TAKE NOTICE that the Council of the Corporation of the Township of Oro-Medonte will hold a
Public Meeting on Wednesday, March 12, 20114, at 7.30 p.m. in the Municipal Council Chambers.
The purpose of the Public Meeting is to obtain public comments on proposed Amendments to the
Official Plan and the Zoning By-law, under Sections 22 and 34 of the Planning Act, R.S.O. 1990 c.
P. 13.
THE PURPOSE of the proposed amendment to the Township of Oro-Medonte Official Plan is to
site specifically amend the Agricultural policies of the Official Plan by adding a policy to Section
C1.4 — Exceptions, to permit a "Heavy Equipment Training Faciiity", described as the training of
students in the operation and maintenance of construction equipment such as excavators, dozers,
back hoe loaders, front end loaders and compactors.
THE PURPOSE of the proposed amendment to Township of Oro-Medonte Zoning By-law 97-95
is to site -specifically expand an existing Rural Industrial (RI) Zone on the lands, as well as add
special provisions to the expanded Rural Industrial (RI) Zone to permit the "Heavy Equipment
Training Facility" described above, thereby placing the subject lands in a Rural Industrial
Exception Zone (RI*Exception).
The above -noted amendments are proposed to apply only to those lands identified in this Notice as
the "Subject Lands", located at 544 and 556 Line 11 north and described as Part of the East Half of
Lot 17, Concession 11 (Oro), in the Township of Oro-Medonte.
A KEY MAP illustrating the location of the subject lands is provided with this Notice.
ANY PERSON may attend the public meeting and/or make written or verbal representation either
in support of, or in opposition to, the proposed Amendments. If a person or public body that files
an appeal of a decision of the Township of Oro-Medonte in respect of the proposed Amendments
does not make oral submission at the Public Meeting, or make written submissions to the
Township before the proposed Amendments is adopted, the Ontario Municipal Board may dismiss
all or part of the appeal.

proposed Official Plan and Zoning By-law Amendments, you must make a written request to the

This letter is further to your Notice of Public Meeting with regard to these amendments
and our previous correspondence dated January 22, 2014.
Given that the area subject to these amendments is sufficiently setback a minimum of
30 metres from the key natural heritage and hydrologic features located on or adjacent
the property, we are satisfied from a watershed perspective that any approval of these
applications would be consistent with the Provincial Policy Statement and would be in
conformity with the Lake Simcoe Protection Plan. On this basis, we have no further
requirements related to the approval of these applications.
Please note that any proposal for major development on the subject lands through the
site plan approval process should be accompanied with a proper stormwater
management report that conforms to Designated Policies 4.8 to 4.11 of the Lake
Simcoe Protection Plan. By definition, major development consists of the construction of
a building or buildings with a ground floor area of 500 square metres or more.

Thank -you for consulting with the Lake Simcoe Region Conservation Authority (LSRCA) with
regard to the proposed Official Plan and Zoning By -Law amendments. The LSRCA has
reviewed these applications for consistency with the Provincial Policy Statement (PPS) and
conformity with the Lake Simcoe Protection Plan (LSPP). It should also be noted that part of the
subject lands are governed by Ontario Regulation 179/06 under the Conservation Authorities
Act. We understand that the purpose of these applications is to permit a Heavy Equipment
Training Facility.
Based on our review, the rear of the subject properly contains and is adjacent to a Key Natural
Heritage feature (woodland) and a Key Hydrologic feature (wetland and watercourses) as
defined by Designated Policies (DP) 6.21 and 6.22 of the LSPP. On this basis we recommend
that any approval of these amendments be subject to the following:
1. That the woodland/wetland feature and the 30 metre minimum vegetation protection
zone be designated Environmental Protection One and zoned Environmental Protection
(EP) through this planning process in accordance with 6.23 DP (LSPP); and
2. That the R1 Exception zone (RI- ) be restricted to lands a minimum of 120 metres from
the woodland/wetland feature.
Alternatively, a Natural Heritage Evaluation (NHE) can be completed in accordance with 6.24-
6.28 DP (LSPP) demonstrating no negative impact to the features as a result of the proposed
use. A satisfactory NHE may reduce the 120 metre setback.

Thank you for circulating the Notice of Public Meeting for the above noted revised applications to the County of
Simcoe. The subject property is located in a prime agricultural area on Canada Land Inventory Class 1, 2 or 3
soils, is designated Agricultural in the Township's Official Plan and therefore subject to the Agricultural policies of
the County Official Plan.
Previously outlined in the County's comment letter dated January 17, 2014, County staff has reviewed the
relevant policies in the Provincial Policy Statement (PPS) 2005, and the County of Simcoe Official Plan (SCOP).
The permitted uses identified in the Section 2.3.3 of the PPS are mirrored in Section 3.6.6 of the SCOP which
states,
"Prime agricultural areas will be protected for agriculture and compatible uses. Permitted uses
are agriculture, agriculture related uses, secondary uses, natural heritage conservation and
forestry, aggregate developments subject to Section 4.4, processing of agricultural products, and
agricultural produce sales outlets generally relating to production in the local area".
Based on the information provided, it is the County planning staff's opinion that the proposed use is not permitted
in the Agricultural designation as it does not meet the definitions of an agricultural use, secondary use or an
agriculture -related use. The proposed use is not compatible, limited in scale, is not secondary to the principle
agricultural use, and does not provide value added agricultural products. Therefore County planning staff cannot
support the proposed applications because they are not consistent with the PPS, and do not conform to Simcoe
County Official Plan.

Thank you for circulating the above noted applications to the County of Simcoe. The subject property is located in
a prime agricultural area on Canada Land Inventory Class 1, 2 or 3 soils, is designated Agricultural in the
Township's Official Plan and therefore subject to the Agricultural policies of the County Official Plan.
County Planning staff have recently met with Township staff and the applicants to discuss the proposed
applications. It is our understanding that the applicant is applying to amend both the Township's Official Plan and
Zoning By-law to permit, as an exception, a heavy equipment training facility on approximately 7 hectares of the
subject property. For your information, County of Simcoe Planning staff conducted a site visit in the spring of 2011
and provided a pre -consultation letter dated April 8, 2011 (attached) advising an industrial use in the Agricultural
designation needs to be small scale and is required to be in proximity to the farm operation.
County staff has reviewed the relevant policies in the Provincial Policy Statement 2005, and the County of Simcoe
Official Plan, and offers the following comments on the proposed development:
Provincial Policy Statement (PPS) 2005
As previously noted, the subject lands are located in a prime agricultural area and therefore the PPS Section 2.3
Agriculture policies apply to this proposal.
Section 2.3.1 of the PPS states,
"Prime agricultural areas shall be protected for long-term use for agriculture."
Section 2.3.3 of the PPS goes on to state,
"In prime agricultural areas, permitted uses and activities are: agricultural uses, secondary uses
and agricultural -related uses.
Proposed new secondary uses and agriculture -related uses shall be compatible with, and shall
not hinder, surrounding agricultural operations. These uses shall be limited in scale, and criteria
for these uses shall be included in municipal planning documents as recommended by the
Province, or based on municipal approaches which achieve the same objective".
Secondary uses are defined in the PPS as:
"uses secondary to the principle use of the property, including but not limited to, home
occupations, home industries, and uses that produce value-added agricultural products from the
farm operation on the property".

Agriculture -related uses are defined in the PPS as:
"means those farm -related commercial and farm -related industrial uses that are small scale and
directly related to the farm operation and are required in close proximity to the farm operation".
County of Simcoe Official Plan (SCOP)

Thank you for pre -consulting with the County of Simcoe. This letter is further to our meeting of April 1, 2011 and is
provided to offer the following comments for consideration as they relate to the proposed zoning by-law
amendment application.
The subject property is designated Agricultural in the Local Official Plan; and therefore subject to the Agricultural
policies of the County Official Plan. Simcoe County Official 'Plan (SCOP) policy 3.6.6 states "prime agricultural
areas will be protected for agriculture and compatible uses. Permitted uses are agriculture, agriculture related
uses, secondary uses, natural heritage conservation and forestry, aggregate developments subject to Section 4.4,
processing of agricultural ,products, and agricultural produce sales outlets generally relating to production in the
local area':
In addition, agriculture related uses is defined by SCOP as being "small scale farm related commercial and
industrial uses directly related to and required to be in close proximity to the farm operation". Therefore, the
County would not object to the proposed excavation school and training provided agriculture is the primary use of
the subject property and the excavation training is agriculturally related and required to be in proximity to a farm
operation. We would respectfully request a copy of documentation submitted to the Township in support of the
proposed application to ensure compliance with the County of Simcoe Official Plan.
The County Official Plan permits local Official Plans and/or zoning by-laws to be more restrictive, therefore
continued pre -consultation with the Township is encouraged.
The above information is intended to be comprehensive and all inclusive, however, over time circumstances and
requirements are subject to change. Additional information, research or study may be required to be provided.

MORGAN Planning & Development has been retained by Russ and Diane
Thornton, owners of 472 Line 11 North, to advise and make representation on his
behalf regarding applications 2013-OPA-01 and 2013-ZBA-12. The Thornton
lands abut the subject property to the south.
It is our understanding that the purpose of the OPA and ZBA is to rezone and re-
designate a portion of 544 and 556 Line 11 North to expand an existing Rural
Industrial (RI) Zone and to add site specific provisions that would permit a `Heavy
Equipment Training Facility'.
The subject property is located in a prime agricultural area on Canada Land
Inventory Class 1, 2 or 3 soils. The lands are designated 'Agricultural' in the
Township Official Plan, they are subject to the Agricultural policies of the County
of Simcoe Official Plan, and to Section 2.3 (Agriculture) of the Provincial Policy
Statement 2005 (PPS).
Township of Oro-Medonte Official Plan (2007)
The objectives of the Agricultural designation as outlined in Section C1.1 of the
Township Official Plan are as follows:
• To maintain and preserve the agricultural resource base of the Township.
• To protect land suitable for agricultural production from development and
land uses unrelated to agriculture.
• To promote the agricultural industry and associated activities and enhance
their capacity to contribute to the economy of the Township.
• To preserve and promote the agricultural character of the Township and
the maintenance of the open countryside.
It is the opinion of MORGAN Planning that a "heavy equipment training facility" is
not an appropriate use on prime agricultural lands rather such a facility should be
located on lands with no agricultural potential. Further, we feel that the

objectives of the Agricultural designation clearly discourage the expansion of
industrial lands into prime agricultural lands.
We note that a "heavy equipment training facility" is not a permitted use in the
Agricultural designation and it is the opinion of MORGAN Planning that any site
specific amendment to permit a "heavy equipment training facility" or to permit
the expansion of an industrial use into prime agricultural lands must prove that
the proposed uses relate solely to agriculture. We understand that a land use
planning report, which would typically address the specific nature of a proposed
use, was not submitted in support of these applications. Therefore it is unclear
how the proposed "heavy equipment training facility" or the proposed expansion
of industrial lands relate to agriculture.
County of Simcoe Official Plan
The subject lands are designated `Agricultural' in the County of Simcoe Official
Plan. Permitted uses in the Agricultural designation are outlined in section 3.6.6
of the County Official Plan (see below).
"Prime agricultural areas will be protected for agriculture and compatible
uses. Permitted uses are agriculture, agriculture related uses, secondary
uses, natural heritage conservation and forestry, aggregate developments
subject to Section 4.4, processing of agricultural products, and agricultural
produce sales outlets generally relating to production in the local area..."
As outlined in the letter dated February 26, 2014 from the County of Simcoe the
proposed "heavy equipment training facility" is not permitted in the Agricultural
designation as it does not meet the definitions of an agriculture use, a secondary
use, or an agriculture -related use.
Provincial Policy Statement 2005
Section 2.3 of the PPS provides policies for the protection of prime agricultural
areas for long-term agricultural use. Specifically, Section 2.3.3.1 states that "In
prime agricultural areas, permitted uses and activities are: agricultural uses,
secondary uses and agriculture -related uses."
Based on the information provided, it is the opinion of MORGAN Planning that
the proposed "heavy equipment training facility" is not permitted on the subject
lands as it does not meet the definitions of an agriculture use, a secondary use,
or an agriculture -related use.
Concluding Remarks
As described above it is the opinion of MORGAN Planning that the applications
as submitted do not comply with the Township Official Plan (2007), the County
Official Plan (2007) or the Provincial Policy Statement (2005). Each of these
documents compels decision makers to preserve prime agricultural lands, by
directing development to lands with no agricultural potential. To this end, we

agree with comments expressed in the letter from County planning staff dated
January 17, 2014 that the applicants should seek a more appropriate location for
the proposed "heavy equipment training facility".
Further, we feel that the proposed expansion of industrial lands and the
establishment of a "heavy equipment training facility" are not compatible with the
character of the surrounding lands. The information provided with the application
fails to address concerns of increased noise, increased truck traffic, or the visual
impacts of an expanding industrial activity in an agricultural zone.
It is important to note that Russ and Diane Thornton have previously expressed
their concerns to the Township regarding the existing noise and visual impacts of
the abutting industrial use. To date no site plan control measures in the form of
fencing or landscaping buffers have been implemented and the possibility of
further expansion of the abutting industrial use is of great concern to Russ and
Diane Thornton.

We would like to proceed with setting up a heavy equipment training facility at 544 Line
11 N., Oro-Medonte. There is a need for well trained heavy equipment operators and there
are few training facilities in the area that are producing employable students. We have
been in communication with several of the local educating facilities and they have
expressed a sincere interest in having a facility located locally to allow less travel time for
students thus allowing more hands on experience time. Our company and other
construction companies are finding that the training that students receive from other
facilities does not have enough hands on time and thus students are ill prepared for entry
level to the work force. This industry is also moving towards having all its operators be
certified and there is no facility in this region that could handle the quantity of operators
that would have to be certified.
It is Our intention to provide both practical and theory with an emphasis on safety for
various types of heavy equipment. We are proposing hosting an introductory course with
advanced components. We see these courses providing the students with an exposure to
equipment used in general construction and the opportunity to pursue specific areas of
expertise. Employers who hire these students would be accepting employees that would
require little supervision as they would have acquired a comfort zone in the construction
field and would possess abilities to operate and maintain equipment. These courses would
provide competency in excavating, site services, water main and sewers, septics and
surveying. It would be our aim to provide these students with sufficient practical time
spent on equipment that they would be considered competent by the industry.

assisting With developing courses and Bear Creek Secondary School has written an
expressed interest in the program and the Simcoe County Board: of Education and Simcoe
Muskoka Catholic District School Board, and Georgian College are interested and
reviewing our proposal. All have expressed an interest in having a local facility.

Introductory Eevell Classroom and Equipment `gime:
Safety: This component would cover safety with equipment, power tools, trenching, and.
hoists.
Equipment: This component would involve experience with excavator, dozer, backhoe
loader, front end loader, compactors.
Training: Students would be trained in survey & layout, pipe layout, water main,
manhole .installation, construction materials, swales, stock piles.
Maintenance: Students would be trained in changing oil, grease points, minor repairs,
use of torches, fluids, and basic hands on changing of wear parts on
equipment.
Communication: This component would include applied mathematics, technical writing,

I am very excited to write this letter on behalf of Morris Shelswell & Sons Excavating & Grading Ltd in
support of their proposed "School for the Trades -Heavy Equipment Operation." Bear Creek Secondary
School began a specialized High Skills, full day, Heavy Equipment Co-op Program 10 years ago. Shelswell
& Sons have provided valuable experiential learning experiences for students enrolled in this co-op
program.
The Bear Creek Heavy Equipment Co-op Program has offered a Dual Credit to participants in the course.
Originally this was achieved through the program at Georgian College but in the past 6 years the
students have had to travel to the Lindsay Campus of Fleming College. This has created a large increase
in costs for our students. A local school for the trades would help to reduce some of these costs. The
program at Bear Creek currently works closely with CAED (Canadian Association of Equipment Dealers)
who help to steer and advise the direction of the program to help meet industry needs.
We fully support Shelswell & Sons proposal and their initiative to create a School for the Trades -
Specializing in Heavy Equipment Operations. We are also very aware that the industry needs Heavy
Equipment Technicians as well and our program encourages students to explore that pathway.

The Shelswell's have been in business for 67 years, employ around thirty people and
work throughout Ontario.
I strongly support their efforts to establish a local heavy equipment training facility. At
the present time, local schools have to send students a considerable distance at a
considerable expense to receive hands-on training. The Shelswell's facility would enable
students to have more hands-on time and less travel time. The training would be tailored
specific to the construction industry to produce better trained students.
I am confident this project is most worthy of your support. It will benefit local residents
and businesses.

"What a beautiful stone," he
remarked.
It wasn't always so.
As Crooks recalled, "it was
really bad here"
The cemetery wasn't much of a
sight until Crooks and a long list.
of other volunteers decided to do
something about it.
Local resident Norman Roe
had been cleaning up around the
graves of his family members.
Crooks, who lives nearby, saw the
work Roe was doing and thought,
"Why can't somebody else come
in and chip in?"
Crooks also had an inherent
interest in the property, located
on Concession 11 near 15/16
Sideroad in Oro-Medonte Town-
ship.
His great-grandfather, Robert
Crooks, donated land to St.
Mark's Anglican Church in 1836.
(The second church structure
was demolished in 1987.) Robert
Crooks's big, red -brick house still
stands in the distance, to the
south of the cemetery.
"There's a lot of history here for
me" Crooks said- Saturday morn-
ing.
What Crooks and others are
doing with the cemetery will help
preserve history for the families
of others who are buried there.
Headstones once buried or
felled are upright; a bench, bird-
bath and a couple of wooden
deer have been placed under a
tree; some 20 trees have been
planted. Crooks saw a stone with
the name "Birch" engraved on it,
and said, "With a name like that,
she deserves a nice birch tree."
And so she got it.
Tree roots have been
unearthed;sunken graves are
being filled in; trees are being
pruned. But what stand out most
are the headstones.
Steve Sanderson, owner of Sig-
nature Memorials in Orillia,
donated his time and expertise.
He helped bring some of the
stones out of the ground and he
straightened others. He also
repaired and replaced old lime-
stone markers, some of which are
150 years old.
Modest about his contribution,
Sanderson said he was "just
trying to be community minded"
"You see a guy doing things like
that," he said of Crooks, "and
you've just got to help out."
