TAKE NOTICE that the Council of the Corporation of the Township of Oro - Medonte will hold a Public
Meeting on Wednesday, March 20`h, 2013, at 7:30 p.m. in the Municipal Council Chambers. The purpose
of the Public Meeting is to obtain public comments on a proposed amendment to the Zoning By -law and a
Draft Plan of Subdivision, under Sections 34 and 51 of the Planning Act, R.S.O. 1990 c. P. 13.
THE PURPOSE of Application 2012 - ZBA -14 is to consider a proposal to amend the Zoning By -law for
the lands proposed to be developed for the 18 lot residential subdivision. The applicant has applied to
rezone the lands from Agricultural /Rural Exception 15 (A/RU "15) and Agricultural /Rural (A/RU) to
Residential One (R1) and Open Space (OS) Zones.
THE PURPOSE of Application 2012 - SUB -03 is to consider a proposal for a Draft Plan of Subdivision
comprised of 18 residential lots that have frontage and access on a new proposed cul -de -sac. The lots
are proposed to have a minimum frontage of 30 metres and a minimum lot area of 0.2 hectares.
THE SUBJECT LANDS, and applicable portions thereof, for Applications 2012 - ZBA -14 and 2012 -SUB-
03 being the lands described as Part of Lot 24, Concession 8 (within the former Township of Oro),
located east of, and fronting onto, Line 7 South, north of the Ridge Road.
A KEY MAP illustrating the location of the subject lands, and portions thereof to which applications 2012 -
ZBA-14 and 2012- SUB -03 respectively apply, is provided on the opposite side of this Notice, in addition to
a map showing the proposed Draft Plan of Subdivision.
ANY PERSON may attend the public meeting and/or make written or verbal representation either in
support of or in opposition to the proposed Applications. If a person or public body that files an appeal of a
decision of the Township of Oro - Medonte in respect of the proposed Applications does not make oral
submission at the public meeting or make written submissions to the Township before the proposed
Amendment is adopted, the Ontario Municipal Board may dismiss all or part of the appeal.
If you wish to be notified of the decision of the Township of Oro - Medonte in respect to the proposed Zoning
By -law Amendment and /or Draft Plan of Subdivision Applications, you must make a written request to the

Based on our review, we recommend that any draft approval of this plan of subdivision
and adoption of the zoning by -law amendment be deferred until the following has been
achieved:
✓ The Functional Servicing and Stormwater Management Report (FSSMR) has
been prepared to the satisfaction of the LSRCA and Township.
We note, based on a preliminary review of the FSSMR, that a water balance and
phosphorus budget has not been provided in accordance with the designated policies of
the Lake Simcoe Protection Plan (4.8 -DP). By copy of this letter, we are advising the
developer's planning consultant of these study requirements.

have completed an initial review of the documentation provided for the proposed subdivision on Conc 8, Pt Lot 24,
Township of Oro - Medonte and have the following comments:
For Storm water management proposed at the site — a Ministry of the Environment Section 53, Sewage Works
Environmental Compliance Approval is required.
As well, in the report by Innovative Planning Solutions titled "Planning Justification Report— 1160895 Ontario Limited"
Page 10 outlines the site and the minor portion of the lands located within the regulated limits of Lake Simcoe Protection
Plan. It appears that a sewage works (storm water management pond) will also be located in this area with a discharge
point in and /or near the regulated area. Should any part of the sewage works be captured within the regulated area; a
water resources impact assessment shall be completed with the Lake Simcoe Protection Plan and associated policies
taken into consideration.

I have been notified of a draft plan of subdivision for 18 lots on a small piece of farmland near
Ridge Road E in Oro Station. The proponent is 1160895 Ont Ltd., the location is part Lot 24,
Con 8 and Application # is 2012 ZBA -14 . We were notified that this subdivision may include 4
lots with septic beds and undisclosed pretreatment systems located within 100m of the Oro
Station Community well at Con 7 and Summerset Drive. Has this been assessed to meet our
wellhead protection areas? I believe this would be called Canterbury well supply.
As well, I was advised that the proposed septic bed at lot 14 is approximately 11 m from a
drilled well. Can you provide the details on this subdivision?
It also appears that this development need to comply with the Lake Simcoe storm water
management requirements of "no net P increase "; as well, will have to go through the Class EA
and approvals process.
If you are providing the info after Monday — please forward it to Greg Athron
(Greg.Athron @ontario.ca) and Chris Hyde (Chris.Hyde @ontario.ca) from our office as I will be
away from the Office for a month starting Monday.

Thank you for circulating the above -noted proposed draft plan of subdivision in Oro Station (1160895 Ontario Limited).
I am requesting additional time to allow the County's Transportation and Engineering department to review the Traffic
Impact Assessment information as it pertains to County Road 20.
I have also had a preliminary review of the proposed application and wonder if an Official Plan Amendment would be
required for Block 19, as stormwater management ponds for residential use should likely be within the settlement
boundary and not within an Agricultural designation. This may warrant further discussion.

regarding proposed Amendment to the Zoning By -Law and the Draft
Plan of Subdivision 2012 - ZBA -14, Oro Medonte Township, March 20,
2013
I have resided at 50 Ridge Road East, adjacent to the proponent's properly for 30 years
and I have a number of concerns related to the above noted proposed Amendment to
Zoning By -Law and Draft Plan of Subdivision.
The proponent has refused to provide us copies of reports related to the proposal
(Planning Justification Report, Functional Servicing and Storm Water Management
Report) so we could properly prepare for this Public Meeting. I believe this shows a
lack of good faith when dealing with the public and lack of transparency with the public
about the proposed development. This has hindered our ability to be properly prepared
for this Public Meeting.
My lawyer recently advised me to request that the Chairman of this Public Meeting
adjourn the meeting until such time that the proponent, who I understand to be "The
Premium Group" from Toronto, provides me with copies of the two reports requested on
March 6, 2013 through the Township of Oro. My lawyer also advised that I should file
an immediate appeal if I made the request for adjournment and it was not granted.
Allowing me to see the documents at the office, without having a copy, makes it
impossible for me to seek advice on the matter. If it is true that the Township does
require consent to release these reports the proponent should be aware that refusal to
give the appropriate consent can only delay the process. I would think it is likely the
reports would be made available in the usual disclosure process preliminary to an OMB
hearing, so why not make them available now?
I believe the Draft Plan of Subdivision proposal is poorly planned and contrary to many
sections of the Official Plan (OP) for Oro - Medonte and should not be approved by the
Township of Oro - Medonte.
A. The proposed development contravenes the "Community Vision" of the OP which is
"Environment First ", with protection for natural heritage systems while managing growth;
to support and emphasize unique character, rural lifestyle and heritage features and to
have a positive impact on quality of life.
B. Section A2.2 of the Oro - Medonte OP calls for maintaining and enhancing the
existing ground water resources in quality and quantity. In my opinion the Draft Plan of
Subdivision fails to have regard for this section of the OP.
Water from the community well will be used to service 18 new homes. The possible
interference with other local wells was evaluated based largely on a 30 year old report
by Snider Well Drilling part of which is hand written.

No on -site testing of any type was observed on the subject property to determine the
capability of the area to support 18 new septic systems which will require some form of
pre- treatment to be accommodated on the numerous small building lots (i.e. possibly
high maintenance aerobic systems ?) . The developer failed to disclose the type of pre-
treatment system that would be used in their reports and based their conclusions largely
on geological mapping reviews, well record reviews, and a review of the "South Simcoe
Groundwater Study ".
The proponent has had no regard for pending legislation under the Clean Water Act,
and has 4 septic systems (lots 1,2,18,19) located within 100 metres (m) of the
"Wellhead Protection Area" intended to protect the water taken from the Oro Station
community well. In addition, the locations of these septic systems may contravene
section B1.6.5 of the Oro - Medonte OP that deals with "Wellhead Protection". Regardless
of whether the new Provincial Legislation is passed or not the Township should have
regard for it.
Our barn is located 0.58 (m) from our rear lot line, our drilled well is located 2.33 m from
our rear lot line and the closest part of our house is 5.79 m (19 feet) from our rear lot
line (see attached survey plan).
The proponent's Functional Servicing and Storm Water Management Plan Mapping
shows a septic bed on proposed lot 13 that is 4 m from our barn and 11.6 m from our
well. Depending on the location of the distribution pipe within the bed, this septic bed
may violate Section 8 of the Ontario Building Code. In addition a drainage swale is
located in the 3 m that are left between the septic bed on lot 13 and our rear lot line.
C. Section A.2.4 of the Oro - Medonte OP calls for the preservation of areas showing a
high capacity for agricultural production.
I have lived adjacent to the subject property for 30 years and there has been no year
when the land was not under agricultural production. The proposed Plan of Subdivision
has no regard for this section of the OP or the section related to the Strategic Objectives
for protecting agricultural lands.
The storm water pond that collects storm water from the north half of the development is
located outside the "Settlement Area ", on agricultural land rather than being located
within the development itself which is contrary to this section of the OP as well.
D. The goal of the Oro - Medonte OP as stated in Section A.2.5 is to protect, maintain
and enhance the natural, agricultural and open space rural character of the area. The
proponent's plan has had no regard for this section of the OP.
A treed vegetative buffer occurs along the rear lot lines of the subject property from
proposed lots 11 -15 (see attached aerial photo).

The treed vegetative buffer behind our house is about 14 metres deep and most of the
buffer is on the subject property. In the past, we have tried to purchase this property to
protect our privacy and the rural and heritage character of the area, but we were denied
the opportunity to purchase this buffer by the previous owner.
The Functional Servicing and Storm Water Management Plan mapping shows the
complete removal of the vegetative buffer on their property from lots 11, 12,13,14,15 to
accommodate a drainage swale and septic beds. Removal of this treed vegetative
buffer behind our house will diminish the rural character of the area.
Removal of the trees on the subject property and the creation of the swale on the lot line
may also adversely affect the health our remaining trees and make them more prone to
wind damage and may result in damage to our home and neighboring properties.
Three of the houses most affected by the removal of this treed vegetative buffer and the
placement of new modern homes are part of the heritage landscape of Oro Station and
have scenic interest and architectural value. Francis Bell, an original settler in Oro, built
one of these homes in 1880 (Robert MacGregor personal communications March
2013). Francis Bell was reported to own all of Lot 24 , Concession 8 in Oro Township
as early as 1872 -3 (Gazetteer and Directory of the County of Simcoe 1872 -3, Eastern
Georgian Bay Historical Society, 1985). The next adjacent home was built by a Bell
descendant (Kith N Kin, J McEwen, 1978) around 1900, and our home, which was built
in 1901, was believed to have originally been built by a Bell descendant as well and
later occupied by the Miller family.
Removal of the treed vegetative buffer and placement of new modern houses behind
these three homes of historic interest is also contrary to Section D3.2.1 of the OP, which
requires that "all new development should occur in a manner which respects the
municipality's physical heritage which includes architectural value, heritage landscape
and village and urban areas of historic and scenic interest ".
E. Section D3.2.5 of the Oro - Medonte OP requires the municipality to preserve or
rescue from excavation, significant archeological resources. The proponent has had no
regard for this section of the OP.
There are 68 known Huron Village Sites in the former Township of Oro, as documented
by Andrew F. Hunter in 1903 (Notes on The Huron Villages in the Township Of Oro)
(see attached note by Hunter). Part of Lot 24, Con 8, the same lot and concession as
the proponent's development is a known Huron Village Site noted as Site 65 by Andrew
Hunter (see attached map by Hunter).
Hunter reports that Richard Bell found the "usual relics" (associated with a village) and a
human skull when he dug the basement for his house on the east half of Lot 24,Con 8.
The Bell property is located directly adjacent to proposed lots 10 and 11. In a History of

Simcoe County(1998 ) by Hunter, he reports Huron Villages can range in size from two
or three lodges to extensive hamlets that cover an area over 15 acres in size.
More recent studies by Wilfred Laurier University have shown that Huron Villages can
be even larger in Simcoe County and their studies of the Warminister Huron Village site
revealed 72 long houses, and there are other village sites in the County with around 100
long houses (J. Hunter, Director of the Huronia Museum, personal communications
March 2013).
The book entitled the "History of Oro" (J.McEwen, 1978) also makes reference to the
archeological significance of the area around Oro Station. Page 1 of the book has a
map showing an Indian Trail along Ridge Road from Shanty Bay to Hawkestone (see
attached).
On page 299, of "The History of Oro" (J.McEwen 1978) notes "there must have been
Indian encampments around Oro Station because farmers have dug up various Indian
tools, such as skinning knives, leather pouches of sharpened stones and a stone
tomahawk" (see attached).
As a result of this historical and more recent information an Archeological Impact
Assessment for the proponent's property is required under Section D.3.2.5 of the OP.
Consideration should also be given to Federal and Provincial Policies that outlines
protocols to follow with First Nation groups before dealing with known native sites.
F. Section A.1.2 (Environmental Protected One) of the Oro- Medonte OP provides
protection for significant portions of habitat of Endangered and Threatened Species.
Ontario Regulation 242/08 under the Endangered Species Act 2007 administered by the
Ontario Ministry of Natural Resources also provides protection for individual species
defined as Endangered under the Act.
I believe there are over 30 Butternut trees on or near the proponent's property, all of
which require assessment by a qualified Butternut Health Assessor pursuant to Ontario
Regulation 242/08 (see attached areal photo).
I believe trees requiring assessment are growing on or in close proximity to the southern
portion of proposed lots 10, 11, 12, 13, 14, 15, 17, and 18.
The south west corner of proposed lot 18 has a mature Butternut tree with a blue
flagging tape that notes "HYDRO ONE BUTTERNUT DO NOT CUT ". The proponent
has had no regard for any possible retainable Endangered Butternut trees on their
property.
The mapping found in the "Functional Servicing and Strom Water Management Plan"
shows a storm water swale located where I believe many of these Butternut trees are
currently located.

The municipality has reasonable grounds to require the proponent to conduct an
Environmental Impact Study of the subject property and should do so under Section
B.5.1.1. of the Oro - Medonte OP.
G. Section E1.9 of the Oro - Medonte OP provides for the removal of older draft plan
approval for residential subdivisions from the OP under certain circumstances if the plan
lapses. These includes developments that are not appropriate for development today
because they impact the rural character of area and the Natural Heritage System the
plan is trying to protect today.
On March 15, 2013 1 submitted a formal Municipal Freedom of Information Act request
to Oro - Medonte Township to obtain all "records" relating the establishment of the Oro
Station "Settlement Area ". Previous to that, planning staff were unable to provide any
information, historical or otherwise, that outlined the logic, rationale, criteria or the
timeline related to the establishment of this "Settlement Area ". I was not aware that this
area was in the "Settlement Area ". I was assured by Township Planning Staff before I
purchased our property in 1983, and more recently before we built a house addition that
the proponent's property was zoned Agricultural and could not be developed.
I am further requesting that the Municipality provide me with an additional opportunity to
comment on the Draft Plan Of Subdivision after they have fulfilled my Municipal
Freedom of Information Act request and provided a reasonable time for what ever
records are produced to be reviewed by myself or my agents.
The "Settlement Area" status of the property should be re- evaluated pursuant to the
results of an Environmental Impact Study, an Archeological Impact Assessment and a
review of sections of the current OP that speak to maintaining and enhancing the rural
character, high agricultural production, and Natural Heritage Systems within the
Municipality.
The principle for possibly removing this area from the Oro Station" Settlement Area"
flows from the intent of Section E.1.9 of the OP.
H. Additional Concerns:
The proponent's agricultural field is tile- drained with at least one row of old yellow clay
field tile that enters our property and continues down -hill, towards Ridge Road. There
may be more field tiles entering our property or adjacent properties along Ridge Road.
The one tile we found on our property was severed by a septic contractor when we
installed a new septic system in the fall of 2007. During the spring of 2008 our
basement flooded for the first time in 25 years. We had never needed a sump pump
during that time but were forced to install one in a small existing sump hole. The pump
ran constantly until late May or early June of that year.

During late June 2008, we encountered the same old yellow clay field the when we
added an addition to our house (see attached photo #).
We were reluctant to cut this field tile on our property and possibly saturate the ground
adjacent to our old house which only has a crawl space under our kitchen and no
weeping tile around the foundation.
To remedy the problem, we allowed the old clay field the to outfall into the new weeping
the installed around the footing of our house addition.
If any other activity other than agricultural use is to occur on the proponent's property,
they will need to properly locate and decommission all field drainage tiles well before
they leave their property to prevent our house weeping tile from being silted in or
otherwise contaminated by their activities.
Summary
We are opposed to the re- zoning of the proponents property from Agricultural /Rural
Exception 15 (A/RU *15) and Agricultural Rural (A/RU) to Residential One (R1) and
Open Space (OS) Zones . We are also opposed to the related Draft Plan of Subdivision
for the property.
The Draft Plan of Subdivision is poorly planned and contravenes many sections of the
Oro - Medonte OP and does not have regard for Natural Heritage Systems , Endangered
Species, ground water resources and agricultural values . It also does not have regard
for the unique character, rural lifestyle, archeological features, scenic interest or
heritage landscape of the village of Oro Station.
I respectfully request for continued communications from the Township regarding any
developments on the proposed By -Law Amendment and the Draft Plan of Subdivision.
