1996-093 To Rezone Part of Lots 21 & 22, Conc 8, Township of Oro-Medonte (formerly Township of Oro), County of Simcoe , THE CORPORATION OF THE TOWNSHIP OF ORO-MEDONTE BY-LAW NO. 96-93 A By-law to Rezone Part of Lots 21 and 22, Concession 8, Township of Oro-Medonte (formerly Township of Oro), County of Simcoe. WHEREAS Zoning By-law No. 1031 was enacted to regulate the use of land and the character, location and use of buildings and structures within the Township of Oro; AND WHEREAS the Council of the Corporation of the Township of Oro- Medonte deems it appropriate to further amend By-law No. 1031, as amended; AND WHEREAS this By-law is in conformity with the Official Plan of the Township of Oro; AND WHEREAS authority is granted pursuant to Section 34 of the Planning Act, R.S.O., 1990 c. P. 13, to the Council of the corporation of the Township of Oro-Medonte to exercise such powers. NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF ORO-MEDONTE ENACTS AS FOLLOWS: 1. Section 6.1.3.2 Exceptions of By-law 1031 for the Township of Oro as amended, is deleted in its entirety and replaced with the following: ".2 Burl Creek Familv Event Park - Part of Lots 21 and 22. Concession VIII Agricultural Exception (A-2) Notwithstanding the permitted uses of section 6.1.1 of this By-law as they apply to the Agricultural (A) zone on Part of Lots 21 and 22, Concession VIII, and shown on Schedule "A" attached as A-2, the following uses shall also be permitted: (a) Temporary Events including: i) an agricultural fair ii) antique show iii) automotive flea market iv) a boat show v) a craft and hobby show vi) a country festival vii) a vehicle show and sales viii)a highland games. (b) Accessory Uses to a Temporary Event 'including: i) ii) concession booths of a non-permanent construction temporary occupancy of a campground, mobile home, or recreational vehicle located on site not longer than the temporary event pa~king for the temporary event. iii) For the purposes of this by-law, a temporary event shall not include a rock festival or heavy metal music performances. A temporary event shall not run for more than nine (9) consecutive days and each temporary event shall be followed by three (3) consecutive days where no temporary event shall take place. Temporary events in anyone year (365 days) shall not run for more than 100 days in aggregate. ~ The lands located on Part Lot 22, Concession VIII, south of the Burl Creek Family Event Park and known as the Barrie Speedway may be used for parking accessory to a temporary event through the duration of the event. No permanent buildings or structures for a temporary event shall be erected on the said lands." 2. section 13 Definitions of By-law 1031 for the Township of Oro is hereby amended by adding the following: a) 13.3 Agricultural Fair after 13.2 Accessorv Use, renumber the successive subsections accordingly and define Agricultural Fair as follows: "13.3 Agricultural Fair (a) means an event sponsored by a canine, equestrian or similar organization for the purposes of: i ) exhibiting animals and/ or birds, a rodeo or ploughing match ii) and which may include an assembly of vendors offering items for sale to the pUblic which is associated with such an event." b) 13.6 Antique Show after 13.5 Animal Hospital, renumber the successive subsections accordingly and def ine Antique Show as follows: "13.6 Antique Show (a) means an assembly of vendors offering antique objects, other than motor vehicles, for sale to the public." c) 13. 7 Automotive Flea Market after 13.6 Antique Show, renumber the successive subsections accordingly and define Automotive Flea Market as follows: "13.7 Automotive Flea Market (a) means a retail sales area held in an open area in which groups of individual vendors offer goods for sale to the public. Goods offered for sale shall be comprised primarily of automotive trucks or similar vehicles, automobile parts, automobile accessories, recreational vehicles and equipment and collectibles. No long term leases between the vendors and operators are permitted and the vendors use their own vehicles or set up temporary structures for their wares." d) 13.38 Hiqhland Games after 13.37 Heiqht, renumber the successive subsections accordingly and define Highland Games as follows: "13.38 Hiahland Games (a) means Cl..... Scottish cultural event whereby ethn.ic sporting events, parades, ethnic dancing, an agricultural fair and the selling of food can occur. Music concerts are not permitted." ,. e) 13.85 Temporary Event after 13.84 street Line, renumber the successive subsections accordingly and define Temporary Event as follows: "13.85 Temporary Event (a) means events of limited duration organized by community, service, cultural, religious, family, corporate, political, ethnic or other similar organizations or the owner of the lands on which the event is occurring, excluding an event held by a group promoting religious or racial hatred." f) 13.88 Vehicle Show after 13.87 Use, renumber the successive subsections accordingly and define Vehicle Show as follows: "13.88 Vehicle Show (a) means an assembly of vendors offering automobiles and other recreational vehicles for display and sale." 2. Schedule "A" attached forms part of this by-law. 3. This By-law shall take effect and come into force pursuant to the provisions of and regulations made under the Planning Act, R.S.O., 1990 c. P. 13.
