1999-101 , . . . . , THE CORPORATION OF THE TOWNSHIP OF ORO-MEDONTE BY-LAW NO. 99-101 BEING A BY-LAW TO AUTHORIZE THE SALE OF LANDS (Part of Block A, north side of Davis Street, and Part of Lots 18 and 19, South side of Davis Street, and Part of Davis Street, McVity Street, and King Street, and all of Lot K, Registered Plan 663 (geographic Township of Oro), Township of Oro-Medonte (formerly Township of Oro), County of Simcoe, designated as Parts 1,2,3,4,5,6,7,8,9,10,11,12, 13,14,15,16,17, 18, 19,20,21,22,23, and Reference Plan 51R-28451.) WHEREAS the Municipal Act, R.S.O. 1990, c.M.45, Section 191 and section 193, as amended, authorize a Council of a municipality to dispose of surplus real property in accordance with the provisions of a by-law passed by the Council establishing procedures governing the sale of such real property; AND WHEREAS the Council of the Township ofOro-Medonte passed By-law No.96-35 pursuant to Section 193 of the Municipal Act on the 17th day of April, 1996, being a by- law to establish procedures for the disposal of the surplus real property owned by the Municipality; AND WHEREAS Council has received no notice of objection to the proposed property by disposal !Tom any party; AND WHEREAS Council therefore deems it expedient to establish procedures for the sale of the lands described in Schedule "A" to this By-law in accordance with Section 6 of Schedule "A" to By-law No. 96-35. NOW THEREFORE THE COUNCIL OF THE CORPORA nON OF THE TOWNSHIP OF ORO-MEDONTE HEREBY ENACTS AS FOLLOWS: 1. That the disposal of the lands described in Schedule "A" to this By-law to the residents of Barrie Terrace as more particularly set forth in Schedule "C" hereto pursuant to the terms of an Agreement between the Township and the residents of Barrie Terrace, collectively called the Barrie Terrace Association and made in accordance with the unsolicited offer received from Barrie Terrace Association, is hereby authorized pursuant to the provisions of Section 6 of Schedule "A" to By- Law 96-35. The sale of the lands described in Schedule "A" to this by-law to the residents of Barrie Terrace shall be completed without tendering the property for sale in accordance with Section 4 of Schedule "A" to By-law 96-35 or listing the property described in Schedule "A" to this by-law for sale in accordance with the provisions of Section 5 of Schedule "A" to By-Law 96-35. 2. That the consideration payable for the lands described in Schedule "A" to this By- law shall be the sum of$I.OO and other good and valuable consideration. 3. That, as a condition ofthe transfer by the Township to Barrie Terrace Association of the lands described in Schedule "A" to this By-law, the Township acknowledges having received transfer(s) to it of the lands described in Schedule "B" to this By-law, which conveyance (s) shall constitute full satisfaction of the consideration payable for the lands described in Schedule "A" to this By-law, as set out in paragraph 2 above. 4. That the Mayor and Clerk be and are hereby authorized to execute all such documentation as may be required to give effect to the foregoing. 5. That this By-law shall come into force and effect on the date of passing thereof. ,- . . By-law read a first and second time this 15th day of September, 1999.
