ADOPTION OF AGENDA a) Motion for Adoption Motion No. SC090821-1 Moved by Crawford, Seconded by Evans Be it resolved that the agenda for the Special Council meeting of Friday, August 21, 2009 be received and adopted, as amended, to defer items: 5a) Report No. TES 2009-28, Jerry Ball, Director of Transportation and Environmental Services, re: Burl's Creek - Live Nations Music Festival; 5b) Report No. FD 2009-29, Richard Playfair, Director of Fire & Emergency Services, re: Burl's Creek - Live Nations Music Festival and 6d) Robin Dunn, Chief Administrative Officer, re: Legal Matter (Tax Registration). Carried. 4. "DISCLOSURE OF PECUNIARY INTEREST AND THE GENERAL NATURE THEREOF - IN ACCORDANCE WITH THE ACT" None declared. 5. Motion No. SC090821-2 Moved by Evans, Seconded by Crawford Be it resolved that 1. Report No. DS 2009-56, Andria Leigh, Director of Development Services, re: Township Official Plan and Zoning By-law Amendments (Try Recycling), Concession 8, Part of Lot 11 (Oro), 2009-OPA-01 and 2009-ZBA-07 be received and adopted. 2. That Council support the adoption of the appropriate Official Plan and Zoning By-law amendments to permit the proposed recycling establishment on a portion of the subject property. 3. That the appropriate by-laws for Official Plan Amendment and Zoning By-law Amendment be brought forward for Council consideration. 4. And Further That the applicant be advised accordingly of Council's decision. Motion No. SC090821-5 Moved by Evans, Seconded by Crawford Be it resolved that the confidential correspondence presented by Andria Leigh, Director of Development Services, re: Property Matter (TRY Recycling) be received; and further that the Clerk bring forward the appropriate by-law for Council's consideration. Carried. d) Robin Dunn, Chief Administrative Officer, re: Legal Matter (Tax Registration). This item was deferred. 7. BY-LAWS: a) By-Law No. 2009-112 Being a By-law to Adopt Amendment No. 29 to the Official Plan (Township -Try Recycling). Motion No. SC090821-6 Moved by Coutanche, Seconded by Crawford Be it resolved that a By-law to Adopt Amendment No. 29 to the Official Plan (Township -Try Recycling) be introduced and read a first and second time and numbered By-Law No. 2009-112. Carried. That By-Law No. 2009-112 be read a third time and finally passed, be engrossed by the Deputy Clerk, signed and sealed by the Mayor. Carried. Motion No. SC090821-7 Moved by Crawford, Seconded by Coutanche Be it resolved that a By-law to amend the zoning provisions which apply to lands within Part of Lot 11, Concession 8 (Former Township of Oro), now in the Township of Oro-Medonte (2009-ZBA-07) be introduced and read a first and second time and numbered By-Law No. 2009-113. Carried. That By-Law No. 2009-113 be read a third time and finally passed, be engrossed by the Deputy Clerk, signed and sealed by the Mayor. Carried. 8. CONFIRMATION BY-LAW a) Being a By-Law to Confirm the Proceedings of the Special Council Meeting Held on Friday, August 21, 2009. Motion No. SC090812-8 Moved by Coutanche, Seconded by Crawford Be it resolved that a By-Law to confirm the proceedings of the Special Council meeting held on Friday, August 21, 2009 be introduced and read a first and second time and numbered By-Law No. 2009-109. Carried. That By-Law No. 2009-109 be read a third time and finally passed, be engrossed by the Deputy Clerk, signed and sealed by the Mayor. Carried. 9.
