BY -LAW NO. 2012 -216
A By -law to Amend By -law No. 2004 -112,
Being a By -law to establish Purchasing and Tendering Procedures
For The Corporation of the Township of Oro - Medonte
WHEREAS Section 270 of the Municipal Act, 2001, S.O. 2001, c.25, as amended,
stipulates that a municipality shall adopt and maintain policies with respect to its
procurement of goods and services;
AND WHEREAS the Council of The Corporation of Oro - Medonte did enact By -law No.
2004 -112 on the 3rd day of November 2004;
AND WHEREAS pursuant to Motion No. CW091118 -11, Council deemed By -law No.
2004 -112 to have been reviewed as required in Section 18 therein, and determined that
By -law No. 2004 -112 would remain in force and effect without amendment;
AND WHEREAS Section 5 of Ontario Regulation 191111, Integrated Accessibility
Standards, pursuant to the Accessibility for Ontarians with Disabilities Act, 2005, states
that designated public sector organizations shall incorporate accessibility criteria and
features when procuring or acquiring goods, services or facilities, except where it is not
practicable to do so, and if a designated public sector organization determines that it is
not practicable to incorporate accessibility criteria and features when procuring or
acquiring goods, services or facilities, it shall provide, upon request, an explanation;
AND WHEREAS the Township of Oro - Medonte is required to comply with Section 5 of
Ontario Regulation 191111, Integrated Accessibility Standards, by January 1, 2013;
NOW THEREFORE the Council of the Township of Oro - Medonte hereby enacts as
follows:
That By -law No. 2004 -112 is hereby amended by the addition of:
"21. Accessiblitv
a) When procuring goods, services and facilities, the Township of Oro - Medonte
shall have regard for the incorporation of accessibility criteria and features, in
addition to quality, cost and time. Where it is impractical for the Township to
incorporate accessibility criteria and features when procuring or acquiring
specific goods, services or facilities, the Township will provide an explanation,
upon request, in a format that is accessible to the requester."
2. This by -law shall take effect on the final passing thereof.
