2015-149 Amend zoning at 298-302 Shanty Bay RoadThe Corporation of the Township of Oro-Medonte By-law No. 2015-149 A By-law to amend the zoning provisions which apply to lands within Plan 1, E Pt Lot 16, W Pt Lot 16, Pt Blk H and RP 51 R-37843, Part 1, and Pt Lots 15 and 16, Pt Blk H, Township of Oro-Medonte, County of Simcoe, 298-302 Shanty Bay Road Lover's Harbour Inc. / Mark Porter (2014-ZBA-02) Whereas the Council of the Corporation of the Township of Oro-Medonte is empowered to pass By-laws to regulate the use of land pursuant to Section 34 of the Planning Act, R.S.O. 1990, c.P.13; And Whereas the Council of the Corporation of the Township of Oro-Medonte has determined a need to amend the zoning for land known municipally as 298, 300, and 302 Shanty Bay Road; And Whereas the Council of the Corporation of the Township of Oro-Medonte deems the said application to be in conformity with the Official Plan and Official Plan Amendment No. 38 of the Township of Oro-Medonte, as amended, and deems it advisable to amend the Zoning By-law. Now Therefore the Council of the Township of Oro-Medonte hereby enacts as follows: 1. Schedule 'A1' to Zoning By-law 97-95, as amended, is hereby further amended by changing the zone symbol applying to the subject lands from the Residential one (R1) and Local Commercial Exception 116) Zones to the Residential One Exception 260 (R1 *260) and Residential One Exception 261 (R1 *261) Zones as shown on Schedule `A' attached hereto and forming part of this By-law. 2. Section 7 — Exceptions of Zoning By-law 97-95 as amended is hereby amended by deleting Subsection 7.116 in its entirety. 3. Section 7- Exceptions of Zoning By-law 97-95 as amended is hereby further amended by adding Subsection 7.260 as follows: "7.260 *260 - Concession 1, Plan 1, E Pt Lot 16, W Pt Lot 16, Pt Blk H and RP 51 R-37843, Part 1, and Pt Lots 15 and 16, Pt Blk H, 298-302 Shanty Bay Road Notwithstanding any other provision in this By-law, the following zone provisions apply on the lands denoted by the symbol *260 on the schedules to this By-law: i) minimum lot frontage required is 21.0 metres (68.9 feet) ii) minimum lot area required is 1200 m2 4. Section 7- Exceptions of Zoning By-law 97-95 as amended is hereby further amended by adding Subsection 7.261 as follows: "7.261 *261 - Concession 1, Plan 1, E Pt Lot 16, W Pt Lot 16, Pt Blk H and RP 51 R-37843, Part 1, and Pt Lots 15 and 16, Pt Blk H, 298-302 Shanty Bay Road Notwithstanding any other provision in this By-law, the following zone provisions apply on the lands denoted by the symbol *261 on the schedules to this By-law: i) floor one (1) of the existing structure is permitted to be used as personal storage space only; ii) floor two (2) of the existing structure is permitted to continue to be used for multi -residential purposes in the form of two (2) residential apartments for a period of three years from date of adoption of this by-law iii) minimum lot frontage required is 21.0 metres (68.9 feet) iv) minimum lot area required is 1200 m2 v) minimum front yard setback required is 3.8 m vi) upon redevelopment of the existing structure, all other provisions of the R1 zone shall apply. 5. This by-law shall take effect on the final passing thereof in accordance with the provisions of the Planning Act, R.S.O. 1990 c.P. 13, as amended.
