Good Afternoon Warden, Deputy Warden and Councilors of Simcoe County,
I wanted to contact you all with regards to County Council October 13th, where there will be
discussion regarding cost submissions against AWARE Simcoe for the "Beeton Woods" efforts
made through the courts. I would hope that you would not be in support of something like
this. I do believe at the April 14th hearing at Simcoe County it was mentioned by staff, (Graham
Davies I believe) that the County ķźķ over look the notification process set out in by-law 5635,
which in all fairness contributed to where we are today. I believe it is enough that it was the
residents tax money going into arguing against the residents. So please I ask you when is
enough enough? I ask that you speak out against this and see the whole picture, stand for your

It confirms the council attendance at the April 14th hearing and the May 12th deliberation.
You will notice that Councillors B. Milne and Dubeau were not present at the April 14th
hearing, yet were present at the May 12th deliberation to vote on the outcome of the
hearing.
Taking that into consideration as well as the

recognize an open planning application by Tecumseth Estates and you have reason for
concern as a citizen of Beeton.
If you found it unreasonable of AWARE Simcoe and residents of Beeton to ask questions
and demand more out of our elected officials when dealing with issues that are close to the
heart of the community, then you should vote to seek reimbursement for legal costs from
AWARE.

COSTS SUBMISSIONS OF THE COUNTY OF SIMCOE
1.The County of Simcoe is a respondent to a judicial review application
brought by the Applicant Aware Simcoe Environmental and Social Solutions Inc
2.Aware brought a motion for an interim injunction to restrain the Co-Respondent
Tecumseth Estates Inc. (the Company) from acting on a tree removal permit granted
to it by the County to clear certain of its property for agricultural purposes. The County
and the Company opposed the interim injunction application and the motion was
dismissed.
3.Her Honour Justice Eberhard gave detailed reasons for the dismissal of the motion,
including the background to the County granting its original permit. She covered the
County having inadvertently omitting notice to abutting property owners, the placing of
the subsequent stop work order, the very complete hearing that was then granted, and
the procedural errors made by the County in holding the hearing and deliberating on its

decision. She found that the process, though flawed, did not meet the tests for an
interim injunction in all of the circumstances.
4.In our respectful submission, there is nothing in the nature, process or result of this case
that would merit the Court deviating from the normal rule that costs follow the results
judicial review, and the even thinner basis for an interim injunction should lead to
5.The nature of the injunction action involved three separate legal issues to be canvassed:
a.Is there a serious question to be tried?
b.Would the litigant who seeks the interlocutory injunction suffer irreparable harm
if it is not granted?
c.Which party would suffer the greater harm from the granting or refusal of the
interlocutory order?
6.In particular, the first issue required the canvassing of a wide spectrum of issues,
including public vs. private rights, elements of natural justice and certain aspects of
3 statutory references to be researched, and then reviewed with the Court.
7.The County, as a public body is most sensitive to, and in most cases appreciative of, the
input of public interest groups into its legislative and administrative processes. That is
the very reason that when it was discovered that part of the process under its Forestry
Bylaw had been inadvertently overlooked, that it determined, in this situation to go
was required.
8.In fact, the AWARE group should be cognizant of the attempts by the County to be
transparent in its various processes. When the AWARE group complained publicly that
the County had not been open enough in the process of adopting a new Official Plan for
the County (even though the OMB found no flaw in the process) the County held an
expansive, and expensive public open house to answer the questions of AWARE and
others.

9.To be considered as well, is who has the primary responsibility for representing the
public interest. County Council is made up of the mayors and deputy mayors of its 16
constituent municipalities. This means that residents of those local municipalities have
both a direct influence on County decisions at the level of their local politicians, and a
second level of input at the County Council table itself. With these two layers of input,
the County Council is very well positioned to represent residents and taxpayers. Much
10.In our respectful submission, it was unfair and in fact inappropriate for this group to
challenge the County in this situation based on irregularities that it knew or should have
known had no discernible effect on the outcome. Simple mathematics was the answer
to one of the complaints, being that of the vote by two councillors who did not attend
part one of the hearing. With respect to the other complaint not being allowed a
- it seems disingenuous at best for AWARE to
have complained about not being able to repeat its hearing position, when the
Mr. Rowe unable to answer questions he was learning of for the first time at the
hearing.
11.One has to keep in mind, of course, that the County is the steward of public monies.
While of course it must defend an action when brought against it, it also has an
obligation to recover the taxpayer dollars spent on an action that a Court has found was
ill-conceived.
12.We have provided a bill of costs divided into three columns. We have shown the actual
fees and disbursements charged to the County. It should be noted that we provide the
County a rate that is discounted roughly by 1/3 from our standard client rates. We have
then shown what would be substantial indemnity rate at 85% and partial indemnity at
amount, of costs in this situation.

Good evening,
I would like to express my utter disappointment at the decision of County Council to consider
allowing the Developers and the County itself to recover costs for the Save the Beeton Woods
judicial review. The only reason there was a judicial review in the first place was because the Town
and County did not follow due process. The Town of New Tecumseth's incompetence (not noticing
or not disclosing the open development application by the applicants) is the reason that these trees
will be cut down. It's extremely discouraging to average working people like me that some politicians
don't have the common decency to take responsibility and admit when they've made a mistake. If
you have any inclination towards environmentalism, you will use your common sense amidst all of
these political games and realize that these woods should remain standing. It is not just a precious
mature woodlot, but it is ENVIRONMENTALLY PROTECTED land and should have been
recognized as such at a very early stage in this game. What is that designation good for if it is
ignored at every corner?
It's not just highly disappointing, but it's frustrating, disempowering, and totally disrespectful to many
people. Please re-consider and at least pay your own fees incurred because of mistakes that TNT
made in the first place.
Be a true leader and stand up for the people and the planet on this one.

On May5, 1960, the Nottawasaga Valley Conservation Authority (NVCA) was created
by Order-in-Council OC-1837-60to:

Budget Process
In August, 2015, the Finance and Administrative Advisory Committee received a staff
report on the budget pressures projected for 2016. Subsequently, the Board of
Directors approved the committee’s recommendation and staff were directed to create
a draft budget for the October2, 2015 meeting. Upon approval, the draft budget will
be circulated to our watershed municipalities for comments. The Board of Directors will
vote on the budget and associated municipal levy at the December 11, 2015Board
meeting.
Budget Vote
Directors of the Board will vote on the budget and levy using a weighted vote based on
the Current Value Assessment levy apportionment formula from the next page. If a
municipality has two members representing their municipality on the Board then the
percentage is split between the two members unless there is a resolution from their
council giving the full vote to one member.

Glossary of Terms
Advertisement & Communications – Includes advertisements, signage for all of the NVCA
conservation areas as well as project site signage. This also includes the NVCA annual Evening
of Thanks volunteer recognition event.
Amortization Expense – Annual expense for the capital purchases that are partially expenses
annually following a fixed asset schedule.
Contributions – Includes donations, grants & special funding from non-government agencies.
Federal Sources – Federal grants or special projects funded by the federal government.
(eg. Lake Simcoe/South-eastern Georgian Bay Clean-Up Fund)
Leases – Equipment leases such as photocopiers, postage meter, etc.
Materials & Supplies – Includes many things like offsite storage, materials and supplies
purchased for weddings, education programs, etc., as well as project material costs required to
complete specially funded projects.
Membership/Professional Dues – Includes membership with Conservation Ontario and
Conservation Authorities Moraine Coalition for the Oak Ridges Moraine; as well as professional
dues for staff as required.
MNRF Transfer Payment – Provincial money for the flood program, which is matched by the
municipal levy.
Municipal Levy – Money provided by municipalities and apportioned by current value
assessment. Other parts of levy include:
Matching Levy – Flood – This is the amount of levy that is matched by municipalities for
the transfer payment from the MNRF.
Special Benefit Levy – This levy is only charged if the corresponding work is required
and is for a specific municipality in relation to ice management
Other Municipal Contributions – Money contributed by specific municipalities for special
municipal projects delivered by the NVCA or Risk Management Official work.
Other Provincial Sources – Other provincial grants or special projects funded by the province.
(eg. Source Water Protection)..
Staff Cost – General staff costs include meals during conferences, mileage for non-fleet
vehicles, etc.
Taxes – Property taxes for the NVCA owned properties paid to the municipalities.
Transportation Cost – Mileage paid to the NVCA Board of Directors.
User Fees – Fees for our programs and services paid by the user. These are not municipal
funds.

Call for Nominations for the Severn Sound Environmental Associations
2015 Environmental Awards
Severn Sound Environmental Associations 2015 Bob Whittam Award
From 1989 to 1997, renowned biologist and naturalist Bob Whittam was the
Chair of the Public Advisory Committee for the Severn Sound Remedial Action
Plan. Bob retired from his post in 1997, but his continued support of the Severn
Sound Environmental Association is highly valued by the staff. Each year we
recognize those who are dedicated and truly interested in improving the Severn
Sound Watershed and area. The nominees considered could include assisting
the Severn Sound Environmental Association or developing their own initiative
such as habitat restoration, stewardship, or environmental education, all of which
promote a healthy Severn Sound ecosystem. We are inviting everyone in our
communities to nominate worthy individuals or groups for the 2015 Bob Whittam
Award.
To nominate someone, a group or an individual who has made and/or continues
to make an important contribution to the Severn Sound ecosystem, please
contact the SSEA office for a nomination form or visit our website at
