Opening of Meeting: Roy Hastings assumed the Chair and called the meeting to order. 2. Adoption of the Agenda: a) Motion to Adopt the Agenda. Motion No. CA140417 -1 Moved by Tupling, Seconded by Macpherson It is recommended that the agenda for the Committee of Adjustment meeting of Thursday, April 17, 2014 be received and adopted. Carried. 3. Disclosure of Pecuniary Interest: None declared 4. Adoption of Minutes: a) Minutes of Committee of Adjustment meeting held on Thursday, March 20, 2014. Motion No. CA140417 -2 Moved by Johnson, Seconded by Macpherson It is recommended that the draft minutes of the Committee of Adjustment meeting held on Thursday, March 20, 2014 be adopted as printed and circulated. Public Meetings: a) 2014 -A -05 (SCS Leasing) ( Shelswell), 544 Line 11 North, Application for relief from Minimum Interior Side Yard Setback to permit the replacement of an existing office building with a new office building. Craig Shelswell, applicant, was present. Motion No. CA140417 -3 Moved by Macpherson, Seconded by Tupling It is recommended that the Committee of Adjustment approve Variance Application 2014 -A -05, subject to the following conditions: 1. That, notwithstanding Table B3 (Minimum Interior Side Yard Setback - IR Zone) of Zoning By -law 97 -95, the proposed building shall otherwise comply with all other applicable provisions of the Zoning By -Law. 2. That the buildings and structures on the property be generally in conformity with the dimensions as set out on the application and sketches submitted and approved by the Committee. 3. That an Ontario Land Surveyor provide verification to the Township of compliance with the Committee's decision by 1) pinning the foundation wall setback and 2) verifying in writing or by way of survey /real property report, prior to pouring of the foundation, that the addition is no closer to the interior side lot line than 1.6 metres. 4. And That the appropriate zoning certificate and building and demolition permit be obtained from the Township only after the Committee's decision becomes final and binding. Carried. Motion No. CA140417 -4 Moved by Tupling, Seconded by Johnson It is recommended that the Committee of Adjustment defers Variance Application 2014 -A -07, at the request of the Lake Simcoe Conservation Authority. Benjamin LeRoux, applicant was present. Bonnie Therrien, neighbour, noted concern over snow falling from the existing, as well as proposed, dwelling onto her fence. Rick. LeRoux, applicant's father, provided more detail regarding the fence and slow load issues brought forward by Mrs. Bonnie Therrien. Motion No. CA140417 -5 Moved by Tupling, Seconded by Macpherson It is recommended that the Committee of Adjustment approve Variance Application 2014 -A -09, subject to the following conditions: 1. That, notwithstanding Table B4 -B (Minimum Interior Side Yard Setback - A/RU Zone) of Zoning By -law 97 -95, the proposed building shall otherwise comply with all other applicable provisions of the Zoning By -Law; 2. That the buildings and structures on the property be generally in conformity with the dimensions as set out on the application and sketches submitted and approved by the Committee; 3. That an Ontario Land Surveyor provide verification to the Township of compliance with the Committee's decision by 1) pinning the foundation wall setback and 2) verifying in writing or by way of survey /real property report, prior to pouring of the foundation, that the addition is no closer to the interior side lot line than 3.4 metres. 4. Motion No. CA140417 -6 Moved by Macpherson, Seconded by Tupling It is recommended that the Committee of Adjustment approve Variance Application 2014 -A -10, subject to the following conditions: 1. That, notwithstanding Table B1 and Schedule A5 of Zoning By -law 97 -95, the proposed building shall otherwise comply with all other applicable provisions of the Zoning By -Law; 2. That the buildings and structures on the property be generally in conformity with the dimensions as set out on the application and sketches submitted and approved by the Committee; 3. That the appropriate zoning certificate and building permits be obtained from the Township only after the Committee's decision becomes final and binding. Carried. Motion No. CA140417 -7 Moved by Tupling, Seconded by Macpherson It is recommended that the Committee of Adjustment approve Variance Application 2014 -A -11, subject to the following conditions: 1. That, notwithstanding Table B1 (Minimum Front Yard Setback - RUR1 * 3) of Zoning By -law 97 -95, the proposed building shall otherwise comply with all other applicable provisions of the Zoning By -Law. 2. That the buildings and structures on the property be generally in conformity with the dimensions as set out on the application and sketches submitted and approved by the Committee. 3. That an Ontario Land Surveyor provide verification to the Township of compliance with the Committee's decision by 1) pinning the foundation wall setback and 2) verifying in writing or by way of survey /real property report, prior to pouring of the foundation, that the addition is no closer to the front lot line than 7.8 metres. 4. That the appropriate zoning certificate and building permits be obtained from the Township only after the Committee's decision becomes final and binding. 5. That the applicant acquires permission from the Nottawasaga Valley Conservation Authority (NVCA) prior to the issuance of a building permit. 6. And That the applicant's request to increase the floor area from 170m2 to 200m2 and reduce the front yard from 15m to 7.8m be approved. Carried. Motion No. CA140417 -8 Moved by Johnson, Seconded by Macpherson It is recommended that the Committee of Adjustment approve Variance Application 2014 -A -12, subject to the following conditions: 1. That, notwithstanding Sections 5.1.3, 5.1.4, 5.1.6 of Zoning By -law 97 -95, the proposed building shall otherwise comply with all other applicable provisions of the Zoning By -Law. 2. That the buildings and structures on the property be generally in conformity with the dimensions as set out on the application and sketches submitted and approved by the Committee. 3. And That the appropriate zoning certificate and building permits be obtained from the Township only after the Committee's decision becomes final and binding. Carried. Motion No. CA140417 -9 Moved by Macpherson, Seconded by Tupling It is recommended that the Committee of Adjustment defer Consent Application 2014 -13-01 in order to provide the applicant the opportunity to address the requirements of the County of Simcoe and the Nottawasaga Valley Conservation Authority. Carried. h) 2014 -B -02 (William and Dorothy Moore), 15 Line 14 South, Application for consent for a technical severance of lands that have merged in title. William Moore, applicant, was present. Motion No. CA1 4041 7 -1 0 Moved by Tupling, Seconded by Macpherson It is recommended that the Committee of Adjustment defers Consent Application 2014713-02, until the Lake Simcoe Conservation Authority and Ministry of Transportation's conditions be satisfied and the Application to the Township of Oro - Medonte to acquire Township Road Allowance be completed.
