2015-191 Amend zoning provisions CON 13 East Part Lot 5, MedonteThe Corporation of the Township of Oro-Medonte By-law No. 2015-191 A By-law to A By-law to amend the zoning provisions On lands described as follows: Concession 13, East Part Lot 5, Medonte (Draft Plan of Subdivision 43T-90082) Township of Oro-Medonte, County of Simcoe Roll # 4346-020-004-09500 and 4346-020-004-09920 Whereas the Council of the Corporation of the Township of Oro-Medonte is empowered to pass By-laws to regulate the use of land pursuant to Section 34 of the Planning Act, R.S.O. 1990, c.P.13. And Whereas Council deems it appropriate to rezone the subject lands, in accordance with Sections C2 and C3 of the Official Plan; Now Therefore the Council of the Township of Oro-Medonte hereby enacts as follows: Schedule `A21' to Zoning By-law 97-95, as amended, is hereby further amended by changing the zone symbol applying to the land located in Concession 13, East Part Lot 5, Draft Plan of Subdivision 43T-90082, in the former geographic Township of Medonte, from Agricultural/Rural (A/RU) and Agricultural/Rural Exception 15 (A/RU*15) Zones to the Residential One Exception 265 Holding Provision (131 *265(H)) Zone, the Open Space (OS), and Open Space Exception 266 (OS*266) Zones as shown on Schedule `A' attached hereto and forming part of this By-law. 2. Section 7 — Exceptions of Zoning By-law 97-95 as amended is hereby further amended by the addition of the following subsection: "7.265 *265 — CONCESSION 13, EAST PART LOT 5 (MEADOW ACRES) "Notwithstanding any other provision in this By-law, the following provisions apply to single detached dwellings on lands denoted by the symbol *265 on the schedules to this By-law: a) Minimum Floor Area, excluding car 90 square metres parking areas within the building b) Minimum First Storey Floor Area 45 square metres c) Minimum required Interior Side Yard 3.0metres 3. Section 7 — Exceptions of Zoning By-law 97-95 as amended is hereby further amended by the addition of the following subsection: "7.266 *266 — CONCESSION 13, EAST PART LOT 5 (MEADOW ACRES) "Notwithstanding any other provision in this By-law, only a Stormwater Management Facility is permitted on the lands denoted by the symbol *266 on the schedules to this By-law. 4. That, in accordance with Section 36 of The Planning Act, R.S.O.1990, the Holdin (H) Provision affixed to the R1 *265 Zone shall not be removed until such time as requirements outlined in the subdivision agreement regarding the issuance of a Certificate of Substantial Completion have been satisfied/issued. 5. This by-law shall take effect on the final passing thereof, subject to the provisions of the Planning Act, as amended.
