2015-062 Amend Zoning South Half of Lot 3, Part Of Lot 4, Conc 4The Corporation of the Township of Oro - Medonte By -law Number 2015 -062 A By -law to amend the zoning provisions which apply to lands within Part of the South Half of Lot 3 and Part of Lot 4, Concession 4 (Former Township of Oro), Township of Oro - Medonte, being Plan 51 M -1035 Lots 9 -13 and Lots 45 -49 inclusive Whereas the Council of The Corporation of the Township of Oro - Medonte is empowered to pass By -laws to regulate the use of land pursuant to Section 34 and Section 36 of the Planning Act, R.S.O. 1990, c.P.13; And Whereas Council deems it appropriate to rezone the lands for residential uses, in accordance with Sections C.14.3.4 and C.14.3.6 of the Official Plan; Now Therefore the Council of The Corporation of the Township of Oro - Medonte hereby enacts as follows: Schedule "A15" to By -law 97 -95, as amended, is hereby further amended by changing the zone symbol applying to the lands located in Part of the South Half of Lot 3 and Part of Lot 4, Concession 4 (Former Township of Oro), Township of Oro - Medonte, being Plan 51 M -1035 Lots 9 -13 and Lots 45 -48 inclusive and identified on Schedule `A' attached to and forming part of this By -law, as follows: Part 1, Plan 51 M -1035 Lots 9 -13: From Residential One Exception Two Hundred Thirty Two (131 *232) Zone and Residential One Exception Two Hundred Thirty Three (R1 *233) Zone to Residential Two Exception Two Hundred Fifty -Six (R2 *256) Zone. Part 2, Plan 51 M -20135 Lots 45 -48: From Residential One Exception Two Hundred Thirty Two (R1 *232) Zone and Residential One Exception Two Hundred Thirty Three (R1 *233) Zone to Residential Two Exception Two Hundred Fifty -Six Hold (R2 *256) (H) Zone. 2. Section 7 — Exceptions of Zoning By -law 97 -95, as amended, is hereby further amended by adding the following subsections: 7.256 *256* - Part of the South Half of Lot 3 and Part of Lot 4, Concession 4 (Former Oro), Plan 51 m -1035 Lots 9 -13 and Lots 45 -48 Inclusive, Horseshoe Valley Lands Ltd." "Notwithstanding Table Al — Residential Zones Permitted Uses, on the lands denoted by the symbol *256* on the Schedule A15 to this By -law, the following uses are permitted: a) Townhouse Dwellings; b) Home Occupations; c) Private Home Daycares; and d) Residential Care Homes. Notwithstanding Table B1 — Standards for Permitted Uses, on the lands denoted by the symbol *256* on the Schedule Al to this By -law, the following provisions shall apply: a) Minimum Lot area 324 square metres b) Minimum Lot Frontage 9 metres c) Minimum Front Yard: i) to dwelling 4.5 metres ii) to garage 6.0 metres d) Minimum Rear Yard: Notwithstanding Section 5.9.1 of Zoning By -law 97 -95, unenclosed porches and balconies may encroach into the exterior side yard a distance of no more than 1.5' metres on lands zoned R2 *256." 3. That all other provisions of the Zoning By -law 97 -95, as amended, shall apply. 4. That the Holding (H) Provision applying to Plan 51 M -1035 Lots 9 -13 shall not be removed until such time that all development - related matters, including servicing, have been addressed to the satisfaction of the Township. 5. That this By -law shall only come into effect following the date of passage hereof and upon the approval of Amendment Number 37 to the Township of Oro - Medonte Official Plan, subject to the provisions of the Planning Act, as amended. In' V/'gg h e s Depuly Clerk, Janette Teeter Explanatory Note to By -law No. 2015 -062 The purpose of the Zoning By -law Amendment is to rezone Part of South Half of Lot 3 and Part of Lot 4, Concession 4, Former Township of Oro, now the Township of Oro - Medonte, being Plan 51M-1035 Lots 9 -13 and Lots 45 -48 inclusive from the Residential One Exception Zones (R1 *232 & R1 *233) to a Residential Two Exception Two Hundred Fifty Six (R2 *256) Zone to permit freehold townhouse units. Plan 51 M -1035 Lots 9 -13 are zoned with a Holding (H) provision that is not to be removed until such time as all development- related matters, including servicing, have been addressed to the satisfaction of the Township of Oro - Medonte.
