I This document provides as follows By-LW HUM= 1403/85 BEING A BY -LAW PURSUANT TO SECTION 309(1) OF THE MUNICIPAL ACT, R.S.O. 1980 TO PERMIT THE OWNERS OF LOTS 52, 53, 55, 56 AND 57, PLAN 626, IN THE TOWNSHIP OF ORO TO MAKE CERTAIN IMPROVEMENTS TO THE LAKESHORE PROMENADE ON PLAN 626. WHEREAS Section 309(1) of the Municipal Act authorizes local municipalities to enact a By- -law for the purpose of setting apart portions of road allowances and permitting the owners of abutting land to make, construct and maintain certain improvements at their own expense; AND WHEREAS the Township of Oro has received a request from the owners of Lots 52, 53, 55, 56 and 57, Plan 626, to make certain improvements to the Lakeshore Promenade on Registered Plan 626; AND WHEREAS Council deems 'it appropriate to authorize such improvements; NOW THEREFORE the Corporation of the Township of Oro hereby enacts as follows: This Council does authorize the Township to enter into the Agreements attached hereto as SCtWule °A" with the registered owners of Lots 52, 53, 55, 56 and 57, Plan 626 for the purpose of allowing such owners to make certain, improvements to the unopened road allowance known as the Lakeshore Promenade Registered Plan 626. fiat the Reeve and Clerk are hereby authorized to execute said Agreements on behalf of the Township of Oro. WHEREAS the McCartneys are the registered owners of Got 52 and 53, Plan 626, in the 'township of Oro, County of Simcoe; AND WHEREAS the Promenade shown on Plan 626 between Lot 52 and 53 and Lake Simcoe is part of an unopened unassumed publ is road al lowance which was dedicated to the Township; AND WHEREAS the McCartneys have made application to the Ministry of Natural Resources to do certain work and improvements on the portion of the Promenade between Lot 52 and 53 and Lake Simcoe; AND *0W the Township is prepared to permit the McCartneys to make improvements to the Promenade on the following terms and conditions: NOW THEMORE THIS AGREEMENT WITNESSETH that in consideration of the sum of One ($1.00) Dollar and in consideration of the mutual covenants contained herein, the parties hereto agree as follows: 1. The McCartneys acknowledge that the Promenade is an unopened, unassumed public highway owned by the Township. 2. All work on. the Promenade is to be completed in accordance with Ministry of Natural Resources guidelines. 3. The work to be completed by the McCartneys shall be limited to cleaning up the Promenade, placing clean fill and top soil on the Promenade, seeding and planting trees and shrubs. 4. The McCartneys agree that no building, structures or permanent fixtures of any type will be constructed on the Promenade. 5. The McCartneys shall release and indemnify the Township from all claims, actions,, daanages, costs and liabilities arising from the McCartneys use of the Promenade and the improvements completed on the Promenade. 6. The McCartneys acknowledge that the Township at all times has the the right to develop,, use, change, alter, open or assume the Promenade as a public highway without any liability or obligation to the McCartneys. 7. The McCartneys acknowledge that the general public is entitled to the unobstructed use of the Promenade as an unopened, unassumed public highway. 8. Nothing in this Agreement shall deem the Township to having assumed or opened the Promenade. 9. This Agreement shall be binding upon the parties hereto, their successors and assigns. All work on the Promenade is to be completed in accordance with Ministry of Natural Resources guidelines. 3. The work to be completed by the Gardiners shall be limited to cleaning up the Promenade, placing clean fill and top soil on the Pramenade, seeding and planting trees and shrubs. 4. The Gardiners agree that no building, structures or permanent fixtures of any type will be constructed on the Proimenade. 5. The Gardiners shall release and indemnify the Township from all claims, actions, damages, costs and liabilities arising from the Gardiners use of the Promenade and the improvements completed on the Pramenade. 6. The Gardiners acknowledge that the Township at all times has the the right to develop, use, change, alter, open or assume the Promenade as a public highway without any liability or obligation to the Gardiners. 7. The Gardiners acknowledge that the gereral' public is entitled to the unobstructed use of the Promenade as an unopened, unassumed public highway. 8.
