2013-127 Amend Zoning - 51 Boyd Crescent - 2013-ZBA-06THE CORPORATION OF THE TOWNSHIP OF ORO- MEDONTE BY- LAW NO. 2013 -127 A By -law to amend the zoning provisions which apply to lands within Block 64, Plan M -679, Concession 8 (Former Township of Medonte), 51 Boyd Crescent (Bachly Investments Inc. 2013- ZBA -06) WHEREAS the Council of the Corporation of the Township of Oro - Medonte is empowered to pass By -laws to regulate the use of land pursuant to Section 34 of the Planning Act, R.S.O. 1990, c.P.13; AND WHEREAS Council deems it appropriate to rezone the lands to permit the development of residential uses, in accordance with Sections B3 and C3 of the Official Plan; NOW THEREFORE the Council of the Township of Oro - Medonte hereby enacts as follows: Schedule 'A24' to Zoning By -law 97 -95, as amended, is hereby further amended by changing the zone symbol applying to the lands located in Block 64 , Plan M -679, Concession 8 (Former Township of Medonte); 51 Boyd Crescent, Township of Oro - Medonte, from the Open Space (OS) Zone to the Residential One Exception (R1 *107) Zone and the Residential One Exception *231 Holding (R1 * 231(H)) Zone as shown on Schedule `A' attached hereto and forming part of this By -law. 2. Section 7 — Exceptions of Zoning By -law 97 -95 as amended is hereby further amended by adding the following subsection: "7.231* *231 * — BLOCK 64, PLAN M -679, CONCESSION 8, MUNICIPALLY KNOWN AS 51 BOYD CRESCENT (FORMER MEDONTE) "Notwithstanding Section 5.33 "Setback from Watercourses ", a 15 metre (49.2 foot) setback to the centerline of the watercourse is permitted on the lands denoted by the symbol *231 on the schedule to this By -law." 3. The portion of the lands zoned Residential One Exception Holding (R1 *231 (H)) shall be subject to a Holding (H) Provision in accordance with Section 2.5 of By -law 97 -95, as amended. The Holding Provision shall not be removed until a Site Plan Agreement that is satisfactory to Council has been entered into which satisfies the requirements of the Nottawasaga Valley Conservation Authority as identified in their June 13, 2013 correspondence. 4. This By -law shall come into effect upon the date of passage hereof, subject to the provisions of the Planning Act, as amended.
