Motion No. CA140918-4 Moved by Macpherson, Seconded by Tupling It is recommended that the Committee of Adjustment grants provisional approval to Consent Application 2014-B-21 for the creation of a new lot for the purpose of a specialized agricultural use, by way of severance. The land to be severed is proposed to have frontage along 15/16 Sideroad East of approximately 215 metres, and a lot area of approximately 7.9 hectares; currently contains two agricultural buildings. The land to be retained is proposed to have a lot area of approximately 5.1 hectares, and currently contains a dwelling and agricultural buildings. Subject to the following conditions: 1. (Braestone) to permit the issuance of building permits within the Braestone Subdivision in advance of the completion of the water treatment facility and Phase 1a servicing. STATUS The Braestone Subdivision has been draft approved by the Ontario Municipal Board since 1994. While the property has changed hands a number of times, the objective has always been to satisfy draft approval conditions and register the subdivision. As it stands today the majority of draft approval conditions have been addressed, with the only remaining major items being finalization of a modified subdivision agreement to address phasing, clearance letter from MNR and clearance from the Town's solicitors on the resident's association approach through a Condominium Corporation. We anticipate those items to be cleared within the next two months as we steadily move forward to registration. This timing works well with the Braestone Subdivision as it meets the commitment to potential homebuyers who have provided deposits that they can anticipate occupancy by the fall of 2015. THE ISSUE The issue we are coming up against is the timing for completion of the water treatment facility and related infrastructure relative to the issuance of building permits for houses. We are currently tendering for the water treatment plant. With construction to begin in October and a 10 month construction lead time, we plan to have the system operational by August 2015. In order to have a September 2015 occupancy of homes under construction, permits would have to be issued by no later than May 2015, well in advance of completion of the water treatment plant. This situation presents an issue as the Township typically does not permit the issuance of a building permit until substantial completion of infrastructure, including the water treatment plant. THE IMPACT Should Braestone be required to wait for the completion of the water treatment facility prior to the issuance of permits for homes, residential construction of the subdivision would be significantly delayed. Residential lots would have to wait until August 2015 to pull permits, delaying potential occupancy to the spring of 2016. This would result in significant economic hardship to Braestone, who has but a lot of hard work and effort into building momentum and garnering interest in the subdivision. This effort includes extensive advertising, holding site walks and open houses, and securing reservations for pre - sales of homes. The feedback from prospective homebuyers is that they expect to occupy their homes by the fall of 2015 if they were to buy in. If Braestone cannot pull permits by the spring of 2015, it is anticipated that the current reservations will be lost, and the current momentum will be set back a full year, resulting in economic hardship for Braestone. THE SOLUTION AND REQUEST Braestone is simply seeking flexibility relative to the Township's requirement, and requesting an avenue by which permits can be issued in advance of completion of the water treatment facility and distribution system. This would be an approach similar to the Town of Collingwood subdivisions where they would allow for construction in advance of the water supply and distribution system being completed, and prohibit occupancy until certificates of compliance are issued. This approach is also occurring with another project by the owners of Braestone known as Windfall. This project in the Town of Blue mountains has the exact same scenario, and the Town permitted development to proceed while municipal sanitary services were being constructed. We would propose a modification to the typical wording in the Braestone Subdivision Agreement that would provide an alternative route to permit issuance subject to conditions. The wording and conditions we would recommend would be as follows: 2 8.2.1 ALTERNATIVE REQUIREMENTS FOR BUILDING PERMITS IN ADVANCE OF WATER SUPPLY AND DISTRIBUTION SYSTEM Notwithstanding the requirements for building permits as set out in Clause 8.2, should the water supply and distribution system works be approved, and the construction of said works have been Page 25 of 100 3 8.a) Eldon Theodore, MHBC Planning, re: Early Building Permi... initiated by the developer, Building Permits may be given and the Chief Building official may receive application subject to the following criteria: (i) The Waterworks including the water supply and distribution system have been initiated and are under construction; (ii) A "Builders" road consisting of the grading, ditch shaping and Granulars, has been constructed on the road providing access to the lot. (iii) Signs denoting "Unassumed Roads" have been installed at the entrances to the subdivision in a location acceptable to the Township, in accordance with Clause 4.1.8 (iv) A Certificate Letter and Lot Development Plan has been given by the Developer's Consulting Engineer or a Professional Engineer registered with the Association of Professional Engineers of Ontario, that the building to be erected on any lot or block within the Plan, for which a Building Permit hos been applied for, is in conformity with the General Location and Lot Grading Plans, or hos received the approval of the Township Engineer with respect to any variance to the Grading Plan. The individual Lot Development Plan must be approved by the Township Engineer prior to the issuance of a Building Permit. A copy of the receipt payment to the Township must be provided to the Township Engineer prior to their review of the Lot Development Plan. (v) All dead trees within the limit of the Plan have been removed. No tree removal is to take place in identified wetlands and Open Space areas; unless there is a safety concern with tree(s), in which case the tree(s) are to be close cut. (vi) The Traffic and Street Nome signs hove been installed and approved by the Township Engineer. (vii) Any Development Charges have been paid, in full, in accordance with the applicable Development Charge By -Lows, enacted pursuant to the Development Charges Act, 1997, as well as By -Lows enacted pursuant to Section 257.53 of the Education Act or alternate arrangement satisfactory to the body enacting the Development Charge By -Law, have been made and the some has been communicated to the Chief Building Official for the Township of Oro-Medonte, in writing, by such a body. (viii) The Developer will deposit with the Treasurer of the Township to cover the cost for removal of constructed buildings on residential lots should the above criteria (i) through (vii) not be satisfied: a. Cosh or certified cheque in the amount of $7,000.00 per lot, representing the estimated cost of the said work as approved by the Chief Building Official, or: b. An irrevocable Letter of Credit from a Chartered Bonk, issued in accordance with the requirements of Schedule "L" with an automatic renewal clause, in the amount of $7,000.00 per lot, representing the estimated costs of the said works as approved by the Chief Building Official. Unless the Letter of Credit is renewed as noted above, the Township shall have the absolute right to refuse to issue Building Permits and to prohibit occupancy of homes, whether partially or fully completed, from the said date, three (3) months prior to the expiration of the Letter of Credit, or the Township may cash the Letter of Credit until a satisfactory Letter(s) of Credit is received by the Township. (ix) No buildings, erected on the lots or blocks within the Plan, shall be occupied, and securities as listed in (viii) shall not be released until the requirements for building permits as listed in this clause and Clause 8.2 have been met to the satisfaction of the Chief Building Official. The above noted wording has been provided to demonstrate how this flexibility can be executed, and provides a level of assurance through the posting of securities. Providing for this additional route to permit issuance for residential homes allows Braestone to stay on track and meet their obligations to prospective homebuyers, and assists with the acceleration of the build -out of this subdivision. There are significant financial implications to Braestone and the future build -out of this subdivision if the development is forced for wait for the water treatment system to be operational before the first permit is issued. We respectfully request that this letter be considered at the September 24th Council Meeting, and that both Township Staff and Council support greater flexibility by directing Planning Staff to incorporate the appropriate wording in the Braestone Subdivision Agreement. Given the nature of this request and the desire of the broader community to assist a family in need, the grassroots nature of this initiative does not fully conform with the criteria outlined within the policy. Council, at its discretion may waive the provisions of this policy to grant this request. Cemetery and present a draft by-law to regulate the maintenance, management, regulation and control of the Township's owned cemeteries. The land transfer process was completed in November, 2013 and the property has been assigned a roll number. 911 signage has also been erected. Staff have met with the Leigh's Corners Volunteer Cemetery Group to obtain any records they had on file for the cemetery. A cemetery sign was also agreed upon and has since been erected. The repairs to monuments and gravestones have been undertaken and grounds maintenance has been assumed by the Recreation and Community Services Department. Annual reports have been filed with the Ministry of Consumer Services in order for the Township to be in compliance. The applicable funds have been transferred from the Board of Management to the Township. The final step in the transfer process is to present a draft by-law for Council's consideration to complete the legislative requirement. Analysis: There is no "standard set" of by-laws that pertain to the activities of every cemetery in Ontario. Each cemetery operation may be unique and may require specific by-laws to reflect its uniqueness. As the five (5) Township owned cemeteries are inactive, it is recommended that one standard by-law apply to all five cemeteries. The draft by-law was developed from the input received from the Ministry of Consumer Services and samples reviewed from other municipalities. The draft by-law is attached as Attachment #2. Considerations: A municipal cemetery by-law or amendment cannot come into effect until it has been approved by the Registrar. The Ministry also provides specific notice and submission procedures which must be followed. Corner Posts: Shall mean any stone or other land markers set flush with the surface of the ground and used to indicate the location of a lot or plot. Crypt: An individual compartment in a mausoleum for the entombment of human remains. Grave: (Also known as Lot) means any inground burial space intended for the interment of a child, adult or cremated human remains. Interment Right: The right to require or direct the interment of human remains or cremated human remains in a grave, lot, niche or crypt and direct the associated memorialization. Interment Rights Holder: Any person designated to hold the right to inter human remains in a specified lot. Lot: For the purpose of this by-law a lot is a grave. Marker: Shall mean any permanent memorial structure that is set flush and level with the ground, and used to mark the location of a burial lot. Service Animal: A service animal means any animal used by a person with a disability for reasons related to the disability and the owner has a valid identification card signed by the Attorney General of Canada, or a certificate of training from a recognized service animal training school. Scattering: Shall mean the act of spreading of cremated remains over a designated area within a cemetery with the knowledge and permission of the Township and in keeping with the cemetery's by-law. Scattering Rights Holder: Any person designated to hold the right to scatter cremated human remains in a specified lot or other designated area within the cemetery. Township: For the purpose of this by-law, the Township is The Township of Oro- Medonte. 2. Conduct a) Hours of Operation: 8:00 a.m. to Sundown. b) No person shall enter or remain in a Cemetery between Sundown and 8:00 a.m. without the permission of the Township. c) Subsection b) shall not apply to a police officer and employees of the Township of Oro-Medonte in the performance of their duties. d) The Township reserves full control over the cemetery operations and management of land within the cemetery grounds. e) No person may damage, destroy, remove or deface any property within the Cemetery. f) All visitors should conduct themselves in a quiet manner that shall not disturb any service being held. 3. Pets or Other Animals: a) No person shall bring any animal onto a cemetery, except a service animal, unless authorized in writing by Council. b) Pets or other animals, including cremated animal remains, are not allowed to be buried/scattered on cemetery grounds. 5. Right to Re -Survey The Township has the right at any time to re -survey, enlarge, diminish, re -plot, change or remove plantings, grade, close pathways or roads, alter in shape or size, or otherwise change all or any part of the cemetery, subject to approval of the appropriate authorities. 6. Burial or Scattering of Cremated Remains a) Payment must be made to the funeral director/service provider before a burial can place. b) The Township shall be given 48 business hours of notice for each burial of human remains of cremated human remains. c) The opening and closing of graves, crypts and niches may only be conducted by those designated to do work on behalf of the Township. d) Cremated remains are not permitted to be scattered on a grave. e) Per the Act, Human remains may be disinterred from a lot provided that the written consent (authorization) of the interment rights holder has been received by the Township and the prior notification of the medical officer of health. A certificate from the local medical officer of health must be received at the cemetery office before the removal of casketed human remains may take place. A certificate from the local medical officer of health is not required for the removal of cremated remains. Memorialization a) No monument, footstone, marker or memorial of any description shall be placed, moved, altered, or removed without permission from the Township. b) Minor scraping of the monument base of an upright monument due to grass/lawn maintenance is considered to be normal wear. c) The Township will take reasonable precautions to protect the property of interment rights holders, but it assumes no liability for the loss of, or damage to, any monument, marker, or other structure, or part thereof. e) Should any monument or marker present a risk to public safety because it has become unstable, the Township shall do whatever it deems necessary by way of repairing, resetting, or laying down the monument or marker or any other remedy so as to remove the risk. f) The Township reserves the right to remove at its sole discretion any marker, monument, or inscription which is not in keeping with the dignity and decorum of the cemetery. 8. Care and Planting a) A portion of the price of interment or scattering rights is trusted into the Care and Maintenance Fund. The income generated from this fund is used to maintain, secure and preserve the cemetery grounds. Services that can be provided through this fund include: - re -levelling and sodding or seeding of Lots or scattering grounds; - maintenance of cemetery roads, sewers and water systems; - maintenance of perimeter walls and fences; - maintenance of cemetery landscaping; - maintenance of mausoleum and columbarium; - repairs and general upkeep of cemetery maintenance buildings and equipment. b) No person other than Township shall remove any sod or in any other way change the surface of the burial lot in the cemetery. c) No person shall plant trees, flower beds or shrubs in the cemetery except with the approval of the Township. d) Flowers placed on a grave shall be removed after a reasonable time to protect the sod and maintain the tidy appearance of the cemetery. Items That Are Prohibited and Permitted a) The Township reserves the right to regulate the articles placed on lots or plots that pose a threat to the safety of all interment rights holders, visitors to the cemetery and Township employees/contractors and prevents the Township from performing general cemetery operations, or are not in keeping with the respect and dignity of the cemetery. Prohibited articles will be removed and disposed of without notification e.g., articles made of hazardous materials such as non -heat resistant glass (excludes glass attached to monuments), ceramics, or corrosive metals; loose stones or sharp objects; trellises or arches; chairs or benches. b) The Township reserves the right to disallow or remove quantities of memorial wreaths or flowers considered to be excessive and that diminishes the otherwise tidy appearance of the cemetery. 10. Contractor/Monument Dealers a) Any contract work to be performed within the cemetery requires the written pre - approval of the interment rights holder and the Township before the work may begin. Pre -approval includes but is not limited to: landscaping, delivery of monuments and markers, inscriptions, designs, drawings, plans and detailed specifications relating to the work, proof of all applicable government approvals and permits, the location of the work to be performed. It is the responsibility of all contractors to report to the Township and provide the necessary approvals before commencing work at any location on the cemetery property. b) Prior to the start of any said work, contractors must provide proof of (any or all may apply depending on scope of work to be performed): - WSIB coverage; - Occupational Health and Safety compliance standards; - Environmental Protection; - WHMIS; - Evidence of liability insurance of not less than $5,000,000. c) All cemetery by-laws apply to all contractors and all work carried out by contractors within the cemeteries' grounds. d) Contractors, monument dealers and suppliers shall not enter the cemetery in the evening, weekends or statutory holidays, unless approval has been granted by the Township. e) No work will be performed at the cemetery except during the regular business hours of the cemetery. f) Contractors shall temporarily cease all operations if they are working within 100 metres of a public gathering until the conclusion of the service. Did you know that more than 2.4 million people in Ontario — that is one in five people in Township of Oro-Medonte — lives with a chronic lung disease such as asthma, chronic obstructive pulmonary disease or lung cancer, and many more are at risk? And did you know that lung disease is the only one of the top 4 chronic diseases in Ontario that has no comprehensive plan to deal with lung health? In November, the Ontario Lung Association and our partners will engage in a series of information and outreach initiatives designed to inform and educate all Ontarians about how to protect and care for their lungs and to advocate for a comprehensive Ontario Lung Health Action Plan. If we don't act today to create an action plan to deal with lung disease, the impact to Ontario's economy by 2040, direct and indirect costs will grow to an astonishing $300 billion. I am writing to invite you to join the mayors and reeves of municipalities throughout Ontario who are supporting lung health in their communities by issuing a proclamation declaring November Lung Month in their cities and towns and to ask the Government of Ontario to create and fund an Ontario Lung Health Action Plan. Severn Sound Environmental Association 67 Fourth Street Midland Ontario L4R 3S9 Tel: 705-527-5166 Fax: 705-527-5167 Website: wwwesevernsoundeca September 15, 2014 To: Severn Sound Watershed CAO's and Clerks RE: TREE SEEDLING DISTRIBUTION PROJECT — REQUEST TO CONSIDER MUNICIPAL PARTICIPATION IN 2015 Over the past eight years, Severn Sound Environmental Association (SSEA) and North Simcoe Stewardship/Dufferin Simcoe Land Stewardship Network have partnered with the Townships of Tay, Tiny, Springwater, Oro-Medonte, and Severn, the Towns of Penetanguishene and Midland, and the City of Orillia to provide local residents with reasonably priced, native tree seedlings for spring planting. The objective of the project is to promote tree planting by residents in the Severn Sound area, improving environmental health and increasing tree cover. The project has been very successful: in the past eight years, 79,490 tree seedlings were purchased and planted by residents of the participating municipalities. The 2014 final report on the program (attached) recommends that the program be offered to North Simcoe municipalities for spring 2015. At this time, SSEA would like to determine if your municipality is interested in participating in the 2015 Tree Seedling Distribution Project. There is no direct funding required from the municipalities to SSEA; however, municipal partners will be responsible for assisting with project promotion and some aspects of project implementation (see below). SSEA will be responsible for coordinating the program, including: • Ordering tree seedlings and organizing pick-up of the bulk seedling order at the nursery. • Creating electronic promotional materials for use by participating municipalities (i.e. information/pricing sheet, species selection guide, and tree planting tips sheet). Participating municipalities can link to the SSEA website, which will contain all the promotional details. • Receiving tree orders and payments from participating residents. We are proposing a tree order deadline of January 23rd, 2015. • Providing receipts and pick-up instructions to participants. • Coordinating volunteers to assist with sorting and distribution of tree orders. The distribution day will be in late April or early May 2015. • Producing a final report on the project by August 2015. Municipal partners will be required to undertake all of the following: • Provide the information/pricing sheet to residents. Options for program promotion by the municipality include: municipal web -site and at municipal facilities (e.g., bulletin boards), inclusion in tax bills and/or other municipal mailings (where possible/appropriate), and local media (e.g., municipal page in newspaper). Promotional materials should be distributed to landowners by December 2014, to allow landowners sufficient time to place their orders before the proposed January deadline. • Provide a suitable facility (e.g., sand dome, roads garage) for the distribution location. The distribution location needs to be cool, indoors, and secure, with sufficient space to store tree orders for a few days. • Provide assistance (e.g., staff, council member, or other municipal representative) with pick up, sorting, and distribution of tree seedlings. o Bulk order seedling pick-up from the nursery (approximately 1/2 day): Several vehicles will be required, including SSEA vehicle(s); each municipality may need to send one truck and driver to the nursery, located in Everett, north of Alliston. Whenever possible, depending on the size and type of vehicles the municipalities have available, SSEA alternates which participating municipalities are required to assist with tree seedling pickup each spring. The tree seedling bulk order is typically picked up from the nursery one or two days prior to the distribution day. o Sorting bulk order into individual landowner orders (approximately 1/2 day): Tree seedlings are normally sorted one day prior to the distribution day, at a central location. Following sorting, orders for participants in each municipality are transported to the designated distribution location. o Distribution of tree orders (approximately 3/4 day): The distribution day is tentatively Saturday, May 2nd, 2015, however the final date will depend on spring weather conditions, which determine when seedlings can be harvested and packaged by the nursery. Brissette, Marie To: Su bject: September 18, 2014 Teeter, Janette RE: AMO Policy Update - Double Hatter Firefighter Double Hatter Firefighter Issue in the Media Issue: Professional firefighters as volunteer firefighters during their free time. Yesterday, this issue was profiled in a front page Globe and Mail story about a firefighter who is taking on the union's actions as relates to `double hatting'. `Double hatting' is forbidden by the International Association of Fire Fighters and its Ontario union, The Ontario Professional Fire Fighters Association. Over the years, union charges have been brought against individuals who are double hatters and as a result, generally stop their involvement as a volunteer. Double hatters want to protect family, friends and the community where they live and are an important backbone of fire services within smaller municipalities and its loss proves challenging. Many double hatters were volunteer fire fighters before becoming salaried professionals. Tom Hunse, a Toronto professional fire fighter for 22 years and a 26 year volunteer with Innisfil Fire Services and his union, is demanding that since he has not stopped his volunteer work that he be fired from his Toronto job. Mr. Hunse is taking a principled stand — that how he uses his free time is his to determine. Yesterday's Globe and Mail and other major news outlets are now covering his story. The public's reaction is that Hunse and other double hatters should be able to use their skills and knowledge in their free time in his own community without repercussion. An arbitration hearing is set for later this year that would deal with his permanent employment status with the City since he is no longer a member in good standing and only Association members in good standing are able to be members of the full-time bargaining unit. Mr. Hunse has filed a Duty for Fair Representation Application with the Ontario Labour Relations Board against the Toronto Professional Fire Fighters Association. The "duty of fair representation" provisions of the Labour Relations Act stipulate that a trade union shall not act in a manner that is arbitrary, discriminatory or in bad faith in representing employees. AMO has requested intervener status as this matter affects many municipal governments and the double hatters that work. This is a matter of fairness and personal liberty as fire fighters should be able to use their free time as they wish to without reprisal or interference. These volunteers should be supported, not pressured for wanting to protect their neighbours in their home communities. The union does not object to full time firefighters working other jobs which many do. What is the solution to this threat? A simple change to provincial law would prevent this type of union interference. To our knowledge, every Canadian province has such protection, except for Ontario and Newfoundland. It is time for Ontario to give our volunteer firefighters the same freedom and protection that other employees in Ontario enjoy, as well as those fire fighters everywhere else in the nation. Attached is a draft council resolution your council may wish to pass that asks the Ontario government to provide this protection to double hatter firefighters who want to serve their home communities in their spare time. As mentioned, double hatters are worried about being threatened with job loss and municipal governments have been watching this matter closely. WHEREAS the training and certification of professional firefighters is established and mandated by the Province of Ontario under the Fire Protection and Prevention Act, 1997; AND WHEREAS it is the responsibility of municipalities to establish fire departments and appoint fire chiefs to provide fire protection services as they determine may be necessary in accordance with their needs and circumstances; AND WHEREAS many Ontario municipalities rely on both full time and volunteer firefighters in order to provide fire protection; AND WHEREAS the International Association of Fire Fighters ("IAFF") Constitution prohibits full time firefighters from volunteering as firefighters in another municipal jurisdiction (i.e. "Double Hatting"); AND WHEREAS the IAFF's stance on Double Hatting is specifically prohibited by legislation in almost all provinces in Canada and much of the United States; AND WHEREAS a volunteer firefighter in the Innisfil Fire and Rescue Service is challenging the IAFF ban on Double Hatting and their expulsions from that union because of his desire to continue volunteering while being employed as a full-time firefighter in another jurisdiction; AND WHEREAS the right of individuals to use their free time in service of their community is a fundamental right in a free, open and democratic society. NOW THEREFORE BE IT RESOLVED that the Council of requests that the Province of Ontario amend the Fire Protection and Prevention Act, 1997 with respect to salaried firefighters who also work as volunteer firefighters, such that if a person is denied membership in an association of firefighters, is expelled or disciplined by the association or engages in reasonable dissent within the association in connection with this kind of dual role, the association is not permitted to require the employer to refuse to employ the person as a salaried firefighter, terminate his or her employment as a salaried firefighter or refuse to assign the person to fire protection services.
