1998-084 For the imposition of fees THE CORPORATION OF THE TOWNSHIP OF ORO-MEDONTE BY-LAW NO. 98- 84 . A By-law of The Corporation of the Township of Oro-Medonte for the imposition offees. WHEREAS Section 220,1 of the Municipal Act, R,S,O, 1990, Chapter M,45, as amended, permits a municipality to pass by-laws for imposing fees for: . services or activities provided or done by or on behalf of it; . costs payable by it for services or activities provided or done by or on behalf of any other municipality or local board; and . the use of its property including property under its control; NOW THEREFORE the Council of The Corporation of the Township ofOro-Medonte enacts the following: 1. DEFINITIONS a) "Oversize" shall mean all equipment or machinery that is greater than: 3,70 m in width, and/or 4,26 m in height, and/or licensed weight. 2, That every person moving oversize equipment or machinery upon Township of Oro- Medonte road allowances shall obtain an annual moving permit attached hereto as Schedule "A", 3, Notwithstanding Section 2, above, all farm equipment and contractors employed by the Township ofOro-Medonte are exempt rrom this by-law, 4, That the permit holder shall be responsible for all damages that might occur on Township road allowances during the move. 5. That the permit holder shall be responsible for the regulation of traffic, 6, That the permit holder shall be responsible for all overhead utility lines and make proper arrangements for utility assistance. 7, That the permit holder shall arrange for a police escort, if required, 8, That the permit holder shall provide proof ofliability insurance and a copy of the C,V,O,R., prior to the permit being issued, " 9, That during load restriction period, special permission must be obtained to move loads greater than 5 tonnes per axle on Township road allowances, 10, That the permit issued is not valid rrom one half hour after sunset to one half hour before sunrise or at any other time when due to insufficient light or unfavourable atmosphere, conditions, persons and vehicles are not clearly discernible at a distance of 150 metres or less. t -2- 11. That every pennit issued pursuant to this by-law shall expire on the 31 st day of December, following the year in respect of which it was issued and the pennit fee paid to the Corporation of the Township ofOro-Medonte at the time of issuing of the pennit shall be $20.00. - 12. That every person who contravenes any Provision of this By-law is guilty of an offence and shall be liable to a fine in an amount to be detennined pursuant to the Provincial Offences Act R.S.O. 1990, Chapter P.33, as amended, and every such fine is recoverable under the Provincial Offences Act. 13. That this By-law shall corne into full force and take effect on July 15, 1998. By-law read a first and second time this 19th day of August , 1998.
