1996-028 Amend by-law no 91-91- Imposition of Development Charges THE CORPORATION OF THE TOWNSHIP OF ORO-MEDONTE BY-LAW NO. 96-28 Beinq a By-law to Amend By-Law No. 91-91, a By-law with Respect to the Imposition of Development Charqes WHEREAS Council of the Township of Oro passed By-Law No. 91-91, being a By-law with respect to the imposition of development charges under Subsection 3(1) of the Development Charqes Act. 1989. AND WHEREAS the Township of Oro became the Township of Oro-Medonte under Bill 51, An Act respecting the Restructuring of the County of Simcoe given Royal Assent in December 1993. AND WHEREAS Council of the Township of Oro-Medonte deems it appropriate to amend By-Law No. 91-91; NOW THEREFORE the Council of the Township of Oro-Medonte enacts as follows: 1. That section 17 shall be deleted and replaced with the following: 17. a) Subject to Section 4 of this By-law, where a residential redevelopment increases the number of dwelling units, a development charge shall only be payable for the increased number of uni ts attributable to the development. b) Further to section 17(a) in determining the increased units subj ect to a development charge, the existing dwelling unit shall be the maximum number of dwelling units in the building or structure that existed within the three years preceding an application for a building permit in respect of the increased dwelling units. c) Further to section 17(b) an owner(s) who has secured the necessary approvals may demolish and replace existing dwelling units and not be subject to a development charge under this By-law in respect of the dwelling units replaced. 2. That section 21 shall be deleted and replaced with the following: 21. That the non-residential portion of the development charge fee shall not come into place nor take effect during the term of this by-law. 3. That this By-law shall come into force and take effect on its final passing thereof. BY-LAW READ A FIRST AND SECOND TIME THIS 3rd DAY OF April, 1996.
