NOTICE OF PUBLIC MEETING FOR PROPOSED AMENDMENT TO THE ZONING BY -LAW OF THE TOWNSHIP OF ORO- MEDONTE 2012- ZBA -05 (Township) TAKE NOTICE that the Council of the Corporation of the Township of Oro- Medonte will hold a Public Meeting on Wednesday, August 15, 2012, at 10:00 a.m. in the Municipal Council Chambers. The purpose of the Public Meeting is to obtain public comments on a proposed Amendment to the Zoning By -law, under Section 34 of the Planning Act, R.S.O. 1990 c. P. 13. THE PURPOSE of the proposed Zoning By -law Amendment is to propose three new definitions for "Kennel ", "Kennel: Class 'A "' and Kennel: Class `B "', and to identify the zones where a "Kennel" use would be permitted. The proposed Amendments would include the following: • The addition of the following new definitions, "Kennel ", "Kennel: Class 'A "' and "Kennel: Class `B" • The inclusion of "Kennel" use in Table B4 A) — Standards for the Agricultural /Rural Zone with additional Special Provision; and • The inclusion of "Kennel: Class 'A "' and "Kennel: Class '13 in Table B4 C) — Provisions for Buildings, Except Single Detached Dwellings. AS the proposed amendments would apply to various lands within the geographic boundaries of the Township of Oro - Medonte, no key map is provided. ANY PERSON may attend the public meeting and /or make written or verbal representation either in support of, or in opposition to, the proposed Amendment. If a person or public body that files an appeal of a decision of the Township of Oro- Medonte in respect of the proposed Amendment does not make oral submission at the Public Meeting, or make written submissions to the Township before the proposed Amendment is adopted, the Ontario Municipal Board may dismiss all or part of the appeal. Zoning Application 2012 - ZBA -05 proposes three new definitions for "Kennel ", "Kennel: Class 'A "' and "Kermel: Class 'B "', the inclusion of "Kennel" use in Table B4 A) - Standards for Agricultural/ Rural Zone with additional Special Provision, and the inclusion of "Kennel: Class 'A'" and "Kennel: Class B "' in Table B4 C) - Provisions for Buildings, Except Single Detached Dwellings. 2012 - ZBA -05 The proposed amendment to the Zoning By -Law, "Definitions", consists of the following: KENNEL Means any building, structure, dog run or other facility, or part thereof where more than three (3) dogs over twelve (12) weeks of age, are. boarded or kept for breeding or show purposes, or where registered dogs are kept for hunting purposes, or where dogs are kept solely for the purpose of routinely entering into dogsled or other similar races. KENNEL, CLASS'A' Means any kennel used for keeping of no more than eight (8) dogs over twelve weeks of age. KENNEL, CLASS 'B" Means any kennel used for keeping of no more than fifty (50) dogs over twelve weeks of age. 201 2- ZBA -05 I lte proposed amendment to the Zoning By -Law, for the Agricultural/ Rural (A /RU) Zone, consists of: •The inclusion of "Kennel" as a permitted use in Table B4 - Standards for Pie Agricultural/ Rural Zone. he amendment of Table B4 - Standards for Agricultural /Rural Zone, by riding a "Special Provision" as follows. (2) Kennels may be permitted in the Agricultural/ Rural Zone subject to approval of a Specific Zoning By -law Amendment and Site plan Control Application. 201 2- ZBA -05 The inclusion of 'fennel: Class'A" and'Kennel: Class'B' to Table B4 C) - Provisions fur Buildings, Except Single Detached Dvrelhngs: Special Provisions: 2. Except in the case where a property owner is able to achieve the Minimum Distance Separation by siting a kennel or boarding facilities on the property, in which case the existing lot area shall be deemed to comply. 2012- ZBA. -05 w. Official Plan designation: Section C12.3.5 of the Township of Oro - Medonte Official PIan states that Dog Kennels may be permitted in the Agricultural designation subject to an amendment of the implementing Zoning By -law. Before considering such an amendment, Council shall be satisfied that: • The size of the proposed dog kennel is appropriate for the area; • The building housing the dog kennel is setback an appropriate distance from lot lines; and • :\n undue concentration of dog kennels does not ah•eady exist in the general vicinity of the proposed kennel. o A new dog kennel may also be subject to a Site Plan Agreement that deals with issues such as buffering, the Iocation and size of the buildings and landscaping to minimize the impact of use on adjacent land uses.
