2015-061 Official Plan Amendment No. 37The Corporation of the Township Of Oro - Medonte By -Law No. 2015 -061 A By -law to Adopt An Amendment to the Official Plan of the Township of Oro - Medonte OPA No. 37 (Horseshoe Valley Lands Ltd.) Whereas The Corporation of the Township of Oro - Medonte is empowered to Amend its Official Plan as required; And Whereas Sections 17, 21, and 22 of the Planning Act, R.S.O. 1990, Chapter P. 13, as amended, provide: Council such authority to amend its Official Plan; And Whereas the policies of the Official Plan of the Township of Oro - Medonte are approved and in force and effect at this time; And Whereas Council has considered the appropriateness of amending the Official Plan in regard to lands within Part of the South Half of Lot 3 and Part of Lot 4, Concession 4 (former Township of Oro), Township of Oro - Medonte, Plan 51 M -1035 Lots 9 -13 and Lots 45 -49 inclusive; And Whereas the Council of the Corporation of the Township of Oro - Medonte deems it necessary and desirable to adopt an amendment to the Official Plan of the Township of Oro - Medonte; Now Therefore the Council of the Corporation of the Township of Oro - Medonte enacts as follows: 1. That the attached explanatory text and Schedule "A ", which constitute Amendment Number 37 to the Official Plan, is hereby adopted and; 2. That the Clerk is hereby authorized and directed to make application to the County of Simcoe for approval of the aforementioned Amendment No. 37 to the Official Plan of the Township of Oro - Medonte; and 3. That this By -law shall come into effect upon the date of passage therefore subject to the provisions of the Planning Act R.S.O. 1990, c. P. 13, as amended. DepuV Clerk — Janette Teeter Official Plan Amendment No. 37 Introduction Part 1 - The Introduction 1.1 Purpose 1.2 Location 1.3 Basis 1.4 Justification Part 2 - The Amendment 2.1 Preamble 2.2 Details of the Amendment 2.2.1 — Text Amendment 2.2.2 — Map Amendment 2.3 Implementation 2.4 Interpretation Schedule `A' Part 3 - Appendix - Report DS2015 -023 5 Part 1 — The Preamble 1.1 Purpose The purpose of this Official Plan Amendment is to amend the wording in Section C14.3.6 Horseshoe Valley Medium Density Residential designation and to amend Schedule D Horseshoe Valley Land Use Schedule in the Township of Oro - Medonte Official Plan. The intent of the Official Plan Amendment is to amend Section C14.3.6 of the Official Plan, as identified for lands shown on Appendix A to this amendment, to permit townhouse dwellings and a maximum density of 23 units per hectare, on lands identified as Plan 51 M -1035, Lots 45 to 48 inclusive and Lots 9 to 13 inclusive 1.2 Location The subject property legally described as Part of South Half of Lot 3 and Part of Lot 4, Concession 4, Geographic Township of Oro, Township of Oro - Medonte, being Plan 51 M -1035 is a registered Plan of Subdivision and approved for residential development. 1.3 Basis The current registered plan is designated for a mix of low and medium density residential uses. Currently approved within the registered plan is 57 single family lots and 27 townhouse lots. This Official Plan Amendment requests to re- designate a total of 9 single family residential lots within the plan to permit a total of 19 townhouse lots. Lots 45 through 48 and lots 9 through 13, as shown on Appendix A to this amendment, are proposed to be re- designated from Horseshoe Valley Low Density Residential to Horseshoe Valley Medium Density Residential to permit eight (8) and eleven (11) townhouse lots, respectively. 1.4 Justification The subject property is located within the Horseshoe Valley Settlement Area and is designated in the Township of Oro - Medonte Official Plan as Horseshoe Valley Low and Medium Density Residential. The Horseshoe Valley Low Density Residential designation is intended to accommodate single family residential 0 uses while the Horseshoe Valley Medium Density Residential designation permits a variety of uses including townhouse and midrise development. The proposal to re- designate the subject lands as shown on Appendix A to accommodate medium density residential uses on the lands represents residential intensification within a settlement area through an efficient and orderly use of infrastructure. The medium density designation will allow for the lands to be developed with a wider range of housing opportunities, providing the opportunity for a greater townhouse mix on lands identified as a growth node by both the Township and the County. The proposed land use conforms to the policies of the Growth Plan, the Provincial Policy Statement (2014), the County of Simcoe Official Plan, and the Township of Oro - Medonte Official Plan. Accommodating a medium residential density and allowing for a wider range of housing types to accommodate the changing market on the development lands represents an appropriate form of intensification within an existing serviced area that demonstrates ongoing growth potential. 7 Part 2 — The Amendment 2.1 Preamble All of this part of the document entitled "Part 2 -The Amendment ", consisting of the attached text and map schedule constitutes Amendment No. 37 to the Official Plan of the Township of Oro - Medonte. 2.2 Details of the Amendment 2.2.1 — Text Amendment Section C14.3.6 of the Official Plan is amended by adding a new Section C14.3.6.10 as set out below: "C14.3.6.10 Part of South Half of Lot 3 and Part of Lot 4, Concession 4 (Oro), Plan 51 M -1035 Lots 9 -13 and Lots 45 -49 inclusive Notwithstanding any other policies in this Plan, on the lands shown as being subject to this Section on Schedule D to this Plan, townhouse dwellings are permitted up to a maximum density of 23 units per hectare." 2.2.2 - Map Amendment: Schedule D Horseshoe Valley Land Use Schedule is hereby amended by re- designating the lands as shown on Schedule A attached hereto from the Horseshoe Valley - Low Density Residential designation to the Horseshoe Valley - Medium Density Residential designation and indicating the lands shown on Schedule A attached hereto as subject to Section C14.3.6.10. 2.3 Implementation Upon approval of this Amendment, Council shall consider an implementing Zoning By -law. 2.4 Interpretation The provisions of the Official Plan, as amended from time to time, shall apply in regard to the Amendment.
