That, notwithstanding Sections 5.1.3 a) 5.1.4, and 5.1.6 of Zoning By-law 97-95, as amended, the detached accessory building shall otherwise comply with all other applicable provisions of the Zoning By-law; 2. BACKGROUND The, 2005 (“AODA”) was passed with the Accessibility for Ontarians with Disabilities Act purpose of developing, implementing and enforcing accessibility standards in order to achieve accessibility for all persons with disabilities with respect to goods, services, facilities, accommodations, employment, buildings structures and premises. The purpose of this Accessibility Policy to is to develop, implement and maintain policies which govern how the municipality will achieve accessibility measures as required through the AODA. 2. DEFINITIONS “Disability” shall mean: (a) any degree of physical disability, infirmity, malformation or disfigurement that is caused by bodily injury, birth defect or illness and, without limiting the generality of the foregoing, includes diabetes mellitus, epilepsy, a brain injury, any degree of paralysis, amputation, lack of physical co-ordination, blindness or visual impediment, deafness or hearing impediment, muteness or speech impediment, or physical r dog or other animal or on a wheelchair or other remedial appliance or device; (b) a condition of mental impairment or a developmental disability; (c) a learning disability, or a dysfunction in one or more of the processes involved in understanding or using symbols or spoken language; (d) a mental disorder; or (e) an injury or disability for which benefits were claimed or received under the insurance plan established under the . STATEMENT The Township of Oro-Medonte shall use reasonable efforts to ensure that its policies and procedures are consistent with the following principles: Goods and services will be provided in a manner that respects the dignity and independence of persons with disabilities; The provision of goods and services to persons with disabilities, and others, will be integrated unless an alternate measure is necessary, whether temporarily or on a permanent basis, to enable a person with a disability to obtain, use or benefit from the goods and services; Persons with disabilities will be given an opportunity equal to that given to others to obtain, use and benefit from the goods and services; Persons with disabilities may use assistive devices and/or support persons in accessing goods and services; Communication with a person with a disability shall be done in a manner that takes into account the person’s disability. 4. GENERAL Through the Accessibility Policy, the Township will develop, implement and maintain policies which govern how the municipality will achieve accessibility measures as required through the AODA. The Township is committed to meeting the accessibility needs of persons with a disability in a timely manner. i. Accessibility Plans The Township will establish, implement, maintain and document a multi-year Accessibility Plan. The Plan will outline the Township’s strategy to prevent and remove barriers and meet its requirements under the AODA. The Plan will be reviewed by the Township’s Accessibility Adviso approved by Council at least once every five years. Members of the public, including those who have a disability, are encouraged to provide input into the development of the Plan. An Annual Status Report will be created which will identify the progress of the measures taken to implement the Plan. The Report will be presented to the AAC and Council. The complete Accessibility Plan and Annual Status Report will be available to the public through the municipal website and at the Township Administration Building. Upon request, the Plan and Status Report can be presented in accessible formats. ii. Procuring or Acquiring Goods, Services or Facilities The Township is committed to accessibility principles and is taking steps to improve accessibility within the Township in accordance with the AODA. Training The Township is committed to ensuring training is provided on the accessibility standards to all employees, volunteers, persons who participate in the developing of Township policies, and all other persons who provide goods and services on behalf of the municipality. Every person will be trained as soon as practicable. Training will also be provided in respect to changes in the Policy on an ongoing basis. Records of the training will be maintained – including dates and names of individuals trained. 5. INFORMATION AND COMMUNICATION i. Feedback The Township will ensure that feedback processes are accessible to persons with disabilities by providing or arranging for the provisions of accessible communications and support, upon request. Feedback can be received online, through writing or verbally. ii. Accessible Formats and Communication Support Upon request, the Township will provide or arrange for the provision of accessible formats and communication supports for persons with a disability. The formats will be provided in a timely manner and take into account the person’s disability. There will be no additional cost charged to the person to provide information in an accessible format. The Township will consult with the person making the request to determine the suitability of an accessible format or communication support. Final determination as to which accessible format or communication support used rests with the Township. The Township will notify the public about the availability of accessible formats and communication supports through the municipal website and through a posting at the Township Administration Building. iii. Emergency Procedure, Plans or Public Safety Information The Township has in place several different emergency procedures, plans and public safety information bulletins. Upon request, public information regarding the Township’s emergency procedures, plans or public safety information bulletins will be provided in an accessible format. Accessible Websites and Web Content The Township will ensure the official municipal website and web content conforms to the World Wide Consortium Web Content Accessibility Guidelines (WCAG). Except where meeting this requirement is not practicable, this conformity applies to websites, web content and web-based application that are controlled directly or through a contractual relationship that allows for the modification of the product and to web content. 6. EMPLOYMENT STANDARDS Employment standards apply to paid employees – not volunteers and other non-paid individuals. These standards are documented in detail in the municipality’s Human Resource Policy Manual. The Township of Oro-Medonte routinely attends to emergencies that require firefighting, policing, ambulance and transportation and environmental services related response through our own resources or those provided by other levels of government. Large scale emergencies (such as chemical spills, plane crashes and natural emergencies — tornadoes, floods, etc.) can severely deplete available resources, requiring additional personnel, equipment and expertise. In cases such as these, this Emergency Plan may be implemented. Response to a major emergency requires an assessment of the incident, effective determination of resources and efficient deployment of those resources. The primary role of government in an emergency is to provide the organizational framework within which the coordinated response will take place, thereby reducing the impact of the incident on the citizens of the municipality, and returning to a state of normalcy as soon as possible. This Plan outlines the roles and responsibilities of the Township of Oro-Medonte, as well as other response agencies at the Township, Provincial and Private Sector levels. Emergencies are defined as situations or impending situations caused by forces of nature, accident or an intentional act that constitutes a danger of major proportions to life and property. They affect public safety, meaning the health, welfare and property, as well as the environment and economic health of The Township of Oro-Medonte. The Township of Oro-Medonte, situated in southern Ontario to the southeast of Georgian Bay and bordering Lake Simcoe, has a population of 21,000. The municipality is located on major road and rail corridors and is home to a developing regional airport. Due to the proximity to dangerous goods transport routes and geographic location, the municipality has the potential for a great diversity of major emergencies. The municipality has established a committee for emergency planning and response. The committee comprises senior officials, department heads and representatives of selected agencies from throughout the Township of Oro- Medonte, The County of Simcoe and the Province of Ontario. The Aim of the Oro-Medonte Township Emergency Plan is to provide for the extraordinary arrangements and measures that may have to be taken to protect the health, safety and welfare of the inhabitants of the Township of Oro-Medonte when faced with an emergency. The Plan is also intended to increase the emergency response capability of the Township of Oro-Medonte by establishing a plan of action to efficiently deploy available emergency services. From The Act: 'An emergency plan' formulated under section 3, 6 or 8 of the Emergency Management Act shall: (a) In the case of a municipality, authorize employees of the municipality or, (b) In the case of a plan formulated under section 6 or 8, shall authorize Crown employees to take action under the Emergency Plan where an emergency exists, but has not yet been declared to exist. 4.1 Actions of the Township Employees When an emergency exists but has not yet declared to exist, Township employees may take such actions under this emergency response plan as may be required to protect property and the health, safety and welfare of the inhabitants of the Township of Oro-Medonte. 4.2 Control Group Notification Process Upon receipt of a warning of a potential emergency, the responding Township of Oro-Medonte department will immediately contact the Township Community Emergency Management Coordinator (CEMC) to request that the notification system be activated Upon notification of an emergency, the CEMC will notify all members of the Township of Oro-Medonte Emergency Community Control Group (CCG) Where a threat of an impending emergency exists, the CEMC will contact the Mayor and the CAO for advice. The Mayor or CAO will decide w convene the CCG or place the group on standby. The request shall not be deemed to be a request that the County of Simcoe assume authority and control over the emergency situation. 4.4 Request for Assistance from the Province of Ontario The Mayor, Emergency Operations Centre Director, or the CEMC may request assistance from the Province of Ontario at any time without any loss of control or authority by contacting Emergency Management Ontario (EMO). EMO Provincial Emergency Operations Centre Emergency Management Ontario staffs the Provincial Emergency Ope Centre (PEOC) on a 24/7 basis. The Township of Oro-Medonte should report emergencies to the Provincial Emergency Operational Centre (PEOC) Duty Officer. Contact information can be found in APPENDIX A. When the Township declares an emergency, it must notify Emergency Management Ontario immediately and fax a copy of the emergency declaration as soon as possible. Theauthorizes the Mayor of Emergency Management and Civil Protection Act the Township of Oro-Medonte, as the Head of Council, to declare that a Township emergency exists. The decision to declare an emergency in all or in part of the Township will be made in consultation with the Township of Oro-Medonte Emergency Community Control Group (CCG). The Declaration of Emergency Form can be found in APPENDIX D. The location of each EOC is confidential and accessible only to authorized individuals to maintain the safety and security of the EOC for the CCG members. The EOC affords the CCG the ability to meet and to coordinate an effective response to mitigate the impacts of the emergency. The EOC is self- contained and stocked with provisions to support the work of the CCG for 72 hours. The positions in the CCG will be filled by staff based on skill, experience and knowledge. These staff will be trained to carry out the specific responsibilities of their assigned position, as described in Section 11.0. Members of the Township of Oro-Medonte Emergency Community Control Group (CCG) are responsible for the following actions or decisio The primary responsibility of the Township of Oro-Medonte Emergency Community Control Group (CCG) is to implement the Emergency Response Plan during an emergency and to provide advice and assistance to the Mayor or Designate in carrying out his/her duties under the Emergency Response Plan. The CCG will coordinate the acquisition of additional resources requested. Decisions to ration resources if required will be made by the CCG and will be based on a priority of need. Equipment assigned to the municipality will be under the control of the municipal site manager and/or the municipal EOC. Actions and decisions normally undertaken by the CCG may include, but are not limited to: Acquiring and assessing information to determine status of the situation. 1. Coordinating emergency service, agencies and equipment, as required or 2. requested by area municipalities. Coordinating services to ensure that necessary actions are taken 3. mitigation of the effects of the emergency provided they are not contrary to law. The CCG appoints the ESM, who is usually a senior staff member from the Oro-Medonte. Upon implementation of the Township of Oro-Medonte Emergency Response Plan, it will be important to ensure that communications are established between the emergency site and the municipal EOC. The primary methods of communication from the municipal EOC, in order of preference shall be: Landline and cellular phones Internet (e.g. Whiteboard application and e-mail) Ham radio Instructions for operating these methods of communication are available in the document: in APPENDIX I. Upon implementation of the Township of Oro-Medonte Emergency Response Plan, it will be important to coordinate the release of accurate information to the news media, issue authoritative instructions to the public and respond to or redirect individual requests for information concerning any aspect of the emergency. In order to fulfill these functions during an emergency, the following positions will be established: Emergency Information Officer Community Spokesperson Public Inquiry Supervisor For more information about the Township of Oro-Medonte Emergency Communications Plan see APPENDIX F. The Township of Oro-Medonte Media Centre will be located at the Old Town Hall. In the event that this location is not appropriate due to the nature of the emergency, an alternate location will be established. Depending on the nature of the emergency, it may be necessary to establish a media information area adjacent to the emergency sit will be decided by the CCG, in consultation with the local municipal Community Control Group. The site media information area will be staffed as determined by the Emergency Information Officer. Page 99 of 109 8b) A Bylaw to Adopt an Emergency Plan And to Repeal By... The role of the Emergency Information Officer is discussed in Section 11.4. The Township Community Spokesperson will be appointed by the CCG. This role will be fulfilled by the Head of Council or his/her designate. Responsibilities of the Community Spokesperson include: Giving media interviews on behalf of the Township of Oro-Medonte Council Redirecting all inquires about decisions made by the CCG, and about the emergency as a whole, to the Emergency Information Officer The Public Inquiry Supervisor acts on behalf of the Emergency Information Officer. Responsibilities of the Public Inquiry Supervisor include: Establishing a Public Inquiry Service, including the appointment of personnel to assist and designation of telephone lines Informing the Emergency Information Officer of the establishment of the above service and designated telephone numbers Responding to and redirecting inquires and reports from the public about the emergency based on information from the Emergency Information Officer Responding to and redirecting inquires pertaining to the investigation of the emergency, deaths, injuries or matters of personnel involved with or affected by the emergency to the Emergency Information Officer and appropriate emergency service Responding to and redirecting inquires pertaining to persons who may be located in evacuation and reception centres to the registration and inquiry telephone numbers Page 100 of 109 8b) A Bylaw to Adopt an Emergency Plan And to Repeal By... Theauthorizes Emergency Management and Civil Protection Act municipalities to enter into agreements wherein each party may provide assistance, in the form of personnel, services, equipment and ma upon to do so by a requesting Municipality in times of emergency. Mutual Assistance Agreement enable municipalities, in advance of an emergency, to set the terms and conditions of the assistance whi requested or provided. Municipalities requesting and providing assistance are therefore not required to negotiate the basic terms and conditions under stressful conditions any may request, offer and receive assistance according to predetermined and mutually agreeable relationships. Under certain circumstances and/or when the combined resources of the Township of Oro-Medonte are deemed insufficient to control the emergency, then the Head of Council may request assistance from the Premier of Ontario. The requesting of said services shall not be deemed to be a request that the Government of the Province of Ontario assume authority and control of the emergency. Such a request shall be made to the Ministry of Community Safety and Correctional Services, Emergency Management Ontario. Assistance may be requested from Emergency Management Ontario at any time. Emergency Management Ontario maintains a 24-hour duty roster and can coordinate assistance from a number of Provincial agencies and the Federal Government, including Military Aid to the Civil Authority. Page 101 of 109 8b) A Bylaw to Adopt an Emergency Plan And to Repeal By... When requested by the Township of Oro-Medonte, Emergency Management Ontario will send staff to the Township of Oro-Medonte to act as a provincial liaison and advice on provincial matters. ODRAP is intended to alleviate the hardship suffered by private homeowners, farmers, small business enterprises and non-profit organizations, whose essential property has been damaged in an unexpected natural disaster. ODR funds to those who have sustained heavy losses for essential items such as shelter and the necessities of life. ODRAP does not provide full cost recovery for all damages resulting from a disaster; it only helps eligible recipients restore essential furnishings and property to pre-disaster condition. ODRAP provides assistance when damages are so extensive that they exceed the financial resources of the affected individuals, the municipality and the community at large. This program does not cover damages of priva non-essential property, nor to essential property where private insurance is normally available. If the disaster is of such size and extent that damages are widespread, similar to that experienced during the 1998 Eastern Ontario ice storm, the Province of Ontario in conjunction with the Federal Government, may initiate the Disaster Financial Assistance Arrangements (DFAA). The Minister of Municipal Affairs and Housing is authorized to declare a disaster area for the purpose of the ODRAP program. The Council, when asking for assistance under the ODRAP program, must adopt a resolution outlining the following: The Township's request for disaster assistance and declaration i. Whether all or a specified portion of the Township is to be decl ii. "disaster area" The Province will contribute up to $2.00 for every local dollar raised by fundraising, to an amount necessary to settle all the eligible claims, up to 90 percent of all eligible costs. A copy of the ODRAP Plan can be found in ANNEX F. Upon the declaration of an Emergency by the Head of Council, Emergency Management Ontario will deploy a liaison team to the CCG to provide advice and assistance. Requests for personnel or resources from the Federal Government must be submitted through the Province of Ontario. Federal assistance will only be provided once the resources of the Township, County and the Province have been exhausted. Financial Assistance for natural disasters is available through the Federal Government's Disaster Financial Assistance Fund. This assistance initiated by the Province. Chief Administrative Officer The individual who is responsible for the administrative management of the Township of Oro-Medonte. Community Emergency Management Coordinator The individual accountable for the development, implementation and maintenance of the emergency management program. Community Spokesperson An individual appointed by the Township of Oro-Medonte Emergency Community Control Group who is responsible for giving interviews to the media about the emergency situation. Disaster Financial Assistance Application for assistance to the Ministry of Municipal Affairs and Housing by a municipality on behalf of its citizens following an emergency for funding to restore key infrastructure to pre-disaster condition. Includes the Ontario Disaster Relief Assistance Program (ODRAP) and Special Assistance Grants. Emergency A situation or impending situation that constitutes a danger of major proportions that could result in serious harm to persons or substantial damage to caused by forces of nature, a disease or other health risk, an accident or an act whether intentional or otherwise. Emergency Management Ontario A branch of the Ministry of Community Safety and Correctional Se Responsible for leading the coordination, development and implementation of emergency management programs in Ontario and partnering with municipalities to assist in their emergency management programs. Also referred to as EMO. Emergency Notification A fan-out procedure to notify the Township of Oro-Medonte Emergency Community Control Group of an emergency or impending emergency. Emergency Operations Centre The location from which the Township of Oro-Medonte Emergency Community Control Group operates. Referred to as the EOC. Emergency Operations Centre Director The individual in charge of the management of the incident. Authorized to delegate responsibility to other individuals. Emergency Response Plan A plan, which is formulated to meet the requirements of the Emergency Management and Civil Protection Act and which governs the position of necessary services during an emergency and the procedures and manner in which the Township of Oro-Medonte employees and other will respond to an emergency. Emergency Site Manager The person at the emergency site who is designated to communicate from the site to the Township of Oro-Medonte Emergency Community Control Group. Appointed by the Township of Oro-Medonte Emergency Community Control Group. Evacuation Centre A location used during an emergency to provide temporary refuge for evacuees and to provide a staging area for deployment of evacuees to an emergency shelter or reception area. Finance and Administration Section A group of individuals responsible for managing the financial costs and human resources concerns of the incident. In small scale emergencies, responsibilities of this section may be completed by one person. Head of Council The individual who presides over Township Council meetings. In the Township of Oro-Medonte, the Mayor is the Head of Council. Incident Action Plan An oral or written plan containing general objectives reflecting the strategy for managing a specific emergency. Liaison Officer The individual responsible for communications between the CCG and other agencies. Normally delegated to the Community Emergency Manageme Coordinator. Logistics Section A group of individuals responsible for facilitating effective and efficient incident management by ordering resources from off-incident locations to provide facilities, transportation, supplies, equipment maintenance, fuel, food services, communication and IT support, and medical services for emergency responders. Incident Management System A set of doctrines, concepts, principles, terminology and organizational processes to enable effective emergency management. Operations Section A group of individuals responsible for the reduction of the immediate hazard, saving lives and property, establishing situational control, and restoration of normal operations. Planning Section A group of individuals responsible for the collection, evaluation and dissemination of incident situation information and intelligence; maintaining the status of resources; preparing status reports; displaying situation information; and developing and documenting the Incident Action Plan. Public Inquiry Supervisor An individual who acts on the behalf of the Emergency Information Officer to establish a Public Inquiry Service and answer and redirect inquires about the situation. Reception Centre An area where people affected by an emergency may temporarily relocate or where information is available to assist individuals during the emergency. Township of Oro-Medonte Emergency Community Control Group The group of Township staff, critical agencies and individuals responsible for the coordination of emergency operations and providing the resources necessary to manage the incident.
