1996-014 Amendment no. 76 to teh official plan THE CORPORATION OF THE TOWNSHIP OF ORO-MEDONTE BY-LAW 1996-14 BY-LAW TO ADOPT AMENDMENT NO. 76 TO THE OFFICIAL PLAN FOR THE OWNSHIP OF ORO he Council of the Corporation of the Township of Oro-Medonte, in ccordance with the provisions of the Planning Act, R.S.O. 1990 .P. 13, hereby enacts as follows: The attached explanatory text and Schedule "A" which onstitutes Amendment No. 76 to the Official Plan for the ownship of Oro is hereby adopted. The Deputy Clerk is hereby authorized and directed to make pplication to the Ministry of Municipal Affairs for approval of endment No. 76 to the Official Plan for the Township of Oro. PART A - THE PREAMBLE - consisting of the purpose, location and basis for the Amendment and does not constitute part of the actual Amendment. PART B - THE AMENDMENT - consisting of the following text, constitutes Amendment No. 76 to the Official Plan of the Township of Oro. PART C - THE APPENDIX - consist of information pertinent to this Amendment in the form of background information. This section does not constitute part of the actual Amendment. TOWNSHIP OF ORO OFFICIAL PLAN AMENDMENT NO. 76 TO THE OFFICIAL PLAN OF THE .., TOWNSHIP OF ORO AS ADMINISTERED BY THE TOWNSHIP OF ORO-MEDONTE PART A - THE PREAMBLE 1 . Purpose The purpose of this Amendment is to change the Official Plan designation from "pits and Quarries and Rural" to the "Rural". 2. Location The lands affected by this amendment are described as West Half of Lot 6, Concession 4, former Township of Oro, County of Simcoe, on the Bass Lake Side Road east of County Road 57. 3. Basis of Amendment The effect of this amendment is to redesignate a portion of the lands from the "pits and Quarries" designation to the "Rural" designation. The lands to be redesignated are approximately 30 acres in area. A site inspection was conducted by the Ministry of Natural Resources in April 1990 and determined that the property had been designated and mapped incorrectly as there was little potential for aggregate on the subject property; and, therefore, the information provided by the Ministry for the Municipality's general mapping was also incorrect and was required to be amended. The use proposed for this property would be a large Rural use. -t PART B - THE AMENDMENT All of this part of the document entitled Part B - The Amendment, consisting of the following text, constitutes Amendment No. 76 to the Official Plan of the Township of Oro. W 1/2 Lot 6 Concession 4 (Oro) Township of Oro-Medonte Your file 1301 Dear Mr. Stagg: Mr. Williams, our District Manager has asked me to respond to the letter you have sent regarding the above mentioned property. As you may be aware, Mr. William Fitzgerald held the position of District Geologist at the time the request was made to have the aggregate designation removed from this property. As a qualified professional, Mr. Fitzgerald's assessment of the property having no potential for aggregate resources is valid. Whether this opinion applies to adjoining properties is not known, although a review of the Aggregate Resource Inventory Report for Oro Township has the area to the west of this site mapped as a selected sand and gravel resource area of primary significance. It would appear that the subject lands is on the very edge of the deposit thereby making the possibility of significant resources unlikely. Unfortunately, additional mapping or testing of aggregate deposits has not been conducted in this area since the ARIP reports were published. It is our usual procedure that if someone would like to change the designation, they are required to provide a report to the effect that aggregate resources are not present on the site. This is a service we no longer provide. . . .2 ~ Page 2 Mr. stagg It is our position, that with the information currently available, a general correction of the off~cial plan and zoning by-law would not be possible unless supported by a comprehensive geological assessment.
