2015-065 Exchange lands - Forrester RoadThe Corporation of the Township of Oro - Medonte By -law No. 2015 -065 A By -law to Declare Surplus and Exchange the land described as Part Lot 17, Plan 712 being Part 6, Plan 51 R- 38903, (Part of PIN 58556 -0166 (LT)), (geographic Township of Oro), Township of Oro - Medonte, County of Simcoe For Part of Lot 18, Plan 712, being Part 23, Plan 51 R- 38903, (Part of PIN 58556 -0079 (LT)), (geographic Township of Oro), Township of Oro - Medonte, County of Simcoe for Municipal Purposes Whereas Council has determined that the land described as Part 6, Plan 51 R- 38903 is not required for municipal purposes and has by resolution declared the lands to be surplus to the needs of the municipality; And Whereas Section 270 of the Municipal Act, 2001, S.O. 2001, c.25, as amended, authorizes a Council of a municipality to sell or otherwise dispose of land in accordance with policies adopted and maintained by the municipality in respect thereof; And Whereas Council passed By -law No. 2012 -112 on the 6t" day of June, 2012, being a By -law to Establish a Policy with respect to the Sale and Other Disposition of Land; And Whereas Council deems it desirable to carry out an exchange of the aforementioned land with the owner of the lands described as Part 23 on Plan 51 R -38903 as part of a procedure that requires the acquisition of that land owner's land for municipal purposes, in accordance with the requirements set out in By -law No. 2012 -112; And Whereas the proposed by -law came before Council of The Corporation of the Township of Oro - Medonte for consideration at its meeting on the 8t" day of April, 2015, and at that time Council received no notice of objection to the proposed exchange of land from any party; Now Therefore the Council of the Township of Oro - Medonte hereby enacts as follows: Authorization for Exchange — Council does hereby authorize the exchange of its lands described as Part 6, Plan 51 R- 38903, (Part of PIN 58556 -0166 (LT)), for those lands described as Part 23 on Plan 51 R- 38903. 2. Sale Price and Consideration — In accordance with By -law No. 2012 -112, Council hereby sets the sale price for land described as Part 6, Plan 51 R- 38903, (Part of PIN 58556 -0166 (LT)), (geographic Township of Oro), Township of Oro - Medonte, County of Simcoe, at "nil ". 3. Acquisition of Land for Municipal Purposes — Council does hereby authorize the acquisition of Part of Lot 18, Plan 712, being Part 23, Plan 51 R -38903 (Part of PIN 58556 -0079 (LT)), (geographic Township of Oro), Township of Oro - Medonte, County of Simcoe, for municipal purposes. 4. Purchase Price and Consideration - In accordance with By -law No. 2012- 112, Council hereby sets the purchase price for land designated as Part of Lot 18, Plan 712, being Part 23, Plan 51 R -38903 (Part of PIN 58556 -0079 (LT)), (geographic Township of Oro), Township of Oro - Medonte, County of Simcoe, at "nil ". In addition to the land purchase price, the Township of Oro - Medonte is responsible for the legal costs, inclusive of disbursements, of the owner associated with the transfer to a maximum of $4,000.00 to exchange the parcels of land for municipal purposes. 5. Consolidation - Upon registration of the Transfer, the respective owners be required, at the Township of Oro - Medonte's expense, to bring an Application under The Land Titles Act, 'R.S.O. 1990, as amended, to consolidate their respective parcels with their abutting property to one Property Identifier Number. 6. Execution of Documents — The Mayor and Clerk are hereby authorized to sign all documents to carry out the intent of this By -law.
