a) Notice of a Complete Application and Public Meeting for Proposed Amendment to the
Zoning By -Law, Concession 1, Part of Lot 7 (Oro), Township of Oro-Medonte, 421
Penetanguishene Road, 2015-ZBA-13 (Jocelyn McArthur (Griffiths)).
Deputy Mayor Hough called the meeting to order at 7:59 p.m. and explained the public
meeting has been called under the authority of Section 34 of the Planning Act, to obtain
public comment with respect to proposed Zoning By-law Amendment Application 2015-
ZBA-13 (McArthur) which proposes to re -zone a portion of the subject lands from
Agricultural/Rural (A/RU) Zone to an Agricultural/Rural Exception (A/RU*##) Zone to, in
addition to the currently permitted uses in the A/RU Zone, permit on the lands the
following uses: winery/cidery, tasting room, hospitality room, retail sales, tied room and
special event facilities.
Notice of the Public Meeting was mailed to landowners within 120 metres of the specified
site on October 15, 2015 and a notice sign was posted on the subject property on
October 16, 2015.
The following correspondence was received: Nottawasaga Valley Conservation Authority
dated October 30, 2015; County of Simcoe dated November 3, 2015; Simcoe County
District School Board dated October 20, 2015.
Andria Leigh, Director, Development Services, explained the purpose and effect of the
proposed amendment. A PowerPoint presentation was presented.
Gary Bell, Skelton Brumwell and Associates, on behalf of the applicant, provided an
overview. A PowerPoint presentation was presented.
The following public persons offered verbal comments with respect to the proposed
amendment: Peter McArthur, Craig Flegel, Sandy Agnew.
Deputy Mayor Hough advised that no additional deputations to Council will be permitted
with respect to the proposed amendment.

b) That an Ontario Land Surveyor provide verification to the Township of compliance
with the Committee's decision by: 1) pinning of the foundation wall of the dwelling
and verifying by way of survey/real property report, prior to pouring of the dwelling
foundation that the dwelling be no closer to the rear lot line than 6.5 metres (21.3
feet);
c) That the applicant provide a detailed site plan that provides the following
information for review and approval by the Township's Building Division to confirm
compliance with the Ontario Building Code: distance to adjacent/ neighbouring
wells, septic tanks and beds, proposed setback between the existing well on the
subject property and the required septic tile bed and tank, location and dimensions
of the required septic tank and septic tile bed, location of waterloo bio filter shed or
area bed.
d) That the location of the proposed tertiary private on-site sewage disposal system
be verified by an Ontario Land Surveyor, due to its close proximity to a well;
e) That the appropriate Zoning Certificate, Engineered Lot Grading Plan, and Building
Permits be obtained from the Township only after Conditions (c) is completed to
the satisfaction on the Township's Building Division and the Committee's decision
becomes final and binding, as provided for within the Planning Act R.S.O. 1990,
c. P. 13.
4. And that the applicant be advised of Committee's decision under the Director,

1. That Report No. DS2015-113, Derek Witlib, Manager, Planning Services re: Consent
Application 2015-B-32 by Don & Sherry Hubbert, 1086 Ridge Road East, Parts of Lot
22 & 23, Concession 10 (Oro) be received and adopted, as amended.
2. The Development Services Committee grant provisional consent to Application 2015-
B-32 to permit a boundary adjustment of approximately 33.7 hectares (83.3 acres) and
to retain a parcel having an area of approximately 1.0 hectare (2.5 acres) and at least
45 metres (150 feet) of frontage on Line 10 South, subject to the following conditions:
a) That the severed lands, be merged in title with the abutting property to the south.
b) That Section 50(3) and 50(5) shall apply to any subsequent conveyance of, or
other transaction involving, the identical subject parcel of land. Therefore, once the
subject parcel of land has been conveyed to the owner of the abutting parcel to the
north, the subject parcel and the said abutting parcel shall merge in title and
become one parcel of land. A solicitor's written undertaking shall be provided to the
Secretary -Treasurer indicating that the necessary steps will be taken to implement
the conveyance and to consolidate the parcels to one Property Identifier Number.
c) That one copy of a Registered Reference Plan of the subject lands prepared by an
Ontario Land Surveyor be submitted to the Committee Secretary -Treasurer;
d) That the applicant satisfy the requirements of the County of Simcoe in their letter
dated November 4, 2015;
e) That the applicant's solicitor prepare and submit a copy of the proposed
conveyance for the parcel severed, for review by the Municipality;
f) That all municipal taxes be paid to the Township of Oro-Medonte;
g) That the Certificate of Consent be issued utilizing Form 4, Section 53 (42) of the
Planning Act, R.S.O. 1990, to merge the parcels; and
h) That the conditions of consent imposed by the Committee be fulfilled within one
year from the date of the giving of the notice.
3. And that the applicant be advised of the Development Services Committee's decision
under the Director, Development Services' signature.

The following correspondence was received: Allan Norman dated November 2, 2015;
Glenwood S.G. Turner dated November 2, 2015; Caroline Norman received November 3,
2015 (submitted additional correspondence at meeting to Director, Development
Services).
Rob Ballantyne, applicant, was present.
Caroline Norman provided concerns of the lot potentially becoming a commercial lot and
requested the scale of the neighbourhood to remain as current. Comments were
suggested to store the materials off site due to the residential area. Additional
correspondence regarding restrictive covenants on title was submitted to the Director,
Development Services.
Craig Flegel provided comments that the building will match the properties in the area and
attested there are no employees at the property.

as amended be received and adopted, as amended.
2. That the Zoning By-law Amendments that would amend the Township of Oro-Medonte
Zoning By-law 97-95, by providing general changes and updates to Sections 2.5.2,
5.1.1.1, 5.1.1.3 (c), 5.6 (d), 5.9, 5.16, 5.20, 5.21, 5.25, 5.32, 5.37, 5.38, 5.39, 6.0, and
removing the Holding (H) symbol from a number of roads now maintained by the
Township as outlined in draft By-law Nos. 2015-192 and 2015-193 be approved.
3. And that the appropriate By-laws be brought forward for Council's consideration.
