1999-096 , '" . ,. , THE CORPORATION OF THE TOWNSHIP OF ORO-MEDONTE BY-LAW NO. 99- 96 Being a By-law to Amend Zoning By-law 97-95 for the Township of Oro-Medonte pursuant to the provisions of Section 34 of the Planning Act R.S.0.1990 c.P. 13, as amended. WHEREAS Zoning By-law 97-95 was enacted to regulate the use of land and the character, location, and use of buildings and structures within the Township ofOro-Medonte; AND WHEREAS the Council of the Corporation of the Township of Oro-Medonte wishes to amend Zoning By-Law 97-95 to revise and update the by-law; AND WHEREAS authority is granted pursuant to Section 34 of the Planning Act, R.S.O., 1990 c. P. 13, to the Council of the Corporation of the Township ofOro-Medonte to exercise such powers. NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWNSHIP OF ORO-MEDONTE ENACTS AS FOLLOWS: 1. The Zoning By-law of the Corporation of the Township ofOro-Medonte consisting of the attached text and mapping changes as shown on Schedule "A", is hereby adopted; 2. Schedules "A, AI, A4 to A6, A9 to A14, and AI? to Al2 ", attached, form part of this By- law. 3. This By-law shall take effect and come into force pursuant to the provisions of and regulations made under the Planning Act, R.S.O., 1990 c. P. 13. BY-LAW READ A FIRST AND SECOND TIME, THIS 1ST DAY OF SEPTEMBER 1999. BY-LAW READ A THIRD TIME AND FINALLY PASSED THIS 1ST DAY OF SEPTEMBER 1999. THE CORPORATION OF THE TOWNSHIP OF ORO- MEDONTE "L",/ IJQ.,,~I Mayor - Ian Beard , . - SCHEDULE 'A' PROPOSED AMENDMENTS TO BY-LAW 97-95 1. Section 5.6 BOATHOUSES is hereby amended by changing the second sentence from "25 percent" to "30 percent". 2. Section 5.7 DECKS is hereby deleted and replaced with the following: (a) Decks attached to a single detached dwelling are not permitted within 20 metres (65.6 feet) of the average high water mark of Lake Simcoe or 15 metres (49.2 feet) from the average high water mark of Bass Lake. (b) Decks which are either attached to a boathouse or are stand alone are permitted to be located at the water's edge provided the total area of the deck and the boathouse does not exceed 70 square metres (753 square feet). (c) Decks are permitted to encroach into the required interior side yard a distance of no more than 1.0 metre (3.2 feet) for one interior side yard only." 3. Section 5.9.1 ARCHITECTURAL FEATURES AND BALCONIES is hereby amended by deleting the following from the third line "roofed or" 4. Section 5.9.1 ARCHITECTURAL FEATURES AND BALCONIES is hereby further amended by adding the following new sentence: "No porches or balconies are permitted to encroach in the setback area from the average high water mark of 15 metres (49.2 feet) from Bass Lake or 20 metres (65.6 feet) from Lake Simcoe" 5. Section 5.16.1 (a) ENLARGEMENT,REPAIR OR RENOVATION IS hereby amended by adding the following at the end ofthe sentence: "... or into the setback area from the average high water mark of 15 metres (49.2 feet) from Bass Lake or 20 metres (65.6 feet) from Lake Simcoe (see Section 5.28)" 6. Section 5.20.1.2 LOCATION OF PARKING IN THE FRONT YARD IN THE Rl ZONE is hereby amended by adding the "SR Zone" to the title and "Shoreline Residential (SR) Zone" at the end of the second line after "Residential One (Rl) Zone", 7. Section 5.28 SETBACK FROM AVERAGE HIGH WATER MARK OF LAKE SIMCOE AND BASS LAKE is hereby amended by adding the following after "no building or structure or septic system tile field": "With the exception of boathouses and pumphouses" . 8. Section 5.33 SETBACK FROM WATERCOURSES THAT ARE NOT IN ENVIRONMENTAL PROTECTION ZONE is hereby amended by deleting the following from the third and fourth lines: "not in the Environmental Protection Zone or not shown on the Schedules to this By-law" and deleting "That are not in Environmental Protection Zone" from the title. 9. Sections 5.28, 5.29, 5.32, and 5.33 are hereby amended by deleting all references to "Septic System Tile Field". 10. Section 5.9.2 is hereby deleted as new fire escapes are not permitted under the Ontario Building Code. 11. Section 6.0 DEFINITIONS is hereby amended by deleting the definition for Septic System Tile Field. 12. Section 6.0 DEFINITIONS is hereby amended by adding a new definition for Pumphouse as follows: "PUMPHOUSE means a structure in which a pump drawing water for consumption is located" 13. Section 6.0 DEFINITIONS is hereby amended by adding a new definition for attached as follows: "ATTACHED means a building otherwise in itself, which depends, for structural support or complete enclosure, upon a division wall or walls shared in common with adjacent building or buildings. If attached by an enclosed breezeway, such breezeway shall be no more then 4.5 metres (14.76 feet) in length." 14. Section 7.2 *2 - SHORELINE AREA IN FORMER ORILLIA is hereby amended by adding the following new sentence: "Stairs, landings, porches, balconies are permitted to encroach into the required interior side yard a distance of no more than 1.0 metre (3.2 feet) for one interior side yard only." 2 , . - , 15. Section 7.82 *82 - Plan M-295, Lots 1-24, Range 2 (Former Oro) is hereby amended by deleting subsection (c) and renumbering subsection (d) accordingly. 16. Schedule Al is hereby amended by changing the Zone symbols applying to lands within Part of Lot 1, Concession 1 (Oro) from the Agricultural/Rural (A/RU) Zone to the Residential One (Rl) Zone as shown on the attached Schedule AI. . 17. Schedule Al is hereby amended by changing the Zone symbols applying to lands within Lot 1, Range 1 (Oro) from the Agricultural/Rural (AJRU) Zone to the Residential Limited Service (RLS) Zone as shown on the attached Schedule AI. 18. Schedule Al is hereby amended by changing the Zone symbols applying to lands within Part of Lot 6, Concession 1 (Oro) from the Agricultural/Rural (AJRU) Zone to the Institutional (I) Zone as shown on the attached Schedule AI. 19. Schedule A4 is hereby amended by changing the Zone symbols applying to lands within Part of Lot 25, Concession 8 (Oro) from no Zone Symbol to the Agricultural/Rural (A/RU) Zone as shown on the attached Schedule A4. 20.
