6. Open Forum:
The Open Forum provides an opportunity for the public to provide verbal
comments to Council, in Open Session, on matters scheduled on the current
agenda, and shall be conducted as follows:
Open Forum shall last no longer than 20 minutes;
Each speaker shall be required to identify the agenda item they are
speaking to and provide their name and address, which may become
part of the public record;
A speaker shall be limited to 2 minutes per agenda item;
No response shall be provided to any question posed during Open
Forum;
No discussion, debate or decisions will occur during Open Forum;

A speaker may provide comment on one agenda item and then shall

requested to limit their comments so as to provide additional

against the Township;

Information and Protection of Privacy Act;
o Comments with respect to any applications which have
proceeded through a Public Meeting in accordance with the
Planning Act, with the exception of comment related to a
recommendation contained within the Staff Report.
The Chair may conclude Open Forum prior to the 20 minute maximum
time limit, for non-compliance with the Open Forum parameters,
Conduct of Members of the Public, or any other reason.

With pleasure I take a moment from my day and tell you how much fun I had at the way home
festival and Boots and Hearts last year!! We did all our shopping for the weekends in the area
to show our thanks to the locals :) wonderful place!! Well run and put together, it had its
hiccups but every event does and with time they can get anything resolved. I thought
traffic control was well planned with early arrivals and no push to get out at the end. A bit of
an mass exodus is expected at the close of the concerts.
My 19 year old son worked at Boots & Hearts and had the best time of his life! Everyone was
very helpful and cooperative PLUS it didn't take as long for the end clean up as he expected.
In most part... there is always those few who unitedly make the whole thing look like chaos BUT
they are the very few.
Please allow these organizers to improve upon these fantastic events and help the community
grow. With council confidence and support shown, people would bring new business to the area
to support the growing tourism! Perhaps they could also sponsor/organize winter events there
as well.
PERFECT VENUE FOR ANY EVENT! BIG OR SMALL
Did I mention I have been going to the Auto Flea markets there both spring and fall for MANY
years LOVE LOVE LOVE IT!!
the noise cant be any worse than the stock car racing that use to go on... change is good but
does not make everyone happy.
I SUPPORT BURLS CREEK EVENT PARK and what they are trying to bring to the area

I live on Line 7 N. Last year was the first year for WayHome @ Burl's Creek. I could hear
the music. I also knew that my Grandaughter, and her friends, & others I know were spending
the weekend there. They all looked forward to this event for weeks. They and apparently
everyone that attended this concert were not disappointed, at all. I listened to Brandon
Flowers, Hozier, Neil Young and soooo many other talented singers/groups in My Own
Backyard. I was proud that this was happening. My granddaughters that were here with me
found this "totally awesome" and found this to be very unbelievable. I camped out that night
listening to this worldwide talent. Did it bother me. Not for a moment. Then I found out that
the local Tim Horton's (line 7N) was swamped with business. Then I found out that the Local
McDonalds was also swamped with business. Days later I found out that the local RV business
was also swamped. with rentals. This was great. Also we were told all about the traffic jams
etc. People invading our properties. As far as I was concerned, it never came to be. Cleanup
was done at an appropriate pace. Traffic was not a hindrance whatsoever. I watched the
traffic go by my home starting on the Thursday. Never was there a slowdown. Not a complaint
for me at all. Believe me, as I had heard so much negativity, I was prepared to spend the
weekend indoors. I was stocked to the rafters with supplies that me & mine, would not want for
anything that weekend.....lol As I mentioned earlier, this is Worldwide talent. Take a look at
this years lineup. Some names might not be familiar, but I do believe everyone will recognize
their songs/music. I am a senior that enjoys and always has, always will, music. Music is an
international aspect that everyone should be enjoying. Be proud that all this Worldwide talent
has accepted the honour to be here. Any musician/group can be invited but take a look at all
that have accepted this invitation to be a part of this event at Burl's Creek. Oro Medonte has
been put on the map for a fantastic Positive reason. Not a Negative reason. Lets keep it that
way. Negativity does nothing for anyone.

To whom it may concern,
I can not believe for one second that you actually even consider closing or not
supporting this venue! Jobs, money into Simcoe county all over as well as Oro. Do
the right thing and allow this venture.

Questions and Information for Council Consideration
We are in receipt of correspondence from Township counsel of 11:54 a.m.,
yesterday. In this letter, Mr. Williams advises that my clients SaveOro and the West
i
regarding the Special Council Meeting. My math tells me that Oro-Medonte
Council will be considering one of the largest undertakings in the
history, being a massive invasion of 25,000+ campers and concert goers, and
Council decided to allow 27 hours and 6 minutes to respond.
Short Notice Provided by Township to Residents
In my twenty years as an environmentalist, planner and now lawyer, I have never
experienced such a naked display of contempt of a Council for its residents.
Sections 2.5 and 2.6 of By-law 2015-123 requires an application to be circulated well
in advance of the proposed event, and the application includes an Operations
Plan a minimum of 60 days prior to the Special Event.
We request, for a second time on the record, a copy of both applications and
proposed Operations Plans for both multi-day concerts. We understand that a
representative of SaveOro was advised on July 5, 2016 by Township Staff that the

Operations Plans is confidential and the noise limits would be included only in the
MOU.
Please advise of the basis for this confidentiality for the Operations Plan. Further,
we request Council confirm that noise limits at the Points of Reception will be
included in the Operations Plan, so it may be enforceable by By-law 2015-123 and
provincial statute. If noise limits are included only in the MOU, please advise of the
Townships assessment of whether enforcement would then only be possible
through civil (contract) law (at likely considerable cost to taxpayers).
Noise Issues with the Special Event Permits and Amendment to By-law 2015-123
Unbeknownst to my client, Council will consider whether to amend the Special
Event Permit By-law to change the procedure for setting noise limits for larger
special events (proposed 2.13.2).
However, this new proposed section does not refer to noise limits at points of
reception. Will the existing enforcement provision (section 2.13.1) also be amended
be amended to ensure it is an offence to exceed the noise limits set by Council, if
they are not at a point of reception?
On our time-limited review of the materials before Council, it appears through the
violation of By-law 2015-123 if the noise limits in section 8 were exceeded. We urge
Council to seek a legal opinion and confirmation from its legal counsel that the
proposed section 2.13.2 does indeed obligate the permit holder and any person to
comply with any noise limit set in the Operations Plan, and not simply noise limits
related to points of reception.
As Council and Township Staff know well,
last years concerts wreaked acoustical havoc on the community. Obscenities of
the foulest kind upset Saturday dinners, windows rattled into the early hours of the
morning, and music could be heard across the lake. Everyone agrees even the
noise limits set by Township were exceeded not once but for both multi-day music
festivals.
January 13, 2016, exceeded the front of house levels during each event.
Further, the dance party noise levels during the Boots and Hearts Festival
Did the
Township take any remedial action for these flagrant violations?
SaveOro and WORA hired acoustical engineer Mr. John Coulter, P.Eng. to peer

Guidelines.
Mr. Coulter identified the following deficiencies with the Township
proposal:
1. Noise limits must be established and monitored at the sensitive receptor, and
not at the sound booth. The new Memorandum of Understanding and
proposed by-law amendments appears to repeat the same mistakes as last
year. While a noise level remains constant at the source, the noise level
experienced by a nearby resident can change by as much as 10 dB
depending on atmospheric conditions.
The Township is requested to amend section 8 of the proposed MOU to this
effect, or else the Township will be permitting the discharge of noise that may
cause an adverse effect, contrary to section 14 of the Environmental
Protection Act.
2. The proposed end times for the music are not appropriate. The cutoff for any
music from any stage should by 11:00 p.m. on weekend nights (Friday and
Saturday) and 5:00 p.m. for workday evenings (Sunday through Thursday).
No amplified sound or music of any kind should be permitted after 11:00 p.m.
The Township is requested to amend section 8 of the proposed MOU to this
effect, or else the Township will be permitting the discharge of noise that may
cause an adverse effect, contrary to section 14 of the Environmental
Protection Act. -minute grace
3. Enforcement of Noise Limits: We request details and confirmation of a
procedure to have the sound levels lowered if limits are exceeded
immediately.

Request for Special Event Permits for 92 and 434 Acres
On July 22, 2015, Deputy Mayor R. Hough and Mr. Stanley Dunford signed a
Grounds Inc. Of note is Clause #1, which reads verbatim:
No Events Without Compliance with Applicable Law
agrees that no events shall occur or be permitted to
occur on any of its lands unless all applicable laws having been complied
with, including, but not limited to, any zoning by-laws and licensing by-
laws.
Even from the scant materials provided, it seems there is another very large areas of
approximately 434 acres that again this year is proposed to be used without
permission i.e. illegally, for camping, parking and concession booths.
The Township Staff Powerpoint presentation rightly notes the proposed use and
permit application for this land does not comply with zoning by-law, and raises
archaeological concerns (no clearance) by the provincial Ministry of Tourism,
Culture and Sport.
We urge the Township to refuse the request for a Special Event Permit on the 434
contingency plan for camping and parking, in the event this permit is not granted
(as it ought to be)?
Lack of Consultation with Residents
My clients ask Council: when was the MOU amended? Why
issued? Does this show another form of contempt for the Corporate Seal of the
Township and its resident who entrusted you to uphold the law?
During his testimony on May 24, 2016, Sergeant
Pileggi testified that he attended at least fourteen meetings to assist in the

the expense of using paid OPP staff time was borne by the public. Our estimate is
that with travel time, the cost of this private security OPP detail planning for a
private concert promoter is in excess of $10,000.

Good afternoon,
I am writing with respect to the Special Council Meeting, which was brought on short
notice and which is being held during the day, when many people are at work. As such,
I am writing to provide my written comments as set out below.
It certainly seems that a lot of time and effort has gone into these materials, which are
being presented and voted on at this meeting - you would think that the same amount
of forethought would have gone into providing adequate notice to the public of this
meeting.
From my review of these materials, I wish to note in writing the following:
1. The 2016 MOU, dated June 29, 2016, has already been provided to and executed
by Mr. Dunford, why hasn't Mayor Hughes and the Clerk executed it?
2. The special events briefing indicates that the Township's risk managementgoals is to
minimize financial and legal risk and to enhance the quality of life for residents. Why is
the township concerned about financial and legal risk? The only people that should be
concerned about financial and legal risks is Burl's Creek, or am I missing something? If
Burl's Creek chose to invest $10M into a property which did not have proper zoning -
they would have to assume all financial and legal risks. Again, what am I
missing???? And, I really don't believe Mayor Hughes is lying awake worried
about my, or my neighbour's, quality of life. I was pretty happy with my quality of life
in Oro-Medonte before Dunford and his crew moved in - I didn't realize my quality of life
needed enhancing. Again, I must be missing something.
3. Most residents in Oro-Medonte are very tolerant and try to be good neighbours. In
that spirit, most people did not kick up a stink or complain about the five stand alone
illegal concerts and which took place over the span of 20 years. Had we known that
these illegal concerts were going to try and be precedent setting events we would have.
4. The Barrie Speedway operated for many years without much disruption to
residents. They usually practiced one evening a week and raced one night each
weekend. The race usually ended around 11 p.m. on the weekends and the week time
practice finished earlier. It was like background noise for most residents and finished at
a reasonable time. Again, most residents in Oro-Medonte try to be tolerant good
neighbours.

I would appreciate receiving a copy of the Special Event Application form submitted by
Burl's Creek, along with a completed event checklist. I would also appreciate receiving a
copy of their operational plan. I note that I have not received any community
notification strategy from the organizer to date, pursuant to the special events
obligations.
I note that the motion to adopt the agenda has been amended to include comments with
respect to Burl's Creek special events permit. Please include my comments, which
clearly reflect my opposition to same.

I'll begin with thanking you for the opportunity to have my legal right to be heard on this
subject.
I don't understand how the minority few in the Save Oro group can halt; prohibit and sabotage
the economic growth of our community! The millions of dollars that have been spent in the Oro-
Medonte township in particular and to the general area as a whole is 100 times greater than all
the farms put together earn. The business in the area that benefitted from the improvements
at Burls Creek should not go without saying, I observed the big motorhomes coming from the
Hitch House - The sold out camping at Heidi's & Oro Campground.
I'm a daughter; grand daughter and great grand daughter of farmers and proud to be but I'm
also practical, I do not want this land to be sold to some extremely rich
and politically connected developer for condo's; housing & high end gated communities!
The land at Burls Creek has been used for over 30 years for special events but since late 2014
or was it early 2015 a negative campaign against any further improvements or expansion to this
land and this area has been thwarted by SAVE ORO. Since when did the voices of so few over
ride the benefits of the many?
The lies and fear mongering campaigning by this group is so absurd that print media will no
longer entertain what they have to say, it's only the TV media looking for another sensational
story (for ratings) that will give this group any voice. Where are the hard facts to support the
accusations there are none! Why are these people aloud to participate in a harassment campaign
with their cameras and glaring stares at anyone attempting to enjoy the events, and what about
all their neighbours who were parking cars on their farms and selling sundries to the many , why
has this group not attacked these neighbours and friends in the same way as they have Burls
Creek?
I recently heard an interview on the CBC with the Mayor of Oro-Medonte who himself actively
was in the area and inspecting the concerns of his constituents during Way Home & Boots n
Hearts events in 2015, and could NOT find any fault with the organizers. The OPP & Emergency
Services all support how these events were run, in fact I believe the Emergency Services at

this event were dispatched into the immediate community to assist one of the local residents in
a quicker response time then existing services could provide.
I have personally seen the Mayor at the Barrie Automotive Flea Market another great event
held to better the economic growth of our region, that has been negatively impacted by this
Save Oro group.
We have had to put up with the Barrie Speedway noise on a weekly basis and the rush of traffic
on Friday/Saturday nights for over 30 years, but this SAVE ORO group never once protested
this, how is that possible!
In closing I to wish we could have the simpler lives of the 19th & 20th centuries but that is not
practical or possible, those who insist this is the better way there are several communities
within Southern and Central Ontario you can move to, but mind yourself they live within
communities in the 21st century.

Good morning,
This email presents my personal comments on only a fraction of the issues surrounding
the vote regarding the Special Events Permits, specifically as it relates to Wayhome, and
Boots and Hearts, 2016. I rely on the technical and professional expertise presented
by representatives of both sides of the issue regarding the many aspects that weigh into
this decision.
Support:
- Overall, I am in favour of the festivals in Oro-Medonte on the full grounds as
requested, while awaiting legal/OMB decisions.
- I firmly believe that the music festivals are and will continue to be a positive feature of
the Oro Medonte tapestry. Oro-Medonte is and can be more than the highway between
Toronto and cottage country. It is also an opportunity to support all of Simcoe
County/Muskoka by giving back to those who give up theirbackyards to entertain us
(e.g., Kempenfest, Mariposa, Wasaga Beach).
- I am encouraged the community integration and support the Burls Creek owners have
demonstrated to date (e.g., OK Friday, soccer fields, support of school music programs,
harvesting, cooperation with local farmers who have reached out for assistance).
Concerns:
- Burl's Creek/Live Nation (and related organizers for these events) have disrespected
the township and its residents by proceeding with the event before full legal status is
verified. This is a precedent for other businesses and organizations to set up without
getting prior approvals. If a landfill was being placed in our township, we would not be
so willing to allow it until all legal matters were settled.
- Traffic patterns may not be the same as last year (which was a positive experience).
This year camping/parking is not included in the general admission, therefore people
may be searching for illegal and destructive alternatives by parking on the road or
camping in public/private areas. Enforcement officers must be out in active numbers.
Residents require hang tags to move about their residential area.
- The bylaw must consider ONLY objective and measurable factors. Detail what is
expected of the venue, detail a clear standard by which to measure decibels and
volume. Subjective and unmeasurable words such as country music have no place in a
municipal bylaw.
- Noise restrictions must be clear (e.g., time of day). Monitoring and subsequent
enforcement of violations of decibel levels take place at the time. Enforcement should
happen at the time, not after. Venue must be fully committed to react (lower sound) and
comply at the time of violation.

The project management of last year's events was outstanding, and part of project
management is listening to stakeholders. I believe this is happening, and appreciate the

This short notice meeting, less than 48 hours to prepare, with an attempt to push
through laws to enable a convicted promotor and developer is by far and away the
sneakiest and most despicable stunt ever pulled by this Administration and Council.
Your minds appear to be already made up and you don't want to be confused by facts.
Is it any wonder various groups won't negotiate a 'win-win' when the Township
continues on with a snafu to forever violate the Human Rights of citizens. Support of this
agenda will confirm Council's desire to destroy liberty, to remove the right to life, to
violate people's rights to enjoyment of property and most of all, your support will
remove the rights of residents to protection of the law.

The province in the form of the MMAH and the MTCS has already communicated in
writing, DON'T DO THIS! The Provincial Policy Statement says DON'T DO THIS! Even
Mayor Hughes says the Township will abide the Province. Then, why are we here today?
Double speak does NOT MAKE IT RIGHT.
"If they go ahead, they will be charged for the zoning infractions because they
undoubtedly will use the unzoned property," Ralph Hough said Friday. "They're not going
toget 40,000 people camping and parking and having the show on the 92 acres that it's

Even Deputy Hough says the laws of the land will be upheld, yet the laws were never
abided by and no convictions of any material consequence were sought by the Township.

Why should residents believe what is being said now when history shows a pattern of
behaviour completely the opposite?
A presentation showing previous ILLEGAL activity doesn't suddenly make it right and
legal. How uninformed and slow do you think the residents are? An attempt to revise the
Special Events By-Law is just another sneaky snake way of trampling rights in order to
enable a convicted developer.
1.Per OM By-Law 2015-123 (Special Events) Sect. 2.10, para d), events of more than
10,000 require approval of Council. When was the Special Events Permit put before
Council for approval? Was it approved?
2. When was Council notified per Sect 2.21?
3. Per other Sections, was Council notified 120 days prior to the Event, per Sect. 2.5?
4. Was the Permit application received 60 days prior per Sect. 2.6?
Like the BAFM fiasco and last year's concerts, the TWP hasn't been able to manage a
process that was touted as necessary and underwritten by Staff and more powers are to
be given that would be further be unable to be managed properly. The guise of
improvements sure won't fly this time around when an amendment is clearly wanted to
cover up a poorly managed process in the first place. Don't be gullible members of
Council.
This is not camping, you want to suborn the creation of a scofflaw migrant refugee
camp. It's not just for 3 days here and 3 days there. The activity and obnoxious impact
to residents has been going on since the illegal BAFM and if you support, will carry on
through the entire summer. WAKE UP COUNCIL, do the right thing so you can sleep at
night.
DO NOT SUPPORT the Special Events Permits, the MOU, which was never enforced
anyway, and the amendments to the Special Events By-Law. I have had an Enforcement
Request for violations at the BAFM in place for 4 weeks now with NO ENFORCEMENT in
sight.
In light of the above FACTS, why would Council, supposedly intelligent people, not be
able to see the real situation of destroying Agricultural lands, the largest
economic driver in the County and Township. You don't dismantle the foundation of
record setting farm incomes in 2014, 2015 and projected 2016 as reported by
Agriculture Canada.
You don't desecrate and destroy Heritage features of the First Nations contrary to the
Heritage Act. Support Chief Doxsee's deputation and VOTE TO IMPLEMENT ALL OF THE
FN REQUESTS.
DO NOT SUPPORT the Special Events By-Law amendment. DO NOT SUPPORT the Special
Events Permit (which would be ILLEGAL anyway), DO NOT SUPPORT the MOU.
