06 17 2013 2013-ZBA-06 (Bachly)NOTICE OF PUBLIC MEETING FOR PROPOSED AMENDMENT TO THE ZONING BY -LAW OF THE TOWNSHIP OF ORO- MEDONTE 2013- ZBA -06 (Bachly) TAKE NOTICE that the Council of the Corporation of the Township of Oro - Medonte will hold a Public Meeting on Monday, June 17, 2013, at 6:00 p.m. in the Municipal Council Chambers. The purpose of the Public Meeting is to obtain public comments on a proposed Amendment to the Zoning By -law, under Section 34 of the Planning Act, R.S.O. 1990 c. P. 13. THE PURPOSE of the proposed Zoning By -law Amendment is to amend the zoning of the lands described as Part Block 64, R.P. 51M-679 Township of Oro - Medonte. The subject lands are presently zoned Open Space (OS) Zone. It is proposed that the lands be rezoned to Residential One Exception 107 (R1 *107) for the purpose of fulfilling conditions of consent 2012 -B -15 to 2012 -B -21. A KEY MAP illustrating the location of the subject lands is provided below. ANY PERSON may attend the public meeting and/or make written or verbal representation either in support of, or in opposition to, the proposed Amendment. If a person or public body that files an appeal of a decision of the Township of Oro - Medonte in respect of the proposed Amendment does not make oral submission at the Public Meeting, or make written submissions to the Township before the proposed Amendment is adopted, the Ontario Municipal Board may dismiss all or part of the appeal. We understand that the rezoning would also allow for a residential use on the remnant parcel which is traversed by a tributary of the Coldwater River. The NVCA has reviewed the most recent site plan which shows a 15 metre setback from the centerline of the „ watercourse. The NVCA is satisfied that the building area is outside of the flood and erosion hazard area associated with the watercourse. While the NVCA generally encourages larger environmental setbacks from watercourses, there is potentially an opportunity for environmental enhancement in this urban setting. Prior to support of this application, the NVCA requires an environmental enhancement plan developed by a qualified professional which could include (but not be limited to) the following suggestions. Watershed . A vegetation planting plan developed to the extent possible for both Counties sides of the Coldwater River tributary using indigenous plants; • Fencing along the northern boundary of the property to alleviate yard encroachment into the enhancement area. Prior to commencement, NVCA Ecologist Dave Featherstone should be consulted for further input on the content of the environmental enhancement plan. The NVCA recommends any approval of this application be deferred at this time until the enhancement plan has been developed and implemented. Alternatively, the NVCA would have no objection to the development and implementation of an environmental enhancement plan through the use of a Holding provision on the Zoning By -law amendment which would require a site plan agreement to be completed and registered on title. We note that development in association with the Coldwater River tributary will require a permit from the NVCA under the Conservation Authorities Act.
