�a }� NOTICE OF PUBLIC MEETING FOR PROPOSED PLAN OF SUBDIVISION, AND AMENDMENT TO THE ZONING BY -LAW OF THE TOWNSHIP OF ORO- MEDONTE 2011- SUB -02 2011- ZBA -10 (Teskey) TAKE NOTICE that the Council of the Corporation of the Township of Ora - Medonte will hold a Public Meeting on Wednesday, September 28, 2011, at 7:00 p.m, in the Municipal Council Chambers. The purpose of the Public Meeting is to obtain public comments on a proposed Plan of Subdivision and amendment to the Zoning By -law, under Sections 51 and 34 of the Planning Act, R.S.O. 1990 c. P. 13. THE PURPOSE of Applications 2011 - SUB -02 and 2011- ZBA -10 are to consider a proposed Plan of Subdivision, comprised of 29 residential lots, on the lands described as Concession 14, South Part Lot 5 (within the former Township of Medonte) located south of Warminster Sideroad, west of Highway 12 and east of Line 13 North. Each of the proposed lots would have frontage on a new road, which is proposed to be accessed from the east side of Line 13 North. The applicant has applied to rezone the lands from Agricultural /Rural Exception 15 (A/RU *15) Zone and Agricultural /Rural (A/RU) Zone to the Residential One (R1) Zone. A KEY MAP illustrating the location of the subject lands is provided on the opposite side, as well as the proposed draft Plan of Subdivision. ANY PERSON may attend the public meeting and/or make written or verbal representation either in support of or in opposition to the proposed Applications. If a person or public body that files an appeal of a decision of the Township of Oro - Medonte in respect of the proposed Applications does not make oral submission at the public meeting or make written submissions to the Township before the proposed Amendment is adopted, the Ontario Municipal Board may dismiss all or part of the appeal. Andersen and Homire). We are therefore requesting that the Township co= ordinate the preparation of a single traffic study for all the proposed subdivisions within Warminster, to assess (and mitigate if required) the cumulative impacts on Highway 12 / Warminster Rd. intersection. We are requesting a traffic shady condition of draft approval, which can be addressed either by a revised Teskey traffic study to include the additional developments, or by the Township in preparing a consolidated study. If improvements to Highway 12 are required as a result of cumulative impacts then we would expect the Township to co- ordinate financial' contributions from the various developers. We have not completed our review of the July 4, 2011 CC Tatham & Associates Functional Servicing and Preliminary Stormwater Management Report. While we will provide comments on the FSR / SWMR under separate cover, as it pertains to drainage, please be aware that any proposed servicing within or crossing Highway 12 (eg. watermain) will require application and approval for an MT© Encroachment permit from this office Please include the following Conditions of Draft Approval: 1. That prior to final approval, the owner shall submit to the Ministry of Transportation for review and approval a detailed stormwater management report, in accordance with MTO Stormwater Management Requirements for Land Development Proposals 2. That prior to final approval, a 0.3m reserve extending across the entire highway frontage be conveyed by deed, free and clear of all encumbrances, to the Ministry of Transportation. 3. That prior to final approval, the owner shall submit to the Ministry of Transportation for review and approval a traffic impact study to assess cumulative impacts on Highway 12 operations associated with all draft plans of subdivision in Warminster, and ensure that appropriate mitigation, if required,, is provided for. Please include the following Notes to Draft Aoroval: MTO Building & Land Use permits are required for all lots within 45m of Highway 12 property limits. MTO permits are also required prior to site grading / servicing / internal road construction, and for site signs; an MTO Encroachment permit is required for works within the Highway 12 ROW. Provide a completed copy of the NVCA checklist that corresponds to the type of facility proposed. 2. Please have a geotechnical engineer review the conceptual design and provide a preliminary geotechnical report that assures that the conceptual design is feasible from a geotechnical perspective. 3. Demonstrate that the SWM facility has at least 0.3m of freeboard above the regulatory storm water surface elevation, which is taken as the greater elevation of the 100 year or regional storm event. 4. Provide written confirmation from the MTO that they are willing to accept drainage from the stormwater management pond into their roadside drainage ditch. These comments are related to this submission and the information provided within this submission. NVCA staff has outstanding concerns and require additional information in order to complete the review of the subdivision application. Additional comments may be provided in the future. Please note NVCA recommends appropriate zoning for lands containing stormwater management ponds, but in general does not object to the re- zoning of the lands.
