2009-111 Memorandum of Understanding between the Township of Oro-Medonte and Ontario Provincial Police (OPP)THE CORPORATION OF THE TOWNSHIP OF ORO-MEDONTE By-Law No. 2009-111 Being a By-Law to Authorize the Execution of the Memorandum of Understanding Between the Township of Oro-Medonte and Ontario Provincial Police (OPP) WHEREAS Section 224 of the Municipal Act, 2001, S.O. 2001, c.25, as amended, provides that the role of Council is to ensure that administrative practices are in place to implement the decisions of Council; AND WHEREAS the Council of the Corporation of the Township of Oro-Medonte deems it expedient to enter into a Memorandum of Understanding with the Ontario Provincial Police (OPP) with respect to the purchase, installation and enforcement of "No Parking" signs for Special Events held at Burl's Creek Family Event Park's events; NOW THEREFORE the Council of the Township of Oro-Medonte hereby enacts as follows: 1. THAT the Mayor and Clerk be authorized to execute the Memorandum of Understanding attached hereto as Schedule "A" and forming part of this By- Law. 2. THAT this by-law shall take effect on the final passing thereof. BY-LAW READ A FIRST AND SECOND TIME THIS 9T" DAY OF SEPTEMBER, 2009. BY-LAW READ A THIRD TIME AND FINALLY PASSED THIS 9T" DAY OF SEPTEMBER, 2009. THE CORPORATION OF THE TOWNSHIP OF ORO-MEDONTE Schedule "A" to By-Law No. 2009-111 MEMORANDUM OF UNDERSTANDING made this 9th day of September, 2009. BETWEEN: THE CORPORATION OF THE TOWNSHIP OF ORO-MEDONTE (the "Township") OF THE FIRST PART - and - ONTARIO PROVINCIAL POLICE (the "OPP") OF THE SECOND PART WHEREAS both parties are desirous in forming a partnership to ensure proper enforcement of the Township's Parking By-law; AND WHEREAS it is mutually understood that the THEREFORE the parties here signed do agree to the following conditions: 1. Term of the Memorandum of Understanding ("MOU") 1.1 The term of the MOU shall commence on August 1, 2009 and expire within 30 days of written notice from either party. 1.2 If the Township or OPP fail to perform or observe any covenant, condition or agreement to the performed or observed herein and such default continues unremedied after written notice from either party, then either party may terminate this agreement within 30 days of receipt of written notice of such intent to terminate without prejudice to any other rights it may have in law or equity. 2. Conditions: 2.1 The Township will be responsible for the following: • Purchase and install of "No Parking" signs on Line 7, 8 & 9 from Highway 11 to Ridge Road and to pass a By-law to reflect the "No Parking" Zone. • The Township's Municipal Law Enforcement Division shall enforce the "No Parking" Zone at all times with the exception of Special Events at Burl's Creek Family Event Park as stipulated in Section 2.2 of the MOU. 2.2 OPP will be responsible for the following: To enforce the Township's Parking By-law, ticketing and towing all illegally parked vehicles on Line 7, 8 & 9 from Highway 11 to Ridge Road for Special Events held at Burl's Creek Family Event Park.
