2015-190 Agreement with County of Simcoe Medical Aid Tiered Response Data SharingThe Corporation of the Township of Oro-Medonte By -Law No. 2015-190 A By-law to Authorize the Execution of an Agreement between The Corporation of the Township of Oro-Medonte and The Corporation of the County of Simcoe for a Medical Aid Tiered Response Data Sharing Agreement Whereas Section 11 of the Municipal Act, 2001, S. 0. 2001, c.25, as amended, authorizes a municipality to pass by-laws with respect to the health, safety and well- being of persons; And Whereas Section 20(1) of the Municipal Act, 2001, R.S.O. 2001, c.25, as amended, provides that a municipality may enter into an agreement with other municipalities for joint undertakings; And Whereas Section 116(1) of the Municipal Act, 2001, R.S.O. 2001, c.25, as amended, provides that a municipality may establish, maintain and operate a centralized communication system for emergency response purposes; And Whereas Section 2(5) of the Fire Protection and Prevention Act, 1997, S. 0. 1997, c.4 provides that a municipality may, under such conditions as may be specified in the agreement, enter into an agreement to receive such fire protection services as may be specified in the agreement from a fire department situated outside the territorial limits of the municipality; And Whereas the Township of Oro-Medonte has entered into an agreement with the City of Orillia for the provision of Fire Dispatch Services; And Whereas Council deems expedient to enter into a Medical Aid Tiered Response Data Sharing Agreement between The Township of Oro-Medonte and The Corporation of the County of Simcoe. Now Therefore the Council of the Township of Oro-Medonte hereby enacts as follows: 1. That the Mayor be authorized to execute the Medical Aid Tiered Response Data Sharing Agreement between The Township of Oro-Medonte and The Corporation of the County of Simcoe attached hereto as Schedule "A" and forming part of this by-law; 2. The Corporation of the Township of Oro-Medonte I Schedule !�' to By -Law No. 9015 - (10 MEDICAL AID TIERED RESPONSE DATA SHARING AGREEMENT This Data Sharing Agreement (the "Agreement") is entered into this I o)- day ofy3oQ ,�10D-g r , 20 15 BETWEEN: THE CORPORATION OF THE COUNTY OF SIMCOE -and- TOWNSHIP OF ORO-MEDONTE WHEREAS: (the "County") (the "Township") 1. The Ministry of Health and Long Term Care maintains a data repository (Ambulance Dispatch Reporting System - ADRS) of call information collected through ambulance communication centres; 2. The County provides paramedic services within the County of Simcoe, and the cities of Barrie and Orillia; 3. The County of Simcoe, through a web based portal collects pertinent emergency response information for calls within the County of Simcoe, and calls serviced by the County of Simcoe outside of its borders; 4. The City of Orillia Fire Service ("Orillia Fire") provides fire dispatching services to the Township and maintains a data repository of call information collected during the course of their contracted duties. Some of these calls relate to emergency responses that include medical aid for which paramedic services from the County are also engaged. 5. The County and the Township wish to enter into an arrangement to share certain data (the "Data") about these calls in order to improve their services to the public. NOW THEREFORE, for the consideration expressed in the recitals above, and for other good and valuable consideration, the parties agrees as follows: 1. The Township expressly authorizes and directs Orillia Fire Service to cooperate with the County and to provide the Data to the County covered by this Agreement. 2. In particular, the Township gives its consent to the County of Simcoe to request and receive fire response data from the Orillia Fire Service AND THAT Orillia Fire Service can release the requested information for the purpose of data matching, response time calculations and mapping. 3. Unless otherwise provided for in this Agreement or by subsequent agreement in writing, no part of the Data may be copied, published, disseminated, or used in any form or by any means other than for the use(s) described and agreed to herein. 4. The Data will include: a. the full emergency response data set for medical tiered calls, in order to facilitate the automatic matching of addresses and responses b. call information and data bases related to identified emergency responses within the County of Simcoe. 5. The Parties agree that such a request for fire response data will be made at the end of every quarter of the calendar year. 6. The County of Simcoe agrees that a shared database consisting of County of Simcoe Paramedic Service response data and Orillia Fire Service response data will be made available for review by Orillia. 7. The Parties understand that there are no assurances of accuracy of completeness in the data provided by the above named Parties. The data is acknowledged to be provided on an "as is" basis. B. The Parties acknowledge and agree that there is no representation, warrant, condition or promise (express or implied, statutory or otherwise) given by any party as to the completeness, accuracy, reliability for any intended use or purpose of any of its data. 9. The Parties shall use appropriate safeguards to prevent use or disclosure of the data other than as permitted to under this agreement. The Parties acknowledge that both the County and the Township are bound by the provisions of the Municipal Freedom of Information and Protection of Privacy Act which shall be adhered to as it may apply to the information being collected and exchanged under this agreement. 10. The Parties individually agree to indemnify and save harmless one another from any suits, actions, claims or demands of any kind if negligence on their part results in an illegal or inappropriate release of the Data or any part of same. 11. This Agreement shall be automatically renewed unless either party provides to the other sixty days notice of their desire to terminate this Agreement in writing. 12. This agreement and any schedules may only be amended by the written agreement of the Parties. 13. The Parties undertake and agree to give one another written notice of any changes in legislation, regulations or policies respecting those Parties that are likely to affect the obligations incurred under this Agreement.
