A By-Law to create a Water Inspection, operation and Maintenance
Department for the Township of Oro-Medonte.

WHEREAS it is deemed expedient by the Council of the Township of
Oro-Medonte to form a Water Works Department of the Township of
Oro-Medonte for the purposes of inspecting, operating and
maintaining water systems in the Township and henceforth to be
recognized as "the Township of Oro-Medonte Water Works Department".
NOW THEREFORE be it enacted by The Municipal corporation of the
Township of Oro-Medonte as follows:
1.
the "Public Services Administrator" shall be responsible for
the proper and efficient administration of the water
inspection operation, and maintenance of the Township of Oro-
Medonte water supply and distribution systems as in Schedule
"A" which forms part of this By-law.

2.
The "Public Services Administrator" shall also be responsible
for the proper and efficient enforcing and inspection of the
Plumbing Code under the ontario Water Resources Act.
3. By-Law No. 88-89 and By-Law No. 90-79 of the Township of Oro
are hereby repealed.

4 .
This By-law shall come into force and take effect upon its
third and final reading.
Any resolution or any By-law of any council contrary hereto and/or
inconsistent herewith are hereby repealed.

SCHEDULE "A"
TO BY-LAW NO. 94-23
OF THE CORPORATION OF THE TOWNSHIP OF ORO-MEDONTE
.
To regulate the Water Inspections, operation and Maintenance of the
Township Water systems.
1. That all owners of property in the Township of Oro-Medonte,
whose property fronts on a Township road provided with a
domestic water system shall have a Municipal Water line
servicing their property by the Township and all such owners
shall connect to the said water line for the supply of
Domestic Water as defined herein, which domestic water shall
be supplied by the Township of Oro-Medonte according to the
terms of this By-law.
2. The authorized rates for the supply of domestic water shall be
those rates as set by Resolution of the Corporation of the
Township of Oro-Medonte from time to time. The annual water
rates shall be due on the same day as the final instalment of
the Municipal taxes in any given year.
All charges and rates shall be due on demand and shall bear
interest at a rate of 1 1/4% per month which is to be added on
the first day of each calendar month thereafter in which the
default occurs. All owners shall be notified in writing of
any water account that is outstanding for thirty (30) days
after the due date thereof and shall be notified that the
township may on the expiration of an additional third (30) day
period, in addition to all other remedies, discontinue the
supply of water to the owner.
3. The Township agrees to use reasonable diligence in providing
a regular and uninterrupted supply of water for domestic use
only, but does not guarantee a constant service or the
maintenance of unvaried pressure and will not be liable for
damages to the customer by reason of any failure in respect
thereto. The watering of lawns or gardens or the filling of
swimming pools are not deemed to be a domestic use under the
terms of the By-law and may be prohibited from time to time by
Resolution of Council and the customer shall be subject to
immediate termination of the water supply in the event of a
breach of such an order.
4.
All owners after having paid to the Township the required
inspection fee as set by Resolution from time to time shall
supply and install all necessary equipment up to the Township
curb stop and be responsible for and keep in good condition,
repair and maintain the supply line and any other plumbing
equipment which may be installed within the owner's lot
limits, provided that the owner shall only complete the
installation up to the township curb stop in the presence of
the Township Inspector. As soon as the water connection
installation is approved by the Inspector he shall forthwith
turn the water on for the owner. If the owner fails to keep
his plumbing and other equipment in good working order and
repair, and as a result thereof, there is a continual loss of
water, the Township may, at its option, forthwith terminate
the supply of water, until repairs are properly effected to
the satisfaction of the Township.

5. The owner further agrees that no person (other than a properly
authorized Agent of the Township), shall be permitted to
repair, remove, inspect or tamper with any of the Township's
equipment, either before, during or after installation, unless
during the continual inspection of the Township Inspector.

The Township shall not be liable to the owner for damages by
reason of failure of the water supply whether due to a
breakdown of equipment, or for reasons beyond the control of
the Township, or for any reason whatsoever. The Township
will, however, exercise reasonable diligence and make such
repairs as may be necessary, and do such acts as within its
powers, to restore the services, and shall at all times for
such purposes (in emergencies), have the right to enter upon
the lands of the owner; provided that if the Township by
reason of its entry on the owner's land occasions any damage
to the owner's property, then such damage shall be repaired in
a proper manner forthwith, at the Township's expense.

7. If the owner fails to keep his water service line, plumbing
and equipment in good working order and repair and as a result
thereof, there is a continual loss of water, the Township may,
with or without notice, enter upon the land where the service
pipe is located and repair the same and charge the cost
thereof to the owner and the cost may be collected in the same
manner as the water rates or the Township may, at its option,
forthwith terminate the supply of water until repairs are made
to the satisfaction of the Township.
8. All disconnection and/or connection fees shall be charged
according to the rates set forth in Schedule "B" attached
hereto, provided that the fee for all reconnect ions shall be
paid prior to reconnection.
9. No one shall connect to the Township water system or relocate
an existing service without having the work inspected by the
Township after making the required application and paying the
necessary fees.
10. Application for a water service connection shall be made and
paid for at the same time as a building permit application (if
applicable) if the property is to be serviced by Municipal
water. For existing buildings the inspection fee shall be
paid prior to commencement of any work with regards to the
proposed connections. The Water Service connection fee shall
be as set by Resolution of the Corporation of the Township of
Oro-Medonte. The Water Service Connection fee shall be paid
in full prior to a building permit being issued.
11. The Township shall not supply water or complete a water
connection unless the water service line and all necessary
equipment from the interior face of the outer wall of the
Owner's building to the Township curb stop has been installed
by the owner at his expense, according to the following
specifications and after having been inspected and approved by
the Township's Inspector prior to backfilling:

have a minimum depth of cover of 1.5 metres
be 19mm diameter type K copper for ductile
iron watermain or series 160 polyethylene for
PVC watermain
have 150mm of sand bedding
have 150mm of sand cover
have a 19mm diameter
installed inside each

12. No property owner connected to a Township of Oro-Medonte
Municipal Water System shall fill or allow to be filled a
swimming pool with water from a Township water system. All
property owners with swimming pools, in-ground or above
ground, shall install a backflow prevention device on all
outside water taps.

13. In addition to any other penalties prescribed by law, each
owner of a property connected to a Township of Oro-Medonte
Municipal Water System who contravenes or does not comply with
any provision of this By-law upon conviction, is guilty of an
offence and shall be liable to a fine in an amount to be
determined pursuant to the Provincial Offences Act, R.S.O.
1990, c. P.33.

14. All rates, provisions and regulations of this By-law shall
come into force and take effect upon the day of the final
passing hereof.

IT IS ORDERED pursuant to the provisions of
the provincial Offences Act and the rules for
the ontario Court (Provincial Division), that
the amount set opposite each of the offences
in the attached schedule of offences under
the provincial Statutes and Regulations
thereunder and Municipal By-law No 94-23 as
amended of the Corporation of the Township of
Oro-Medonte, attached hereto, is the set
fine, for those offences to take effect May
12th, 1994.
