BY-LAW NO. 99- 68
A BY-LAW FOR PARTICIPATION BY A MUNICIPALITY IN OMERS IN RESPECT
OF ITS HEAD OF COUNCIL AND COUNCILLORS.

A By-law to authorize participation in the Ontario Municipal Employees Retirement System
(OMERS) in respect of its Head of Council and Councillors.
WHEREAS pursuant to subsection 15(1) of the OMERS Act, R.S.O. 1990, Chapter 0.29 and
Regulation 890 as amended, a municipality may, by By-law, elect to participate in OMERS in
respect of its Head of Council and Councillors and to the OMERS Fund the total of the employer
and member contributions, and has all the powers necessary and incidental thereto.
THEREFORE be it enacted as a By-law of the Township of Oro-Medonte (the employer) as
follows:
1. The Employer hereby elects to participate in OMERS in respect of its Head of Council
and Councillors as of the first day of January, 1999 (the effective date) and authorizes the
Clerk to submit forthwith this election in writing by providing a certified copy of this By-
law to the President of the Ontario Municipal Employees Retirement Board.
2. Every person who, on the effective date is the Head of Council and a Councillor of the
Employer may become a member of OMERS on the effective date.
3. Every person who becomes the Head of Councilor a Councillor after the effective date
shall become a member on the date the person becomes the Head of Councilor a
Councillor.
4. Despite clauses 2 and 3, a Head of Councilor Councillor who is receiving an OMERS
pension may elect to become a member, at which point his or her OMERS pension shall
be suspended.
5. The Treasurer of the Employer is hereby authorized to deduct from the contributory
earnings of the Head of Council and each Councillor who is a member of OMERS, the
contributions required to be made by the member, and to remit such contributions
together with the amounts required under the OMERS Act to be paid by the Employer to
the OMERS fund.
6. The Clerk (the Agent) is hereby authorized to execute all necessary documents and to do
all such things as are necessary to carry out the intent of this By-law, in accordance with
section 6 of the OMERS regulation.
