Our consideration of this offer is based on regaining the property access which existed at the time of purchase but which was later taken away through an obscure series of events. A brief summary of those events is included in the following documentation. (Please refer to the letter to Council dated Feb 23, 2009.) In considering this acquisition, we evaluated the following access options from our property: 1. A laneway heading west (via the 33 southerly feet of Monk Street) to Penetanguishene Road which is geographically level land. This was how we originally drove to and accessed our property until private residential development made that impossible (see attached notes). 2. A laneway heading east (via the 33 southerly feet of Monk Street) to Ridge Road. Its construction would be a monumental task due to steep slopes and deep ravines and therefore economically unfeasible for us. 3. Road access to the north of our property in the event of future development in that direction. Two options exist: a) Acquisition of only that portion of the southerly 33 ft of Monk Street which abuts our property. Access would require the developer to link us into their street system. b) Acquisition of the southerly 33 ft of Monk Street that extends from our property west to Colbome Street. Access options into a development would be more numerous, but would still require developer cooperation to link into their street system. For us to make a decision the following points need consideration: 1. Can we obtain surety in writing from the Township to gain access to a possible street system to the north in the event of future development? 2. Would the acquisition of the southerly 33ft of Monk Street help to achieve the above? 3. Are there other ways or regaining access to the northern boundary of our property that we, have not as yet, considered. We look forward to working with council to resolve the above issues. Douglas Irwin Director of Corporate Services /Clerk Township of Oro Medonte 148 Line South, Box 100 Oro, ON LOL 2X0 Re: Unopened Road Allowance Southerly 33 feet of Monk Street Without Prejudice between Colborne Street and O'Brien Street) Thank you for the opportunity to respond to your inquiry regarding the above mentioned road allowance and in our case, specifically the 33 southerly feet of Monk Street abutting that parcel of land with the legal description of PLAN 918 PT BLK X RP 51R25054 Part 3. (I will refer to this parcel as the hilltop property) The hilltop property was purchased by our parents, Hans and Erika Stauffert in 1965. As a result of our Father's passing in 2006, this hilltop property is now owned by my brothers Dean Stauffert, Kurt Stauffert and myself, Marion Elliott. The issue of Monk Street, its status and the impact on this hilltop property has spanned thirty-four years in our family's history and has not been without confusion. We clearly remember the frustration and disbelief our parents experienced as they attempted to get clear answers with regard to the Monk Street situation. We feel that it is vital to a fair resolution that Council be aware of critical events in the history of this situation Therefore we are taking the opportunity to outline the highlights chronologically and provide you with a copy of the correspondence to support our response. 1965: The above mentioned property is purchased by our parents Hans and Erika Stauffert The purchase was preceded by an inquiry to the Township of Oro through the legal firm of Livingston, Myers and Cockburn as to the possibility of a building permit for this property. The township response by Mr. W. B. Tudhope, Clerk and Treasurer is included. It states that Monk St. is not an open road and it is an allowance for a road on Plan No. 1 and has not been closed and does not appear to have been taken over as a Public Road. Point of interest: The tax bill for this hilltop property stated that the frontage was on Monk St. 1969: Our parents purchased an abutting piece of property,Lot 26,Lot 27and part of Block X currently described as 356 Shanty Bay Rd. Due to the passage of a provincial law (year not known), the hilltop property and 356 Shanty Bay Rd. fused into one property. (Two adjacent properties owned by the same individual(s) became one) 1978: Committee of Adjustment Hearing and our parents were granted the severance of the hilltop property from the 356 Shanty Bay Rd. property. Both properties were zoned Residential General at that time. 1980: Letter of objection filed by the legal firm of Livingston, Myers and Cockburn on behalf of our parents to request that the hilltop property retain its Residential General zoning and not be changed to Page 8 of 146 Agenda Item 4a) 9:00 a.m. Marion Elliott, re: Part of Monk Street. Agricultural under the Restrictive Area By -Law No. 1213 -80. This request was denied and clearly had an impact on the status of the hilltop property and questions as to future value. 1982:(Aug. 10th) Our Parents noted that Mr. and Mrs. Monteith appeared to be occupying a part of Monk St. between Colbourne St. and 0' Brien St. A letter from the legal firm of Livingston, Myers and Cockburn was sent to the Township of Oro, on behalf of our parents. The lawyers indicated that they had conducted a subsearch of title and found no By -law of the Township (or County) registered purporting to close Monk St. and yet the deed to Muriel Monteith registered as Number 738842 purported to include in its description by way of quit claim, the Northerly 33 feet of Monk St. Our parents had been paying their taxes with frontage on Monk St. and this apparent change would negate the potential public access to the northerly portion of their hilltop property. Township was asked to clarify. 1982:(Aug. 12th) Mr. G. Roberts, Oro Township Deputy Clerk Planning Administrator responded that no By -law had been passed to open up, assume or close "Monk St." and questioned whether "Monk St." had existed. He questioned whether Township had any jurisdiction to quit claim any portion of such. 1882:(Aug. 17th) Livingston, Myers and Cockburn communicated with our parents to say that; 1. Township felt that By -law 695 registered in 1950 had effectively closed the roads. The legal firm did not agree. 2. Township claimed no interest in that street. 3. Livingston, Myers and Cockburn felt the Municipality still owned the streets. 4. Although the Township claimed no interest in that street they would be prepared to quit claim the South half of Monk St. abutting our parents' hilltop property at our parents' expense for survey and conveyance. How would this be possible if Township questioned its jurisdiction? 1983 (Jan.) Our Father, Hans Stauffert writes a letter to the Reeve and Members of Council asking for a definitive clarification to the actual legal status of Monk St. and O'Brien St. 1983(Sept) Eight Months Later. No final solution has been arrived at. The Township Solicitor is waiting to speak to Mr. Monteith (away on a construction project). We wonder how this would determine the status of the streets in question. 1985Township took the position that ownership of the streets Adam St., Colbourne St., Monk St., and McVity St remains with the Township, except for Monk St.. which was conveyed with the original Crown Patent. There seemed to be an opportunity for quit claim on the part of the Township. 1985(Aug.) Upon conveyance of that portion of Monk St. across the P.Perri property, procedures for road closings could commence. (see enclosed letter dated August 13 th.,1985) HOWEVER MONK ST. WILL REMAIN A ROAD ALLOWANCE) including that portion abutting the hilltop property. If Monk Stremained a road allowance, why is only the southerly 33' of Monk St available for purchase? The potential public access from the northerly boundary of the hilltop property was effectively land locked with the aquisition of Monk St. by Mr. Perri and the driveway of, at that time, Mr. and Mrs. Monteith being built across parts of Monk St. and O'Brien St. Page 9 of 146 It is very apparent that our parents purchased the hilltop property with the northerly boundary on Monk St., an unopened road allowance,which was defined as their frontage of approximately 124 feet and for which they paid taxes for many years. Without notification, their tax bill suddenly stated a new frontage, one on the Ridge Rd. of approximately 29 feet. There appears to have been several changes in the status of Monk St., creation of a property without the potential access it once had and in so doing affecting its potential value, changes in the ownership of Monk St. and questions of jurisdiction with little or no notice or consultation. We are interested in looking to a positive solution with regards to clearing up this long standing and frustrating situation. Our parents have had considerable expense in the past, trying to stay ahead of what seems to have been a never ending number of changes, typically to their detriment and we feel that it is unreasonable for us to assume major costs to tidy up what must be a challenging issue for Township as well. We would consider meeting with the appropriate individuals to discuss options to facilitate adding the southerly 33 feet of Monk St. to the hilltop property at minimal cost. Roy has asked the Wilson sisters from Collingwood to join everyone on stage for the finale. Hawkestone Singers according to Roy are 40 members of a keen group that should be applauded for their efforts and improved presentation. OTHER BUSINESS (a) Peat Operations Councillor Jack Rupke inquired if any progress has been made in the area of using peat soils for agricultural activities. The CAO responded that Chair Hackson, Councillor McCallum, representative from the Growers' Association and the CAO met with Minister Cansfield, Ministry of Natural Resources and her staff to discuss the presence of conflicting legislation. This was an excellent meeting which has led to the establishment of a Peat Working Group. A Terms of Reference has been established and forwarded to MNR staff for review and approval. The CAO indicated she is awaiting approval to move forward with the Committee. (b) Site Visits Ramara Councillor O'Donnell extended thanks to Rob Baldwin, Manager, Watershed Science for joining himself and Township staff on site visits. (c) Red Barn Theatre Mayor Rob Grossi advised that the Red Barn Theatre is now back in business (following a fire) out of their temporary location at the Stephen Leacock Theater, Town of Georgina. Mayor Grossi asked Members to support the Theatre which delivers great shows by attending some of the events. In addition, Chair Hackson suggested that if any municipalities are looking for prizes (ie golf prizes, staff prizes, gifts, etc.) to consider purchasing Red Barn theatre tickets. (d) Arnold C. Matthews Nature Reserve The Board viewed a video taken at the Arnold C. Matthews Nature Reserve dedication ceremony. This event was attended by approximately 200 guests including Minister Cansfield, Ministry of Natural Resources, Julia Munro, MPP, York Simcoe, and Mayor Rob Grossi, Town of Georgina, LSRCA Board Member. Since then, York has experienced overwhelming success in increased calls to 9 -1 -1, leading to increased arrests of impaired drivers Safe Roads...Your Call was launched in Simcoe County on April 22, 2008, following its adoption by County council. This was the result of work by 3 partners: The County of Simcoe; MADD Barrie Simcoe Branch; and RIDE 24/7 (a coalition of community partners with particular interest in road safety, including all 6 police agencies who serve Simcoe County). This partnership provided 115 road signs displayed on county roads. MADD and RIDE 24/7 equally shared the cost of purchasing the signs and the County installed them at its own expense. Generally, signs were installed at major intersections and at County boundaries. In the summer of 2008, the city of Orillia also adopted Safe Roads...Your Call, and 10 additional signs were installed in that community. The cost of the signs was covered by RIDE 24/7, and installation was handled by the municipality. Since the implementation of Safe Roads...Your Call in the County of Simcoe and the City of Orillia there has been a significant increase in the number of phone calls to 9 -1 -1 to report impaired driving. The OPP 9 -1 -1 Communication Centre has received 3,142 calls reporting possible impaired drivers between May 2008 and May 2009. As a direct result of these calls, many potentially dangerous drivers have been taken off our roads, making them safer for us all! Last spring, twenty municipalities from across Simcoe County came together united in the fight against Impaired Driving by launching the program. Over a year ago I attempted to bring to your attention what I consider to be a matter of importance regarding a potentially dangerous situation affecting public safety respecting the current speed limit on the stretch of road on the 4th Line North between Mount St. Louis Road and the Ingram Side -road. You may be aware of a previous decision by council to lower the speed limit from 80 to 60 km /hr between Mount St. Louis Road and the Moonstone Side -road on the 4 Line North based on similar concerns to mine and my neighbours. The reason that I got involved was that one of the children that visits my barn told me that her father was so upset with the speeding drivers on our road that he was considering throwing rocks at them. My reaction was to attempt to teach them and my other concerned neighbours that there is a better way to resolve the issue. It seemed to me that working through the appropriate channels and due process was the appropriate action. I initially called the roads department and requested that a multi -user caution sign be placed at the top of the first blind hill to alert drivers to the lawful activities that frequently take place and the need to share the road with the participants in those activities. Any type of sign was denied because of potential litigation resulting from assuming liability by the township. I have noted that throughout the township similar existing signs have not been removed. My next step in the process was to write a letter to council (August 22, 2008) with the supporting signatures of 18 of 22 tax payers along this stretch of road. I appeared before the committee in whole as a deputation and was told that a study would be conducted to determine if a speed reduction would be extended down the 4 line to Ingram Side -road, as requested in my letter. I understand that this apparently is a low priority issue, however, one year has passed and nothing has happened. I contacted Road Superintendent Ball with phone calls through -out the year and was assured that the study would eventually be conducted. Our request has apparently been lumped together with further similar requests from other residents throughout the township and I have been told that they would all be addressed together. Personally, I have concerns about this. My thoughts are that each situation should be looked at on its individual merit from a risk management assessment. However, when a majority of residents in one particular area come forward and identify a high risk and seek help to reduce their risk one would hope that appropriate action would be taken. I now wonder what I have achieved in my quest to teach my young neighbours about what I believed to be the best possible solution, i.e. to bring this issue to council's attention for resolution. As stated above I initially requested a caution sign. Once again I would like to ask for consideration in this regard. My personal use of this road, as an equestrian, is a huge concern to me for personal safety. 1 am enclosing some articles of interest relating to this. A tragedy occurred in a neighbouring municipality last April involving a horse and rider. The Ontario Equestrian Federation (membership 18,500) has responded with an educational program for riders. I believe that the general public also needs to be educated and I view a caution sign as a good way of alerting them to equestrians sharing the road. I have also obtained permission from the author of a safety guide to use it as an educational tool for drivers in rural areas. Included in the guide are appropriate references from the Highway Traffic Act. Did you know: Frightening a horse on the road is in fact a ticketable offence? Per the Highway Traffic Act: Part X, section 167 Pass Slow and Wide! Horses have minds of their own, like small children, and as flight animals can often behave in ways that do not seem logical to humans Please slow down, especially on dirt or gravel roads where debris might be flung at riders and horses, causing not only injury, but also unexpected behaviour from the horses. Fact: Riders may be encountered on roadways during all seasons. Be especially careful during winter months where our options are limited if the horse does something unpredictable. If you do come across a frightened horse, please stop until the horse is back under control. Hints and Tips: Riders are very aware of the traffic around them. In the past you could ride down a road and cars would move over or even stop to allow you to ride. However, most motorists don't know that horses still have the right of way according to the highway traffic act. Today's drivers are distracted by cell phones, GPS's, children and the hustle and bustle of busy lives. Riders need to become proactive when it comes to riding on the roads. I recommend that ki riders wear a florescent vest, reflective tape on the back of saddles and on the back of boots or use some bright orange cloth and make ankle wraps. The trick is to get the drivers to see you in hopes that they will slow down and move over. Also remember, when crossing the road in e group make sure to take your time and allow enough time for all to cross before riding on. Tree Seedling Distribution Project SSEA Final Report May 2009 Background Severn Sound Environmental Association (SSEA), North Simcoe Stewardship (NSS), and the Townships of Tay, Tiny, Oro Medonte and the Towns of Midland and Penetanguishene partnered together to provide local residents of the five municipalities with reasonably priced, native tree seedlings for planting in the spring of 2009. SSEA coordinated the program, ordering the seedlings, providing promotional materials to the municipalities, receiving seedling orders and payment from residents, and coordinating the pickup and distribution of tree seedlings. Results Nursery Seedling Order The preliminary bulk tree seedling order was placed with the nursery in mid August 2008. The nursery has a large demand for seedlings, and some species and quantities requested were not available, despite the fact that the order was placed almost nine months in advance of the distribution date. The bulk seedling order was finalized with the nursery in March 2009, following the tree order deadline for residents. Promotion In January 2009, SSEA produced a one -page promotional sheet for each participating municipality (Appendix A) that included a species and price list. Each municipality was responsible for determining how to best distribute the information to residents. Municipalities typically included the promotional sheet with tax bills, or mentioned the program in a newsletter or newspaper; information was also posted on municipal and SSEA web sites. In addition, SSEA directly emailed past project participants to notify them the program was being offered again in 2009. SSEA also prepared more detailed information, including answers to `Frequently Asked Questions' to assist landowners in selecting species, planning for tree planting, and handling and planting trees. This information (Appendix B) was posted on the SSEA web site. Landowner Seedling Orders SSEA accepted seedling orders by email or by telephone, to allow verification that the seedlings would be available from within our bulk seedling order. Response to the 2009 Tree Distribution Project was very good. In total, 225 participants purchased 11,040 trees and shrubs of nine different species (Table 1). Many of the species offered sold out just before the tree order deadline (February 27 2009). General information on demand for additional species and quantities was tracked to help estimate seedlings that should be preordered in the future. When seedling orders were placed, approximately 90% of the participants provided an email address for correspondence about the program. Having email addresses enabled SSEA to quickly provide order confirmation information to participants, as well as send out reminders about the pick up day. Generally, larger orders of 100 trees or more were primarily composed of conifer species (pine, spruce, fir and cedar), which are likely being used for reforestation efforts. Smaller orders usually contained a larger proportion of hardwood trees and shrubs, which the landowner may be using for ornamental and /or wildlife habitat enhancement purposes. In March, SSEA generated receipts and pickup instructions for each order, which were mailed to participants by the municipalities in early April. SSEA received seedling orders from landowners in other North Simcoe municipalities, including the Townships of Severn and Georgian Bay. By pre arrangement, these residents picked up their seedlings from a location in one of the participating municipalities, since there was no designated distribution location in the Townships of Severn or Georgian Bay. Demand for tree seedlings continued for weeks following the order deadline; email addresses were tracked for disseminating information on a 2010 Tree Distribution Program. Seedling Pickun. Sorting Distribution The bulk tree seedling order was picked up on May 1 by SSEA staff (one van, on pickup truck), and one pickup truck each from North Simcoe Stewardship, Town of Midland, Township of Tay, and Township of Tiny. There were 85 large bags of seedlings in the bulk order, and there was adequate room in the six vehicles to transport the entire order in one trip. Volunteers, SSEA, NSS and municipal staff sorted the seedlings into individual landowner orders at the Township of Tay Roads Garage in Victoria Harbour in the afternoon on May 1 Orders for each municipality were then transported to the designated pickup locations by municipal staff. A joint pickup location for Midland and Penetanguishene residents was used, with the idea that the pickup location would alternate between the two municipalities each year; Oro Medonte, Tiny, and Tay each used a facility in their own municipality to reduce travel time for residents (Table 2). On distribution day, participants were provided with a Tree Planting Tips sheet (Appendix C). Expenses Compared to Revenue The main expenses SSEA incurred for the 2009 project were staff time (processing seedling orders and project coordination), tree seedlings, mileage /vehicle costs, printing expenses, and materials (i.e., tree bags for packaging individual orders); sources of revenue included NSS funding, and proceeds from tree sales (Table 3). In 2009, the revenue generated from tree sales and partner funding was sufficient to cover the cost of trees as well as all of the project expenses (Table 3). Conclusions and Recommendations The pilot project in 2007 and expanded programs in 2008 and 2009 confirm that there continues to be a large demand by local residents for a native tree distribution program. In 2009, demand for seedlings continued for weeks after the order deadline, and many participants in all municipalities expressed an interest in purchasing trees again in 2010. This is a popular program that encourages private landowners to become involved in tree planting, improving environmental health at the local scale and beyond. Consequently, it is recommended that the program be offered again in 2010. The preliminary tree seedling order should be placed as early as possible, and no later than August 2009 in preparation for the 2010 Tree Distribution Program. The provincial government's 50 Million Tree Program (large -scale tree planting) has increased demand for seedlings from nurseries. Longer time frames would be beneficial for dissemination of promotional materials and providing residents with ample time to consider participating in the program. Municipalities have varied deadlines for tax bills and other municipal mailings, and longer time -frames would allow for a variety of promotion options to be utilized. A large bulk tree seedling order requires a considerable amount of vehicle space to transport. Bare -root seedlings arc fragile and need to be handled carefully. Truck and trailer combinations or larger capacity trucks would reduce the number of vehicles required to pickup the bulk seedling order. If possible, depending on the size and type of vehicles the municipalities can send, SSEA will alternate the municipalities requested to assist with tree seedling pickup each year. Municipal staff and/or representatives assisting with seedling sorting and distribution worked well, providing a more visible partnership to the program, and helping to keep implementation costs low. Recommendation #1: Continue the tree distribution program in 2010. The stock is grown in fields, and is harvested in early spring when the plant is dormant. Bare -root stock is perishable, and must be handled carefully and planted as soon as possible. Buying bare -root stock is considerably cheaper than purchasing container -grown plants. How big will the tree seedlings be? In general, seedlings are 1 to 4 year -old bare -root plants (i.e. not potted). Seedlings are approximately 15 to 60 cm (6 to 24 in height, and ''A cm (1/4 in stem diameter. Tree seedlings are perishable, and must be handled carefully and planted as soon as possible, ideally the same day they are picked up. Where ran l find details about the pick date, times and location? The pick -up day for tree orders will be in late April or early May 2009. The pick -up date and location varies by municipality. Receipts and pick -up instructions will be mailed in late March 2009, when the details are finalized. Receipts will be required as proof of purchase on the pick -up date. If you are unable to pick up your seedlings, you are required to make arrangements to have someone pick up your order on your behalf (send your receipt with them). We do not have the appropriate facilities available to store or distribute seedlings after the pick -up day. Tree bags are large paper bags with a plastic liner, similar in size to a large curbside garbage bag. Depending on the type and size of the trees and the quantity of trees in the order, more than one tree bag may be required. A trailer is not generally needed for picking up seedlings. Tree orders containing several hundred trees and /or a large proportion of evergreen seedlings will be bulkier than small orders of hardwood/shrub seedlings. It is important to handle seedlings gently, and keep the seedlings cool and well ventilated at all times. Legal Legislative Services To: Clerks of Rural and Northern Municipalities in the Province of Ontario August 13, 2009 Sent via email Re: Support of Moratorium Call by Ontario Medical Association to Halt Major Health Care Restructuring Decisions The Municipal Council of the Town of Fort Erie at its meeting of August 10, 2009, passed the following resolution regarding the above matter: WHEREAS in April 2009, Hearth Minister David Caplan announced the establishment of the Rural and Northern Health Care Panel and his commitment "to examining these issues and providing a Provincial Framework to support rural communities," and WHEREAS as part of the first stage, the Rural and Northern Health Care Panel will collate and review the current activities underway across the Province; it will provide recommendations to identify unique needs: it will co- ordinate metrics and targets to be achieved through strategic investments; and it will examine the existing programs and services targeted to northern and rural Ontario, and WHEREAS in July 2009 the members appointed to the Panel were announced and they will recommend steps the Province can take to improve access to health care in rural and northern communities including identifying rural Ontario's unique health care challenges, such as increased travel time required to access health care facilities, recruiting and retaining qualified health care professionals, and providing timely emergency services to remote locations, and WHEREAS the Ontario Medical Association recently called upon the Provincial Government to place a moratorium on major health care restructuring decisions until the Rural and Northern Health Care Panel reports its findings and makes recommendations, and WHEREAS it is deemed expedient to support the Ontario Medical Association in its moratorium efforts; NOW THEREFORE be it resolved by the Municipal Council of the Town of Fort Erie that it hereby petitions the Province of Ontario to act according to the call for a moratorium by the Ontario Medical Association to stop all major health care restructuring decisions until the Rural and Northern Health Care Panel reports its findings and recommendations, and order the LHIN's and hospitals in rural and northern communities to put a hold on major restructuring of health care services, and further THAT the Minister of Health take special notice and immediately halt the conversion of the Emergency Department at Douglas Memorial Hospital to an Urgent Care Centre scheduled for September 27, 2009 and reverse the action taken at Port Colborne General Hospital pending the outcome of the Panel's report and development of the expected action plan, and further Our Focus: Your Future Mailing Address: The Corporation of the Town of Fort Erie Municipal Centre, 1 Municipal Centre Drive Fort Erie, Ontario, Canada L2A 2S6 Office Hours: 8:30 a.m. to 5:00 p.m- Tel: (905) 871 -1600 Fax: (905) 871-4022 Web -Site: www.forterie.on.ca Page 79 of 146 Agenda Item 7b) Mayor H.S. AND THAT the Mayor and Clerk be authorized to execute the Memorandums of Understanding with Burl's Creek Family Event Park and the Ontario Provincial Police regarding the Virgin Fest Music Festival scheduled for August 28, 29 and 30, 2009. Burl's Creek, together with Live Nations, will be hosting the Virgin Fest Music Festival on August 28, 29 and 30, 2009. Last year, these two organizations hosted the Jack Johnson concert on August 2, 2008, in which approximately 25,000 people attended the one (1) day event. With the exception of traffic flow and parking issues, the concert was a success. The Virgin Fest Music Festival scheduled for late August, 2009 is anticipating a larger and younger crowd for the three (3) day event. As such, various staff from Burl's Creek, Live Nations, County of Simcoe, the O.P.P. and the municipality have been meeting to prepare an operational plan to address issues of traffic flow, parking, medical attention and an emergency detour route. ANALYSIS: At the information meeting held on July 27, 2009 at Barrie O.P.P. headquarters, Detachment Commander Andy Mayo advised that there would be 97 "on duty" or "paid duty" officers assigned to this event. Fire and Emergency services advised that there would be five (5) units and four (4) manned units, respectively, on site during the event. Transportation and Environmental Services will be purchasing and installing "No Parking" signs on the east and west sides of Lines 7, 8 and 9, from Highway #11 to the Ridge Road. Also included in this no parking zone will be the Canterbury Subdivision. Since the July 27 meeting, the County of Simcoe Engineering Department has advised that upon Council approval, "No Parking" signs will be installed on Ridge Road, from Line 7 easterly to Line 9. As indicated within the MOU for traffic and parking, the O.P.P. will enforce the NO PARKING zone on Lines 7, 8 and 9 from Highway #11 to the Ridge Road. The Township Municipal Law Enforcement division will patrol and enforce all parking issues outside of the special event area. In the event of an accident or highway shut down on Highway #11, an Emergency Detour Route has been developed to detour traffic to the north side of Highway #11 and along 15/16 Sideroad, and then south to the Burl's Creek. This will reduce traffic volume along the Ridge Road and eliminate congestion for local residents. FINANCIAL: The cost to purchase the "No Parking" signs, including "u" channel posts, hardware and installation, is estimated at $12,000.00. These costs, including a yearly maintenance fee, are to be recovered from Burl's Creek Family Event Park. September 1, 2009 Ontario Growth Secretariat Ministry of Energy and Infrastructure 777 Bay Street, 4 Floor, Suite 425 Toronto ON M5G 2E5 Proud Heritage, Exciting Future RE: Township of Oro Medonte Submission —Simcoe Area: A Strateaic Vision for Growth The Township of Oro Medonte is a primarily rural municipality located between the Cities of Barrie and Orillia along the north shoreline of Lake Simcoe. The Township has a population of 20,800 (in 2006 census) which increases with the seasonal population to approximately 25,000 with property owners who live full -time in the Greater Toronto Area and migrate to their seasonal homes. The Township was formed through amalgamation in 1994. The first Official Plan was completed in July 1995 with a vision that recognized: the location and importance of the environmental features and natural resources of the Township, the rural character of the area, the socio economic characteristics of the area; and the needs of present and future residents. In July 2001, the Township initiated a review of the Official Plan to ensure that the policies clearly articulated the desire to protect the Township's natural features and related ecological functions. This Plan was intended to provide the basis for managing change in the Township to the year 2023 and designated sufficient land for commercial, industrial, and residential uses for the identified planning horizon. With the adoption of the County of Simcoe Official Plan in November 2008, and the requirement for the Township to be consistent with Provincial legislation including the Provincial Policy Statement and the Places to Grow Growth Plan, the Township is proceeding with a review of their Official Plan anticipating a completion in June 2010. The Township has historically had one of the higher population growth rates in the County. The Township is attractive because of its recreational and rural character as well as its location next to the growing Cities of Barrie and Orillia where major urban services and employment opportunities are available. The Township's Official Plan contains a number of policy directions and designations which have a direct influence on the comments being submitted to the Province in regard to the Simcoe Area: A Strategic Vision for Growth which were discussed with Ministry and County representatives at a meeting on August 13, 2009. Coordinating growth with infrastructure investment. While the Township supports these guiding principles, there are specific concerns with the potential impacts of their implementation within Oro Medonte. They are as follows: Population Allocation The population and employment allocations identified in Tables 2 and 3 allocate an additional 6,200 people and 1,300 employment jobs to the Township of Oro Medonte to 2031. The Township's Official Plan approved by the Ontario Municipal Board in 2007 identifies a permanent population increase of 8,000- 10,000 people by 2023 to approximately 29,000 and a seasonal increase in population of approximately 4,000 -5,000 people. The allocations identified by the Province to 2031 result in a reduction of 1,100 people to 27,000 from the projections identified in the adopted County Official Plan and a reduction of 2,000 in the Township OP allocation. The Township has serious concerns with the allocation reductions based on existing approvals (registered and draft plan), seasonal conversions, and the OP identification of growth areas including Craighurst and Horseshoe Valley to be developed as "complete communities" consistent with provincial direction. As noted below, Horseshoe Valley is one of two developments owned by Skyline Development known as "Georgian Valley", the current Official Plan identifies approximately 750 dwelling units and 1000 medium density units some of which are seasonal in nature. Through a design charette and master plan process, this number of units has increased and exceeds the Provincial allocation; but would achieve all other goals of the Provincial policies and as noted below provide a major economic benefit to Oro- Medonte and the surrounding area. Given the Province's decrease in allocations, the Official Plan review to be completed in 2010 will necessitate consideration of down designation of settlement area lands and the Township's inability to be consistent with provincial policy in the development of complete communities in order to achieve the allocations in the Simcoe Area: A Strategic Vision for Growth. Any further reductions in these allocations will further impact the municipality's ability to plan for development consistent with provincial policy direction. In addition, given that the Township includes a portion of the Lake Simcoe shoreline and the entirety of Bass Lake, the Township has a number of seasonal units (owned by GTA residents) and this allocation is not identified in the proposed population allocation. The Township has historically seen an increase in the conversion of these units from seasonal to year round occupancy which would therefore increase the population allocation provided to the Township without any additional permissions (building permits, rezoning) being required from the Township. This seasonal conversion has the ability to further restrict the reduced allocation being suggested by the Province. Strategic Employment Areas Figure 1 of the Strategic Vision identifies a "Highway 11 Employment District in the Simcoe County Official Plan (not approved)" which are identified as being of local importance and are intended to be recognized through a proposed growth plan amendment (Page 19). The Economic District within Oro Medonte is the Lake Simcoe Regional Airport and the surrounding lands that have been designated in the Township's Official Plan since 1995 for airport- related Industrial development. The Township proposes the following regarding the permitted uses identified for these lands: airport facilities and accessory uses, airport related manufacturing, assembly, maintenance, processing, fabrication, storage and /or warehousing uses, research establishments, business offices, and wholesaling establishments. The Township requests that the lands identified on the attached map (See Attachment #1) be the identified boundaries of the "Highway 11 Employment District" and include lands located between Concessions 5 and 8. Edgar Special Policy Area The Township has lands designated as the "Edgar Special Policy Area" as shown on the attached map (See Attachment #2). This property is the former Edgar Occupational Centre which was owned and operated through the Province. The property was developed in 1952 as a radar base, in the early 1960's the property was transferred to the Management Board Secretariat to be utilized as a residential and occupational facility for adults with developmental disabilities and was used in this capacity until March 1999 when the facility was closed. At the time of the facility closing, the property was designated a special policy area in order to recognize the existing sewer and water infrastructure and to enable the re -use of the existing structures and property. The Official Plan policies clearly articulate that only development which utilizes the existing infrastructure capacity is permitted, based on the sewage treatment plant capacity to treat 62,500 gallons of effluent per day, equating to a 625 person maximum development capacity on the property. The Ontario Realty Corporation (ORC) is currently canvassing for expressions of interest to consider the potential re- development of these lands. It is recognized that the property is not located within a designated settlement; but currently exists and provides for a fully serviced community with a number of the amenities and features associated with a "complete community The Township is requesting that the Province to confirm their support by recognizing the existing designation and permission for re- development of this property; which will enable the ORC to continue with this endeavor as well as the co- ordination between the various provincial ministries. Craighurst Settlement Area In 1997 the first Official Plan for the amalgamated Township of Oro Medonte was approved, and encouraged future development to occur in settlement areas. It identified Craighurst as one of two areas (Hawkestone being the other) in which long -term planning to accommodate growth should be carried out. The Secondary Plan for Craighurst was initiated in 1999; and after several delays, including the Intergovernmental Action Plan (IGAP), Oro Moraine Land Use planning exercise, and the Official Plan review from 2001 to 2006, was adopted by Oro Medonte Council on May 27, 2009. The Secondary Plan provides for this partially serviced settlement to proceed with additional development on the basis of full municipal services and the provision of a range of services and amenities in the development of a "complete community" consistent with provincial direction. The Secondary Plan was adopted on the basis of the alternate density target established in the adopted County Official Plan with the requirement for a minimum density of 32. The Strategic Vision (page 21) identifies that the Minister may permit an alternative target to recognize municipalities with few and small settlement areas and lower forecasted growth. The alternative density target of 32 for Craighurst will provide the municipality with the ability to meet all planning policies of the PPS and the PTG, and the Simcoe Growth Plan but also maintain the rural character and quality of life which is desired by our residents. The Township is therefore requesting confirmation of the Province's support for the alternate density target requirement for a minimum density of 32 as established through the adopted County of Simcoe Official Plan. Recreation and Tourism Development The Simcoe Area: A Strategic Vision for Growth provides direction that municipal official plans are to provide appropriate planning direction and limits on development associated with tourism and recreational activities. The Township has a number of recreation and tourism facilities (including downhill and cross country ski facilities, mountain biking facilities, golf courses, and a special events park) one of which is Horseshoe Valley Resort. Horseshoe Valley Resort was recently purchased by Skyline International Development with the intent to proceed with development of the resort lands for a major resort commercial and residential development. Horseshoe Valley is a designated settlement area in the Township and County Official Plans as identified on the attached map (See Attachment #2). Combined, these two projects form "Georgian Valley" two major recreation -based developments intended to provide regional economic significance for North Simcoe. The development at Horseshoe Valley meets all of the planning objectives of the provincial policies it is to be fully serviced, provides for both housing and employment, promotes the development of a sustainable and compact community which will enhance the well being and quality of life that is important to residents of Oro Medonte. The Township respectfully requests that these projects be recognized as a `Tourism Destination" in the Simcoe Area: A Strategic Vision for Growth document and that given the nature of the seasonal, recreational -based population and employment allocations associated with this development they be excluded from the population and employment allocations for the Township in order to promote this development which promotes economic development beyond the two Townships. On behalf of Oro Medonte, we would respectfully request that the Province consider that planning by numbers, based on population and employment allocations, does not provide the Township the flexibility to satisfy Provincial policies and direction. Planning strictly on the basis of allocations will result in negative implications (phasing, down designation) in the Township and put the municipality in a position of being unable to achieve the Province's principles outlined in the Growth Plan, Places to Grow, and the Provincial Policy Statement to build strong complete communities. Last year, these two organizations hosted the Jack Johnson concert on August 2, 2008, in which approximately 25,000 people attended the one (1) day event. With the exception of traffic flow and parking issues, the concert was a success. The Virgin Fest Music Festival scheduled for late August, 2009 is anticipating a larger and younger crowd for the three (3) day event. As such, various staff from Burl's Creek, Live Nations, County of Simcoe, the O.P.P. and the municipality have been meeting to prepare an operational plan to address issues of traffic flow, parking, medical attention and Emergency Fire Services and an emergency detour route. ANALYSIS: At the information meeting held on July 27, 2009 at Barrie O.P.P. headquarters, Detachment Commander Andy Mayo advised that there would be 97 "on duty" or "paid duty' officers assigned to this event. Transportation and Environmental Services will be purchasing and installing "No Parking" signs on the east and west sides of Lines 7, 8 and 9, from Highway #11 to the Ridge Road. Also included in this no parking zone will be the Canterbury Subdivision. Since the July 27 meeting, the County of Simcoe Engineering Department has advised that upon Council approval, "No Parking" signs will be installed on Ridge Road, from Line 7 easterly to Line 9. As indicated within the MOU for traffic and parking, the O.P.P. will enforce the NO PARKING zone on Lines 7, 8 and 9 from Highway #11 to the Ridge Road. The Township Municipal Law Enforcement department will patrol and enforce all parking issues outside of the special event area. In the event of an accident or highway shut down on Highway #11, an Emergency Detour Route has been developed for Rescue 7 to detour traffic to the north side of Highway #11 and along 15/16 Sideroad, and then south to the Burl's Creek. This will reduce traffic volume along the Ridge Road and eliminate congestion for local residents. FINANCIAL: The cost to provide adequate Emergency vehicles and a 24 hr. Emergency personnel standby for 3 days is $24,750. These costs, shall be paid to the Township of Oro Medonte by the Event organizer Live Nations Virgin Festival before the conclusion of the Event.. An agreement was developed which formed the basis of a partnership and relationship with the Oro Medonte 77's. The agreement was also necessary to define roles and manage associated risks with a Junior "A" franchise. The agreement was approved by Council in By -Law 2008 -080. The 2008 -2009 hockey season was a success and the club wishes to renew the agreement for the 2009 -2010. Attached is the draft agreement for the 2009 -2010 season and facility rental permit #2484. Use of Facility {i) The Township of Oro Medonte (hereinafter called "the Township and The Oro Medonte 77's Junior Hockey Club (hereinafter called "The Club WHEREAS The Club has the intention of utilizing the Oro Medonte Community Arena, hereinafter referred to as "The Arena during the 2009/2010 hockey season; AND WHEREAS all parties wish to clarify the conditions affecting use of The Arena; NOW THEREFORE the parties hereto covenant and agree each with the other as follows: This Agreement shall be in force and effect from September 16, 2009 to April 6, 2010 or until the end of The Club's 2009/2010 Hockey season, whichever date occurs first. The date will not go beyond April 9, 2010. (a) In accordance with this Agreement and the Township Facility Permit, which is issued further to this Agreement, the Club is hereby entitled to use The Arena facilities to play each of its regularly scheduled hockey games of its league schedule and its playoff schedule for the 2009/2010 hockey season. (b) The Arena facilities, which The Club shall be entitled to use for the duration of this Agreement, shall include the following: The ice surface including seating areas for games and practices. (b) The Permit holder must comply with all Federal and Provincial laws and Township By -laws, and with all Township policy and procedures. (c) The Permit holder is prohibited from selling or distributing articles in any facility without prior consent from the Director of Recreation and Community Services. (d) The Permit holder agrees to follow all posted rules and regulations of The Oro Medonte Community Arena. All activities must be conducted in a professional manner. (e) The Permit holder must be 18 years of age or older and must be present for the duration of times as outlined on the Permit. (f) It is also agreed that no food and /or beverages will be sold on The Arena premises, excluding the Booster Club where alcohol may be served in accordance with Township of Oro Medonte Municipal Alcohol Policy. (g) The Oro- Medonte is a smoke free facility and all visitors to the facility must abide by the no- smoking regulations in place. (h) Flood Time: i) One ice hour ice time will be based upon a 50 minute hour allowing for 10 minute flood tune. ii) The Township reserves the right to adjust ice time for additional flood time if required to maintain ice thickness requirements. (i) Banquet Hall (i) A booster club will be permitted in the banquet hall on game nights under separate permit. The permit will be subject to the terms and guidelines in the Municipal Alcohol Policy. (ii) No minors will be permitted in the Banquet Hall for a special occasion permit function. Rental Fee 5. Keys (a) The Club hereby agrees to pay $77.00 hour for non -prime time rental and $130.00 /hour for prime time rental, inclusive of GST, per hour for each hour or portion thereof of ice time scheduled or used by The Club; (b) The club agrees to pay $164.00 for licensed functions in the Banquet Hall (Booster Club) $290.00 for Special Events with LCBO Special Occasion Permit and 528.00/ hour for meetings. (c) The Club hereby agrees to arrange for and to pay directly for the cost of employing all attendants necessary for the sale and retrieval of all tickets required at games, plus the supervision of the building in order to assure the safety of the public and the security of The Arena facility. Adequate attendants are necessary to ensure all entrances are monitored. (a) The Township shall at its discretions supply keys to the Club. (b) Keys cannot be consigned to others unless The Club has obtained the prior written approval of the Township. 6. Buildine Security and Protection of the Public (a) The number of Police Officers /Security Staff required to be on duty will be determined by The Club in conjunction with the Township, recognizing that it is The Club's responsibility to protect the public, maintain crowd control and ensure that The Arena is being operated in a safe manner during all of The Club's games. (b) Any person who has in his or her possession any intoxicating substance or who appears to be unpaired or displaying improper conduct will be removed from the Facility. Adherence to Legislation. S. Reuuirements Regarding Serving Alcohol: (a) In the event The Club wishes to serve alcohol, it is the sole responsibility of The Club to obtain a liquor license and to provide a copy of the license to the Recreation and Community Services Department in advance. (b) All servers must have Smart Serve certificates. (c) Compliance is required with the Township Municipal Alcohol Policy. The Club will be held solely liable for injuries and/or damages arising from failure to adhere to Township policy and regulatory requirements. 9. Fire Safety (a) All announcements will be made by The Club over the Arena public address system regularly before and during each game advising the public that smoking is prohibited in all areas of the Arena. Also, The Club shall announce the license plate number of vehicle(s) parked in the fire route outside The Arena and request that all vehicles be relocated from the fire route in a timely manner, The Township reserves the right to contact the Ontario Provincial Police, and or Oro Medonte Fire Department and advise them of any situations that may arise in this regard. (b) The Club shall check the number of people being admitted to each game and ensure that the maximum number does not exceed 400 persons. The distribution of spectators shall be as follows: Bleachers -225 persons Lobby Seated 35 persons Standing (Lobby and Stands) 40 persons Banquet Hall 100 persons Note: The maximum occupancy and the following distribution numbers are based on crowd control and functionality of facility. (d) The Club shall advise and provide confirmation in writing to the Township at least fourteen days in advance of any planned special event programs for any game. (e) All exits must be kept free and clear at all times. (f) The Club will be required to attend training and carry out all fire evacuation procedures as directed by Township Arena Attendants for which an acknowledgement of undertaking will be signed. (g) 10. Season Scheduling The dressing room hallway must be kept clear at all times. The Club will advise visiting teams of this requirement. (a) The Club agrees to the schedule of times and dates indicated on the Permit when the Arena will be required throughout the season. Cancellation and additional bookings must be confirmed with the Township in writing at least one week in advance of the date in question. The normal hourly rate will be charged in accordance with paragraph 4(a) hereof if cancellations are not received at least one week in advance. Unavoidable emergency cancellations (i.e. road closures) will be accepted by the Township up to two hours before the game time with no penalty or charges to The Club or commitment from the Township to provide alternate ice time. The days and times indicated on the Permit will continue depending on The Club's Hockey season as required but not beyond April 9, 2010. Record Keening The Club agrees to maintain an accurate count of the number of people admitted for each game. The Club agrees to maintain all necessary records for the duration of this Agreement and to provide a detailed breakdown of attendance to the Township upon request. 12. Removal of Offending Patrons Township employees shall have the right to refuse admission to any person or persons to the Arena, or may require that any person leave or be removed from the Arena. 13. Damage to the Premises The Club agrees to assume responsibility for all costs relating to repairs to The Arena structure and contents resulting from misuse of the facilities by The Club or its guests. 14. Stored Equipment It is understood and agreed that any equipment left or stored at the Arena shall be the responsibility of The Club and The Club agrees to indemnify and save harmless The Township for any claim or claims against such equipment so left or stored. The Club agrees to remove all equipment from The Arena, including equipment belonging to its hockey players, immediately at the end of the hockey season. The Club is obligated to ensure that storage is neatly organized and not in contravention of fire codes or health standards. The Township reserves the right to inspect the rooms used by The Club and stipulate requirements to ensure health safety. 15. Local Hockey Assistance The Club will provide players, coaches and training staff to assist Oro -Minor Hockey with its local hockey program. The Club also agrees to provide additional assistance to the Oro -Minor Hockey League and Oro Skating Club with terms being agreed upon between the parties. 16. Use of Banquet Hall The Club shall be entitled to have the use of the Banquet Hall in The Arena subject to availability under separate permit at the described costs in 4b. Use of Township Symbol or Louo The use of The Township symbol or logo is not permitted and is strictly prohibited without written consent from the Director of Recreation and Community Services. 18. Invoices and Payment (a) Monthly payments of from The Club to the Township commence September, 2009 for ongoing ice rental. Payments are due the last business day of each month. The final month will be adjusted to reflect the actual balance due. Monthly statements will be issued. The parties hereto agree to keep proper and complete accounts to enable each party to obtain sufficient information in order to determine what monies are due and payable under the terms of this Agreement. A representative of the Township of Oro Medonte will be on the Oro Medonte 77's Executive to act as liaison for the Township and will attend monthly meetings of the Executive. (b) Overdue accounts will be charged interest at a rate of 18% per month; failure to pay accounts promptly may result in Agreement and Permit cancellation. 19. Insurance The Club shall provide an up -to -date copy of its liability insurance policy with coverage of not less than TWO MILLION DOLLARS ($2,000,000.00) showing the Township as an additional named insured. 20. Guarantee (a) The Oro Medonte 77's Hockey Club, of the Township of Oro Medonte, County of Simcoe, hereby guarantees all and punctual payment of monies which are, or may become due and owing to the Township by The Club in accordance with the terms of this Agreement. (b) If The Club: (i) shall fail to pay any of its monthly installments for on -going ice rental or other sums payable under this Agreement when due, and allow such default to continue for five (5) days following the giving by the Township to The Club of written notice of such default; or (ii) if The Club shall fail to perform any of the other covenants or conditions in this Agreement or if The Club fails to observe or 7 of 10 Page 140 of 146 Agenda Item 12b) Memorandum dated September 2, 2009, Shawn Binns, Director of... perform any of the above, and allows any such default to continue for fifteen (15) days following the giving by the Township to The Club written notice of such default; then, the Term of this Agreement may, at the option of the Township and without notice to The Club, be terminated and the entitlements vested in The Club and any and all other rights of The Club hereunder shall thereupon immediately cease and expire as fully and with Iike effect as if the entire term of the Agreement had elapsed. (c) If The Club shall default in the performance of any covenant (other than any covenant to pay Rent) on its part to be performed under this Agreement, and if such default shall continue for fifteen (15) days following the giving by the Township to The Club written notice of such default, the Township may enter upon the assigned rental premises and shall not be liable to The Club for any loss or damage to The Club's merchandise or business caused by acts of the Township, acting reasonably in so remedying the default or neglect of The Club. (d) If the Township at any time is compelled or elects to pay any sum of money or do any act which would require payment of any sum of money by reason of the failure of The Club to comply with any provisions of this Agreement or if the Township is compelled or elects to incur any expense, including legal fees, by reason of any default of The Club under this Agreement, the sum or sums, including legal fees on a solicitor and client basis, so paid by the Township with all interest, costs and damages shall be deemed to be Additional Rent hereunder and shall be paid by The Club to the Township forthwith upon demand and upon presentation of proof of payment. (e) If the Township shall re -enter or if the Agreement shalt be terminated as set out above, then Rent in the form of the monthly installments shall immediately become due from The Club and be paid up to the time of such re -entry or termination, together with reasonable expenses of the Township.. 21. Termination Upon Notice With Cause 21. Notice The Township may terminate this Agreement forthwith, without liability, and without limiting any of its other rights or remedies, upon written notice to The Club if: (a) The Club is in breach of, or attempts to breach, any of its obligations under this Agreement; The Club is unable to pay its debts when due or is insolvent, is ordered or adjudged to be bankrupt, is placed in the hands of a receiver, enters into any scheme or composition with her creditors, is dissolved, liquidated or wound up, or makes any assignment for the benefit of their creditors; or (c) Either party is unable to carry out their obligations under this Agreement by reason of a Force Majeure, meaning any bona fide delay or state of affairs beyond the control of a party (other than as a result of financial incapacity) which shall cause any party to be unable to fulfill or to be delayed or restricted in the fulfillment of an obligation. (b) 23. Assignment The Club may not assign this Agreement or any of its rights hereunder or assign or delegate any of its obligations hereunder without the prior written permission of the Township. Any such assignment shall be null and void. This Agreement and The Club's rights and obligations hereunder may be assigned by the Township. This Agreement shall bind and inure to the benefit of the parties hereto and their respective and permitted successors and assigns. 24. Entire Agreement This Agreement contains the entire agreement between The Club and the Township and supercedes any prior agreement, obligation, statement, representation, understanding, warranty or communication, whether oral or written. No waiver or modification of any provision of this Agreement shall be binding unless it is in writing and signed by each of the parties. Any notice required or permitted to be given hereunder shall be given in writing and shall be deemed to have been received (i) upon personal delivery, or (ii) five days after being deposited in the Canadian mail system, whether by registered or certified mail, express mail, or postage prepaid, where addressed to either party at the addresses set forth herein.
