1. That Report No. DS2015-085, Adrianna Spinosa, Planner, re: Minor Variance
Application, 2015-A-20 (Finney), 25 Moon Crescent, Plan M123, Lot 20 be received and
adopted.
2. That Minor Variance Application 2015-A-20 by A. Finney, specifically to permit the
construction of an attached garage addition with a reduced interior side yard setback of
1.5 metres and reduced front yard setback of 6.5 metres, on lands located in Plan M123,
Lot 20 (Medonte), Township of Oro-Medonte, known as 23 Moon Crescent, be approved.
3. That the following conditions be imposed on the Committee's decision:
a. That notwithstanding Table B1 of Zoning By-law 97-95, the proposed addition shall
otherwise comply with all other applicable provisions of the Zoning By-law;
b. That the buildings and structures on the property be in conformity with the
dimensions as set out on the application and sketches submitted and approved by
the Committee;
c. That Staff may require an Ontario Land Surveyor provide verification to the Township
of compliance with the Committee's decision by 1) pinning the foundation wall; 2)
verifying by way of survey/real property report, prior to the pouring of the footing and
if no footing, the foundation, that the addition be located no closer than 1.5 metres
from the interior side lot line, and no closer than 6.5 metres from the front lot line; and
d. That the appropriate Zoning Certificate, Engineered Lot Grading Approval, and
Building permit be obtained from the Township only after the Committee's decision
becomes final and binding, as provided for within the Planning Act R.S.O. 1990, c.P.

130.06 square metres (1,400 square feet) and an increased height of 5.49 metres, on lands
located in Concession 9, South Part Lot 21 (Medonte), Township of Oro-Medonte, known as
204 Peter Street East, be deferred for the applicant to consider a reduction in gross floor
area and height, and to attend the next Development Services Committee meeting.

Variance Application 2015-A-29 (Rhynold & Quesnelle), 204 Peter Street East,
Concession 9, South Part Lot 21 be received and adopted.
2. That Minor Variance Application 2015-A-29 by C. Rhynold & T. Quesnelle, specifically to
permit an accessory building with an increased floor area of 130.06 square metres
(1,400 square feet) and an increased height of 5.49 metres, on lands located in
Concession 9, South Part Lot 21 (Medonte), Township of Oro-Medonte, known as 204
Peter Street East, be approved.
3. That the following conditions be imposed on the Committee's decision:
a. That notwithstanding Sections 5.1.4 and 5.1.6 of Zoning By-law 97-95, the proposed
accessory building shall otherwise comply with all other applicable provisions of the
Zoning By-law;
b. That the proposed buildings/structures and landscaping on the property be
substantially and proportionally in conformity with the dimensions as set out on the
application and sketches submitted and approved by the Committee;
c. That Staff may require an Ontario Land Surveyor to provide verification to the
Township of compliance with the Committee's decision by 1) pinning the foundation
wall; 2) verifying by way of survey/real property report, prior to the pouring of the
footing and if no footing, the foundation, that the detached accessory building does
not exceed a floor area of 130.06 square metres; 3) Confirming, prior to approving
the framing inspection that the maximum height of the accessory building is no more
than 5.49 metres measured from grade to the midpoint of the roof;
d. That the appropriate Zoning Certificate and Building Permit be obtained from the
Township only after the Committee's decision becomes final and binding, as provided
for within the Planning Act R.S.O. 1990, c.P. 13.
4. And That the applicant be advised of the Committee's decision under the Director,
Development Services' signature.

2. That Minor Variance Application 2015-A-28 by Premier Operating Corporation Ltd.,
specifically to permit the storage of new cars in addition to the permitted uses of the
property, on lands located in Part of Lot 21, Concession 4 (Oro), known as 134 Line 4
South, be approved.
3. That the following conditions be imposed on the Committee's decision:
a) That notwithstanding the permitted uses of Table A4 (Agricultural/Rural Zone) and
Section 7.26 (A/RU*26 Exception zone), and the provisions of Section 5.24 (Parking
of Unlicensed Motor Vehicles in the A/RU Zone) of Zoning By-law 97-95, the uses of
the lands shall otherwise comply with all other applicable provisions of the Zoning By-
law;
b) That new car storage is only permitted during the period from November 1 st of any
year to April 1 st of the following year and only as an accessory use to a drive-in
movie theatre;
4. And That the applicant be advised of the Committee's decision under the Director,

5 be received and adopted.
2. That Minor Variance Application 2015-A-30 by N. Swallow, specifically to permit the
construction of a single detached dwelling with a reduced interior side yard setback of
1.5 metres and reduced rear yard setback of 7.46 metres, on lands located in
Concession 11, Plan 626, Lot 53, East Part Lot 5 (Oro), Township of Oro-Medonte,
known as 13 Myrtle Avenue, be approved.
3. That the following conditions be imposed on the Committee's decision:
a. That notwithstanding Table B1 of Zoning By-law 97-95, the proposed single detached
dwelling shall otherwise comply with all other applicable provisions of the Zoning By-
law;
b. That the buildings and structures on the property be in conformity with the
dimensions as set out on the application and sketches submitted and approved by
the Committee;
c. That Staff may require an Ontario Land Surveyor to provide verification to the
Township of compliance with the Committee's decision by 1) pinning the foundation

Variance Application 2015-A-31 by 2063334 Ontario Inc., Part of East Half of Lot 5,
Concession 13 (Medonte) be received and adopted.
2. That Minor Variance Application 2015-A-31 by 2063334 Ontario Inc., specifically to
permit a total of three (3) model homes, on lands located in Part of East Half of Lot 5,
Concession 13 (Medonte), be approved.
3. That the following conditions be imposed on the Committee's decision:
a) That notwithstanding and Section 5.36 of Zoning By-law 97-95, the proposed model
homes shall otherwise comply with all other applicable provisions of the Zoning By-
law and that the provisions and standards of the Residential One Exception 28
(R1 *28) Zone be applied.
b) That the Owner apply for and obtain Site Plan Approval for the model homes;
c) That the appropriate Zoning Certificate and Building permit be obtained from the
Township only after the Committee's decision becomes final and binding, as provided
for within the planning Act R.S.O. 1990, c.p. 13;

It is recommended:
1. That Report No. DS2015-089, Andria Leigh, Director, Development Services, re:
Consent Application 2015-B-12 and Minor Variance Application 2015-A-25 (Robin and
Nicole Baker), 1968 Line 8 North, Con. 8, Pt Lot 9 be received and adopted.
2. The Development Services Committee grant provisional consent to Application 2015-6-
12 to create a hobby farm lot, subject to the following conditions:
a. That one copy of a Registered Reference Plan for the subject lands indicating the
severed parcel be prepared by an Ontario Land Surveyor and be submitted to the
Secretary -Treasurer;
b. That the applicant's solicitor prepare and submit a copy of the proposed conveyance
for the parcel severed, for review by the Municipality;
c. That the applicant pay $ 2,000.00 to the Township for the severed lot created as
cash -in -lieu of a parkland contribution;
d. That all municipal taxes be paid to the Township of Oro-Medonte;
e. That the applicant apply for and obtain approval of a Minor Variance to permit a lot
size of less than 2 hectares for a hobby farm on the severed parcel;
f. That the Township apply a Holding ("H") provision on the severed land to control
future development;
g. That the conditions of consent imposed by the Committee be fulfilled within one year
from the date of the giving of the notice.
3. The Development Services Committee grant Minor Variance Application 2015-A-25,
subject to the following conditions:
a. That, notwithstanding Table B4 (A) of Zoning By-law 97-95, the severed lot shall
otherwise comply with all other applicable provisions of the Zoning By -Law.
4. And That the applicants be advised of the Committee's decision under the Director,
Development Services' signature.

a) Correspondence from Brian Smith, Mayor, Town of Wasaga Beach, dated August 7,
2015, re: Proposed Bill 73, Smart Growth for our Communities Act.

Whereas the Development Services Committee has received correspondence from Brian
Smith, Mayor, Town of Wasaga Beach, dated August 7, 2015; correspondence and
Planning Report No P15-022, Township of Clearview, dated July 6, 2015; and
correspondence from Sharon R. Goerke, Clerk, Township of Severn, dated May 8, 2015,
providing comments regarding proposed Bill 73;
And Whereas the Province is proposing amendments to the Planning Act that would:
a) not allow amendments to an Official Plan or Zoning By-law within two years of their
passing;
b) require Council approval for a minor variance within two years of a site-specific Zoning
By -Law Amendment; and
And Whereas Council has concerns that these amendments are not in keeping with
Provincial direction for efficient land use planning, will hinder the orderly development of the
municipality, and are unrealistic in addressing unforeseen development circumstances;
Now Therefore It Is Recommended That the Development Services Committee
recommends to Council that it supports the concerns from the Townships of Clearview and
Severn, and the Town of Wasaga Beach;
That the Province of Ontario be respectfully requested to remove these policies from Bill 73;
And That this resolution be forwarded to The Honourable Ted McMeekin, Ministry of
Municipal Affairs, the Townships of Severn and Clearview, and The Town of Wasaga Beach
under the Mayor's signature.
