TAKE NOTICE that the Council of the Corporation of the Township of Oro - Medonte will hold a
Public Meeting on Wednesday September 24, 2014 at 7:00 pm in the Municipal Council
Chambers. The purpose of the Public Meeting is to obtain public comments on a proposed
Amendment to the Zoning By -law, under Section 34 of the Planning Act, R.S.O. 1990 c. P. 13.
A KEY MAP illustrating the location of the subject lands, and a copy of the applicant's sketch are
included with this notice,
THE PURPOSE of the proposed Zoning By -law Amendment is to amend the zoning of the lands
located at 605 Penetanguishene Road, Concession 1, South Part of Lot 11, Township of Oro -
Medonte, The lands are proposed to be rezoned from Institutional (1) Zone to an Institutional (1)
Exception Zone to add a martial arts school as a permitted use on the subject lands.
ANY PERSON may attend the public meeting and /or make wdtten or verbal representation either
in support of, or in opposition to, the proposed Amendment. If a person or public body that files an
appeal of a decision of the Township of Oro - Medonte in respect of the proposed Amendment does
not make oral submission at the Public Meeting, or make written submissions to the Township
before the proposed Amendment is adopted, the Ontario Municipal Board may dismiss all or part
of the appeal.
If you wish to be notified of the decision of the Township of Oro - Medonte in respect to the
proposed Zoning By -law Amendment, you must make a wdtten request to the address below.

Further to your circulation regarding the above noted application, the Ministry has
reviewed the submission in accordance with the requirements under the ministry's
Public Transportation and Highway Improvement Act and the following outlines our
comments:
• The MTO is not in opposition to the proposed rezoning as long as the new use
will not create significant increase in a traffic volume. The ministry cannot support
any upgrade for this site as an intensification of the use and increase in traffic
volume may create operational and safety issues at the ramp terminal. Please
note that there is insufficient spacing between the access and the ramp.
• In general the proponent should be aware that the MTO has plans to redevelop
this interchange and upgrade the ramp terminals. When the MTO comes
through with the interchange upgrades there may be impacts to this property and
the access. It is too soon to determine what the impacts will be and therefore we
cannot allow any redevelopment of these lands until the design has been
finalized. We just hope that the new interchange can be accommodated within
the existing ROW.
According to the ministry's Title Records for this site, it appears that unfortunately
the current user has extended the parking lot onto provincial land (within the
MTO ROW), which is not acceptable. MTO has concerns because it creates a
liability issue for the ministry. Once confirmed that the parking area is
encroaching MTO ROW it will have to be removed immediately and the Hwy
ROW restored to original or better conditions before the rezoning process
would be approved. All costs associated with bringing this site into compliance
will be responsibility of the property owner. In the meantime, please ask the
proponent to provide a survey plan to confirm his property limits. If there will be
same discrepancy with the location of the existing fence and the side property
limits then the issue has to be addressed and resolved before a martial arts
school will be permitted under a new Institutional Exception Zone. Please inform
the owner that the fence should be placed onto his lands, 0.3m inside the PL.
The property would not qualify for any upgrades to the existing entrance, which
currently is in use for an Institutional occupation under the municipal by law, as
the access does not comply with the new guidelines. Therefore please be aware
that the ministry will not allow now or in the future the property to be rezoned for
any commercial use and as a result the existing entrance also cannot be
upgraded for commercial use.
• Please note that, if the owner of this property will consider any redevelopment of
the site for further institutional use, it will require the ministry review and
approval. Consequently, the existing entrance may be conveyed to the current
standards (under existing zoning) or be limited to the Right -In Right -Out
scenario. In addition, please be aware that the min setback for all above and
below grade structures is 14m from the MTO's current or future property limits.
Note: A well must be setback a min of 30m from the property limits.
• All new signage on the site must be placed under a ministry issued sign permit.
Proposed signs must be shown on the site plan.
• Permits must be obtained from our - office located on the 7 t Floor, Atrium Tower,
