BY-LAW NO. 98-78
Being a By-law to Enter Into an Agreement Between The Corporation of the Township of
Oro-Medonte and The Corporation ofthe Township of Spring water, The Corporation of
the Township of Georgian Bay, The Corporation of the Township of Severn, and The
Corporation of the Township of Tay for the joint use of the Ministry of Transportation and
Communications Tower at Mount St. Louis.
WHEREAS it is deemed expedient to enter into an Agreement between the Township ofOro-
Medonte and The Corporation ofthe Township of Spring water, The Corporation ofthe
Township ofOeorgian Bay, The Corporation of the Township of Severn, and The Corporation of
the Township ofTay in the matter of the joint use of the Ministry of Transportation and
Communications Tower at Mount St. Louis;
NOW THEREFORE the Council of The Corporation of the Township ofOro-Medonte hereby
enacts as follows:
1, That Mayor and the Clerk be authorized to execute the Agreement, attached hereto as
Schedule "A" which forms part of this By-law;
2. That this By-law shall come into full force and effect on its final passing thereof,
By-law read a first and second time this 29th day of July, 1998.

WHEREAS the Fire Chiefs of the five (5) Municipalities are
in agreement that it is feasible and advantageous for each of
their Municipalities to jointly make use of the Ministry of
Transportation and Communications Tower at Mount st. Louis;
AND WHEREAS the equipment, as listed under Schedule "A"
attached hereto and forming part of this Agreement, will be
jointly used by the five (5) Municipalities for their mutual
benefit;
NOW THIS AGREEMENT WITNESSETH THAT:

The parties hereto agree with each other that the purchased
tower equipment as shown on Schedule "A" attached hereto and
forming part of this Agreement will be jointly owned and
operated by the five (5) Municipalities party to this
Agreement.

5. The parties hereto agree with each other to manage the tower
equipment as a joint venture under the terms and conditions
set out by the Ministry of Transportation and Communications
listed on Schedule "B" attached hereto and forming part of
this Agreement to ensure the maintenance and integrity of
the Ministry facility and avoidance of harmful effect due to
interference.
6.
The parties hereto agree with each other to share equally
all costs and expenses to manage the tower equipment, and so
as not to restrict the generality of the foregoing, costs
and expenses will include upgrades, maintenance, repairs and
insurance.
7. The parties hereto agree with each other that the joint
operation of this communication tower system will be
governed by the rules and regulations as contained in the
Radio Telephone Procedural Manual for Municipal Fire
Departments in Ontario developed by the Office of the Fire
Marshal.
8. The parties hereto agree with each other that should in the
future a Municipality wish to withdraw from this Agreement,
said Municipality will forfeit their ownership share of the
jointly used equipment as shown on Schedule "A" attached
hereto and forming part of this Agreement.
9. The parties hereto agree with each other that this Agreement
will remain in force and effect from year to year unless a
letter of request to open the Agreement is received by all
parties to the Agreement on or before the first day of
November in any year.
IN WITNESS WHEREOF the parties hereto have executed this
Agreement under the hands of their proper office in that behalf
and have affixed the corporate seal thereto.

SCHEDULE "Bft
Communications Tower Joint Agreement
between the
Township of Springwater, Township of Georgian Bay,
Township of Severn, Township of Oro-Medonte and
Township of Tay
TERMS AND CONDITIONS
1. That no inimical frequency relationships or products can be
tolerated between the frequencies either proposed or
presently in use by MTC and MCS.
2. That should inimical frequency relationships or harmful
products or effects occur at any date after Township
installation takes place, remedial action will be taken at
Township expense.
3. That if remedial action is unsuccessful, the Township radio
equipment shall be removed from the site at the expense of
the Township.
4. That the installation of the Township equipment at the site
shall be done by qualified personnel.
5. That installation of the Township antenna and coaxial feed
line(s) shall not incur the boring of holes or crushing of
the tower member steel.
6. That antenna(s) and coaxial cable, where necessary, shall be
installed in such a manner that minimum wind and ice loading
occurs.
7. That access to the equipment building shall be granted by
the Ministry to qualified service personnel for the
installation, removal, repair, maintenance, servicing or
inspection of the Township equipment.
8. That the Township shall be responsible for the delegated
personnel at the subject site, in case of accidents or
injury, during installation, removal, repair maintenance,
servicing and inspection, and save harmless the Ministry
from all claims and/or damages arising out of such events.
9. In the event the Township no longer requires occupancy at
the site, the Ministry equipment shall be restored or
returned to the original operating configuration that
existed prior to the Township's occupancy.
