wednesday, July 6, 2016. Motion No. SC160706-9 Moved by Coutanche, Seconded by Jermey Whereas the Township of Oro-Medonte did enter into a Memorandum of Understanding with Burl's Creek in 2015 to address a number of specific matters relating to special events on lands owned and/or leased by Burl's Creek, including the provision of financial security and the reimbursement to the Township of various expenses associated with the holding of special events on those lands; And Whereas the Mayor and Clerk have been authorized to execute a Memorandum of Understanding Amendment dated June 29, 2016 with Burl's Creek, which makes amendments to the 2015 Memorandum of Understanding and, among other things, includes provisions to address matters related to risk management, the establishment by Council of allowable sound level limits and times for the 2016 events and the creation of a comprehensive sound monitoring program; And Whereas Burl's Creek have submitted such operational plans as may be required by the Special Events By-laws including operational plans as required pursuant to Section 2.11 of said by-law; Now Therefore be it resolved that pursuant to the Special Events By-law, as amended, Council of the Township of Oro-Medonte issues Special Events Permits for each of the 2016 WayHome and 2016 Boots and Hearts music festival events, for the 92 acres which are zoned in By-law No.97-95 as Private Recreation Exception 30 and 31, conditional upon: • adherence with the Special Events By-law, including the conditions in Section 2.12, and such conditions as may be deemed appropriate in accordance with the Special Events By-law, • adherence to the 2015 Memorandum of Understanding as amended, and • compliance with all operational plans as required under the Special Events By-law. And that the CAO be authorized to prepare and issue the Special Events Permits in accordance with the above direction from Council. Unanimously Carried. Motion No. SC160706-10 Moved by Crawford, Seconded by Coutanche Be it resolved that pursuant to the Special Events By-law, as amended, Council of the Township of Oro-Medonte denies the request for Special Events Permits for each of the 2016 WayHome and 2016 Boots and Hearts music festival events, for those lands beyond the 92 acres which are not zoned for special events or temporary parking, camping and concession booths. Council recessed at 11:58 a.m. and reconvened at 12:24 p.m. b) Report No. RC2016-08, Shawn Binns, Director, Recreation & Community Services re: Oro African Church Grand Reopening. Motion No. SC160706-11 Moved by Coutanche, Seconded by Crawford Be it resolved 1. That Report No. RC2016-08, Shawn Binns, Director, Recreation & Community Services re: Oro African Church Grand Reopening be received and adopted, as amended, to change the Event Day 1 to Open to the Public and potentially extend the time as plans develop and progress. 2. That pursuant to By-law No. 2015-212, Refreshment Stand By-law, as amended, that Council authorizes an exemption to Section 16.2, to authorize the operation of refreshment stands on municipal property; That Council authorizes an exemption to Section 16.8, to allow Refreshment Stand in an Agriculture/Rural (A/RU) Zone; And That, in accordance with Section 17.2, a license to operate or maintain a refreshment stand for the event will not be required. 3. And That Council approve an allocation of $13,600 as a potential budget overrun to support the Oro African Church Celebration events as presented in Report No. RC2016-08. Unanimously Carried. 9. Confirmation By -Law: a) By -Law No. 2016-103: Being a by-law to confirm the proceedings of the Special Council meeting held on Wednesday, July 6, 2016.
