"'�..�.� COUNTY OF S1MCOF s COUNTY OF SIMCOE �oLryTY StM coa To: COMMITTEE OF THE WHOLE Section: Performance Management - Finance Item Number: CCW 15-192 Meeting Date: June 23, 2015 Subject: Heritage Tax Rebate Program Recommendation: THAT should Council wish to implement a Heritage Property Tax Rebate Program, the program as outlined in Item CCW 15-192 be approved; AND THAT the necessary By-law to adopt the Heritage Tax Rebate Program be presented to County Council, substantively in the form attached as Schedule 1 to Item CCW 15-192. Executive Summary: County Council directed that staff prepare a report on a County Heritage Tax Refund By-law and the financial impact that this by-law would have on the County. This items provides background information and reviews the option and financial impact of potentially implementing a Heritage Property Tax Rebate Program at the County level. Background/Analysis/Options: Heritage Property tax relief programs were created under Section 365.2 of the Municipal Act which authorized local municipalities to provide relief in the range of 10 to 40 percent of the property taxes levied on an "eligible" heritage property as defined in the same section of the Act. The tax rebate program provides owners of designated and eligible properties with a measure of ongoing relief against their annual tax liabilities. This is intended to provide the owners of eligible heritage properties a measure of financial assistance in recognition of the fact that they are maintaining and preserving a building of importance to the local heritage. June 23, 2015 Committee of the Whole CCW 15-192 2 Heritage Property Tax Rebate Program To be eligible for a county rebate the property must be located within the County of Simcoe and designated under Part IV or be a part of a heritage conservation district under Part V of the Ontario Heritage Act and subject to: • An easement agreement with the local municipality in which it is located, under section 37 of the Ontario Heritage Act; or • An easement agreement with the Ontario Heritage Foundation, under section 22 of the Ontario Heritage Act; or • An agreement with the local municipality in which it is located respecting the preservation and maintenance of the property In addition, the property must also comply with any additional eligibility criteria established by the area municipality. When a lower tier municipality passes a by-law for an eligible heritage property the lower tier is required to notify the Minister of Finance and the upper tier of the amount of taxes to be reduced or refunded for lower tier purposes. The Heritage Tax Refund Program applies only to lower -tier municipalities that have notified the County that they have passed a Heritage Tax By-law in accordance with Section 365.2 of the Municipal Act, 2001. If the upper tier municipality receives notice of an area municipality's by-law, it may pass its own by-law to authorize a similar reduction or refund of taxes levied for upper tier purposes in that area municipality. An area municipality may have different rebate percentages for different property classes. In addition, minimum or maximum amounts of taxes to be rebated or refunded may also be established. If the upper -tier municipality passes a by-law, the costs of the rebate are shared by both municipalities and the Province (for education purposes) in the same proportion that they share in the tax revenue from the eligible properties. If the upper -tier does not pass a by-law, the costs are shared between the area municipality and the school boards without affecting the upper tier's share. In this case, the area municipality may choose to cover the upper -tier portion. Unique Requirements of a Heritage Property Tax Rebate Program The heritage property tax rebate program differs from all other tax policy rebate programs in that this program is implemented at the option of the area municipality rather than at the County level. The Province determined that area municipalities should have jurisdiction over this particular tax policy as they are responsible for designating properties under the Ontario Heritage Act. This creates some difficulties for the County as it could result in inequitable treatment for taxpayers across the County. Under the legislation, the area municipalities determine whether or not to have a heritage property tax rebate program and determine the parameters. The County then decides whether or not to fund its share of the cost of the programs adopted by each of the area municipalities. If the area municipalities adopt different programs or if some area municipalities implement a program and some do not, the County could find itself treating taxpayers differently in the various area municipalities. June 23, 2015 Committee of the Whole CCW 15-192 3 The only way in which the County can treat all taxpayers equitably is under a situation where all sixteen area municipalities have a common heritage property tax rebate program or a situation where the County does not fund its share of the heritage property tax rebate program for any of the area municipalities. Current Local Municipality Programs The Town of Collingwood, Town of Midland, Town of Penetanguishene, Township of Springwater and Township of Tay have instituted heritage tax relief by-laws and have previously requested that the County provide similar tax relief. No other local municipality has adopted a heritage tax relief program. Schedule 1 identifies municipalities that adopted a Heritage Property Tax rebate program as of May, 2015. Financial and Resource Implications: Based on the current participation of the member municipalities the impact would be approximately $32,750 per year to the County of Simcoe which would be accommodated within the General Municipal budget. OF THE CORPORATION OF THE COUNTY OF SIMCOE Being a by-law to provide for tax refunds for eligible heritage properties WHEREAS Section 365.2 of the Municipal Act, 2001, S.O. 2001, c25, as amended, provides that Council may pass a by-law establishing a program to provide heritage tax refunds in respect of eligible heritage properties; AND WHEREAS Section 365.2, subsection (6) of the Municipal Act, 2001, S.O. 2001, c25 as amended, states that "A lower -tier municipality that passes a by-law under this section shall notify the upper -tier municipality of the amount of taxes to be reduced or refunded for lower -tier purposes under the by-law."; AND WHEREAS Section 365.2, subsection (7) of the Municipal Act, 2001, S.O. 2001, c25 as amended, states that "An upper -tier municipality that receives a notice under subsection (6) may pass a by-law to authorize a similar reduction or refund of taxes levied for upper -tier purposes. AND WHEREAS a request has been received for the County of Simcoe to establish a Heritage Tax Credit program for properties designated under the Ontario Heritage Act; NOW THEREFORE the Council of The Corporation of the County of Simcoe enacts as follows; 1. DEFINITIONS In this By-law: 1.1 "built heritage resource" means a building or structure of historic or architectural value that reveals some of the broad architectural, cultural, social, political, economic or military patterns of our local history or that has some association with specific events or people that have shaped the details of that history. 1.2 "County" means The Corporation of the County of Simcoe; 1.3 "Council" means the Council of The Corporation of the County of Simcoe; 1A "eligible heritage property" means a property or portion of a property, i) that is located in a lower -tier municipality within the County of Simcoe; Page 15 of 18 5.d) Mayor H.S. Schedule 1 Committee of the Whole CCW 15-192 Page 2 ii) that is designated under Part IV of the Ontario Heritage Act or is part of a heritage conservation district under Part V of the Ontario Heritage Act; and iii) that is subject to either an easement agreement with the municipality under section 37 of the Ontario Heritage Act, an easement agreement with the Ontario Heritage Foundation under section 22 of the Ontario Heritage Act, or an agreement with the municipality respecting the preservation and maintenance of a built heritage resource on the property. 1.5 "heritage tax refund" means an amount of tax that may be refunded in respect of an eligible heritage property. 1.6 "municipal" means the lower -tier municipality 1.7 "owner(s)" includes a corporation and partnership and the heirs, executors, administrators and other legal representatives of a person to whom the context can apply according to law; 1.8 "person(s)" includes a corporation and partnership and the heirs, executors, administrators and other legal representatives of a person to whom the context can apply according to law; 2. HERITAGE TAX REFUND PROGRAM 2.1 Program Applies to Certain Lower -Tier Municipalities The Heritage Tax Refund Program applies only to lower -tier municipalities that: i) have notified the County that they have passed Heritage Tax By-law in accordance with Section 365.2 of the Municipal Act, 2001; and ii) are identified in Schedule "A" of this By-law. 2.2 Amount of County Refund The amount of a heritage tax refund must be between 10 and 40 per cent of the taxes for County purposes levied on the property. The specific percentage applicable for any eligible property will be the same as that provided for by the lower -tier by-law, and shall be set out in Schedule "A" of this By-law. Schedule 1 Committee of the Whole CCW 15-192 Page 3 2.3 Taxation Years No refund or reduction of shall be provided by the County in respect of a property for a taxation year that precedes the "First Effective Taxation Year' set out in Schedule "A" of this By-law for the lower -tier in which it is situated. The "First Effective Taxation Year" shall be the year in which the lower -tier is added to "Schedule A", or any other year that Council deems appropriate. 2.4 Program subject to Council Approval and Funding The Heritage Tax Refund Program set out in this By-law is subject at all times to the availability of funding for the program. This By-law is subject at all times to the availability of funding for this program and the Heritage Tax Refund contemplated by this By-law may be eliminated by Council through repeal of the By-law at any time with no notice whatsoever to affected persons. 2.5 Program subject to Provincial regulations This Heritage Tax Refund Program is subject to any regulations that the Minister of Finance may make governing by-laws on tax refunds and reductions for heritage properties. 2.6 Program subject to lower tier municipalities program guidelines This Heritage Tax Refund Program is subject to any guidelines that the lower tier municipality may make governing by-laws on tax refunds and reductions for heritage properties. 2.7 Schedule "A" Schedule "A" as made, and amended from time -to -time, shall be attached to, and form a part of this by-law.
