1998-070 To Amend By-law 1997-095, as amended, the Zoning By-law for the Corporation of the Township of Oro-Medonte with respect to Block 47, Plan M-510 and Parts 1,2,3 and 4 of Plan 51R-23973 <, . THE CORPORATION OF THE TOWNSHIP OF ORO-MEDONTE BY-LAW NO. 98- 70 Being a By-law to amend By-law No. 97-95, as amended, the Zoning By-law for the Corporation of the Township of Oro-Medonte with respect to Block 47, Plan M-510 and Parts 1, 2, 3 and 4 of Plan 51R- 23973 in the Township of Oro-Medonte (former Flos Township.) . WHEREAS the Council of the Corporation of the Township of Oro-Medonte is empowered to pass By-laws to regulate the use of land pursuant to Section 34 of the Planning Act, 1990; AND WHEREAS the owner of Block 47, Plan M-510 and Parts 1, 2, 3 and 4 of Plan 51R-23973 in the Township of Oro-Medonte, has filed an application with the Township of Oro-Medonte to amend By-law No. 97-95 as amended; AND WHEREAS it is deemed appropriate to amend By-law No. 97-95 as amended to rezone the subject lands to permit residential and limited commercial development. NOW THEREFORE the Council of the Corporation of the Township of Oro-Medonte enacts as follows: 1. Schedule 'A-14' to Zoning By-law No. 97-95 is hereby amended by: . re-zoning Parts 1, 2, 3 and 4 of Plan 51 R-23973 from the Local Commercial Hold (LC-H) Zone to the Local Commercial Exception One Hundred and Twenty-Eight (LC*128) Zone . re-zoning part of Block 47 of Plan M-510 from the Local Commercial Hold (LC-H) Zone to the Residential One Exception One Hundred and Twenty- Nine (R1-129) Zone; re-zoning part of Block 47 of Plan M-510 from the Residential One Hold (R1-H) to the Residential One Exception One Hundred and Twenty-Nine (R1-129) Zone; and, all as shown on Schedule 'A1' attached hereto and forming part of this By-law. 2. Section 7.0 Exceptions is hereby amended by the addition of the following sub- section: "7.128 *128 - Parts 1,2, 3 and 4 of Plan 51 R-23973 (former Flos) Notwithstanding any other provision in this By-law, only the following uses are permitted on lands denoted by the symbol *128: . art galleries; business offices; convenience retail stores; custom workshops; dry cleaning distribution depots: financial institutions; medical clinic; museums; personal service shops; repair shops; retail stores; service shops, light. . . . . . In addition, all buildings and structures shall be set back a minimum of 11 metres from the lot line abutting County Road 22, or 26 metres from the centreline of County Road 22, whichever is greater. , -2- 3. Section 7.0 Exceptions is hereby amended by the addition of the following sub- section: . "7.129 *129 - Block 47 of Plan 51 M-510 (former Flos) Notwithstanding any other provision in this By-law, the minimum lot frontage is 26 metres and all buildings and structures shall be set back a minimum of 11 metres from the lot line abutting County Road 22, or 26 metres from the centreline of County Road 22, whichever is greater on the lands denoted by the symbol *129 on the schedules to this By-law." This By-law shall come into effect in accordance with the provisions of the Planning Act, R.S.O 1990, c.P 13. READ A FIRST AND SECOND TIME on the 17th day of June, 1998.
