Mayor Ian Beard chaired the meeting.
Mayor Ian Beard opened the meeting by explaining to those present
that this Public Meeting was to receive public comments with
respect to a proposed Zoning By-Law Amendment, under provisions of
Section 34, of the Planning Act. The applicant has applied to
rezone certain lands, Lot 22, Concession 14, being Part 1 on
Reference Plan 51R-22765, former Township of Oro, to permit
permanent residential use.
To date, the Council of the Corporation of the, Township of Oro-
Medonte have not made a decision on this application, other than
proceeding to this Public Meeting. Only after comments are
received from the Public, requested agencies and Township Staff,
within the appropriate time period, will Council make a decision on
this application.
Notice of the Public Meeting was mailed out on December 29, 1994,
to all property owners within 120 metres of the subject lands.
Mayor Beard then asked the Clerk if there had been any
correspondence received on this matter. The Clerk responded by
indicating that a letter had been received from Estelle Kates
stating her objection as the rezoning would detract from the
neighbourhood and it does not meet minimum lot frontage
requirements.
The Mayor then stated that those persons present would be afforded
the opportunity of asking questions with respect to the proposed
Amendment. He then turned the meeting over to the Township
Planner, Ms. Kris Menzies, to explain the purpose and effect of the
proposed zoning By-Law Amendment.

Kris Menzies
Thank you, Mr. Mayor. The property is located, as the Mayor has
stated, on Part of Lot 22, Concession 14, more specifically
described in a Reference Plan. Generically speaking, the lot
fronts onto the 3th Concession Road and is approximately five lots
north of Lake Simcoe on the Concession Road. The purpose of
tonight's Public Meeting is to afford Council the opportunity to
hear public comments on the rezoning prior to its consideration for
passing. The property is currently zoned Shoreline Residential;
the applicants are making a request to rezone the property to
General Residential. This is more commonly referred to as a
Conversion in order to allow legal year-round use of the dwelling
unit located on the property. There are certain requirements under
the Official Plan which must be adhered to before the Planning
Department is in a position to make favourable recommendation, one
of which is the lot must have a minimum lot frontage of fifteen
metres; this property has a minimum lot frontage of forty-five
metres; and, it is required to have a minimum lot area of eleven
hundred square metres and this property has a lot area of almost
double the requirement. Those are my comments, Mr. Mayor.

Mr. Mayor, to Ms. Menzies. Do you know anything about what Mrs.
Kates is talking about, about not enough frontage?
Kris Menzies
Not specifically. I am aware that she has had conversations with
the Township's CAO and the Township zoning Administrator concerning
this matter; but, when I spoke to both of those people today it
wasn't relayed to me as to what her concerns were in the zoning
requirements. In fact, the current zone, now, requires a minimum
thirty-metre frontage and the new zone requires a minimum of
thirty-metre frontage, notwithstanding the conversion policy
requirements. By the survey provided, this lot is in excess of
that so I'm not quite sure what the concern is.

So this lot is totally okay, then.

From my standpoint, yes.

Kris, the letter seems to mention something about a severance. Is
there a possibility that the writer is confused or something in
that regard, thinking that there is property being severed in this
case rather than a simple Conversion.
Kris Menzies
It's my understanding and, once again, I didn't speak to them
directly, that they did have concerns of the previous severance.
the property was severed by the ontario Municipal Board in 1990.
The Kates, it's my understanding, purchased the property after this
lot was severed. It's also my understanding they had concerns with

that severance as well as concerns related to their property value
if, if I can paraphrase, if the cottages in the area all of a
sudden became year-round residences. I'm not sure of the relevance
of the severance but it's my understanding that it was clearly
identified to them that it's not a severance issue, it's a rezoning
issue just to allow legal year-round use of the house.

Through the Mayor, to Kris. Am I correct in understanding that
this is Kates' former portion of the subject property which was
created by Consent?
Kris Menzies
No, she's not.
She's a neighbour.
Councillor Cotton
Do you know what zone she's situated in?
Kris Menzies
I don't know her legal description of her property, but if she's
anywhere close to the vicinity, you know, twelve lots up, twelve
lots down, twelve lots across the street, she's Shoreline
Residential. But I have not looked up what her particular zoning
is, it's an assumption of mine.

Which only allows seasonal use.
Kris Menzies
That's correct.

Is this property not on the water?
Kris Menzies
No, it is not. It was severed off of a large waterfront property
and it created basically a key lot. Councillor Cotton knows what
I'm speaking about. A key lot is, this lot had a very large
frontage on the road and a very narrow frontage on Lake Simcoe.
Basically, forty-five metres was taken off the road frontage and a
portion of the front of the lot was severed off creating a
driveway-type of situation to what remained as the lakefront
property which then opened up to the lake creating what's normally
referred as a key lot.
