A By-law to Permanently Close Part of Monk Street
between Penetanguishene Road and Colborne Street on Plan 1 (Oro),
Township of Oro-Medonte, County of Simcoe
And
To Release The Corporation of the Township of Oro-Medonte's interest in
Part of Monk Street between Penetanguishene Road and Colborne Street
on Plan 1 (Oro), Township of Oro-Medonte, County of Simcoe
Whereas Section 11 of the Municipal Act, 20901, S.O. 2001, c.25, as amended,
provides that a lower -tier municipality may pass by-laws with respect to highways;
And Whereas Section 34 of the Municipal Act, 20901, S.O. 2001, c.25, as amended,
provides that a by-law permanently closing a highway does not take effect until a
certified copy of the by-law is registered in the proper land registry office;
And Whereas Part of Monk Street between Penetanguishene Road and Colborne
Street on Plan 1 (Oro) is located within the boundaries of privately owned lands;
And Whereas there is a history of correspondence in which the Township of Oro-
Medonte, and its predecessor the Township of Oro, have confirmed that the Township
claims no interest in the Part of Monk Street between Penetanguishene Road and
Colborne Street on Plan 1 (Oro);
Now Therefore the Council of the Township of Oro-Medonte hereby enacts as follows:
1. Council does hereby permanently close Part of Monk Street between
Penetanguishene Road and Colborne Street on Plan 1 (Oro), Township of Oro-
Medonte, County of Simcoe, more particularly described in Schedule "A",
attached hereto and forming part of this by-law.
2. Council does hereby release its interest in Part of Monk Street between
Penetanguishene Road and Colborne Street on Plan 1 (Oro), Township of Oro-
Medonte, County of Simcoe, more particularly described in Schedule "A",
attached hereto and forming part of this by-law.
3. The Mayor and Clerk are hereby authorized to execute all necessary
documentation to carry out the intent of this by-law.
4. This by-law shall take effect on the final passing thereof.
By-law read a First, Second and Third time, and Passed this 18th day of June,
2014.
