THE CORPORATION OF THE TOWNSHIP OF ORO-MEDONTE BY-LAW NO. 99- 130 BEING A BY-LAW TO AMEND BY-LAW 98-106, WHICH REGULATES MUNICIPAL WATER SYSTEMS WITHIN THE TOWNSHIP OF ORO-MEDONTE AND TO REPEAL BY-LAW NO. 99-107 WHEREAS Section 2 (1) ofthe Public Utilities Act, R.S.O. 1990, provides that the corporation of a local municipality may acquire, establish, maintain and operate waterworks; AND WHEREAS Section 2 (3) of the Public Utilities Act, R.S.O. 1990 provides that the council of the corporation may define an area in the municipality and may assess and levy on the ratable property in the area, the cost ofthe waterworks, including debenture charges, the cost of maintenance and management and the cost of the water or any part thereof; AND WHEREAS Section 8 ofthe Public Utilities Act, RS.O. 1990 provides that the corporation may regulate the distribution and use of the water in all places where and for all purposes for which it may be required, and fix the prices for the use thereof, and the times of payment, and may erect such number of public hydrants and in such places as it may see fit, and may direct in what manner and for what purposes the same shall be used, and may fix the rate or rent to be paid for the use of the water by hydrants, fireplugs and public buildings; AND WHEREAS Section 12 of the Public Utilities Act, RS.O. 1990 provides that the corporation may pass by-laws for regulating the time, manner, extent and nature of the supply by the works, the building or persons to which and to whom the water shall be furnished, the price to be paid therefor, and every other matter or thing related to or connected therewith that it may be necessary or proper to regulate, in order to secure to the inhabitants of the municipality a continued and abundant supply of pure and wholesome water, and to prevent the practicing of frauds upon the corporation with regard to the water so supplied, and for providing that for a contravention of any such by-law the offender is guilty of an offence; AND WHEREAS Section 28 of the Public Utilities Act provides that Council may pass by- laws for the maintenance and management of the works and the conduct of its officers and others employed in connection with them, and may also by by-law or resolution fix the rates or charges for supplying the public utility and the charges to meet the cost of any work or service done or furnished for the purpose of a supply of a public utility, and the rent of or charges for fittings, apparatus, meters or other things leased or furnished to consumers, and provide for the collection of such rates, charges and rents, and the times and places when and where they shall be payable and for allowing such discounts or penalties as may be considered expedient; AND WHEREAS Section 50 (1) of the Public Utilities Act, provides that any person authorized by the Township for that purpose has free access, at all reasonable times, and upon reasonable notice given and request made, to all parts of every building or other premises to which any public utility is supplied for the purpose of inspecting or repairing, or of altering or disconnecting any service pipe, wire or rod, within or without the building, or for placing meters upon any service pipe or connection within or without the building as he or she considers expedient and for that purpose or for the purpose of protecting or regulating the use of the meter, may set it or alter the position of it, or of any pipe, wire, rod, connection or tap, and may alter or disconnect any service pipe. AND WHEREAS Section 222 of the Municipal Act, RS.O. 1990, as amended, provides that councils of local municipalities may pass by-laws requiring owners of buildings of any class or classes of buildings in the municipality or in any defined area to connect the said buildings to the water works of the municipality; ! ! . ... ,'''' . e -2- AND WHEREAS By-Law No. 98-106 was passed on November 4,1998. AND WHEREAS Council deems it appropriate to amend By-Law No. 98-106, AND WHEREAS By-Law No. 99-107 was passed on October 6th, 1999. AND WHEREAS Council deems it appropriate to repeal By-law No. 99-107. NOW THEREFORE the Council of the Corporation of the Township ofOro-Medonte enacts as follows: 1. THAT Schedule "A" of By-Law 98-106 is hereby deleted and replaced with Schedule "A", attached hereto. 2. THAT Schedule "A" attached, forms part of this By-Law. 3. THAT By-Law No. 99-107 is hereby repealed. 4. THAT this By-law shall take force and effect upon final passage hereof. READ A FIRST AND SECOND TIME THIS 15th DAY OF DECEMBER, 1999.
