There are many significant differences as compared to the previous version, most noteworthy for municipalities: FIT applications will now be accepted during specific application windows, rather than on an · ongoing basis, and the OPA, as a first step, will award 200 MW of small [10 – 250 kW] FIT contracts All project applicants, including those who already submitted their applications, will be assessed · and prioritized based on a point system which gives the first priority to aboriginal groups or community groups [co-operatives]. Following that, projects which receive municipal council support will be prioritized, even over pre-existing applications A new price structure, and new restrictions on the types of properties where most types of · projects can be installed (excluding roof-mounted solar projects) stth October 1, to November 30, 2012 The first application window will run from , and there have been no other application windows announced. It is highly unlikely that there will be enough aboriginal or co- operative projects to fill up the 200 MW capacity, which means that municipalities (as well as educational and health institutions) would likely be awarded a contract if they submit an application before the th November 30 deadline. While the rates offered for FIT projects have been reduced, the price of solar panels has also come down, so roof-mounted solar installations are nearly an equally good investment as they were under the previous rules. Many Ontario municipalities have profited greatly from undertaking their own FIT projects i (Kapuskasing, for example). Using current cost estimates, a 250 kW rooftop PV installation, would $1.5 million (CND) in income generate roughly during the 20 year span of the FIT contract, even if it was ii 100% financed (using 10 year term at 5%). This type of installation would fit on a regular arena roof, and would be considered a very low-risk investment. “Council” 1.9.means the Council of The Corporation of The Township of Oro-Medonte; “Disabled Person Parking Space” 1.10. means a designated parking space or parking area under this By-law for the exclusive use of a vehicle displaying a permit in accordance with the requirements of the Highway Traffic Act, 1990, and the regulations there under and this By-law; “Disabled Person Parking Permit” 1.11. means a disabled person parking permit issued under the Highway Traffic Act, 1990, and is currently valid, or a permit, number plate or other marker or device issued by another jurisdiction and is currently valid and recognized under the Highway Traffic Act, 1990, and the regulations there under; “Driver” 1.12. means a person who drives or is in actual physical control of a vehicle; “Driveway” 1.13. means improved land on a highway which provides vehicular access from the roadway to a laneway or a parking area on adjacent land; “Fire Route” 1.14. means a private roadway designated as a fire route by one or more signs erected by or on behalf of the owner or occupant of the private roadway; “Highway” 1.15. includes a common and public highway, street, avenue, parkway, square, place, bridge, viaduct or trestle, designed and intended for, or used by the general public for the passage of vehicles, including unopened and unassumed highways; tm; šE Page 127 of 188 15a) Being a Bylaw to provide for the restricting and r... “Intersection” 1.16. means the area embraced within the prolongation or connection of the lateral curblines, or, if none then the lateral boundary lines of two or more highways that join one another at an angle, whether or not one highway crosses the other; “Leave or Left When Prohibited” 1.17. means the parking of a motor vehicle: 1.17.1 in excess of any time limit so posted; or 1.17.2 where a time limit is not posted in excess of two hours or, 1.17.3 for any use other than the normal use intended for the property. “Local Board” 1.18. means a local board within the meaning of the Ontario Municipal Board Act, R.S.O. 1990, c. 0.28; “Motorized Snow Vehicle” 1.19. means a self-propelled vehicle designed to be driven primarily on snow; “Municipal Property” 1.20. means property of The Township of Oro-Medonte or any local board thereof; “Municipality” 1.21. means The Corporation of The Township of Oro-Medonte; “Municipal Law Enforcement Officer” 1.22. means a person duly appointed by the Corporation for enforcing the provisions of thi By-law and who shall have the powers as set out in the Provincial Offences Act, R.S.O., 1990. c.P.33, as amended; “Owner” 1.23. when used in relation to property means the registered owner of the property; “Owner” 1.24. when used in relation to a vehicle means the last registered name on file with the Ministry of Transportation of Ontario; “Park” or “Parking” 1.25., when prohibited, means the standing of a vehicle, whether occupied or not, except when standing temporarily for the purpose of and while actually engaged in loading or unloading merchandise or passengers; “Parking Space” 1.26. means that part of the surface of a roadway designated for the purpose of parking a vehicle; “Pedestrian” 1.27. means a person on foot or an invalid, child or other person in a wheeled chair or baby carriage; “Person” 1.28. means any human being, firm, association, partnership, private club, incorporated company, corporation, tenants in common, joint tenants, agent or trustee and the heirs, executors or other legal representatives of a person to whom the context can apply according to law and for the purpose of this By-law includes the owner or driver of a vehicle “Police Officer” 1.29. means a member of the Police Force or a person authorized to regulate, direct or enforce the provisions of this By-law and the Highway Traffic Act. “Private Roadway” 1.30. means a roadway or laneway on private property; “Roadway” 1.31. that part of the highway that is improved, designed or ordinarily used for vehicular traffic, but does not include t shoulder and, where a highway includes two or more separate roadways, the term "roadway" refers to any one roadway separately and not to all of the roadways collectively; “Service Vehicle” 1.32. means any municipal vehicle, including emergency vehicles; tm; šE Page 128 of 188 15a) Being a Bylaw to provide for the restricting and r... “Shoulder” 1.33. means that part of the highway immediately adjacent to the roadway and having a surface which has been improved with asphalt, concrete or gravel for the use of vehicles; “Sidewalk/Footpaths” 1.34. means that portion of a highway as is set aside by The Corporation of The Township of Oro-Medonte for the use of pedestrians; “Special Event” 1.35. means those events approved by Council; “Stand” or “Standing” 1.36.when prohibited, means the halting of a vehicle, whether occupied or not, except for the purpose of and while actually engaged in receiving or discharging passengers; “Stop" or “Stopping” 1.37., when prohibited, means the halting of a vehicle, even momentarily, whether occupied or not, except when necessary to avoid conflict with other traffic or in compliance with the directions of a Police Officer or of a traff control sign or signal; “Township of Oro-Medonte” 1.38. means The Corporation of The Township of Oro-Medonte; “Trailer” 1.39. means a vehicle that is at any time drawn upon a highway by a motor vehicle, except an implement of husbandry, a mobile home, another motor vehicle or any device or apparatus not designed to transport persons or property, temporarily drawn, propelled or moved upon such highway, and except a side car attached to a motorcycle, and shall be considered a separate vehicle and not part of the motor vehicle by which it is drawn; “Traffic Control Device” 1.40. means any sign, or roadway, curb or sidewalk marking, or other device erected or placed under the authority of The Corporation of The Township of Oro-Medonte for the purpose of guiding or directing traffic; “Vehicle” 1.41. includes a motor vehicle, trailer, commercial motor vehicle, an automobile, motorcycle, motor assisted bicycle, a motorized snow vehicle, traction engine, farm tractor, self-propelled implement of husbandry road building machine and any other vehicle propelled or driven otherwise than by muscular power. GENERAL REGULATIONS 2. 2.1 Where any expression of time occurs or where any hour or oth period of time is stated, the time referred to shall be eastern standard time, provided however, if what is known as "daylight saving time" has been generally adopted in the Regional Area for any period of the year, under any statute, order-in-council, By- resolution or proclamation, whether the same is effective in law not, such time shall be the time referred to during such period any reference to time in this By-law. 2.2 The Director of Transportation and Environmental Services, o his/her designate, for The Township of Oro-Medonte, shall have the authority to place or erect and to maintain such authorized signs as are required to give effect to the provisions of this B 2.3 The Director of Transportation and Environmental Services or his/her designate, of The Township of Oro-Medonte is hereby authorized to place or erect and to maintain temporary "No Parking" signs and "No Stopping" signs on any highway; 2.4 Schedules to this By-law shall form part of this By-law and entry in a column of such a Schedule shall be read in conjunction with the entry or entries across there from and not otherwise; 2.5 A word interpreted in the singular number has a correspondin meaning when used in the plural; tm; šE Page 129 of 188 15a) Being a Bylaw to provide for the restricting and r... 2.6“May” shall be construed as permissive; 2.7“Shall” shall be construed as imperative. 3. DISTANCES 3.1 Where a distance is used in this By-law as part of a prohibi parking or stopping within a specified distance of an object, structure, land or part of a highway, such distance shall be measured: 3.1.1 From the projection of the nearest curb line or edge of th roadway in the direction stated unless it is specifically stated otherwise; or 3.1.2 along the curb or edge of the roadway from a point in such curb or edge of roadway opposite such object, structure, land or part of a highway, unless the context otherwise requires, or; 3.1.3 from such object, structure, land, or part of a highway in directions. 3.2 All distances/dimensions are measured in the metric measurement unless otherwise stated. EXEMPTIONS IMPRACTICAL 4. 4.1 This By-law applies only to highways forming part of the roa system under the jurisdiction of the municipality; 4.2 If compliance therewith be impractical, the provisions of th law shall not apply to: 4.2.1 ambulances, police, fire department, or public utility emergency vehicles; 4.2.2 vehicles of the Corporation or vehicles contracted by the Corporation where such vehicles are actually engaged in the performance of cleaning, maintenance, repair, construction, snow removal or other work on any highway within The Township of Oro-Medonte; or 4.2.3 tradesman bona fide temporarily stopping or parking for the purpose of loading or unloading equipment to complete minor repairs. For the purpose of this exemption “temporarily” shall mean a time limit of not more than two hours. 5. GENERAL STOPPING OR PARKING REGULATIONS 5.1 No person shall park or stop any vehicle on any highway or portion thereof unless on the right side of the highway having regard to the direction in which the vehicle had been proceeding with the right front and right rear wheels and runners not more than 0.15 metres from the curb or boundary of the roadway, as near as the condition of the highway permits. PARKING PROHIBITED WITH SIGNS 6. 6.1 When authorized signs have been erected, no person shall pa vehicle, or permit a vehicle to remain parked on any highway; 6.1.1 at the side and between the limits set out respectively in Columns 1, 2, and 3 of Schedule “A”. 6.1.2 within the intersection of the Rail Trail and the highway, 6.1.3 within the signed portion of the entrance to the Rail Trai tm;šE Page 130 of 188 15a) Being a Bylaw to provide for the restricting and r... 7. PARKING PROHIBITED WITHOUT SIGNS 7.1 When authorized signs have not been erected, no person shall park a vehicle or permit a vehicle to remain parked on any highway; 7.1.1 within fifteen metres (15m) of an intersection; 7.1.2 within three metres (3m) of a fire hydrant; 7.1.3 in front of the main entrance to, or any emergency exit from any church, or other building or enclosed space in which persons may be expected to congregate in large numbers; 7.1.4 in front of or within one and one half metres (1.5m) of a laneway or driveway; 7.1.5 so as to interfere with the formation of a funeral procession. 7.1.6 in such a position that will prevent the convenient remova of any other vehicle previously parked; 7.1.7 for the purpose of displaying the vehicle for sale; 7.1.8 for the purpose of greasing, repairing, servicing or paint of vehicles except for such repairs as have been necessitated by an emergency; 7.1.9 on the roadway where the width of the roadway is six metres (6m) or less; 7.1.10 on a driveway within one metre (1m) of a sidewalk or footpath, or if there is no sidewalk or footpath within three metres (3m) of the roadway; 7.1.11 so as to impede or obstruct the flow of other traffic dur their lawful use of the highway; 7.1.12 on a boulevard. 8. TEMPORARY NO PARKING SIGNS 8.1 The Director of Transportation and Environmental Services, o his/her designate is authorized and directed to erect or place a the Director’s discretion temporary “No Parking” signs on any highway used by the general public for the passage of vehicles. Temporary changes indicated by the erection of such signs shall not be effective after the next Council meeting, unless confirme by resolution of Council at such meeting, which resolution shall stipulate the length of time such changes shall be in effect; 8.2 Without limiting the generality of the foregoing, such signs erected in the event of fire, or parades, or while large assembl are in an auditorium or otherwise, for a reasonable period of ti immediately preceding and following such assemblies, provided however, that such “No Parking” signs shall be erected one hour or more before such parades or assemblies; 8.3 No person shall at any time park a vehicle on any of the hig parts of highways, or sides of highways where temporary “No Parking” signs have been erected. STOPPING PROHIBITED - SPECIFIED PLACES WITHOUT SIGNS 9. 9.1 No person shall stop a vehicle or permit a vehicle to remain stopped on any highway: 9.1.1 on, or partly on, or over a sidewalk or footpath; 9.1.2 within fifteen metres (15m) of an intersection or crosswal 9.1.3 on the roadway side of any stopped or parked vehicle; tm;šE Page 131 of 188 15a) Being a Bylaw to provide for the restricting and r... 9.1.4 upon any bridge or elevated structure except where parking is otherwise permitted in this By-law; 9.1.5 within thirty metres (30m) of either end of a bridge or elevated structure; 9.1.6 within fifteen metres (15m) of the nearest rail of any lev crossing of a railway. 9.1.7 within the turning basin of a cul-de-sac; 9.1.8 on a highway 10. PARKING PROHIBITED FOR WINTER ROAD MAINTENANCE 10.1No person shall park, or leave standing, a vehicle on a highway, th whether attended or unattended, between October 15 and April th 30 inclusive, in such a manner as to interfere with winter road maintenance. For clarity, and without limitation, if a winter r maintenance vehicle must alter its course to avoid a parked vehicle, or is prevented from entering an area it would otherwis have entered to perform winter road maintenance because of a parked vehicle, that vehicle is deemed to be interfering with wi road maintenance. 10.2Notwithstanding Section 10.1 of this By-law, legal parking is th permitted, for recreational purposes between October 15 and th April 30 inclusive, along the roadways of the locations set out in Schedule “B” attached hereto and forming part of this By-law. F clarity, and without limitation, any vehicle parked within the locations identified on Schedule “B” shall not be deemed to be interfering with winter road maintenance. 11. PARKING PROHIBITED - PRIVATE PROPERTY AND PROPERTY OF THE MUNICIPALITY 11.1 For the purposes of this section the following definitions apply: “occupant” 11.1.1 when used in relation to property means: 11.1.1.1 the lawful tenant or lessee of the property; 11.1.1.2 the registered tenant or lessee of a condominium unit, whose consent shall extend only to the control of the unit of which he is tenant or lessee and any parking spaces allotted to him by the condominium corporation or reserved for his exclusive use in the declaration or description of the property; 11.1.1.3 the spouse of a person described in the 13.1.1.1 or 13.1.1.2; 11.1.1.4 the board of directors of the condominium corporation; 11.1.1.5 a person authorized, in writing, by the property owner as defined in 13.1.1.1, 13.1.1.2, 13.1.1.3 or 13.1.1.4 to act on the owner's behalf for requesting the enforcement of a By-law passed under this paragraph. “owner” 11.1.2 when used in relation to property means: 11.1.2.1 the registered owner of the property; 11.1.2.2 the registered owner of a condominium unit, whose consent shall extend only to the control of the unit of which he is owner and any parking spaces allotted to him by the condominium corporation or reserved for his exclusive use in the declaration or description of the property; tm;šE Page 132 of 188 15a) Being a Bylaw to provide for the restricting and r... 11.1.2.3 the spouse of a person described 13.1.2.1 or 13.1.2.2; 11.1.2.4 where the property is included in a description registered under the Condominium Act, 1998, S.O. 1998, Chapter 19, the board of directors of the condominium corporation. “municipal property” 11.1.3 means all property owned or occupied by The Township of Oro-Medonte or any local board thereof except municipal roads controlled under the Highway Traffic Act or a municipal traffic control By-law; 11.2 The vehicle shall be deemed to be left without consent, whe owner or occupant of property has posted signs: 11.2.1 stating conditions on which a vehicle may be parked or le on the property; or 11.2.2 prohibiting the parking or leaving of a vehicle on the property; 11.3 No person shall park or leave a vehicle on: 11.3.1 private property without first having obtained permission from the owner, occupant or any adult resident of the property; 11.3.2 property owned or occupied by The Township of Oro- Medonte or any local board thereof without first having obtained written consent from The Township of Oro- Medonte or the local board unless authorized signs have been posted indicating parking is permitted; 11.4 Where a driver of a vehicle, not being the owner has been charged under Section 11.3 of this By-law and is liable to a penalty, the owner of the vehicle is also liable to such penalty unless, at the time of the offence, the vehicle was being used without the owner's consent; 11.5 No person shall park a vehicle or permit a vehicle to remai parked on property owned by The Township of Oro-Medonte or any local board thereof where: 11.5.1 an area that is designated by sign as reserved, unless th area is reserved for such person; 11.5.2 an area designated by sign as an area where parking is prohibited; 11.5.3 for any period in excess of 24 hours. 12. FIRE ROUTES 12.1 Where signs are displayed, no person shall stop, stand or p vehicle in: 12.1.1 fire route zone 12.1.2 Within the signed portion of the highway on the side of t highway which the fire hall is located and the opposite side of the highway of such fire hall. 13. PARKING SPACES FOR PERSON WITH DISABILITIES PROHIBITED PARKINGWITH SIGNS 13.1 For the purposes of this Section: When authorized signs have been erected, designating a space as a disabled persons parking space, no person shall park or sto a vehicle or allow a vehicle to remain parked or stopped in a public parking area in a parking space reserved for persons with disabilities unless a valid disabled person parking permit is op displayed on the dashboard of the vehicle. tm;šE Page 133 of 188 15a) Being a Bylaw to provide for the restricting and r... 13.2 Enforcement of this Section on property other than property owned by the municipality will only be carried out upon written request by the owner. 14. SIGNS - TRAFFIC SIGNALS 14.1 No person shall move, remove, deface or in any manner inter with any sign, traffic control signal, marking, or other traffic device placed, erected or maintained under this By-law. 14.2 No person shall erect a traffic control signal, marking, or traffic control device without authority. 14.3 No person shall place, maintain or display on any highway, sign, marking or device which purports to be, or is an imitation or resembles an authorized sign or which conceals from view or interferes with the effectiveness of an authorized sign. 15. FRESHLY PAINTED LINES ON ROADWAY 15.1 No person shall drive any vehicle over any marking on the roadway where markers are in place to indicate that the marking material has been freshly applied. 16. ENFORCEMENT AND ADMINISTRATION 16.1 This By-law shall be enforced and administered by The Towns of Oro-Medonte Municipal Law Enforcement Officers. 17. PARKING INFRACTION NOTICE 17.1 Where a vehicle is found parked in contravention of the pro of this By-law, Municipal Law Enforcement Officers may complete and place upon or attach to the vehicle or give to the person driving the vehicle a parking infraction notice in the form of a serially numbered notice stating: 17.1.1 the license number of the vehicle, concise description of the vehicle and the expiry date of the sticker; 17.1.2 a description of the offence; 17.1.3 the date, time and location of the alleged offence; 17.1.4 the signature of the signing officer; 17.1.5 the set fine for the alleged offence; 17.1.6 that the owner or driver thereof may make a voluntary ear payment in the amount and manner set forth and pay the fine as indicated on the parking infraction notice prior to th the 15 day as set out in the Provincial Offences Act, 1990 Part II. 17.1.7 that the owner or driver therof may enter a not guilty pl within 15 days of the offence and request a trial date be set as set out in the Provincial Offences Act 1990 Part II. 17.2 The Municipal Law Enforcement Officer shall prepare the par ticket in duplicate and shall attach one copy of the parking infraction notice to the vehicle or give the copy of the parking infraction notice to the driver of the vehicle and deliver one c the Corporation. 18. VOLUNTARY PAYMENT 18.1 Notwithstanding the provisions of Section 17 of this By-law person served with a Parking Infraction Notice for an offence as set out in this By-law, may make an early payment in the manner shown on the reverse side of such notice within seven (7) calendar days from the date of the notice was issued. tm;šE Page 134 of 188 15a) Being a Bylaw to provide for the restricting and r... 19. OWNER LIABLE 19.1 The owner of a vehicle may be charged with and convicted of offence under this By-law for which the driver or the vehicle is subject to be charged and on conviction the owner is liable to t penalty prescribed or provided for the offence, unless, at the t of the offence, the vehicle was in possession of some person other than the owner without the owner’s consent. 20. EXEMPTIONS 20.1 This By-law shall not apply to the Corporation, or to its e when engaged in the maintenance of a designated parking space or the enforcement of this By-law. 21. OFFENCES 21.1 Any person who contravenes any provision of this By-law is of an offence and on conviction is liable to the maximum fine as provided for in the Provincial Offences Act, R.S.O., 1990, c.P.33, as amended and/or Part XIV of the Municipal Act, 2001, as amended. 22. TOW/IMPOUND VEHICLE 22.1 Notwithstanding any other penalty imposed by this By-law, the Municipal Law Enforcement Officer issuing the parking infraction notice may have the vehicle towed away and impounded at the owner's expense pursuant to section 170(15) of the Highway Traffic Act, 1990, as amended; 22.2 All towing and impounding charges incurred under this secti shall become a lien against the vehicle and enforced in accordance with the Repair and Storage Liens Act, R.S.O. 1990, c.R.25, as amended. 23. CONFLICT 23.1 Subject to 21.2, in the event of a conflict between the pro this By-law with the provision of any other By-law of the Corporation or any applicable government regulation, the provision that establishes the higher standard to protect the health, safety and welfare of the general public shall prevail; 23.2 Notwithstanding 21.1, if there is a conflict between this B the Highway Traffic Act, 1990 the provisions of the Highway Traffic Act, 1990 shall prevail. 24. EXEMPTION LIMITED BY ACT OF LAW 24.1 Any exemption authorized by this By-law in any manner shall way be construed or interpreted as an exemption, limitation or excuse from a person’s requirement to abide by and comply with any other Federal, Provincial or Municipal Law. 25. SEVERABILITY 25.1 If a court of competent jurisdiction should declare any sec this By-law, or part thereof, including any part of the schedule be invalid, such section or part thereof is deemed severable fro this By-law and shall not be construed as having influenced Council to pass the remainder of this By-law and it is the inten of Council that the remainder of the By-law shall survive and remain in force. 26. BY-LAWS REPEALED 27.1 By-law Nos. 2009-022, 2009-138, 2009-186, 2010-032, 2010-73 2011-122 and 2011-163 are hereby repealed in their entirety. 28. THE CORPORATION OF THE TOWNSHIP OF ORO-MEDONTE BY-LAW NO. 2012-177 A By-Law to Authorize the Execution of an Agreement Between The Township of Oro-Medonte And The Canadian Union of Public Employees and Its Local 2380 WHEREAS the Municipal Act, 2001,S.O. 2001, c.25, Section 224, as amended, states that it is the role of Council to ensure that administrative practices and procedures are in place to implement the decisions of Council; ANDWHEREAS the Council of The Corporation of the Township of Oro-Medonte deems it desirable to enter into a collective agreement with the Canadian Union of Public Employees and its Local 2380, effective January 1, 2012 to December 31, 2015. Township of Oro-Medonte and CUPE Local 2380 ARTICLE 1 PURPOSE 1.01 The purpose of this Agreement is to provide for a collective bargaining relatio between the Corporation and the Union with respect to the bargai herein, to secure the prompt disposition of grievances, and to p responsible o ARTICLE 2 RECOGNITION 2.01 The Corporation recognizes the Union as the exclusive bargaining all matters covered by this Agreement for all employees of the C Township of Oro-Medonte save and except foreperson, persons above the rank of foreperson, administrative secretary, students employed during t period, students employed on a cooperative or government sponsor with a community college and Recreation program instructors and persons regular employed for not more than twenty-four (24) hours per week. 2.02 Corporation relating to the grievance procedure, arbitrations, collective bargaining, whenever otherwise entitled under relevant labour legislation, a mutually agreed by the parties. ARTICLE 4 MANAGEMENT RIGHTS 4.01 The union recognizes and acknowledges that the management of the Corporation and the direction of the working forces are fixed exclusively in the restricting the generality of the foregoing, the Union acknowled function of the Corporation to: a) maintain order, discipline and efficiency; b) hire, promote, demote, classify, transfer and retire employees; c) discipline or discharge a probationary employee for just cause; d) discipline or discharge regular employees for just cause; e) make, enforce and alter, from time to time, rules and regulations to be observed by the employees, provided such rules and regulations do not confli provisions of this collective agreement; f) determine the nature and kind of business and activities conduct corporation, machinery and equipment to be used, the methods and techniques of work, the content of jobs, the scheduling of work, the schedulin including the scheduling of shifts and overtime, the number of e employed, the extension, limitation, curtailment or cessation of operations or any part thereof, the standards of performance of employees, and to deter all other functions and prerogatives; g) to set qualifications and establish and administer tests for the the Corporation promotion and transfers; h) and, without limiting the generality of the foregoing, generally Corporation. Township of Oro-Medonte and CUPE Local 2380 ARTICLE 5 RELATIONSHIP 5.01 The Employer shall deduct from the wages of employees the amount of regular Union Labour Relations Act, R.S.O. 1990, C.L.2 as amended. 5.02 The parties agree to a mandatory irrevocable check off of regulafrom the pay of all bargaining unit employees. Deductions shall be made f-weekly payroll period. It shall be forwarded to the Secretary Treasurer th than the fifteenth (15) day of the month following, accompanied by a list of names of all employees from whose wages the deductions have been made. 5.03 The Union shall indemnify and save the Corporation harmless from judgments, attachments and from any other form of liability as a making any deductions in accordance with the foregoing authorizati assignments. The Union will make refunds directly to all employe deductions have been made. ARTICLE 6 ACQUAINTING NEW EMPLOYEE WITH COLLECTIVE AGREEMENT 6.01 The Corporation agrees to acquaint new employees with the fact that a C Agreement is in effect. ARTICLE 7 CORRESPONDENCE 7.01 Unless otherwise specified in this Agreement, correspondence bet or Designate and the Union shall pass between the Chief Administrative Officeand Vice President of the Union local. ARTICLE 8 LABOUR MANAGEMENT COMMITTEE 8.01 A Labour Management Committee shall be established consisting of two (2) representatives of the Union and two (2) representatives of the Committee shall meet once every two (2) months to discuss issues workplace which affect the parties. Committee members shall receive a notice and an Human Resources agenda prepared by at least forty-eight (48) hours in advance of the Human Resources meeting. The Union shall inform of agenda items not later than forty- eight (48) hours in advance of the agenda deadline. Union committee members shall not suffer any loss of pay for having attended a meeting. Township of Oro-Medonte and CUPE Local 2380 ARTICLE 9 REPRESENTATION 9.01 Negotiating Committee The Corporation shall recognize a Negotiating Committee composed three (3) employees selected by the union, to include the Unit Vice-President and one (1) employee from the inside group and one (1) employee from the out 9.02 Bargaining unit members of the Negotiating Committee shall not s benefits when meeting with the Corporation. 9.03 Stewards In order to provide an orderly and expeditious procedure for the grievance, the Corporation acknowledges the right of a Union to than two (2) Stewards. Subject to the following considerations, a Steward shall assist any bargaining unit member in preparing and presenting his grievancee with the Collective Agreement. 9.04 Notification of Identity a) The Union shall notify the Corporation in writing of the names os, Officers and Officials. The Union shall notify the Corporation of any and regard. The Corporation shall not be required to recognize a Ste Official until his name has been provided by the Union to the Coriting. b) The Corporation shall, if requested, supply the Union with a lis other personnel with whom the Union may be required to transact 9.05 Servicing Grievances It is understood that a Steward has Corporation work to perform. Accordingly, the Steward shall normally service grievances outside of regular wor necessary to service a grievance during working hours, he will n first obtaining the permission of his immediate supervisor. Township of Oro-Medonte and CUPE Local 2380 ARTICLE 11 GRIEVANCE PROCEDURE 11.01 A grievance is a difference between the parties relating to the administration, or alleged violation of the Collective Agreement 11.02 The parties agree that it is of utmost importance that grievance as possible. 11.03 No employee shall have a grievance until the employee has given supervisor an opportunity to resolve the complaint. 11.04 If an employee has a complaint, he shall discuss it with his immediate supervisor wit three (3) working days (and before 12:00 noon on the third day) origin of the circumstances giving rise to the complaint, in ord an opportunity to resolve the complaint. The employee and his supervisor s discuss the complaint and the supervisor shall respond to the co working days of the meeting. The employee may request the presen 11.05 Failing adjustment of the complaint to the mutual satisfaction of the em supervisor, the employee may grieve. Township of Oro-Medonte and CUPE Local 2380 11.08 Any matter so referred to arbitration, including any question as by mutual agreementSole Arbitrator or a arbitrable, shall be heard by a Board of three (3) members composed of a Chair and a nominee appointed by Corporation and the Union. The notice of the party referring the decision to arbitration shall contain the name of its nominee to the Arbitration Board. The recipient of the notice shall within fourteen (14) days advise the other party of the na two (2) nominees so appointed shall, within fourteen (14) days o second of them, appoint a third person who shall be the impartial Chair. Ifrecipient of the notice fails to appoint a nominee, or if the two (2) nomineeagree upon a chair, within these time limits, the appointment shall be made br upon the requests of either party. The Arbitration Board shall hear and determine the matter and shall issue a decision. The decision shall be final a parties and upon any employee affected by it. The decision of a e decision of the Arbitration Board, but if there is no majority, the decision of the Chair will govern. 11.09 The Arbitration Board shall not be authorized to alter, modify, of this Agreement, nor to make any decision inconsistent therewith. 11.10 The Corporation and the Union shall each pay one-half (1/2) of the fees and expenses of the Chair of the Arbitration Board and shall each pay the fees a nominee. 11.11 It is agreed by the parties that the time limits set out with re arbitration are mandatory and must be adhered to unless mutually the parties. 11.12 Where no reply is given to a grievance within the time limits sped, the Union or the Corporation may submit the grievance to the next step in the Gri 11.13 Where the Arbitration Board determines that a disciplinary penal excessive, it may substitute such other penalty for the discipli discharge as it considers appropriate in the circumstances. 11.14 The Corporation has the right to file a grievance with respect t application, administration or alleged contravention of the AgreUnion. Such grievance shall be presented in writing signed by the Chief Administrative Officer Vice his/her designate, and handed to the President of the Local within seven (7) working days of the occurrence or origination of the circumstanc grievance. Failing settlement, a meeting will be held with the Union and the National Representative, and the Union shall give its written reply to th (7) working days following the meeting. ARTICLE 12 DISCIPLINE AND DISCHARGE 12.01 Employees Who Have Completed Probationary Period No Employee shall be disciplined or discharged without just cause. 12.02 Probationary Employees The Corporation may, in its discretion, terminate a probationary that such discretion shall not be exercised in a manner that is 12.03 Prior to the imposition of discipline or discharge, an employee shall be given reas the presence of his/her Steward or Union Representative, if so r Human Resources or employee. Such employee shall be advised promptly in writing by Supervisor of the reason for such discipline or discharge. 12.04 Human a) An employee is entitled to review his personnel file in the pres ResourcesHuman Resources . The employee must provide forty- notice of the intended review and a mutually convenient time will be established. b) twenty-four (24) months has passed since the last such notice, the prec disciplinary notice shall not be relied upon by the Corporation in assessing appropriate discipline. ARTICLE 13 SENIORITY 13.01 Seniority is the length of service with the Corporation since th purposes of lay off, recall, job posting and promotion, seniorit departmental basis. The Seniority date as p be accurate if no objection is made to the seniority date within twenty (20) fu days of posting (inclusive of posting). 13.03 Loss of Seniority Seniority shall terminate, and the employee shall be deemed to h employee: a) resigns from the employ of the corporation; b) retires, or is retired; c) is discharged for just cause and is not subsequently reinstated or arbitration procedures in this agreement; d) is off work due to layoff for a period of twelve (12) months; e) is absent without leave for three (3) consecutive working days during which time he has failed to contact his immediate supervisor. it is the respon to provide an explanation satisfactory to the corporation; f) fails to report to work within five (5) working days after being notified by the corporation of a recall; g) fails to return to work upon termination of an authorized leave reason acceptable to the corporation is given. h) is absent due to sickness or accident for a period of his seniory, or twenty four (24) months, whichever is less. Su continue to pay union dues at their last unionized rate. 13.05 Temporary Employees If a temporary employee works thirteen (13) consecutive months h to be a full-time employee, and shall be placed on the seniority list with a most recent hire. A Call Out is defined as: An emergency call out where an employee is required to make an extra trip to and from his place of employment. If an employee received another call-out while working on the initial call-out, the additional call-out shall be considered to be a continuation of the first call-out. An employee cannot claim more than one call-out in the applicable three or two hour period. 17.06 Meal Allowance Where an employee is required to work four (4) hours of continuo as established in Article 16 the scheduled shift he shall be supplied with a meal eleven dollars ($11.00) allowance of . A meal allowance shall not be paid if a meal is supplied. ARTICLE 21 ATTENDANCE 21.01 The Corporation is entitled to regular attendance on the part of 21.02 If an employee is unable to attend at work as scheduled, he is r Immediate Supervisor or designate, not later than the employ time, providing details of the reasons for his absence from work duration of the absence. Employees are not permitted to purchase any non-Employer issued safety equipment or clothing. 23.04 Temporary Transfers Where an employee, at the request of the Corporation, performs a period of five (5) consecutive working days, the employee shall the Employees wage pay band for all hours worked in that higher rated job. Employees who are working according to the stand-by schedule shall be paid a stand-by $20.00 per week day, $30.00 per day on weekends and public holid allowance of (as outlined in Article 18.01). Transportation Services Winter Operations It shall be mandatory for all employees deemed qualified by the stand-by for winter operations. While on winter operations it is understood that employees on stand-by are to respond in a timely fashion and in a fit condition having regard to weather conditions. The Employer retains the right to maintain a sufficient number of employees to meet operational requirements. Employees deemed qualified by the Employer to be on stand-by for winter operations may request a weekend or Statutory Holiday off from s-by. Such request shall not be unreasonably denied. Employees deemed qualified by the Employer shall be paid a stand-by allowance of $30.00 per day on weekends and public holidays (as outlined in Article 18.01) and any days included in a Holiday Shutdown as authorized by Cou All other Employees excluding Transportation Services Employees excluding those specified above who are deemed qualifi Employer shall be scheduled in a mandatory stand-by rotation schedule. The Employer and Employees shall jointly create the stand-by rotation schedule. An employee with permission from their Supervisor may exchange shif another qualified employee. Employees required to be available to work on the stand-by schedule and who are given a Township cell phone or pager and for this purpose, are expected to respond to the call and be on reported incident within 30 minutes. Employees who are working according to the stand-by schedule shall be paid a stand-by allowance of $20.00 per week day, $30.00 per day on weekends public holidays (as outlined in Article 18.01). 23.08 Shift Premiums If an employee works a shift, the majority of whole hours fall outside the hours of 7:00 a.m. and 4:30 p.m., he shall receive a shift premium of: 2012 seventy cents ($0.70) 2013 eighty cents ($0.80) 2014 ninety cents ($0.90) 2015 one dollar ($1.00) per hour, in addition to his regular hourly rate, for all hours in the shift. Shift premium is not payable in addition to overtime premium. 23.09 Wing Premiums Employees operating a wing-equipped plow trucks without a wingman shall receive a premium of: 2012 seventy cents ($0.70) 2013 eighty cents ($0.80) 2014 ninety cents ($0.90) 2015 one dollar ($1.00) per hour during such operation. The wing premium will be in addi premium if applicable.
