permanently closed and be declared surplus to the needs of the municipality and
transferred by direct sale to the abutting property owners, being 815 Line 5 South and
654 Ridge Road West.
3. That the owners of 815 Line 5 South and 654 Ridge Road West be advised that the
lands to be conveyed are to merge on title with the respective properties and that each
property owners will be required to bring an Application under The Land Titles Act,
R.S.O. 1990, as amended, to consolidate the parcels to one Property Identifier Number,
at their expense upon transfer.
4. That the applicants be advised of the land value established for the said land and, upon
acceptance of the offer, the Clerk bring forward the appropriate by-law for Councils
consideration.
5. And that the applicants be advised of Councils decision under the Director of Corporate
Service/Clerks signature.

Recommendations for 2014 Oro-Medonte Official Plan Review
By the Rescue Lake Simcoe Coalition and AWARE Oro-Medonte -
April 2014
The members of the Rescue Lake Simcoe Coalition and AWARE Oro-Medonte request that the
Township of Oro-Medonte incorporate the following recommendations into the new Official Plan
(OP) to conform to the Lake Simcoe Protection Plan (LSPP) and to best protect Oro-Medonte's
forests and wetlands, and Lake Simcoe.
Include a target in the OP to protect 40 percent high quality natural vegetative cover in the
Lake Simcoe watershed portion of Oro-Medonte, and create an action plan to achieve that
target.
Adopt and use the Ministry of Natural Resources' draft definitions of key natural heritage
features and key hydrologic features for LSPP policy 6.30-SA.
Simplify the OP by reducing the number of environmental designations; namely EP, EP1,
and EP2. Create a new environmental protection designation that will conform to the
protection legislated by the LSPP for key natural heritage features and key hydrologic
features, called Environmental Protection for Woodlands and Wetlands (EPWW). This
would make the OP easier to use and understand.
Place the following features into the EPWW designation:
The Rail Trail Greenlands, all the undeveloped woodlands and wetlands that are
between the Ridge Road and the developed areas along the Lake Simcoe shoreline
and between Barrie and Orillia, excluding the current built up areas.
All key natural heritage features as defined by LSPP policy 6.21-DP (wetlands,
significant woodlands, significant valleylands and natural areas abutting Lake
Simcoe).
All key hydrologic heritage features as defined by policy 6.22-DP (wetlands,
permanent and intermittent streams, and lakes other than Simcoe).
All areas of high quality natural cover that are 25 hectares or greater.

Update policies applying to lands adjacent to key natural heritage system and key hydrologic
features to conform to the LSPP.
Update the map Township of Oro-Medonte Official Plan Natural Features - Schedule B; to
make it clear and easy for residents, developers and planners to see what areas are off-
limits to development.
Solicit information about the habitats of endangered species in order to increase the level of
protection from EP2 to EP1 where appropriate.
Adopt the recommendations in the forthcoming Shoreline Management Strategy, which
stems from LSPP policy 6.12 and 6.13-SA.
Commit to taking action on these two LSPP policies in the updated OP:
6.14-SA: Public bodies are encouraged to actively re-naturalize public areas adjacent
to shorelines and streams to a minimum of 30 metres where practical and feasible.
6.15-SA: Through the implementation of the stewardship, education and outreach
policies (8.5-8.11) owners of existing cottages and residences will be encouraged to
re-naturalize shorelines and areas adjacent to streams up to 30 metres where
practical and feasible.
Ensure that a hydrological assessment is completed prior to granting planning approvals for
new waterfront lots to ensure that the density of development will not cause the nitrate limit
to be exceeded. (See MOE Guideline D-5-4). Small lot development should be restricted to
sites that meet the highest recommended standards for nitrate control.
Make the criteria for creating new lots more restrictive.
Where possible, we suggest that owners of large lots in Settlement Areas be allowed
subdivide and or sever their lots into one or more lots. This recommendation allows for the
creation of new lots in existing Settlement Areas in Oro-Medonte without losing natural
cover.
For the mandatory septic inspection program, insist that inspectors are trained and carry
proper certification in order to carry out septic inspections for the Township. The inspectors
should be prepared to explain to the homeowner how and why the procedure would result in
an assurance that their septic system meets or exceeds the standards. As a minimum, we
recommend that the Township set up a website that shows how the septic inspections
should be performed.

Recommendations for 2014 Oro-Medonte Official Plan review
By the Rescue Lake Simcoe Coalition and AWARE Oro-Medonte,
June 2014
The Township of Oro-Medonte is in the process of revising its Official Plan to conform to the Lake
Simcoe Protection Plan (LSPP). The members of the Rescue Lake Simcoe Coalition and AWARE
Oro-Medonte request that the Township incorporate the following recommendations into the new
Oro-Medonte Official Plan. Note that the recommendations are not an inclusive list and do not
include all the revisions that must be done to bring the Official Plan into conformity with the LSPP.
Objective:
Update and revise the current Oro-Medonte Official Plan so that it conforms to all Lake Simcoe
Protection Plan policies. The updates will apply to the part of Oro-Medonte that is in the Lake
Simcoe watershed.
Assumption
Although, the Official Plans of Municipalities are reviewed about every five years, we assume that
we are planning for health of Lake Simcoe for the long term. We do not want to be discussing the
very same problems and poor prognosis of Lake Simcoe in five, twenty, fifty or one hundred years
from now. Therefore, for the purposes of our recommendations, we assume that we are planning
for the future good health of Lake Simcoe for the next fifty to one hundred years.
Economic Development Plan of Oro-Medonte:
The following challenges and needs were taken from the Economic Development Plan for Oro-
Medonte completed by the Ontario Ministry of Agriculture, Food and Rural affairs and others,
dated September 2011. The information came from a survey obtained from two community
meetings attended by 60 people and from a survey filled out by 56 respondents. Listed below is a
sample of some of the development and environmental concerns that were identified:

Preserving natural beauty and recreational opportunities.
Avoiding environmental degradation.
Maintaining the rural atmosphere.
Controlling development so it doesnt change the rural atmosphere.
A clear plan for growth areas.
Avoidance of urban sprawl.
Maintain the treed landscape.
Deforestation, water pollution and loss of species habitat.
Pollution of Lake Simcoe.
Lack of bike trails.
Fortunately, the Township may be able to satisfy and meet the above challenges when it conforms
the OP to the LSPP and implements the following recommendations.
Problems and Recommendations:
1. Natural Cover Target
Problem
One of targets of the LSPP is to achieve 40 percent high quality natural vegetative cover in the
watershed. High quality natural vegetative cover refers to wetlands and woodlands that meet
HQNC Oro
particular site level criteria and are 25 hectares or larger. (Please refer to the
Medonte.pdf
map sent.) At the moment, the high quality natural vegetative cover in the part of
Oro-Medonte that is in the Lake Simcoe watershed is roughly 40 percent.
Part of Policy 6.23-DP of the LSPP states that development or site alteration is not permitted
within a key natural heritage feature, a key hydrologic feature or a related vegetation protection
zone. However, there are exemptions to this policy; for example existing uses as at the date the
LSPP was passed are allowed. (See LSPP Policies 6.23-DP and 6.45-DP for a list of all the
exemptions) ). An example of an existing use is to allow the owner of a woodlot that is zoned
Rural to build a house on the land. This means that the owner could cut down trees and therefore
reduce the amount of natural vegetative cover. We are concerned that the cumulative effect of all
the exemptions will reduce the high quality natural vegetative cover to less than 40 percent. This
would harm Lake Simcoe by allowing more phosphorus to flow into the lake every year.
Although Section B of the current Official Plan contains many worthwhile general statements
related to the preservation and enhancement of the natural environment, it does not contain any
measurable objectives.
Recommendation
The solution is to protect at least 40 percent high quality natural vegetative cover to mitigate the
impact of the exemptions to policy 6.23 of the LSPP. We recommend that the township include
this target in the appropriate section of the revised Official Plan. This measurable, achievable and
challenging target will be clear to developers, the public and planners.

2. Natural Heritage Definitions
Problem
The Ministry of Natural Resources (MNR) has not yet approved the draft definitions of key
natural heritage features and key hydrologic features written by the MNR pursuant to LSPP
policy 6.30-SA.
Recommendation
We recommend that the Township adopt and use the MNR draft definitions of key natural
heritage features and key hydrologic features for LSPP policy 6.30-SA. The draft definitions are

.) These definitions are inclusive and include nearly all large and small woodlands and
wetlands. The inclusive nature of the draft definitions will protect as much as possible and will
therefore limit the loss or fragmentation of Oro-Medontes precious woodlands and wetlands.
3. Simplifying Environmental Protection Designations
Problem
The current OP contains three different environmental designations: EP, EP1 and EP2. In
addition, the LSPP may require a fourth designation, in order to protect the key natural heritage
features and key hydrologic features. These similar designations make the OP complicated and
difficult to understand.
Recommendations
a. Take this opportunity to review and simplify the current environmental designations. The
Township may need a new environmental protection designation that will conform to the protection
legislated by the LSPP for key natural heritage features and key hydrologic features as defined
by the draft definitions given by LSPP policy 6.30 SA. We suggest that the new designation be
called Environmental Protection for Woodlands and Wetlands (EPWW).
b. Place the following features into the Environmental Protection for Woodlands and Wetlands
designation:
i. The Rail Trail Greenlands, all the undeveloped woodlands and wetlands that are between the
Ridge Road and the developed areas along the Lake Simcoe shoreline and between Barrie
and Orillia, excluding the current built up areas.
ii. Key natural heritage features as defined by LSPP policy 6.21-DP (wetlands, significant
woodlands, significant valleylands and natural areas abutting Lake Simcoe).
iii. Key hydrologic heritage features as defined by policy 6.22-DP (wetlands, permanent and
intermittent streams, and lakes other than Simcoe).
iv. Areas of high quality natural cover that are 25 hectares or greater (as shown on the map
produced by MNR called, Areas of High Quality Natural Cover in the Lake Simcoe
Watershed Oro-Medonte dated December 12, 2012).

4. Simplifying Maps
Problem
The municipality is not required to update its maps when it updates its policies to conform to the
Lake Simcoe Protection Plan. Outdated maps will confuse everyone working on land use issues,
and we fear, will lead to inadequate understanding of, and inadequate protection of forests and
wetlands.
Recommendations
a. Update the map Township of Oro-Medonte Official Plan Natural Features - Schedule B, so
that it includes all the features listed under recommendation number 3, features we suggest be
included in a new designation, EPWW, using mapping completed by the MNR as a result of the
LSPP. The map should make it clear and easy for residents, developers and planners to see what
areas are off-limits to development.
b. Update policies applying to lands adjacent to key Natural Heritage System and Key Hydrologic
Features to conform to the LSPP. See section B of the Oro-Medonte Official Plan, and LSPP
Chapter 6, vegetation protection zones, and LSPP policy 6.27.
5. Endangered Species
Problem
The 2007 Official Plan says that no habitats of endangered species were known when the
Environmental Protection 1 (EP1) boundaries were drawn, but that the habitats of endangered
species would be added to EP1 if additional studies were done.
Recommendation
The OP should include and reflect information about the habitats of endangered species. Solicit
input from naturalist groups, members of the public, local colleges, the Ministry of Natural
Resources, and others on current research and information regarding the habitat of endangered
species within Oro-Medonte, in order to increase the level of protection from EP2 to EP1 where
appropriate. This should be done very soon, to allow participants time to prepare submissions.
6. Protecting Shorelines
Problem
The Lake Simcoe shoreline is heavily developed, and needs to be naturalized in order to improve the
lakes environmental health.
Recommendations
a. Adopt the recommendations in the forthcoming Shoreline Management Strategy, which stems
from LSPP policy 6.12 and 6.13-SA.

7. The Creation of New Lots
Problem
One of the main objectives of the Oro-Medonte Official Plan is to maintain the rural character of
the Township. The current OP contains many references to the need to protect the environment
and maintain the rural quality of life. Also, the Provincial Places to Grow legislation directs new
development to the Settlement Areas (called Rural Settlement Areas in the current OP). In spite
of the objectives of the Township and the Province, it is possible to create new lots outside
Settlement Areas. For example, Sections C6.3.1, C2.3.1, C2.3.2 and D2.2.1 of the OP allow new
lots to be created. Over time the Official Plan could allow the creation of many new lots. These
new lots will erode the rural character of the Township by creating strips of housing (strip
development) along the rural concession roads.
Recommendations
We recommend that the Township review the regulations in the Official Plan for creating new lots,
for example:
Section C1.3.2: This section is very restrictive, no recommendation.
Section C2.3.1: We propose that the Township make this section more restrictive and define what
is meant by only a limited number of new lots for residential purposes can be created. How many
is limited?
Section C2.3.2: No recommendation.
Section C6.3.1: This section may be sufficiently restrictive.
Section D2.2 and D2.2.1:
Over a period of 28 months, from January 2012 to April 2014, 20 new lots were created under
Policy D2.2.1 of the Township of Oro-Medonte Official Plan. Lots created at that rate would
amount to 956 new lots in the whole Township over the next 100 years. We are concerned about
the number of lots that may be created in the Lake Simcoe watershed part of Oro-Medonte.

Problem
The Phosphorus Reduction Strategy paper tell us that new development will put additional
phosphorus into Lake Simcoe. Therefore, until housing and other developments can be built on
new lots without harming the lake, we suggest the following.
Recommendation:
Make the restrictions for creating new lots more restrictive. For example, if housing or other
development is planned for a new lot, make sure that the development is done is ways that will not
produce additional run-off that may harm the lake.
8. Insufficient Land for Development
Problem
When existing building lots inside and outside of Settlement Areas are filled, where will the
Township settle people? How will the Township accommodate population growth without
contributing to urban sprawl and without reducing woodland and wetland cover?
Recommendation
We believe that intensification is part of the answer to the above problems. For example and
where possible, we suggest that owners of large lots in Settlement Areas be allowed subdivide
and or sever their lots into one or more lots. This recommendation allows for the creation of new
lots in existing Settlement Areas in Oro-Medonte without losing natural cover.
9. Septic System Inspections
Problem
Some of the phosphorus loading into Lake Simcoe comes from faulty or obsolete septic systems.
We are very pleased that individual septic systems are being inspected in Oro-Medonte. However,
many residents are concerned that the rules followed by the inspectors fail to identify inadequate
systems and that the inspectors do not find obsolete or inadequate septic systems.
Recommendations
a. Inspectors must be trained and carry proper certification in order to carry out septic inspections
for the Township, and the inspectors should be prepared to explain to the homeowner how and
why the procedure will result in an assurance that their septic system meets or exceeds the
standards.
b. As a minimum, we recommend that the Township set up a website that shows how the septic
inspections should be performed. Ideally, we would like the Township to send a mailing to each
household that indicates how the septic inspections should be carried out.

10. Progress Report to the Public
Problem
The residents of Oro-Medonte would like to know what the Township is doing to reduce the
amount of phosphorus flowing into the lake.
Recommendations
We understand that this is outside of the OP review process, but the public consultations provide
an opportunity for the Township to update the residents on its progress in completing the following

When can treed areas be connected to be considered one woodland?
e.g. This is one woodland if the
length of the connecting narrow
linear treed area is no more than 3
times its average width.
e.g. If the average width of the connecting linear treed area is 10 metres, then the maximum
length of the connecting treed area must be no more than 30 metres (10X3) for all these treed
areas to be considered as one woodland. If this connecting treed area is longer than 30 metres,
the treed areas will be considered to be separate features and most of the connecting link could
not be part of a significant woodland.

Thank you for your resolution regarding the Rural Schools Funding Review process
dated April 9, 2014. AMO is aware of the impacts to community well-being caused by
school closures and we are monitoring this issue closely.
The Rural Ontario Municipal Association (ROMA) has previously met with the Minister
of Education to raise concerns specifically about the shutting down of rural schools
and the social and economic impacts that closures cause for local communities. It is
our understanding that the Ministry was exploring approaches that consider
community consolidation of school assets. For example, the integration of local
programs and services such as libraries and community centres within existing rural
school infrastructure. The community hub model is an opportunity ROMA suggested
that could be built upon as a best practice in Ontario.

Federal Funding to Improve Water Quality throughout the Watershed
The NVCA board approved an agreement that will see the Authority receive a total of
$1.1 million /South-eastern Georgian Bay
Clean-up Fund over the next three years. The funding will support three on-the-ground
programs to improve water quality:
Healthy Waters from Brook to Bay will provide grants to area landowners and
community groups undertaking water quality improvement projects.
Nottawasaga Watershed Improvement Project will see NVCA continue to
coordinate the stream restoration efforts of community groups in the northern
part of the watershed.
This work falls under the umbrella of the Nottawasaga Watershed Improvement
program (N-WIP), a water quality improvement initiative funded through
-Georgian
Bay.
Innisfil Creek and Upper Nottawasaga Watershed Improvement Programwill
allow NVCA to continue water quality and stream restoration work in the
southern part of the watershed. This program will be conducted collaboratively
with the South Simcoe Streams Network.
Funding for Pretty River and Black Ash Creek Restoration
The board also approved an agreement with the Ministries of Environment and
Agriculture and Food that will see NVCA receive $25,000 in funding for stream
restoration work in Collingwood. The grant, received from the Great Lakes Guardian
Fund, will support bank stabilization and habitat improvement work along Black Ash
Creek and Pretty River in during the summer and fall of 2014.
Three New Monitoring Wells to be Installed in Melancthon
The board agreed to NVCA adding three new monitoring wells to its Provincial
Groundwater Monitoring Network (PGMN). The wells will be located in Melancthon, near
Shelburne, an area that presently lacks a monitoring well. Data gathered from the new
wells will provide valuable insights into the health of our groundwater system.

To All Honourable Members of Oro Medonte Council:
Mount St. Louis Moonstone Ski Resort is requesting exemption from By-law No. 2010-
075 as amended. Section 3.10 states No person shall paint on attach any sign to a
trailer and/or any part of a dismantled motor vehicle, whether or not it is licensed or on
wheels, unless the property zone permits the existence of the trailer or dismantled
motor vehicle
For the previous 15 summer seasons in advance of ski season and during the MSLM
summer Season Pass Sale, the ski resort has advertised its annual sale with a large
sign attached to a mobile tractor trailer. This trailer sits on its business property
th
alongside the 7 concession and is visible form the 400 extension highway. Please see
attached pictures of signage from 2013 summer season.
Last summer MSLM was informed by the township that the ski resort had to remove the
trailer.
Currently MSLM is undertaking building a permanent sign in replacement of the trailer.
See attached quotes and picture to reflect the size and scope of this project. It includes
drawings and quotes from two respective companies, Abracadabra Signs and
SpeedPro Imaging engaged in this tender process. There are two other companies,
Fast Signs and The Look Company also competing for this project. This is a lengthy and
expensive project and cannot be completed in time to advertise this current summer
Season Pass Sale. The construction of this sign will involve the MTO and the township
to ensure MSLM is in compliance with all signage by-laws both locally and provincially.
As a result, MSLM would like to request to use this trailer again this season starting

immediately and remaining up until November 2 2014 to advertise the expansion of
night skiing and its annual summer Season Pass Sale. The trailer will showcase our
website address and the words, NEW NIGHT SKIING PASS SALE NOW
MSLM is in the process of expanding its business and increasing its workforce which
will greatly affect this Township and its positive economic growth. The Ski resorts ability
to launch these changes is in direct result of its ability to advertise its product and the
success of its summer Season Pass Sale.
It is our hope and intention that Oro Medonte Council will support the efforts of the ski
resort and grant an exemption to this by-law.

Please consider my request for an exemption to the sign by-law, section 6.5.1.1. , Billboard Signs are
limited in size to 1 (one) square metre (10.8 sq. ft.) per each 1 (one) metre (3.3 ft.) of frontage of the

I have proposed to build a billboard sign that is 40 feet tall by 100 feet wide, adjacent to Highway 400
near Horshoe Valley Road.
The reason that the proposed sign is so large is that the MTO does not allow billboard signs within 400
metres of the 400-series highways (400, 401, 409, etc.). However, signs at least 400 metres back from
these highways are outside of their regulated area and are permitted. In order for these signs to be
visible from this distance, they have to be quite large.
Support for this proposal:
1) This is a very large farm property, with approximately 400 metres of frontage in the north-south
direction (adjacent to Hwy 400). The property complies with the first restriction (one square
metre of size for each metre of frontage) in that the proposed sign size is about 370 square
metres. Therefore, it is only the second part of section 6.5.1.1. which we are seeking an
exemption for.
2) There are precedents for these types of large signs both in Oro-Medonte and in neighbouring
townships. Specifically, the number of existing jumbo signs by township are:

3) Oro-Medontes immediate neighbouring township to the south, Springwater, which is the most
relevant comparable in that the Hwy 400 extension also goes through their township, does not
have specific size restrictions included in their sign bylaw, other than a provision that the
Building Department may have to review applications for large signs:
Springwater sign bylaw 2.17: Applications for billboard type or large sign structures may require
approval from the Building Department, and shall be reviewed by the Chief Building Official.
Each application for a large sign or structure shall be weighed on its own merit.
Obviously, Oro-Medonte has their own sign policy and is not bound or necessarily influenced by
what other townships do. However, we include this as a reference for how other townships are
addressing the same issue, as you may deem it appropriate to have some consistency with
other townships with respect to the approach to this issue.
4) There is not a risk of Oro-Medonte becoming cluttered with several of these types of signs as
there are very few sites that are conducive to this type of sign. Essentially, it has to be a farm in
order to have the necessarily visibility (no trees for 400 metres from the highway) and there are
very few farms along Hwy 400 that are suitable.
5) These signs promote local businesses both in Oro-Medonte and in central / northern Ontario in
general and are good for the economy and for tourism.
As a gesture of appreciation for your consideration of our request, we would be prepared to offer the
Township free billboard advertising in the amount of $10,000. This could be used to promote economic
development or any other initiatives the township may wish to promote. This advertising may be within
Oro-Medonte or may be within other parts of Ontario such as Barrie, Innisfil, etc. The details of
location, timing, etc. would have to be discussed and confirmed.

the Council of the Township of Oro-Medonte hereby enacts as follows:
That
1. the Township enter into the Site Plan Control Agreement attached hereto as
Appendix A, on lands described on the attached Schedule A;
That
2. the Mayor and Clerk are hereby authorized to execute the Site Plan Control
Agreement on behalf of the Corporation of the Township of Oro-Medonte;
That
3. the attached Appendix A and Schedules A, B, C and D shall form part of
this By-Law;
That
4. this By-Law shall take effect on the final passing thereof.

Whereas
the Owners have applied to the Township of Oro-Medonte to permit the
construction of a single detached dwelling on lands described in Schedule A, attached
hereto;
And Whereas
the Township has enacted a By-law to provide for the designation of the
lands as a "Site Plan Control Area";
And Whereas
the Owner intends to develop the lands in accordance with the Site Plan
attached hereto as Schedule B;
Now Therefore
This Agreement Witnesseth That in consideration of the mutual covenants
hereinafter contained, the parties hereto hereby covenant and agree as follows:

1. Covenants by the Owner
The Owner covenants and agrees as follows:
a) The Owner owns the subject lands described in Schedule A, attached hereto, and
has provided the Township with a Registered Deed containing the legal description
of the subject lands.
b) This Agreement may be registered against title to these subject lands and shall
take priority over any subsequent registrations against the title to the subject lands.
c) No work shall be performed on the lands, nor any use made of the subject lands
with respect to the proposed development, except in conformity with all the
provisions of this Agreement.
d) The Owner shall, prior to the execution of this Agreement, obtain all necessary
permits and approvals from the Township and from all Ministries and Agencies,
including, but not limited to, the County of Simcoe.
e) The Owner shall, prior to the execution of this Agreement, pay all municipal taxes
and charges related to obtaining the approval of these lands for the intended use.
f) The Owner shall pay a refundable deposit for such reasonable costs as may be
involved to the Township in having its solicitor, engineer, planner and staff, perform
any work in connection with this Agreement, including the preparation, drafting,
execution, and registration of this Agreement. The Owner acknowledges and
agrees that the Owner shall be responsible for the cost of performance of all the
Owners obligations hereunder, unless the context otherwise requires. Every
provision of this Agreement, by which the Owner is obligated in any way, shall be
deemed to include the words at the expense of the Owner, unless specifically
stated otherwise. The refundable deposit for expenses and actual cost shall be
$1,000.
The Owner shall replenish the refundable deposit, to its full amount, when
the expenses and actual costs are submitted by the Township.
g) The Owner shall have delivered to the Township, all Transfers/Deeds, Discharges
and Easements, or other documents required by Schedule C, as well as
certification from the Owners solicitor that the Transfer/Deeds and Easements shall
provide the Township with good title, free and clear from all encumbrances.
h) The Owner agrees that prior to issuance of a Building Permit, a Sewage System
Permit approval must be received by the Township/Ministry of the Environment.
2. Covenants by the Township
The Township covenants and agrees as follows:
a) That the Township has enacted a By-law to permit the construction of a single
detached dwelling described in the Site Plan (Drawing S1) and Elevation Drawings
(Drawings A3- A6).
b) That the Township agrees that subject to compliance by the Owner with all relevant
Municipal By-laws and Provincial Statutes and Regulations, the Owner may
proceed to develop the subject lands, as indicated on the Site Plan attached hereto
as Schedule B, subject to the development restrictions contained herein.
3. Development Restrictions
The Parties hereto acknowledge and agree that any use of the subject lands by the Owner
shall be on and subject to the following terms and conditions:

a) Site Plan
The use and development of the subject lands shall be in accordance with and as
set out on the Site Plan, attached hereto as Schedule B.
b) Lighting
All lighting systems installed outside, such as floodlights, shall be directed away
from any adjacent residential use and/or roadway, not to cause interference in any
way.
c) Parking Areas and Driveways
All parking areas and driveways shall be constructed in conformity with Sections
5.19 and 5.20 of By-law No. 97-95, as amended, and the Ontario Building Code
Regulation #419/86, and such parking areas, loading, and access areas shall be
kept free and clear of snow and ice and kept adequately drained. All entrances
shall be constructed, as in Schedule B attached. The Owner agrees to obtain
all necessary approvals from the Ministry of Transportation, County of Simcoe and
Township of Oro-Medonte.
d) Outside Storage
No outside storage shall be permitted between any buildings on the premises and
any street.
e) Garbage Storage
The Owner agrees to provide suitable storage areas for garbage and waste, as
shown on the Site Plan, and to install and maintain litter containers in and around
development on the lands. All metal scrap and associated refuse contained in the
fenced compound shall be removed on a weekly basis.
f) Garbage Collection
The Owner acknowledges and agrees that any Industrial, Commercial and
Institutional (I. C. & I) and multi-unit locations (six (6) units and over) will not
receive curb side waste collection services from the County of Simcoe. Each I. C.
& I location and multi-unit residential location will be responsible for their own
garbage and recycling disposal.
g) Landscaping
The Owner shall complete all landscaping and landscaped areas shown on the
Site Plan, attached as Schedule B, as soon as weather permits, and all grading
and sodding required, according to any Engineering drawings submitted, shall be
done on all lawn areas.
h) Erosion and Siltation Control
The Owner must take all necessary precautions to prevent erosion and
sedimentation of ditches and culverts, slopes, etc., within the Site Plan, and
downstream prior to and during construction. The Owner agrees to maintain all
erosion and siltation control devices in good repair until vegetative cover has been
successfully established.
Tree Preservation
j) No trees shall be cut outside the immediate area surrounding the proposed
dwelling, septic system, and driveway, as shown on approved Site Plan Drawing S-
1 prepared by G Andrews, dated March 25, 2014, unless dead or diseased.

4. Development Changes
The parties acknowledge and agree that there shall be no changes to this Agreement or
the Schedules attached hereto, unless and until such changes have been approved by all
parties. It is the intention of the parties that material amendments to this Agreement be
properly recorded.Such amendments may take the form of a registered Amending
Agreement, an unregistered Agreement, exchange of correspondence, Memorandum of
Confirmation, or notations on Engineering drawings. The nature of such record of
amendment shall depend on circumstances.
5. Security
Prior to signing the Agreement, the Owner will deposit, with the Treasurer of the Township,
to cover the faithful performance of the obligations of the Owner arising under this
Agreement, including but not limited to the construction of the works and services
identified in Schedule D to this Agreement (the said Work), the following securities:
a) Cash in the amount of one hundred percent (100%) of the estimated cost of the
said work, as approved by the Township Engineer and Township Council, or:
b) An irrevocable Letter of Credit from a chartered bank, issued in accordance with the
requirements of Schedule E, with an automatic renewal clause in the amount of
one hundred percent (100%) of the estimated costs of the said works, and as
approved by the Township Engineer. The Letter of Credit shall be for a minimum
guaranteed period of one (1) year, or such time as the Township decides, and shall
be renewed automatically, as necessary, thirty (30) days prior to expiration.
c) The Township reserves the right to accept or reject any of these alternative
methods of providing securities. Prior to depositing the securities, the Owners
Engineer shall submit an estimate of the cost of the works to the Township
Engineer for approval. When the cost estimate has been approved, it will be set
out in Schedule D of this Agreement and will become the basis for the limits of the
securities.
d) Any Letter of Credit or security filed with the Township is based upon the estimated
cost of completing the various matters prescribed by this Agreement. However, all
Letters of Credit and security received by the Township may be used as security for
any item or any other matter which, under the terms of this Agreement, is the
responsibility of the Owner, including without limiting the generality of the foregoing,
payment of engineering, legal, planning or other costs incurred by the Township,
which are the responsibility of the Owner, under the terms of this Agreement.
e) Upon written notification by the Owners agent, certifying that all required works
for which the Letter of Credit was submitted have been completed in accordance
with the plans submitted and upon confirmation by the Township or its agent that
the Owners obligations under this Agreement have been completed, the
Township will return said Letter of Credit.
f) If in the event of default of the Owner under any of the provisions of this
Agreement, it becomes necessary for the Township to realize on its security or
deposits, then the Township shall give, by registered mail, twenty-one (21) days
notice, its intent to draw down on the security or deposit.
6. Compliance
Any action taken by the Township or on its behalf, pursuant to this Agreement, shall be in
addition to and without prejudice to any security or other guarantee given on behalf of the
Owner for the performance of its covenants and agreements herein, and upon default on
the part of the Owner hereunder, the Township shall, in addition to any other remedy
available to it, be at liberty to utilize the provisions of Section 427 of the Municipal Act,
2001, S.O. 2001, c. 25, as amended.

7. Co-operation
The Owner consents to the registration of this Agreement by the Township, upon the title
of the subject lands, at the expense of the Owner and agrees to execute such further and
other documents, consents or applications, as required, for the purpose of securing
registration and giving effect to the provisions of this Agreement.
8. Binding Effect
This Agreement, and everything contained herein, shall be binding upon the successors
and assigns of the parties hereto, and upon the lands described in Schedule A, attached
hereto, such Schedule being a legal description of the lands, and it is further agreed that
this Agreement shall be prepared, approved and registered on title.
9. Severability of Clauses
Should any section, subsection, clause, paragraph, or provision of this Agreement be
declared by a Court of competent jurisdiction to be invalid, the same shall not affect the
validity of the Agreement as a whole or any part thereof, other than the provision so
declared to be invalid.
10. Save Harmless
The Owner, on behalf of itself, its successors and assigns, agrees to indemnify and save
harmless, the Township from and against any and all claims, suits, actions and demands
whatsoever, which may arise either directly or indirectly by reason of any work or service
performed by the Township, its servants or sub-contractors in order to complete the work
or services required to be completed under this Agreement, provided the subject matter of
such action, suits, claims or demands was not caused intentionally or through gross
negligence on the part of the Township, its servants or agents or sub-contractors.
In Witness Whereof, the Parties hereunto have affixed their respective seals
under the hands of their proper officers duly authorized in that behalf.

shall be constructed, as in Schedule B attached. The Owner agrees to obtain
all necessary approvals from the Ministry of Transportation, County of Simcoe and
Township of Oro-Medonte.
d) Outside Storage
No outside storage shall be permitted between any buildings on the premises and
any street.
e) Garbage Storage
The Owner agrees to provide suitable storage areas for garbage and waste, as
shown on the Site Plan, and to install and maintain litter containers in and around
development on the lands.
f) Garbage Collection
The Owner acknowledges and agrees that any Industrial, Commercial and
Institutional (I. C. & I) and multi-unit locations (six (6) units and over) will not
receive curb side waste collection services from the County of Simcoe. Each I. C.
& I location and multi-unit residential location will be responsible for their own
garbage and recycling disposal.
g) Landscaping
The Owner shall complete all landscaping and landscaped areas shown on the
Site Plan, attached as Schedule B, as soon as weather permits, and all grading
and sodding required, according to any Engineering drawings submitted, shall be
done on all lawn areas.
h) Erosion and Siltation Control
The Owner must take all necessary precautions to prevent erosion and
sedimentation of ditches and culverts, slopes, etc., within the Site Plan, and
downstream prior to and during construction. The Owner agrees to maintain all
erosion and siltation control devices in good repair until vegetative cover has been
successfully established.

4. Development Changes
The parties acknowledge and agree that there shall be no changes to this Agreement or
the Schedules attached hereto, unless and until such changes have been approved by all
parties. It is the intention of the parties that material amendments to this Agreement be
properly recorded.Such amendments may take the form of a registered Amending
Agreement, an unregistered Agreement, exchange of correspondence, Memorandum of
Confirmation, or notations on Engineering drawings. The nature of such record of
amendment shall depend on circumstances.
5. Security
Prior to signing the Agreement, the Owner will deposit, with the Treasurer of the Township,
to cover the faithful performance of the obligations of the Owner arising under this
Agreement, including but not limited to the construction of the works and services
identified in Schedule D to this Agreement (the said Work), the following securities:
a) Cash in the amount of one hundred percent (100%) of the estimated cost of the
said work, as approved by the Township Engineer and Township Council, or:
b) An irrevocable Letter of Credit from a chartered bank, issued in accordance with the
requirements of Schedule E, with an automatic renewal clause in the amount of
one hundred percent (100%) of the estimated costs of the said works, and as
approved by the Township Engineer. The Letter of Credit shall be for a minimum
guaranteed period of one (1) year, or such time as the Township decides, and shall
be renewed automatically, as necessary, thirty (30) days prior to expiration.
c) The Township reserves the right to accept or reject any of these alternative
methods of providing securities. Prior to depositing the securities, the Owners
Engineer shall submit an estimate of the cost of the works to the Township
Engineer for approval. When the cost estimate has been approved, it will be set
out in Schedule D of this Agreement and will become the basis for the limits of the
securities.
d) Any Letter of Credit or security filed with the Township is based upon the estimated
cost of completing the various matters prescribed by this Agreement. However, all
Letters of Credit and security received by the Township may be used as security for
any item or any other matter which, under the terms of this Agreement, is the
responsibility of the Owner, including without limiting the generality of the foregoing,
payment of engineering, legal, planning or other costs incurred by the Township,
which are the responsibility of the Owner, under the terms of this Agreement.
e) Upon written notification by the Owners agent, certifying that all required works
for which the Letter of Credit was submitted have been completed in accordance
with the plans submitted and upon confirmation by the Township or its agent that
the Owners obligations under this Agreement have been completed, the
Township will return said Letter of Credit.
f) If in the event of default of the Owner under any of the provisions of this
Agreement, it becomes necessary for the Township to realize on its security or
deposits, then the Township shall give, by registered mail, twenty-one (21) days
notice, its intent to draw down on the security or deposit.
6. Compliance
Any action taken by the Township or on its behalf, pursuant to this Agreement, shall be in
addition to and without prejudice to any security or other guarantee given on behalf of the
Owner for the performance of its covenants and agreements herein, and upon default on
the part of the Owner hereunder, the Township shall, in addition to any other remedy
available to it, be at liberty to utilize the provisions of Section 427 of the Municipal Act,
2001, S.O. 2001, c. 25, as amended.

7. Co-operation
The Owner consents to the registration of this Agreement by the Township, upon the title
of the subject lands, at the expense of the Owner and agrees to execute such further and
other documents, consents or applications, as required, for the purpose of securing
registration and giving effect to the provisions of this Agreement.
8. Binding Effect
This Agreement, and everything contained herein, shall be binding upon the successors
and assigns of the parties hereto, and upon the lands described in Schedule A, attached
hereto, such Schedule being a legal description of the lands, and it is further agreed that
this Agreement shall be prepared, approved and registered on title.
9. Severability of Clauses
Should any section, subsection, clause, paragraph, or provision of this Agreement be
declared by a Court of competent jurisdiction to be invalid, the same shall not affect the
validity of the Agreement as a whole or any part thereof, other than the provision so
declared to be invalid.
10. Save Harmless
The Owner, on behalf of itself, its successors and assigns, agrees to indemnify and save
harmless, the Township from and against any and all claims, suits, actions and demands
whatsoever, which may arise either directly or indirectly by reason of any work or service
performed by the Township, its servants or sub-contractors in order to complete the work
or services required to be completed under this Agreement, provided the subject matter of
such action, suits, claims or demands was not caused intentionally or through gross
negligence on the part of the Township, its servants or agents or sub-contractors.

A By-law to Permanently Close Part of Monk Street
between Penetanguishene Road and Colborne Street on Plan 1 (Oro),
Township of Oro-Medonte, County of Simcoe
And
To Release The Corporation of the Township of Oro-Medontes interest in
Part of Monk Street between Penetanguishene Road and Colborne Street
on Plan 1 (Oro), Township of Oro-Medonte, County of Simcoe
Whereas
Section 11 of the Municipal Act, 20901, S.O. 2001, c.25, as amended,
provides that a lower-tier municipality may pass by-laws with respect to highways;
And Whereas
Section 34 of the Municipal Act, 20901, S.O. 2001, c.25, as amended,
provides that a by-law permanently closing a highway does not take effect until a
certified copy of the by-law is registered in the proper land registry office;
And Whereas
Part of Monk Street between Penetanguishene Road and Colborne
Street on Plan 1 (Oro) is located within the boundaries of privately owned lands;
And Whereas
there is a history of correspondence in which the Township of Oro-
Medonte, and its predecessor the Township of Oro, have confirmed that the Township
claims no interest in the Part of Monk Street between Penetanguishene Road and
Colborne Street on Plan 1 (Oro);
Now Therefore
the Council of the Township of Oro-Medonte hereby enacts as follows:
1. Council does hereby permanently close Part of Monk Street between
Penetanguishene Road and Colborne Street on Plan 1 (Oro), Township of Oro-
Medonte, County of Simcoe, more particularly described in Schedule A,
attached hereto and forming part of this by-law.
2. Council does hereby release its interest in Part of Monk Street between
Penetanguishene Road and Colborne Street on Plan 1 (Oro), Township of Oro-
Medonte, County of Simcoe, more particularly described in Schedule A,
attached hereto and forming part of this by-law.
3. The Mayor and Clerk are hereby authorized to execute all necessary
documentation to carry out the intent of this by-law.
4. This by-law shall take effect on the final passing thereof.

By-law No. 2014-094
A By-law to Amend By-law No. 2014-012, A By-law of The Corporation of the
Township of Oro-Medonte to provide for the imposition of fees or charges
(Fees and Charges By-law)
Whereas
Section 8 of the Municipal Act,2001, S.O. 2001, c. 25, as amended provides
the powers of a municipality under this or any other Act shall be interpreted broadly so
as to confer broad authority on the municipality to enable the municipality to govern its
affairs as it considers appropriate and to enhance the municipalitys ability to respond to
municipal issues;
And Whereas
Section 9 of the Municipal Act,2001, S.O. 2001, c. 25, as amended,
provides that a municipality has the capacity, rights, powers and privileges of a natural
person for the purpose of exercising its authority under this or any other Act;
And Whereas
Part XII, Section 391(1) of the Municipal Act,2001, S.O. 2001, c. 25, as
amended, authorizes a municipality to impose fees or charges on persons, for services
or activities provided or done by or on behalf of it; for costs payable by it for services or
activities provided or done by or on behalf of any other municipality or local board; and
for the use of its property including property under its control;
And Whereas
Section 110 of the Municipal Act,2001, S.O. 2001, c. 25, as amended,
provides that a municipality may enter into agreements for the provision of municipal
capital facilities by any person and may pass by-laws to enter into agreements relating
thereto;
And Whereas
The Corporation of the Township off Oro-Medonte has entered into such
an agreement with Skyline Utility Services Inc. in regards to the Horseshoe Valley
Resort Waste Water Treatment Plant, pursuant to By-law No. 2014-075, that is owned
and operated by Skyline Utility Services Inc.;

And Whereas
Council of the Township of Oro-Medonte did, on the 5 day of February
2014, enact By-law No. 2014-012 to provide for the imposition of fees or charges;
And Whereas
Council deems it necessary to amend By-law No. 2014-012;
Now Therefore
the Council of the Township of Oro-Medonte hereby enacts as follows:
1. That Section 2 of By-law No. 2014-012 be amended by adding:
Schedule K Waste Water Treatment
2. That Sections 4 and 5 of By-law No. 2014-012 be amended by replacing
Schedules A to and including J with Schedules A to and including K.
3. That Appendix A entitled Schedule K to By-law No. 2014-012 Waste
Water Treatment attached hereto and forming part of this by-law be added to
By-law No. 2014-012.
4. That Section 3 of Schedule G to By-law No. 2014-012 and Section 2.5 of
Schedule J to By-law No. 2014-012 be amended by replacing Oro-Medonte
Administration Office, 148 Line 7 South, Box 100, Oro, Ontario L0L 2X0 with
Oro-Medonte Administration Centre, 148 Line 7 South, Oro-Medonte, Ontario
L0L 2E0.

5. That Section 3 of Schedule G to By-law No. 2014-012 and Section 2.5 of
Schedule J to By-law No. 2014-012 be amended by replacing Administration

Appendix A to By-law No. 2014-094
Schedule K to By-law No. 2014-012
Waste Water Treatment
1.
An annual waste water treatment services charge, as specified below, shall be
imposed per unit upon those lands more particularly described in Schedule A
of By-law No. 2014-075, being the Horseshoe Valley Resort Waste Water
Treatment Plan Municipal Capital Facility By-law, an agreement between The
Corporation of the Township off Oro-Medonte and Skyline Utility Services Inc.
The said charge will be comprised of the following components:
a) Annual Waste Water Treatment Plan (WWTP) $ 904.43
operating costs
b) Recovery of immediately-required maintenance $ 266.50
and repair of the WWTP
c) Reserve fund contribution for future upgrades, $ 113.38
improvements, repairs and maintenance
d) Township administrative costs $ 41.81
Total Annual Charge $ 1,326.12
Quarterly Charge $ 331.53
The above charge includes all applicable taxes, unless otherwise specified.
2.
The Treasurer shall, for each calendar quarter, issue bills to each applicable
land for the applicable number of units based on the above waste water
treatment services charge. Bills shall be due and payable not less than twenty
one (21) days from the date of mailing.
3.
Waste water treatment services charge bill payments shall be payable to The
Corporation of the Township of Oro-Medonte and may be paid during office
hours in person or by mail at the Oro-Medonte Administration Centre, 148 Line
7 South, Oro-Medonte, Ontario L0L 2E0, or at most financial institutions.
Payments made at a financial institution shall be deemed to be paid on the date
shown by the Tellers stamp on the bill stub. The Township shall not be
responsible for any applicable service charges payable to the bank. Cheques
only can be dropped at the drop boxes located at the Administration Centre and
Moonstone Fire Hall.
4.
The Treasurer shall impose a five (5) percent late charge on all unpaid accounts
on the day after the due date.
5.
If an account remains unpaid, the municipality may collect amounts payable
pursuant to Section 398(2) of the Municipal Act, 2001, c.25, as amended.

Being a By-Law to Confirm the Proceedings of the Council Meeting held on
Wednesday, June 18, 2014
Whereas Section 5 of the Municipal Act, 2001, S.O. 2001, C. 25, as amended
provides that the powers of the Municipal Council shall be exercised by By-Law,
unless the municipality is specifically authorized to do otherwise;
And Whereas The Council of The Corporation of the Township of Oro-Medonte
deems it expedient that the proceedings at this Council Meeting be confirmed and
adopted by By-Law;
Now Therefore the Council of The Corporation of the Township of Oro-Medonte
hereby enacts as follows:
1. That the actions of the Council at its Council Meeting held on Wednesday, June
18, 2014, and in respect to each Motion, Resolution and other actions passed
and taken by the Council at its said Meeting is, except where prior approval of
the Ontario Municipal Board is required, hereby adopted, ratified and confirmed.
2. That the Mayor and the proper Officials of the Township are hereby authorized
and directed to do all things necessary to give effect to the said action or to
obtain approvals where required and to execute all documents as may be
necessary on behalf of the Council of the Corporation of the Township of Oro-
Medonte.
3. That the Mayor/Chair and Clerk/Designate are hereby authorized and directed to
execute and affix the corporate seal to all necessary documents.
4. And That this by-law shall come into force and take effect on the final passing
thereof.
