A By-law to convey Parts of Lakeview Boulevard, Registered Plan 589 (geographic Township of Oro), more particularly described as Parts 1 through 9 and 11 through 17 inclusive, Registered Plan }5R-30339, Township of Oro-Medonte, County of Simcoe. $1 WHEREAS pursuant to Section 297 of the Municipal Act, R.5.0. 1990, c.MA5, as amended, Council is empowered to stop up and close any part of a highway; AND WHEREAS pursuant to Section 315 of the Municipal Act, R.5.0. 1990, c.MA5, as amended, Council is empowered to sell any part of a highway which is legally stopped up and closed; . AND WHEREAS all of Lakeview Boulevard, Registered Plan 589 (geographic Township of Oro), more particularly described as Parts 1 through 17 inclusive, Registered Plan ~/1-5R-30339, Township of Oro-Medonte, County of Simcoe, more particularly described in Schedule "A" attached hereto and forming part of this By-law, has been stopped up and closed by By-law 2001-076 passed by the Township of Oro-Medonte on August 22, 2001; AND WHEREAS the Municipal Act, R.5.0. 1990, c.MA5, sections 191 and 193, as amended, authorize a Council of a municipality to dispose of surplus real property in accordance with the provisions of a by-law passed by the Council, establishing procedures governing the sale of such property; AND WHEREAS Council passed By-law No. 1996-35 on the 1ih day of April, 1996, being a By-law to establish procedures to provide for the disposal of real property within the Township of Oro-Medonte, pursuant to Section 193(2) of the Municipal Act, R.5.0. 1990, c.MA5, as amended; . AND WHEREAS Council has determined that the said road is not required for municipal purposes, and has by resolution declared all of Lakeview Boulevard, Registered Plan 589 (geographic TownslJjp of Oro), more particularly described as Parts 1 through 17 inclusive, Registered Plan 9.SR-30339, Township of Oro-Medonte, County of Simcoe, more particularly described in Schedule "A" attached hereto and forming part of this By-law, to be surplus to the municipality; NOW THEREFORE the Council of the Township of Oro-Medonte hereby enacts as follows: 1. Authorization of Sale - Council does hereby authorize the sale of Part of Lakeview Boulevard, Registered Plan 589, more particularly described as Parts 1 through 9 and 11 through 17 inclusive, Registered Plan 'i5R-30339, Township of Oro-Medonte, County of Simcoe, as described in Schedule "B" attached hereto and forming part of this By-law, to the registered owner from time to time of the abutting lands described as Lots 1 to 30, Registered Plan 589, more particularly described in Schedule "B" attached hereto and forming part of this By-law. . 2. Sale Price - In accordance with Section 315 of the said Municipal Act, Council hereby sets the sAle price for Parts 1 through 9 and 11 through 17 inclusive, Registered Plan P.3R-30339, Township of Oro-Medonte, County of Simcoe, as described in Schedule "B" attached hereto and forming part of this By-law, at a consideration of amounts as set out in Schedule "B" attached hereto and forming part of this By-law. , II. . . . . . 3.
