Deputy Mayor Hough called the meeting to order at 7:04 pm and explained the public meeting has been called under the authority of the Planning Act, Sections 34, R.S.O. 1990 c. P.13, to obtain public comment with respect to a proposed Amendment to the Zoning By-law, Application 2014-ZBA-03 (Vasey) 2101 Horseshoe Valley Road (County Road 22) and described as Concession 1, Part Lot 40 (Vespra), in the Township of Oro- Medonte. Notice of the Public Meeting was mailed to landowners within 120m (400 feet) of the specified site on March 20, 2014 and a sign posted on the subject property on March 20. The Public Meeting notice was also posted on the Township’s website on March 21, 2014. The following correspondence was received at the meeting: None. Josh Mueller, Intermediate Planner, explained the purpose and effect of the proposed amendment. A PowerPoint presentation was presented. The following public persons offered verbal comments with respect to the proposed amendment: Betty Veitch, Peter and Gina Vasey, Steve Watson (submitted correspondence dated April 8, 2014), Sheila Craig. Background The ministry released its Major Capacity Expansion Policy Framework on December 20, 2013. A commitment was made to issue a Call for Proposals in early 2014. This Call for Proposals represents the beginning of a process that will lead to the selection of successful proposals which, collectively, will meet provincial goals for postsecondary education in Ontario -- increased capacity at the undergraduate degree level; greater affordability for students, institutions, and the province; improved institutional differentiation; and regional of fairness, competitiveness, and transparency and by a commitment to serve the public interest. This long-term initiative will help ensure that our postsecondary education system will have the right spaces in the right places for Ontario students. 2. Timelines for Submitting a Proposal The closing date for submission of a Notice of Intent is June 27, 2014. The closing date for submission of the full proposal is September 26, 2014. The Board of Health has communicated to the provincial government its concerns regarding the potential for increased harm to the health of the public with the increased availability in alcohol that would occur with proposed changes to provincial alcohol controls in recent years such an increase in the availability and consumption of alcohol and thus of alcohol related harms in Ontario. Research has demonstrated that increased consumption and harm from alcohol is associated with accessibility to alcohol as determined by the number of retail outlets and vendors per capita, hours and days of sale, and type of retailing system. Government retailing systems such as the Liquor Control Board of Ontario (LCBO) have been shown to be significantly more effective in controlling access to alcohol and are more effective in preventing sales to minors and to intoxicated patrons thereby curtailing alcohol related harms. The expansion of the sale of wine at farmers markets would erode alcohol control policies put in place to mitigate alcohol related harms in Ontario. This privatization of alcohol sales would set a precedent for the further expansion of the sale of other alcohol products in other venues across Ontario. In addition to increasing the availability of alcohol and eroding evidence-based policy, it would further normalize alcohol as an innocuous and common product for members of the general public including children and youth attending farmers markets to purchase local fresh produce. PRE-SERVICING AGREEMENT THIS AGREEMENT MADE BETWEEN: Township of Oro-Medonte (hereinafter called the “Township”) - and - 2353970 Ontario Inc. (hereinafter called the “Developer”) WHEREAS the Developer is the registered owner of the lands described in Schedule “A” attached (the “Subdivision Lands”); AND WHEREAS the Developer desires to commence installing municipal services within the Subdivision Lands, prior to the registration of the Plan of Subdivision and the execution of the Subdivision Agreement with the Township; NOW THEREFORE THE PARTIES HERETO AGREE AS FOLLOWS: 1. ASSUMPTION OF RISK BY DEVELOPER 1.1 The Developer agrees to assume all risk in commencing installation of Township services, as defined in Article 1.4 hereof, on the Subdivision Lands, prior to the execution of a Subdivision Agreement with the Township and the registration of the Plan of Subdivision. REQUIREMENTS PRIOR TO THE COMMENCEMENT OF WORK 2.1 The Developer agrees to submit the following to the Township, in a form satisfactory to the Township, prior to the commencement of the installation of Township services on the Subdivision Lands: a) A letter from a qualified Engineer experienced in the field of Township services confirming: 1. Retainer - That their firm has been retained by the Developers to act as Consulting Engineers for 2353970 Ontario Inc. 2. Terms of Retainer - The terms of their retainer with the Developer as follows: a) Plans and Specifications - Prepare plans and specifications for the construction of Township services; b) Cost Estimates - Prepare cost estimates for the Township services to be constructed from the drawings; c) Approvals - Obtain all necessary approvals to construct; d) Co-ordination - Co-ordinate the installation of Township services to avoid conflicts with regards to telephone, cable T.V., and Township services; e) On-Site Inspections - Ensure that all on-site inspections of Township service installations are conducted by the Developer’s Consulting Engineers at all times during construction; f) As-Constructed Drawings - Submit certified “as-constructed” drawings after acceptance of the Township services; g) Change in Retainer – If at any time during the project: i) The terms of their retainer are changed by the Developer, or; ii) If they become aware that they will not be able to provide “as constructed” drawings, they will notify the Township within twenty-four (24) hours; h) Erosion and Siltation Control - Ensure all necessary precautions are taken to prevent erosion and sedimentation of sewers, ditches, 4 Page 156 of 240 15.a) A By-law to Authorize the Execution of a Pre-Servicing... culverts, slopes, etc., both within the subdivision and downstream, prior to and during construction. b) Confirmation letters are to be filed with the Township Clerk, confirming the following: 1) The Township Engineering Consultant has no objection to the pre- servicing; 2) The Planning Division has no objection to the pre-servicing; 3) The Township Solicitors have no legal objections to the pre-servicing. c) Payment of cash or certified cheque required to cover the cost of the Township’s lawyer and Planner for all costs involved in processing the Pre- Servicing Agreement, and for all the Township’s Engineers for checking of plans, specifications and inspection on behalf of the Township for the sum of Ten Thousand Dollars ($10,000). As accounts are received from the Township Planner, lawyer, and Engineer, they will be paid by the Township and then submitted to the Developer for reimbursement within thirty (30) days. In the event that the deposit is drawn down to a level of Five Thousand Dollars ($5, 000) or less, and the Developer does not pay the accounts within thirty (30) days, it is hereby understood and agreed that the Developer is in default of this Agreement and all work must cease; d) A Letter of Credit, as per Schedule “C”, in the amount set out in Schedule “B”, attached, as security to ensure the due completion of the Township services to be constructed by the Developer, and as security to be held by the Township for the warranty periods to be more particularly described in the Subdivision Agreement for the Subdivision Lands. The said Letter of Credit shall provide that if in the sole opinion of the Township, default under the terms of this Agreement has taken place, the said Letter of Credit may thereupon be drawn upon in whole or in part; e) A certified copy of an insurance policy, or a certificate of insurance, confirming Five Million Dollars comprehensive general liability in the amount of ($5,000,000.00) , naming the Township as co-insured, and containing the following additional provisions or endorsements: 1) Products/Completed Operations provisions; 2) Cross-liability clause; 3) Blasting included, only if done by an independent contractor; 4) Notice of Cancellation - a provision that the insurance company agrees to notify the Township within fifteen (15) days, in advance, of any cancellation or expiry of the said insurance policy. f) All Servicing Plans shall be submitted to and accepted by the Township Engineer; g) A letter of opinion, from a qualified Engineer experienced in the field of Township services, stating that Environmental Compliance Approval (ECA) from the Ministry of the Environment and Energy is not required for the Pre-Servicing works that are the subject of this Agreement. 3. INSPECTION BY THE TOWNSHIP 3.1 The Developer agrees to permit unrestricted access to the Subdivision Lands to the Township and its agents for the purpose of inspection of the Township services to be installed by the Developer. Notwithstanding that inspections may be conducted by the Township or its agents, the Developer shall bear sole responsibility for the soundness of the Engineering design of the Township services, and for ensuring that the Township services to be installed will function, 5 Page 157 of 240 15.a) A By-law to Authorize the Execution of a Pre-Servicing... as intended, and will be compatible with the final Plan of Subdivision when and if such Plan of Subdivision is approved. 3.2 If, in the opinion of the Township, there is an emergency situation as a result of any work undertaken by the Developer or its servants, or agents, which requires immediate attention to avoid damage to private or public property or services owned by the Township or to eliminate a potential hazard to persons, such work may be done immediately by the Township at the expense of the Developer, but notice shall be given to the Developer at the earliest possible time. 4. APPLICATION OF SECURITY 4.1 In the event of default by the Developer under the terms of this Agreement, or if the Township is required to enter onto the Subdivision Lands or the abutting Township lands to conduct any work on the Township services or the connection of the Township services to facilities due to an emergency, the Township shall be entitled to draw upon the security posted by the Developer pursuant to the terms of this Agreement, in whole or in part, to cover the costs incurred by the Township in remedying the default on the part of the Developer, or in addressing the emergency situation. 5. NO REDUCTION OF SECURITY 5.1 The Developer acknowledges and agrees that no reduction in the amount of security filed by the Developer with the Township, in accordance with the terms of this Agreement, shall be permitted until such time as the Developer has entered into the Subdivision Agreement for the Subdivision Lands with the Township. Thereafter, any reductions in the security posted by the Developer shall be completed in accordance with the terms of the said Subdivision Agreement. 6. NO ASSUMPTION OF TOWNSHIP SERVICES 6.1 The Developer acknowledges and agrees that the Township shall not be required to assume the Township services to be constructed by the Developer, pursuant to the terms of this Agreement, until such time as the Developer has entered into a Subdivision Agreement with the Township for the Subdivision Lands, and the Township services have been completed, inspected, and approved. 7. NOTICE 7.1 Any notice required to be given pursuant to this Agreement may be given by prepaid registered post to the Developer at the following address: 2353970 Ontario Inc. 1946 Wilkinson Street Innisfil, ON L9S 1X3 and such notice shall be deemed to have been given and received on the third day after mailing. 8. The Corporation of The Township of Oro-Medonte By-Law No. 2014-051 A by-law to authorize certain capital works of The Corporation of the Township of Oro-Medonte (The “Municipality”); to authorize the submission of an application to the Ontario Infrastructure and Lands Corporation (“OILC”) for financing such capital works; to authorize temporary borrowing from OILC to meet expenditures in connection with such works; and to authorize long term borrowing from OILC for such works through the issue of debentures Whereas the Municipal Act,2001 (Ontario), as amended, (the “Act”) provides that a municipal power shall be exercised by by-law unless the municipality is specifically authorized to do otherwise; And Whereas it is now deemed to be expedient to authorize for the municipal purposes of the Municipality the new capital works described in column (2) of Schedule “A” (individually a “Project”, collectively the “Projects”) attached hereto and forming part of “ this By-law (“Schedule A”) in the amount of the estimated expenditure set out in column (3) of Schedule “A”, subject in each case to approval by OILC of the financing for such Projects that will be requested by the Municipality in the Application as hereinafter described; And Whereas in accordance with section 4 of Ontario Regulation 403/02, the Council of the Municipality has had its Treasurer update its most recent annual debt and financial obligation limit received from the Ministry of Municipal Affairs and Housing (as so ” updated, the “Updated Limit), and, on the basis of the authorized expenditure for each Project as set out in column (3) of Schedule “A” (“Authorized Expenditure”), the Treasurer has calculated the estimated annual amount payable in respect of each Project (collectively the “Project Limits”) and has determined thatthe aggregate of the Project Limits does not exceed the Updated Limit, and accordingly the approval of the Ontario Municipal Board under the Ontario Municipal Board Act (Ontario), as amended, is not required before any such Project is authorized by Council; And Whereas subsection 405(1) of the Act provides that a municipality may authorize temporary borrowing to meet expenditures made in connection with a work to be financed in whole or in part by the issue of debentures if, (a) the municipality is an upper-tier municipality, a lower-tier municipality in a county or a single-tier municipality and it has approved the issue of debentures for the work; (b) the municipality is a lower-tier municipality in a regional municipality and it has approved the work and the upper-tier municipality has approved the issue of debentures for the work; or (c) the municipality has approved the issue of debentures for another municipality or a school board under section 404; And Whereas subsection 401(1) of the Act provides that a municipality may incur a debt for municipal purposes, whether by borrowing money or in any other way, and may issue debentures and prescribed financial instruments and enter prescribed financial agreements for or in relation to the debt; And Whereas the Act also provides that a municipality shall authorize long term borrowing by the issue of debentures or through another municipality under section 403 or 404 of the Act; And Whereas OILC has invited Ontario municipalities desirous of obtaining temporary and long term debt financing in order to meet capital expenditures incurred after December 31, 2003 in connection with eligible capital projects to make application to OILC for such financing by completing and submitting an application on the form provided by OILC (the “Application”); Page 170 of 240 15.d) A by-law to authorize certain capital works of The Cor... - 2 - And Whereas the Municipality has submitted an Application to OILC to request financing for the Projects by way of long term borrowing through the issue of debentures to OILC and by way of temporary borrowing from OILC pending the issue of such debentures; And Whereas OILC has accepted and has approved the municipality’s application; Now Therefore the Council of the Township of Oro-Medonte hereby enacts as follows: 1. The Council of the Municipality hereby confirms, ratifies and approves the completion by the Treasurerof an Application and the submission by such authorized official of an Application, duly executed by such authorized official, to OILC for the financing of the Projects in the maximum aggregate principal amount of $2,750,000 substantially in the form of Schedule “B” hereto and forming part of this By-law, with such changes thereon as such authorized official approved. 2. (a) Construction of each Project in the amount of the respective estimated Authorized Expenditure set out in column (3) of Schedule “A” is hereby approved and authorized; (b) Any one or more of theMayorand the Treasurer are hereby authorized to conclude contracts on behalf of the Municipality for the construction ofthe Projects in accordance with the Municipality’s usual protocol; (c) Where applicable, the Engineer of the Municipality will forthwith make such plans, profiles and specifications and furnish such information as in the opinion of the Engineer is necessary for the construction ofthe Projects; and (d) Where applicable, the construction of the Projects shall be carried on and executed under the superintendence and according to the direction and orders of such Engineer. 3. TheMayorand the Treasurer are hereby authorized to negotiate and enter into, execute and deliver for and on behalf of the Municipality a financing agreement (a “Financing Agreement”) with OILC that provides for temporary and long term borrowing from OILC in respect of the Projects on such terms and conditions as such authorized officials may approve, such execution and delivery to be conclusive evidence of such approval. 4. The Mayorand/or the Treasurer are hereby authorized, pending the substantial completion of a Projector as otherwise agreed with OILC, to make temporary borrowings pursuant to section 405 of the Act in respect of each Project, on the terms and conditions provided in the Financing Agreement and on such other terms and conditions as such authorized officials may agree, and to sign such evidence of indebtedness as OILC may require (a “Note”); and the Treasurer is authorized to sign such certifications as OILC may require in connection with such borrowings in respect of the Projects; provided that the amount of borrowings allocated to any Project does not exceed the Authorized Expenditure for such Project and does not exceed the loan amount set out in column (4) of Schedule “A” in respect of such Project. 5. Subject to the terms and conditions of the Financing Agreement and such other terms and conditions as OILC may otherwise require, theMayorand the Treasurer are hereby authorized to enter into long term borrowing in respect of the Projects and to issue debentures to OILC on the terms and conditions provided in the Financing Agreement and on such other terms and conditions as such authorized officials may agree (“Debentures”); provided that the principal amount of such Debentures issued in respect of a Project does not exceed the Authorized Expenditure for such Project and does not exceed the loan amount set out in column (4) of Schedule “A” in respect of such Project. In accordance with the provisions of section 25 of the Ontario Infrastructure and Lands Corporation Act, 2011, as amended from time to time hereafter, as security for the payment by the Municipality of the indebtedness of the Municipality to OILC under the Debentures (the “Obligations”), the Municipality is hereby authorized to agree in writing with OILC that the Minister of Finance is entitled, without notice to the Municipality, to deduct from money appropriated by the Legislative Assembly of Ontario for payment to the Municipality, amounts not exceeding the amounts that the Municipality fails to pay OILC on account of the Obligations and to pay such amounts to OILC from the Consolidated Revenue Fund. 7. For the purposes of meeting the obligations of the Municipality in respect of the Note and any Debentures, the Municipality shall provide for raising in each year as part of the general levy, the amounts of principal and interest payable in each year under the Note and any outstanding Debenture, to the extent that the amounts have not been provided for by any other available source including other taxes or fees or charges imposed on persons or property by a by-law of any municipality. 8. (a) The Mayorand/or the Treasurer are hereby authorized to execute and deliver the Note, the Mayorand the Treasurer are hereby authorized to enter into, execute and deliver the Financing Agreement and to cause Debentures to be issued, the Clerk and Treasurer are severally hereby authorized to generally do all things and to execute all other documents and papers in the name of the Municipality in order to perform the obligations of the Municipality under the Financing Agreement and to carry out the issuance of the Note and Debentures, and the Treasurer is authorized to affix the Municipality’s municipal seal to any such documents and papers. (b) The proceeds realized in respect of the Note and Debentures, after providing for the expenses related to their issue, if any, shall be apportioned and applied for the respective Projects and for no other purpose except as permitted by the Act. 9. The Corporation of the Township of Oro-Medonte By-Law No. 2014-050 Being a By-Law to Confirm the Proceedings of the Council Meeting held on Wednesday, April 23, 2014 Whereas Section 5 of the Municipal Act, 2001, S.O. 2001, C. 25, as amended provides that the powers of the Municipal Council shall be exercised by By-Law, unless the municipality is specifically authorized to do otherwise; And Whereas The Council of The Corporation of the Township of Oro-Medonte deems it expedient that the proceedings at this Council Meeting be confirmed and adopted by By-Law; Now Therefore the Council of The Corporation of the Township of Oro-Medonte hereby enacts as follows: 1. That the actions of the Council at its Council Meeting held on Wednesday, April 23, 2014, and in respect to each Motion, Resolution and other actions passed and taken by the Council at its said Meeting is, except where prior approval of the Ontario Municipal Board is required, hereby adopted, ratified and confirmed. 2. That the Mayor and the proper Officials of the Township are hereby authorized and directed to do all things necessary to give effect to the said action or to obtain approvals where required and to execute all documents as may be necessary on behalf of the Council of the Corporation of the Township of Oro- Medonte. 3. That the Mayor/Chair and Clerk/Designate are hereby authorized and directed to execute and affix the corporate seal to all necessary documents. 4.
