1996-047 - I THE CORPORATION OF THE TOWNSHIP OF ORO-MEDONTE BY-LAW NO. 96- 47 A By-law to Rezone East Half of Lot 1, Concession 8, Township of Oro-Medonte (formerly Township of Oro), county of Simcoe. WHEREAS zoning By-law No. 1031 was enacted to regulate the use of land and the character, location and use of buildings and structures within the Township of Oro; AND WHEREAS the Council of the Corporation of the Township of Oro- Medonte deems it appropriate to further amend By-law No. 1031, as amended; AND WHEREAS By-law 1031, as amended, must be further amended to implement Amendment No. 74 to the Official Plan of the Township of Oro Planning Area, as now administered by the Township of Oro- Medonte; AND WHEREAS authority is granted pursuant to section 34 of the Planning Act, R.S.D., 1990 c. P. 13, to the Council of the Corporation of the Township of Oro-Medonte to exercise such powers. NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF ORO-HEDONTE ENACTS AS FOLLOWS: 1. Schedule "F", Map 2 to By-law 1031, as amended, of the former Township of Oro, is hereby further amended by rezoning the areas as shown on Schedule "A" attached hereto and Schedule "A" attached hereto forms part of this By-law. 2. section 6.2.3 of By-law 1031 of the former Township of Oro, Rural (RU) Zone Exceptions, is hereby amended by adding the following subsection after subsection 2: "3. East Half of Lot 1. Concession 8 Notwithstanding the uses permitted in section 6.2.1 of this By-law, on the lands within the area zoned "RU-3" in the East Half of Lot 1, Concession 8, former Township of Oro, no building or structure requiring sewage disposal facilities will be permitted unless the Health Unit, or other agency having jurisdiction, approves such facilities on the basis that, upon buildout of the facilities in the adjacent area zoned Cl-3, the maximum nitrate loading criteria of the Reasonable Use policy, or other applicable policy or guideline, will not be exceeded." 3. section 9.2.4 of By-law 1031 of the former Township of Oro, General Commercial (C1) Zone Exceptions, is hereby further amended by adding the following subsection after subsection 2: "3. East Half of Lot 1. Concession 8 Notwithstanding the provisions of subsections 9.1.3, 9.2.1, and 9.2.2 of this by-law, the following shall apply with regard to the area zoned "Cl-3" in the East Half of Lot 1, Concession 8, former Township of Oro. (a) Permitted Uses clinic professional office associated with the health related field pharmacy/drugstore security office or police office secondary residential use accessory use, building, or structure, including a private garage and facilities for the sheltering of vehicles associated with a police and/or security office (b) Zone provisions In addition to the provisions of subsection 9.2.2 of this by-law, the following provisions shall apply. (i) The maximum combined floor area for all main buildings, excluding a secondary residential use and a security office or police office, shall be 750 square metres (8073 square feet). (ii) The pharmacy/drugstore shall be located within the same building as a clinic and its floor area shall not exceed 25 per cent of the bui lding , s floor area." (c) Secondary Residential Use provisions (i) A secondary residential use may be permitted as either a dwelling located within any building whose principal use is other than that of a dwelling, or a single family dwelling. (ii) If a secondary residential use is located within a non-residential building, the provisions of subsection 9.1.3 of this by-law shall apply. . (iii)If a secondary residential use is a single family dwelling, such dwelling shall have a minimum floor area of 100 square metres (1076.4 square feet) and the provisions of subsection 9.2.2 of this by-law shall apply." 4. This By-law shall take effect and shall come into force pursuant to the provisions of and regulations made under the Planning Act. BY-LAW READ A FIRST AND SECOND TIME, THIS 15th DAY OF HAY, 1996.
