2011-042 Close Road Allowance - Lots 20-21, Concession 14THE CORPORATION OF THE TOWNSHIP OF ORO-MEDONTE BY-LAW NO. 2011-042 A By-law to Permanently Close Part of the Original Road Allowance between Lots 20 and 21, Concession 14 (Oro), Township of Oro-Medonte, County of Simcoe And To Release The Corporation of the Township of Oro-Medonte's registered interest in Part of the Original Road Allowance between Lots 20 and 21, Concession 14 (Oro), Township of Oro-Medonte, County of Simcoe WHEREAS Section 11 of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, provides that a lower-tier municipality may pass by-laws with respect to highways; AND WHEREAS Section 34 of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, provides that a by-law permanently closing a highway does not take effect until a certified copy of the by-law is registered in the proper land registry office; AND WHEREAS Section 67 of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, provides that if, before January 1, 2003, a person in possession of an original road allowance or a predecessor in title of that person opened a highway in the place of the original road allowance on that person's land without receiving compensation for the land and the person is in possession of all or part of the original road allowance, that person is entitled to the soil and freehold of the allowance or part of it and to a conveyance of the original road allowance or part of it; AND WHEREAS Part of the Original Road Allowance between Lots 20 and 21, Concession 14 (Oro) is located within the boundaries of privately owned lands; AND WHEREAS The Corporation of the Township of Oro-Medonte has established and maintains a road allowance, known as Lakeshore Boulevard East, which is situated northerly of the part of the original road allowance between Lots 20 and 21, Concession 14 (Oro), Township of Oro-Medonte, County of Simcoe, more particularly described in Schedule "A", attached hereto and forming part of this by-law; AND WHEREAS The Corporation of the Township of Oro-Medonte does now deem it expedient to permanently close and release its registered interest in part of the original road allowance between Lots 20 and 21, Concession 14 (Oro), Township of Oro- Medonte, County of Simcoe, to the underlying property owners as more particularly described in Schedule "A", attached hereto and forming part of this by-law; AND WHEREAS by virtue of Section 67 of the Municipal Act, 2001, S.O. 2001, c. 25, as amended, The Corporation of the Township of Oro-Medonte is not required to provide notice through an advertisement; NOW THEREFORE the Council of the Township of Oro-Medonte hereby enacts as follows: 1. Council does hereby permanently close part of the original road allowance between Lots 20 and 21, Concession 14 (Oro), Township of Oro-Medonte, County of Simcoe, more particularly described in Schedule "A", attached hereto and forming part of this by-law. 2. Council does hereby release its registered interest in part of the original road allowance between Lots 20 and 21, Concession 14 (Oro), Township of Oro- Medonte, County of Simcoe, to the underlying property owners as more particularly described in Schedule "A", attached hereto and forming part of this by-law. 3. The Mayor and Clerk are hereby authorized to execute all necessary documentation to carry out the intent of this by-law. 4. This by-law shall take effect on the final passing thereof.
