2014-166 Certificate of Substantial Completion and Acceptance (Underground)The Corporation of the Township of Oro - Medonte By -Law No. 2014 -166 Being a By -Law to Authorize the Issuance of the Certificate of Substantial Completion and Acceptance (Municipal Underground Services) for 2008628 Ontario Ltd. (Diamond Valley Estates Phase 3), Plan 51 M -957 Whereas Section 51, Subsection (26) of the Planning Act, R.S.O. 1990, Chapter P. 13, as amended, provides that municipalities may enter into agreements imposed as a condition to the approval of a plan of subdivision and such agreements may be registered against the land to which the subdivision plan applies; And Whereas Council for the Corporation of the Township of Oro - Medonte entered into a Subdivision Agreement with 2008628 Ontario Ltd. (Diamond Valley Estates Subdivision) in March 2010 for one hundred and twenty eight (128) residential lots on Diamond Valley Drive, Emerald Terrace, Topaz Court, Opal Court, Ruby Ridge, and Sapphire Way. And Whereas the requirements of this Subdivision Agreement with respect to the underground works for Phase 3 comprised of 20 residential lots (Lots 16 -24 (Topaz Court), Lots 25 -26 (Diamond Valley Drive), Lots 85 -92 (Opal Court), and Lot 93 (Diamond Valley Drive) have now been met; Now Therefore the Corporation of the Township of Oro - Medonte hereby enacts as follows: That the Certificate of Substantial Completion and Acceptance (Municipal Underground Services) for Diamond Valley Estates (2008628 Ontario Ltd.), Plan 51 M -957 Phase 3 may now be issued by the Township Engineers (AECOM) in compliance with the Subdivision Agreement between the Corporation of the Township of Oro - Medonte and 2008628 Ontario Ltd.. 2. That the attached Schedule "A ", Certificate of Substantial Completion and Acceptance (Municipal Underground Services) shall form part of this By -Law. 3. That this By -law shall come into force and take effect on the final date of passing thereof. By -law read a First, Second and Third time, and Passed this 12th day of November, 2014. Description of the Works: SCHEDULE "A" AECOM 55 CcdarPoiale Drive, Suiteoo Banie; ON, Canada UN SR7 wrvw.aecom.com TOWNSHIP ENGINEERS SUBSTANTIAL COMPLETION AND ACCEPTANCE (MUNICIPAL UNDERGROUND SERVICES) Township of Oro- Medonte Diamond Valley Estates - Phase 3 Plan 51M -957 2008628 Ontario Ltd. 60118278 f43 -T- 930191 705 721 9222 tel 705 734 0764 fa< • Watermain Works in the Diamond Valley Estates Phase 3 on Topaz Court from the intersection of Diamond Valley Drive west (134 metres) and Opal Court from the intersection of Diamond Valley Drive east (156 metres); • Drainage Works consisting of road crossing culvert and ditches in the Diamond Valley Estates Phase 3 on Topaz Court (134 metres) and Opal Court (156 metres) from the cul -de -sac to the 'intersection of Diamond Valley Drive; We, AECOM, notify the Municipality that the above mentioned works were inspected on October 8, 2014 and to the best of our knowledge and judgement, are complete in accordance with the Subdivision Agreement except for the deficiencies below: • Items listed in AECOM Construction Status Report dated October 8, 2014. We hereby accept these works for use and operation by the Municipality subject to the rectification of the above noted deficiencies and to the rectification of any further deficiencies that may become apparent during the maintenance period and to the maintenance that is require by the Subdivision Agreement and its Amendment. The date of Substantial Completion and Acceptance (Municipal Underground Services) is established by the Certificate as of October 17, 2014.
