'" ,. e e THE CORPORATION OF THE TOWNSHIP OF ORO-MEDONTE BY-LAW NO. 98-59 BEING A BY-LAW OF THE CORPORATION OF THE TOWNSHIP OF ORO-MEDONTE FOR THE ESTABLISHMENT OF A HYDRO ELECTRIC COMMISSION WHEREAS: 1. Ontario Hydro distributes and supplies hydro electric power to the Township of Oro-Medonte (the "Township"). 2. The Public Utilities Act, R.S.O. 1990, c.P-52, Section 38 (the '~ct') provides that the Township may entrust the construction of the works and the control and management of the works for the supply of hydro electric power in the Township to a commission. 3. The Township is about to establish such works for the supply of hydro electric power in the Township. 4. The Township has passed By-law No. 98-58 eliminating the requirement to obtain the assent of the electors before establishing a commission pursuant to Section 67 of the Act. NOW THEREFORE, THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF ORO-MEDONTE, ENACTS AS FOLLOWS: 1. In this by-law: the "Act" means the Public Utilities Act, R.S.O. 1990, c.P-52.. the "Commission" means the Oro-Medonte Hydro Electric Commission as established in this by-law. the "Township" means the Corporation of the Township of Oro-Medonte. 2. A commission is hereby established as a body corporate and is entrusted with the construction of the works and the control and management of the works for the supply of hydro electric power within the Township and the commission shall be named the "Hydro Electric Commission of the Township of Oro-Medonte". 3. Upon the passing ofthe By-law, all the powers, rights, authorities, and privileges now or hereafter conferred upon the Township by the Act or any general or special act with respect to the construction, control and management of the works for the supply of electric power within the Township shall be exercised by the Commission and not by the Township. 4. Upon the passing of the By-law, the Commission shall consist of three members on terms and conditions as set out under Part III of the Act. ......
